HomeMy WebLinkAboutOrdinance No. 2134 ORDINANCE NO. 2134 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA ADDING SECTION 11.28. 270 TO THE AZUSA MUNICIPAL CODE RELATING TO ACCESSWAYS FOR FIRE VEHICLES. THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council hereby adds to Chapter 11.28 Section 11.28 .270 of the Azusa Municipal Code to read as follows : "Section 11. 28. 270. ACCESSWAYS FOR FIRE VEHICLES. "A. Each parcel or lot used for apartments, condominiums, a hospital, or institutional, commercial, or industrial purposes , shall provide and maintain thereon vehicular access for emergency fire vehicles . Such accessway shall be unobstructed and not less than twenty-five (25) feet in width and thirteen (13) feet, six (6) inches minimum height, vertical clearance. "Variance from the requirements of this subsection may be approved by the Fire Department only upon a determination that safety and access has been provided which is substantially similar to that available were the required accessways provided. "B. Accessways for emergency fire vehicles shall be posted as ,follows : 1. A metal sign, sixteen inches by sixteen inches in size , shall be mounted atop a six foot metal post. Said sign shall bear the following legend: "FIRE ACCESSWAY NO PARKING SECTION 11 . 28.270 AZUSA MUNICIPAL CODE" 2 . All of the curb faces flanking the accessway shall be painted red with the words , 'Fire Accessway' printed thereon in three inch, white letters, every twenty linear feet. 3 . Where there is no curbing adjacent to the accessway, the 25-foot access shall be marked by a painted chrome-yellow line, two inches wide on each side of the accessway. 4 . The surface of every accessway shall bear the words 'No Parking - Fire Accessway' in chrome-yellow paint printed in letters at least 12 inches high with a two-inch stroke. The wording shall be spaced to cover the entire width of the accessway and each wording group shall not be located further than 75 linear feet apart. Deviations from these posting requirements may be permitted by the Azusa Fire Department or other competent authority authorized by the City Council only upon a showing that: a. Special circumstances make compliance impractical, and b. An alternative method of posting will provide substantially similar notice to the public. The posting requirement as set forth in subsection Bl, B2 , and B3 of this section shall apply to fire accessways established prior to the adoption of this Section 11 .28.270 , as well as those established subsequent thereto. "C. Parking or the maintenance of any obstruction within any portion of a posted fire accessway is prohibited. Any vehicle parked in violation of the Section shall be subject to be towed away and impounded. "D. Any violation of the provisions of this Section shall be infractions and shall be punishable by a fine of not less than fifty dollars ($50) . "E. The registered owner of any vehicle parked in violation of this Section 11 . 28 . 270 shall be responsible for all expenses incurred in connection with the towing and impounding of such vehicle. "F. The Chief of Police has the duty to enforce the provisions of this section. In addition, pursuant to the provisions of Section 836 . 5 , California Penal Code, the Fire Chief of the Azusa City Fire Department, together with his designated fire prevention officers , is authorized to enforce the pro- visions of this section. Pursuant to the provisions of Section 836 .5 California Penal Code, the Fire Chief of the City of Azusa and his designated fire prevention officers are authorized to arrest persons in violation of this section. " SECTION 2 . The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law. -2- `/ PASSED AND APPROVED this 5th day of April , 1982 .
