HomeMy WebLinkAboutOrdinance No. 2155 ORDINANCE NO. 2155 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING SECTION 3 . 32 . 030 OF THE AZUSA MUNICIPAL CODE RELATING TO AN INCREASE IN THE ROOM TAX RATE AND ADDING SECTION 3. 32 . 150 TO THE AZUSA MUNICIPAL CODE RELATING TO THE USE OF ROOM TAX PROCEEDS THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS : SECTION 1. Section 3. 32 . 030 of the Azusa Municipal Code is hereby amended to read as follows: "Section 3. 32. 030 RATE -- PAYMENT PROVISIONS. For the privilege of occupancy in any hotel, each transient is subject to and shall pay a tax in the amount of ten percent of the rent charged by the operator. This tax constitutes a debt owed by the transient to the City which is extinguished only by payment to the operator or to the City. The transient shall pay the tax to the operator of the hotel at the time the rent is paid. If the rent is paid in installments, a proportionate share of the tax shall be paid with each installment. The unpaid tax shall be due upon the transient' s ceasing to occupy space in the hotel. If for any reason the tax due is not paid to the operator of the hotel, the Tax Administrator may require that such tax shall be paid directly to the Tax Administrator. " SECTION 2 . Section 3. 2 . 150 is hereby added to the Azusa Municipal Code to read as follows: "Section 3. 32. 150 USE OF TAX PROCEEDS. The proceeds arising from the tax imposed by this chapter shall be credited to the general fund of the City. SECTION 3. The City Council finds and declares that this Ordinance is one relating to taxes for the usual and current expenses of the City. This Ordinance shall take effect January 1, 1982. SECTION 4 . The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
