By order of the Mayor, the City Council met in Special Session at the above time and place, Notice of the meeting having been delivered to each Council member as required. Roll Call: Councilman: Fawcett, Ortuno, Johnson, Roll Call Romero, Memmesheimer, City Attorney, City Engineer City Clerk Mayor Memmesheimer stated that the business before Proposed Easterly the Council was the consideration of the proposed Annexation of Easterly Annexation of the Hadley -Cherry properties. Hadley -Cherry Mayor Memmesheimer stated that he desired comments properties. from the Council on the letter received from Hadley - Cherry, Inc. in which they gave tentative approval for annexation to the City of their third unit at Foothill Park based on the following items which had been arrived at after negotiations with the City Engineer. "1. Approval of house sizes. Our three bedroom home contains approximately 965 square feet and the four bedroom home contains approximately 1160 square feet. 2. The approval of the tentative map as now existing which provides for lots of 6,000 square foot areas. 3. Two inch plant mix may be used for street paving instead of rock and oil 4. Select material base to be used on Fenimore Street only. Balance of tract paving on properly worked subsoil. 5. City of Azusa will require approximately 11,000 square feet of sidewalks. 6. City of Azusa to require approximately 17 less sewer main holes than Los Angeles County. 7. Minimum of street lighting to be required." City Engineer Williamson submitted a letter commenting on the seven items. Discussion of items established that: 1. House sizes acceptable - with garages 2. Lot sizes to be minimum of 6,000 sq. ft. 3. Street paving would be checked by Engineer 4. Material would be inspected by Engineer. Walks to be placed on heavily traveled streets near schools. 6. Sewer manhole spacing acceptable. 7. Street lighting to be studied for further clarification. 316 CITY HALL AZUSA, CALIFORNIA SATURDAY, JANUARY 29, 1955 Councilman Johnson was of the opinion that "since the proposed tract was below the standards set by the City, annexation at this time should not be considered." Councilman Johnson submitted the following statement for the record: "When I was sworn into office as a Councilman, I took an oath to uphold the laws of the City of Azusa for the protection of the people living 1n Azusa and for the protection of the property rights of taxpayers inside the City. These proceedings constitute a tearing down of the laws I swore to uphold, and are for the sole benefit of persons and properties outside the:city of Azusa. Since I take my oath of office seriously, my position is simple. Let them annex first, and comply with our laws, or stay out and do as they please. I shall vote against this Mdeal" if it reaches the Council table." Mayor Memmesheimer stated that although the Council could take no official action at this Special Meeting, he felt that a letter should be sent to Hadley -Cherry acknowledging their letter and setting forth the feelings of the Council on the several items. Moved by Councilman Fawcett, seconded by Councilman Romero that the Mayor be authorized to send a letter to Hadley -Cherry, Inc., advising them of the Special Council Meeting of Saturday, January 29th, and advising them that items 1 through 6 of the letter submitted by them were not objectionable to the Council. However, item 7 of the letter would need further discussion and clarification. In addition, Council approval would be had before mailing the letter.
