The meeting opened with the Flag Salute. Invocation was offered by Reverend Farrell. Roll" -Call: Councilmen: Fawcett, Ortuno, Johnson Romero, Memmesheimer City Attorney, City Engineer City Clerk Mayor*Memmesheimer asked if there were any corrections to be made in the Minutes of the Meeting of Feb. 7, 1955, and the adjourned meeting of Feb. 15, 1955. Councilman Johnson stated that in the minutes of February 7th meeting, on page 5, paragraph 3, "placing the engineering functions" should be corrected to read "placing the traffic engineering functions"; also on pa§e 13, paragraph 2, next to the last line, the words 'compile a diagram" should be deleted and "to have a complelte inventory" inserted in their place. I Councilman Johnson stated that "On page 14 there is a correction which requires a motion and vote. I wish to state the reasons for the motion for the record. =At the time Mr. Ortuno made his motion to strike my statement he failed to disclose that on the day previous (Sunday, February 6, 1955) Mayor Memmesheimer, Councilman Romero, Councilman Ortuno, and City Attorney Mr. Tscharner, held a secret meeting at which matters concerned with the Hadley -Cherry development, which are of interest to the City, were deliberated. I move that the.stribken statement be reinstated in the minutes. 7:30 P.M. Flag Salute Invocation Roll Call Corrections Motion by Councilman Johnson $67 Councilman Ortuno asked the City Attorney his opinion Opinion of City as to whether this could be termed a secret meeting. Attorney. The,Attorney stated in his opinion it was not a meeting of any kind, it was just a discussion of problems, and did not concern the City in any way. There'.'being no second, the motion died for lack of a second. The City Clerk announced that he had received six bids in answer'to the Notice Inviting Bids for the gasoline supply for the City of Azusa for the period beginning March 1, 1955 and closing February 29, 1956. Councilman Johnson disqualified herself on the grounds of stock ownership. Moved'by Councilman Ortuno, seconded by Councilman Fawcett and unanimously carried that the bids be opened and_publicly declared. The -City Clerk announced that he had received 4 bids -in answer to the Notice Inviting Bids for one High Pressure Pump. Moved by Councilman Ortuno, seconded by Councilman High Pressure Fawcett and unanimously carried, that the bids be Pump bids opened. opened and publicly declared. Bids were received from the following companies: THE HARDIE MANUFACTURING COMPANY WIN WARD COMPANY FOOTHILL SUPPLY COMPANY GENERAL MACHINE AND WELDING WORKS, INC. Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried, that the City Engineer, City Attorney, Supt. of Light and Water, and Chairman of Light and Water study these bids and report back to Council. The City Clerk reported that one bid had been received in answer to the Notice Inviting Bids for one Electric Bid on Electric Typewriter General Accounting Machine. Typewriter Moved by Councilman Johnson, seconded by Councilman General Acctg. Fawcett and unanimously carried that the bid be opened Machine and publicly declared. Bid was received from the following company: The National Cash Register Company . . . . . $6,787.70 Moved by Councilman Johnson, seconded by Councilman Fawcett and unanimously carried, that this bid be accepted and the machine be purchased.from the National Cash Register Company. The City Clerk announced that he had received seven bids in answer to the Notice Inviting Bids for street lighting materials. Moved by Councilman Ortuno, seconded by Councilman Bids on street Fawcett, and unanimously carried, that bids be opened lighting materials and publicly declared. The matter of a request for approval to operate an Auto -Repair Shop at 151 E. Foothill Blvd., which had been tabled at the meeting of Feb. 7th, was again brought before Council. Moved by Councilman Johnson, and unanimously carried that the table. Moved by Councilman Ortuno, and unanimously carried that an auto repair shop at 151 E Neary and Mark Hacker. seconded by Councilman Ortuno this matter be lifted from Request to operate garage granted to Neary & Hacker seconded by Councilman Romero license be granted to operate Foothill Blvd., by Alexander 870 371 CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 21, 1955 7:30 P.M. The City Attorney read the resolution of the Planning Application for Commission recommending that the petition of Jehovah's Variance - denied - Witnesses for a variance be denied. Upon the advice Jehova's Witnesses and recommendation of the City Attorney, the Mayor asked each Council member if they had read the complete ver- batum account of the hearing before the Planning Commission. It was ascertained that each Council member had read the report. Discussion followed concerning the advisability of'tabling this matter to the next meeting, but this was decided against in view of the number of property owners from that area who were in the audience. It was decided that it would be imposing a hardship on these people to table the matter to a later date, thus making it necessary for them to appear in person again. Moved,by.Councilman Fawcett, seconded by Councilman Romero and unanimously carried, that the City Council confirm the action of the Planning Commission and deny the application for variance of Jehovah's Witnesses upon'all of the grounds as set forth in the Resolution of.the Planning Commission denying it. In „regard to the request for variance to M-1 of property at 235 N. San Gabriel for the purpose of operating an upholstery and furniture repair shop, the City Clerk read copy of a letter from District Engineer, Division of -Building and Safety listing corrections to be made to the building before consideration of approval can be given. The City Clerk also read a letter from the -Fire Chief concerning this building. Mr. and Mrs. Irwin spoke to Request for Council assuring them that this business they hoped to Variance - Irwin start -the ' re, would not be noisy, unsightly, or in any Upholstery and way a nuiance to the neighborhood. Repair Shop. - Mr.'and Mrs. Hughes, owners of property in the vicinity, Denied spoke to Council, stating that the neighborhood was aware ofthis upholstery business going into the building and would not protest it, as they would rather have this type cof business than have it revert back to a laundry again. After further discussion by Council, it was decided that for the good of the City as a whole, their request for a variance to M-1 should be disallowed. Moved by Councilman Fawcett, seconded by Councilman Johnson that the recommendation of the Planning Commission be disapproved and the petition for variance be denied. Motion passed by the following vote: AYES: Councilmen: Fawcett, Ortuno, Johnson, Memmesheimer NOES: Councilman: Romero ABSENT: None Mr.�Bartlett appeared before Council requesting per- mission to remove a piece of curbing on Virginia, south Request for per - of Foothill Blvd., for the purpose of making a driveway mission for drive - from .the street into his warehouse. Mayor Memmesheimer way - Mr.Bartlett " suggested to Mr. Bartlett that he take this up with the City Engineer to see if it will be safe for paving to be broken. This does not require action on the part of the Council'and can be taken care of by the Engineering Department. A letter was received from Joe Leonetti requesting the Request for -Council's feeling towards his proposed operation of a Council's opinion cocktail lounge at 118 E. Foothill Blvd. now operated on operation of as Warren's Cafe. Mr. Leonetti appeared at Council cocktail bar - table to speak in his own behalf on this matter. It Joe Leonetti was stated that the City Council cannot bind themselves :to any conditions that may arise in the future. It will be necessary to go through the prescribed channels. 1 CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 21, 1955 The request received from the Azusa Ministerial Assn. for the Erection of a third church directory sign at the western entrance to the City, which had been tabled at the meeting of February 7th, was again brought -to the attention of the Council. Moved by Councilman Fawcett, seconded by Councilman Romero and unanimously carried that this matter be raised from the table.. Moved by Councilman Fawcett, seconded by Councilman Ortuno and duly carried that the City Engineer be authorized to secure right-of-way and to purchase third sign to be erected at the western entrance to the. City. Letter was submitted from the First Baptist Church, 405"N. Azusa Avenue, asking for loan of City equipment for removing debris from the Church grounds. They stated that Wayne Lloyd, a member of their Church, and a City employee qualified to operate the skip loader, had offered his services in this work. Moved by Councilman Romero, seconded by Councilman Fawcett and unanimously carried that permission be granted the First Baptist Church to use City skip loader and truck to be run by qualified City employee to remove debris from the Church grounds. 373 7:30 P.M. Request for erection of church sign at western entrance to City. Request by First Baptist Church for loan of City equipment. Mayor Memmesheimer announced to the representatives of Request for clergy the Azusa Ministerial Association who were present in for invocations. the audience that the City Council was having difficulty lining up Clergy to give the invocation at the Council meetings, and asked for more cooperation in this respect. Letters were received from Azusa Civitan Club requesting the City to support their annual Jr. College Baseball Request for ad by Tournament by buying a full page ad in the official Jr. College Base - program and donating trophies, ball Tournament It was bhe opinion of the Council that these matters should be handled by the Chamber of Commerce due to the increased budget allowance to that body. Moved by Councilman Johnson, seconded by Councilman Fawcett and duly carried, these letters be referred to the"Chamber of Commerce for action by them. The,.City Clerk was instructed to contact the Civitan Permits for banner: Club to ascertain if they planned to hang banners across to be obtained on Foothill Blvd, as in previous years. If so, they were request. to request permission immediately to that encroachment permits can be obtained from the State Highway Division. Letter was submitted by the Gospel Lifeline League, Inc. requesting permission to solicit funds in the City of Azusa. It was the general opinion of the Council that this would not be in the best interest of the City. Moved by Councilman Johnson, seconded by Councilman Fawcett and unanimously carried that the request of the Gospel Life Line League to solicit, --funds in the City of Azusa be denied and thatXhey be so advised. It was requested that the Visiting Nurse Assn, be granted $1,000.00 for the year 1954-1955. The City Attorney stated that this should be made subject to their entering into substantially the same agreement we made. with them last year. Moved by Councilman Fawcett, seconded by Councilman Romero and unanimously carried that the Visiting Nurse Assn, be granted $1,000.00 for 1954-1955 subject to signing substantially the same agreement as was entered into for 1953 - 1954. Request to solicit funds denied - Gospel Lifeline League. Request for funds Visiting Nurse Asst - granted. 374 t .i' :r CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 21, 1955 7:30 P.M. The Chief of Police submitted a letter to Council reporting an accident involving Motorcycle Unit #81, Sergeant,Magnell on Foothill Blvd, just east of Virginia.Avenue. Moved by Councilman Fawcett, seconded by Councilman Johnson and unanimously carried, that this letter be filed.` Chief of Police submitted a request for approval pf membership for Marjorie Hunter and Sergeants Sheehan and'Warren in the Southern California Juvenile Officer's Association. The yearly membership fee in this Assn. is $2.00 per member, plus meal expense for attendance at meetings,�transportation will be furnished by radio car when available. Moved by Councilman Romero, seconded by Councilman Fawcett and unanimously carried that permission be granted to enroll Marjorie Hunter and Sergeants Sheehan and'Warren in the Southern California Juvenile Officer's Assn. and meal expenses allowed. It was the recommendation of the Personnel Board that the City Engineer's request for a step raise from 1st to 2nd step ($243.00) of the pay plan for Mrs. Marian Brown, Typist -Clerk, be approved by Council. Moved by Councilman Johnson, seconded by Councilman Romero, and unanimously carried, that Marian Brown, Typist -Clerk be raised to 2nd step of pay plan ($243.00) per month and the City Attorney be authorized to draw resolution accordingly; to be effective March 14, 1955. The Personnel Board submitted a recommendation to Council to raise George Morse, Patrolman, from Step 2 to Step 3 at $358.00 per month, effective Feb. 16, 1955. Moved by Councilman Johnson, seconded by Councilman Fawcett and unanimously carried, that George Morse, Patrolman be raised from Step 2 to Step 3 of the pay plan, $35$.00 per month, effective Feb. 16, 1955, and that City Attorney draw resolution accordingly. A letter of resignation signed by David Miranda was submitted by the Department of Public Works. This resignation was to be effective as of Feb. 21, 1955. Moved by Councilman Romero, seconded by Councilman Fawcett, and unanimously carried that the resignation of David A. Miranda be accepted and the City Attorney to draw resolution accordingly. A letter was submitted from Azusa Civil Defense request- ing permission to purchase educational booklets and pamphlets to replenish their depleted stock. An order blank listing the needed items was attached. Moved'by Councilman Fawcett, seconded by Councilman Romero and unanimously carried that request of Civil Defense to purchase booklets and pamphlets be granted and City Clerk be authorized to send in the attached order blank. Letter'of recommendation was submitted by City Engineer, Chairman of Public Works, City Attorney and Supt. of Public -Works for the awarding of the bid for�the con- struction of sewers in the Rodecker Tract area. It was recommended that the bid be awarded to A. R. Milosovich & Son of Arcadia, the lowest responsible bidder. The amount of the bid was $24,445.35 Moved by Councilman Romero, seconded by Councilman Fawcett and unanimously carried that the contract for the construction of sewers in the Rodecker Tract area be awarded to the lowest responsible bidder, A. R. Milosovich & Son of Arcadia, and the Mayor be authoriz- ed to sign the contract, after which the City Clerk will return the bonds or checks to the unsuccessful bidders. 375 Traffic Accident Police Officer Magnell Membership - So. Calif. Juvenile Officer's Assn. Step Raise - Mrs. Marian Brown - approved. Step Raise - George Morse Patrolman Resignation of David Miranda Request for publications - Civil Defense. Bid awarded on sewers for Rodecker Tract area - A. $. Milosovich & Son $76 ,- , CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 21, 1955 7:30 P.M. The City Engineer and Chief of Police submitted a report to Council concerning traffic conditions in the area of Fourth, Bayless and Hollyvale Streets in regard to parking of employees vehicles from Gilfillan and other industries. Upon investigation of the situation it was decided that parking restrictions should be imposed on these streets and signs were ordered from the Auto- mobile Club and will be set out in the near future. Moved by Councilman Fawcett, seconded by Councilman Romero and duly carried that this report be accepted and filed. A letter was submitted by the City Engineer recommend- ing that the two remaining bays in the Auditorium which are•not now covered with accoustic tile be so covered and then the walls painted to provide the proper setting for•the new furnishings. Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried that City Engineer, Chair- man of Public Works and Public Works Supt, be appointed a -Committee with power to act to make the best arrange- ments possible for installing accoustic tile on the ceiling and painting of the walls. 377 Parking restrictior. Fourth, Bayless & Hollyvale Improvements in Auditorium accoustics. City Engineer submitted a letter to Council requesting Request for house permission to employ the Crane House Movers of E1 Monte relocation work to do the necessary moving work in connection with the house to be relocated at Paramount Avenue and Orange, the cost of this to be $1,240.00. Moved by,Councilman Romero, seconded by Councilman Ortuno and duly carried that the City Engineer be authoriz- ed to employ the Crane House Movers of E1 Monte to do necessary work and moving for the price of $1,240.00 City Engineer suggested to Council that it might prove beneficial to hzve an Emergency Ordinance requiring sewer contractors coming In for permits, to have written authorization from property owner for them to do the work. It was"the opinion of the Council that forms could be made up that would satisfy the conditions required. A letter was submitted from the City Engineer request- ing authorization to do the necessary preliminary work to establish a Gas Tax Project to cover the repaving of Cerritos Avenue, south of First Street, as there will be very little useable paving left after the excavation work is completed for the sewer lines. Due to the fact that Cerritos Avenue would soon be carry- ing a much heavier volume of traffic from the sub- division now under construction nearby, it was his recom- mendat;iori that this project would be justified. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that the City Engineer be authorized to do the necessary preliminary work to establish a Gas Tax Project for repaving of Cerritos Avenue. The City'Attorney presented for Council consideration the matter,of the claim of Mrs. Loucile Eagle, 430 S. Jackson Ave., for damage to her auto which had been referred to him at the last meeting. It was'the opinion of the Attorney that although there might be some basis to show that the damage was cuased through the driver's negligence, it is also a fact that the road -was under repair by City forces and that visibility was poor due to fog and some negligence on the part of the City might be shown. He recommended payment of the claim. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried, claim for damages to auto of Mrs. Loucile Eagle be paid. Forms suggested for sewer contractors Gas Tax Project for paving of Cerritos Avenue. Claim for damages Mrs. Eagle. 378 r - 379 CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 21, 1955 7:30 P.M. The City Attorney reported on condemnation proceedings, which had been previously authorized, for property on Property appraised the east side of Angeleno Avenue between Third and for condemnation. Fourth Streets. An appraiser appointed by the court had assessed the properties as follows in a report submitted Feb. 18, 1955: Lot No. 13 @ $340.00 corner lot Lots No. 14 through 23 @ $185.00 Lot No. 24 @ $340.00 corner lot 150.00 for chicken shed 150.00 each for necessary damage to two pepper trees. The original complaint called for condemning 40 feet, but; by taking 252 ft. the two pepper trees could be saved, but would need to be kept trimmed. In the opinion of.the Attorney the appraisal given, although $35 per lot higher than what was offered by the City is a reasonable estimate. Moved by Councilman Johnson, seconded by Councilman Fawcett.and unanimously carried, that the City Attorney be.authorized to dispose of this matter on the basis of the'report of Clifton Sheetz, Inheritance Appraiser, dated Feb. 18, 1955, other than the amount authorized therein for the two trees which are not within the lands that are taken, but as to those trees, the City Attorney is authorized to make the best settlement he can. They City.Attorney reported on two demands for payment Presented by R. S. Brooks which had been referred to him -for study and recommended that they be paid. In connection with this study, he had examined records of payments made to Mr. Brooks at the time the contract was=let for the construction of tennis courts for the purpose of determining if overpayments had been made. It was his opinion that the payments that were made, were based on the originals contract cost and any changes made that affected the cost would not reflect on pay- ments due on original contract price. Moved by Councilman Ortuno, seconded by Councilman Fawcett and unanimously carried, the recommendation of the.City Attorney be accepted and the demands of R. S. Brooks be paid. Councilman Ortuno offered for its second and final reading Ordinance No. 481 of the City of Azusa, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, COUNTY`OF IAS ANGELES, STATE OF CALIFORNIA, AMENDING ORDINANCE NUMBER 409 OF THE CITY OF AZUSA, ENTITLED: 'AN ORDINANCE ESTABLISHING A ZONING AND DISTRIBUTING PLAN -WITHIN THE CITY OF AZUSA, CREATING THIRTEEN USE ZONES, REGULATING THE USE OF_.PROPERTY, HEIGHT AND AREA OF'STRUCTURES AND OPEN SPACES FOR LIGHT, AIR AND VENTILATION; ADOPTING A MAP OF SAID ZONES; DEFINING TERMS USED; PROVIDING FOR THE ADJUSTMENT, ENFORCEMENT, AND AMENDMENT THEREOF; PRESCRIBING PENALTIES FOR VIOLATION; AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH', AS SAID ORDINANCE IS AMENDED BY ORDINANCES NUMBER 441 and 455, AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES INSOFAR ONLY AS THE PROVISIONS OF SAME CONFLICT HEREWITH." Councilman Romero offered the following Resolution entitled: "RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "EASTERLY ANNEXATION DISTRICT NO. 5" AND GIVING NOTICE OF THE PROPOSED ANNEXATION." Councilman Romero moved its adoption, seconded by Council- man Johnson. This Resolution was passed and adopted by the following vote: AYES: Councilman: Fawcett, Ortuno, Johnson, Romero, Memmesheimer NOES: None ABSENT: None and numbered Resolution No. 3174 The City Attorney stated he felt the Council ought to allow him extra compensation for litigation and annexa- tion work. He is now being paid the sum of $400.00 per month, and as he devotes from 1/4 to 1/3 of his time to City work and his cost to run his business amounts to about $600 per month, he felt he is entitled'to a little more money for the extra work of litigation and annexations, retroactive to Feb. 1, 1955. 381 7:30 P.M. Ordinance 481 Zoning Plan Resolution No -3174 Annexation - Easterly #5 Request by City Attorney for extra pay approved. 882 CITY HALL AZUSA, CALIFORNIA MONDAY, FEBRUARY 21, 1955 7:30 P.M. Moved by Councilman Ortuno, seconded by Councilman Romero and unanimously carried that City Attorney be paid for court litigations on the basis of $10.00 per hour and that he be paid for annexation procedures retroactive to Feb. 1, 1955 and the City Attorney to prepare resolution accordingly. Councilman Fawcett offered the following Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING AGREEMENT FOR ELECTRICAL DISTRIBUTION FACILITIES AND ENERGY BETWEEN THE CITY OF AZUSA AND HOWARD C. She stated there was a regarding Humane female dog in the neighborhood causing trouble and Officer disturbance and the Humane Officer was unable to catch her. Colver from Charter Oak be present at future meetings with respective Mayors of Covina, West Covina, Azusa and Glendora when considering zoning and problems of planning in general as they relate to this area of the East San Gabriel Valley. Also read was copy of letter from Mr. McMicken, City Administrator of the City of Glendora to Stuart Coulter, President of Charter Oak Chamber of Commerce. Ellington and Councilman Johnson submitted a recommenda- tion on refurbishing the auditorium. They presented two samples of rugs, one red and grey, one green, and a sample; of red and green velvet drapes. It was suggested that the red and grey carpeting would not show the wear and soil as quickly as the other. Moved by Councilman Romero, seconded by Councilman-Ortuno and unanimously carried, the first choice of the committee the red --and grey carpeting and the red velvet drapes be accepted.
