The City Council of the City of Azusa met in adjourned
session at the above time and place.
Roll Call: Councilmen: Fawcett, Ortuno, Johnson, Romero,
Memmesheimer
City Attorney, City Engineer,
City Clerk
Mayor Memmesheimer announced that he had requested
the City Attorney to prepare a Resolution authorizing
the employing of special counsel in the matter of
Martha M. Johnson vs, the City Council of the City of
Azusa.
City Attorney read the Resolution and a letter from
O'Melveny & Myers, Attorneys, stating terms for
services.
Councilman Ortuno offered the following Resolution
entitled:
"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA,
LOS ANGELES COUNTY, CALIFORNIA, EMPLOYING SPECIAL
COUNSEL IN THE MATTER OF MARTHA M. JOHNSON AS MEMBER
OF THE CITY COUNCIL OF THE CITY OF AZUSA, A MUNICIPAL
CORPORATION, AND INDIVIDUALLY, AS PETITIONER, VS.
CITY COUNCIL OF THE CITY OF AZUSA, A MUNICIPAL..CORPORA-
TION, THE CITY OF AZUSA, A MUNICIPAL CORPORATION, AS
RESPONDENTS."
Councilman Ortuno moved its adoption, seconded by
Councilman Romero. This Resolution was then passed
and adopted by the following vote:
AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer
NOES: Councilman Johnson
ABSENT: None
and numbered Resolution No. 3203
Letter was submitted from the U. S. Naval Ordnance Test
Station requesting permission to post four placards
2' x 21, at Azusa Avenue and Foothill Blvd, announc-
ing the forthcoming "Armed Forces Day" on May 21, 1955.
Moved by Councilman Ortuno, seconded by Councilman
Fawcett, and unanimously carried that this matter
be referred to the City Engineer and Chief of Police
for clearance with the State Highway Department with
power to act.
City Attorney announced that with regard to the Court
hearing on April 27th in the matter of Martha M.
Johnson vs, the City of Azusa, it would not be
necessary for the Council members to be present at
Court, but he thought it advisable that the City
Engineer, City Clerk, and the Mayor be authorized
to attend.
Moved by Councilman Romero, seconded by Councilman
Ortuno and unanimously carried that the City Engineer
City Clerk and Mayor Memmesheimer be authorized to
attend the Court hearing on April 27, 1955.
The Chief of Police recommended that Sgt. Jerry Warren
be permitted to attend the California State Division
of the International Association for Identification
Conference which will be held at Santa Barbara on
May 25 - 28, 1955, and that he be allowed expense
money in the amount of $100.00; letter of request
having been submitted to him by Sgt. Warren.

Moved by Councilman Fawcett, seconded by Councilman
Ortuno that the -recommendation of the Chief of Police
be accepted and that Council grant permission for Sgt.
Jerry Warren to attend the California State Division
of the International Association for Identification
Conference at Santa Barbara May 25 - 28, 1955, and
allow expense money in the amount of $100.00. Motion
passed by the following vote:
AYES: Councilmen: Fawcett, Ortuno, Romero, Memnesheimer
NOES: Councilman Johnson
ABSENT: None
Councilman Johnson stated that until the legality of
providing expense money for attendance at conferences
was decided, she would cast a "No" vote.
Mayor Memmesheimer announced that the matter of the
Easterly Annexation District U0. 5 (as revised) would
be held over iintil the next regular meeting of Council.
City Attorney asked to be excused from this adjourned
meeting as he had other important City business to be
taken care of elsewhere.
Before he left the Council meeting, the City Attorney
read a bulletin from the League of California Cities
opposing Amendments to Bill AB1934 regarding proceed-
ings of annexation.
I>Zoved by Councilman Fawcett, seconded by Councilman
Ortuno that Cit -,r Attorney be authorized to send wire
to Assemblyman Geddes, for the City of Azusa, opposing
Amendments to AB1934. Motion passed by the following
vote:
AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer
NOES: Councilman Johnson
ABSENT: None
Mayor Memmesheimer stated that as long as there would
be no other matters brought before Council tonight
which would require the City Attorney's attention,
he should be given permission to leave the meeting.
Moved by Councilman Ortuno, seconded by Councilman
Romero and unanimously carried that the City Attorney
be excused from the meeting.
City Attorney left the meeting at 7:50 P.M.
Mayor announced that a Governor's Industrial Safety
Conference Meeting was to be held May 2, 1955, at
450 N. Grand Avenue, Los Angeles at 1 P.M. The
subjects under discussion would be."Training Program
Outline", "Safety Program of Edison Company",and
"Safety Training Program used by City of Pasadena".
City Engineer stated it was his opinion that someone
from the City should attend this meeting.
Moved by Councilman Ortuno, seconded by Councilman
Fawcett and unanimously carried that City Engineer
be authorized to attend the Governor's Industrial
Safety Conference in Los Angeles on May 2, 1955.
Letter was submitted to Council from the Office of
the Mayor of the City of Manhattan Beach asking
for the support of the City of Azusa to obtain
passage of Assembly Bill No. 499, which is now
before the State Assembly, which would give to the
City of Manhattan Beach title to its submerged
tidelands. After some discussion of this, it was
decided best to table the matter for further study.
Moved by Councilman Ortuno, seconded by Councilman
Fawcett, and unanimously carried that this matter
be tabled.

City Clerk announced he received advice from the Con-
troller of the State of California regarding the
estimated apportionments to be made from the Motor
Vehicle License Fee Fund during the 1955-56 Fiscal
Year. City of Azusa's share amounted to $68,300.00.
City Clerk presented a. report regarding the matter of
the excess of expenses over fees due the County
Building Department in the amount of :v356.99 covering
the period from January 1 through March 31, 1955.
Report of the Treasurer of the Visiting Nurse Associa-
tion of Azusa was submitted to Council. This was the
Treasurer's Statement as of January 31, 1955, and
listed the actual bank balance as of that date to be
$1,369.26, and as of March 31, 1955 to be $825.30.
Moved by Councilman Ortuno, seconded by Councilman
Fawcett and unanimously carried that this Report on
the Visiting Nurse Association of Azusa be filed.
Letter was submitted by City Engineer to which was
attached Change Order No. 2 covering modifications
necessary to obtain the best repaving job on the
streets in the Rodecker Tract, Project W120. This
entailed an additional expense of 382 for labor costs
but would be well repaid, in his opinion, by the
decreased maintenance expense over the years.
Moved by Councilman Ortuno, seconded by Councilman
Fawcett and unanimously carried that Mayor Memmesheimer
be authorized to sign Change Order No. 2, Project #120,
covering modifications in specifications for repaving
streets in Rodecker Tract.
Supt, of Public Works submitted letter to Council
recommending that $30 of the $100 deposit from the
San Gabriel Valley Kennel Club to cover maintenance
and clean-up expense for the Dog Show held April 24,
be returned as the matron for the Women's Rest Room did
not put in her full time.
Moved by Councilman Fawcett that the recommendation of
the Supt, of Public Works be accepted and the City
return $30 to the San Gabriel Valley Kennel Club. It
was brought out in discussion that there were other
items to be taken care of in this matter and therefore
it would be best to table it and take care of it all
at one time.
Councilman Fawcett then withdrew his motion.
Moved by Councilman Johnson, seconded by Councilman
Ortuno and unanimously carried that this matter be
tabled to the next regular meeting.
Councilman Johnson presented to Council an unsigned
letter she had received through the mail requesting
investigation at the corner of Sunset and Foothill late
Saturday & Sunday nights.
Moved by Councilman Johnson, seconded by Councilman
Fawcett that this matter be referred to the Chief of
Police to investigate the corner of Sunset and Foothill
on Saturday and Sundae nights. This motion passed by
the following vote:
AYES: Councilmen: Fawcett, Johnson, Romero, Memmesheimer
NOES: Councilman Ortuno
ABSENT: None
Councilman Ortuno stated he cast a "No" vote for the reason
that the letter was unsigned.
Mayor Memmesheimer asked if there were any other
matters to be brought before Council.

Councilman Ortuno stated he had one matter he would
like to bring up and that was with regard to the
decision reached on April 18th to ask that the City
of Azusa be reassigned to the Santa Anita Judicial
District. It was his opinion now, that this should
be given more consideration. Mayor Memmesheimer
repeated some of the reasons justifying this request,
such as the heavier case load at Citrus Court, the
matter of public transportation to Santa Anita Court,
etc. Councilman Ortuno stated he still,felt this
should be given more consideration.
Moved by Councilman Ortuno, seconded by Councilman
Johnson and unanimously carried that Council reconsider
the motion of 4j18/55 adopting the Resolution request-
ing that the City of Azusa be removed from the Citrus
Judicial District and be assigned to the Santa Anita
Judicial District.
Moved by Councilman Johnson, seconded by Councilman
Romero and unanimously carried that the following Bills
and Requisitions (Lw -3085 - 3o96) be paid.
