HomeMy WebLinkAboutOrdinance No. 2168 ORDINANCE NO. 2168 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, EXTENDING THE EFFECTIVENESS OF ORDINANCE NO. 2145 DECLARING A MORATORIUM ON THE ESTABLISHMENT OF ANY ARCADES PENDING A STUDY BY THE PLANNING COMMISSION OF A PROPOSAL FOR MORE EFFECTIVE REGULATION ON SUCH USE; SAID ORDINANCE TO BE ADOPTED AS AN URGENCY ORDINANCE PURSUANT TO SECTION 65858 OF THE GOVERNMENT CODE. WHEREAS, the City Council on April 19, 1982, adopted Ordinance No. 2136 declaring a moratorium on the establishment of any Arcades pending a study by the Planning Commission of a proposal for more effective regulation of such use; and WHEREAS, the City Council on August 16 , 1982, adopted Ordinance No. 2145 extending Ordinance No. 2136 declaring a moratorium on the establishment of any Arcades pending a study by the Planning Commission of a proposal for more effective regulation on such use; and WHEREAS, the study of the establishment of any Arcades has not yet been completed; and WHEREAS, pursuant to Section 65858 of the Government Code, said Ordinance No. 2145 continues in effect for a period of no longer than eight (8) months unless the City Council after notice pursuant to Section 65856 of the Government Code and a public hearing extends the effectiveness of said Ordinance; and WHEREAS, the City Council after notive given pursuant to Section 65856 of the Government Code has conducted a hearing on the extension of the effectiveness of Ordinance No. 2145 for a period of one year. NOW, THEREFORE, the City Council of the City of Azusa of the State of California, does ordain as follows: SECTION 1. The City Council of the City of Azusa finds that there is a current and immediate threat to the public health, safety or welfare and that the approval of additional Arcades would result in a current and immediate threat to the public health, safety or welfare. SECTION 2. The effectiveness of Ordinance No. 2136 was hereby extended for a period of eight (8) months from August 16 , 1982 , by Ordinance No. 2145. SECTION 3 . The effectiveness of Ordinance No. 2145 is hereby extended for a period of one year from April 15 , 1983. SECTION 4 . This Ordinance is adopted as an urgency measure to protect the public safety, health and welfare and shall take effect upon its adoption pursuant to the provisions of Sections 65856 and 65858 of the Government Code. SECTION 5. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law. PASSED AND ADOPTED this 4th day of April, 1983.
