HomeMy WebLinkAboutOrdinance No. 2198 ORDINANCE NO. 2198 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE AZUSA MUNICIPAL CODE BY ADDING THERETO CHAPTER 2 . 17 CONSISTING OF SECTIONS 2 .17 . 010 - 2. 17 . 040 REFERRING TO THE ESTABLISHMENT OF A UTILITIES COMMISSION THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. The Azusa Municipal Code is hereby amended by adding thereto a new Chapter 2 . 17 consisting of Sections 2 . 17 . 010 - 2 .17 . 040 to read as follows : "Section 2 . 17 . 010 . Created. There is hereby established and created a Utilities Commission in and for the City. "Section 2 .17 . 020 . Appointment. The Utilities Commission shall consist of five members . All of the members of the Commission shall be resi- dents of the City, none of whom shall be officers or employees of the City. Of the members of the Commission, one shall be a person over the age of sixty-five (65) years and one shall own a business operating within the City. Of the mem- bers of the Commission first appointed, two shall be appointed for terms of one year; one for a term of two years; one for a term of three years; and one for a term of four years. The successors of the members of the Commission first appointed shall be appointed for terms of four years . All members shall be appointed by the Mayor subject to confirmation by the City Council. The Commis- sion shall annually elect one of its members as its chairperson, one of its members as a vice- chairperson, and another of its members as a secretary, whose terms shall be the calendar year. Members of the Commission may be removed upon a majority vote of the Council. Vacancies occurring in the Commission shall be filled as in the same manner as provided for in the initial appointment. Members of the Commission shall hold office until their reappointment or until their successors have been appointed and have qualified. "Section 2 . 17 . 030 . Powers and Duties . The Utilities Commission is to act in an advisory capacity to the City Council in all matters per- taining to the operation of electric, water and sewer utilities . The Commission may adopt its own rules for transacting business . The Commis- sion may: (1) Consider the annual budget for utilities operation during the process of their preparation and make recommendation with respect thereto to the City Council . (2) Recommend to the City Council schedules of rates for utilities services. (3) Arbitrate consumer complaints regarding utilities services. (4) Perform such other advisory functions as may be referred to or requested of them by the City Council . "Section 2 .17 . 040 Compensation. The members of the Utilities Commission shall receive com- pensation in an amount to be established by City Council Resolution for their services as members of the Commission. Members shall also be reimbursed for any reasonable and necessary expenses incurred by them in the performance of their duties as members of the Commission. SECTION 2 . The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
