THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. Chapter 19 . 57 . 010 , is hereby added to the Azusa Municipal Code to read as follows: CHAPTER 19 .57 DESIGN REVIEW COMMITTEE 19 . 57 . 010 Purpose 19 . 57 . 020 Membership 19. 57 . 030 When Required 19. 57 . 040 Contents and Procedures 19 . 57. 050 Filing Fee 19. 57 . 060 Grounds for Rejection 19 . 57 . 070 Time Limits 19 . 57 . 080 Compliance 19. 57 . 010 . PURPOSE. The purposes of design (architectural) review are to: 1. Encourage the orderly and harmonious development of property within the city. 2 . Implement the general and specific plans of the city pertaining to the preservation and enhancement of the character and unique assets of the community. 3 . Recognize the positive effects of high aesthetic standards on the physcial, social and economic well-being of the community. 4 . Promote and encourage innovative and creative design consistent with, and complementary to, principles of sound community design, while discouraging excessive similarity, dissimilarity or inappropriateness of design. 5. Ensure that the design of building sites and appurtenant structures and landscaping recognizes and provides for: compatibility with the scale and character of existing and projected uses and buildings in the environs, preservation and enhancement of public views and spaces, appropriate buffers and transitional areas, solar access and shade for purposes of energy conservation and comfort, and its relationship with the natural features of its surroundings. 19. 57 . 020 . MEMBERSHIP. The Design Review Committee shall consist of the Director, or designee thereof, of the following Departments: 1. Community Development/Planning 2 . Parks Division 3. Public Works Division 4 . For properties located within the Community Redevelopment Project Area, the Executive Director of the CRA, or designee thereof. 19 . 57 . 030 . WHEN REQUIRED. The jurisdiction of design review shall extend to all new development and/or exterior remodeling or reconstruction of existing building sites, structures, signs and landscaping located in any Commercial or Manufacturing Zone, or in any Multiple Family Zone consisting of fain (4) or more units. 19 . 57 . 040. CONTENTS AND PROCEDURES. 1. Application Form. Applications shall be made on forms prescribed by the City Community Development/Planning Director. Said forms shall prescribe the information necessary for evaluation of the proposal. 2 . Elements of Design Review. The applicant shall submit, in conjunction with a completed application, such plans, drawings and similar information as may be deemed necessary by the Design Review Committee to fully evaluate the physical, aesthetic and other environmental qualities of the proposed project. Such plans or drawings shall be drawn to appropriate scale and shall consist of the following: (a) Building Site: Relationship of the site to its existing setting inclusive of topography, landform and other natural or man-made features . (b) Building Orientation: Consideration of the scale and character of buildings and structures relative to their surroundings , their potential impacts on public views, privacy and solar access, and attention to solar access and shade opportunities for energy conservation. (c) Access/Circulation: Design of vehicle and pedestrian accessways for safe, convenient and efficient access and circulation with minimum visual disruption to the overall project theme. (d) Parking Areas: Design to minimize noise, glare, increases in ambient temperature and visual disruptions to the overall project design theme, inclusive of the effective use of natural planting materials to assist in the mitigation of such adverse effects and to enhance the natural setting. (e) Lighting: System design should provide for enhancement of safety while avoiding light and glare nuisances to surrounding properties. Fixtures should be compatible with the overall project design theme. (f) Landscaping/Open Spaces: Landscaping and open spaces should complement and enhance building design, integrate into the overall design theme, provide for solar access and shade, enhance public views, and provide buffer or transitions where appropriate. (g) Fences/ Walls: Any walls or fences, including required screening of utilities or outdoor storage areas, should be compatible with the overall project design theme. (h) Design Theme: The design of buildings and structures, inclusive of style, form, size, materials, roof line and colors, should reflect a unifying theme compatible with the character of the site and its surroundings, while avoiding excessive similarity. -2- (i) Mass and Scale: Proportions should be in scale with the site and its surroundings to provide an element of openness. (j) Materials and Colors: Materials, textures and colors, of all buildings and structures, inclusive of equipment screening, should be closely coordinated to achieve architectural compatibility with the overall project design theme and with the surroundings. (k) Signage: The scale, placement, materials and color (s) of all signs should be compatible with and complementary to the overall project design theme. Incomplete, improper or unclear applications, plans or drawings shall be rejected for review and will not be accepted for filing. 3 . Meeting Schedules. Applications for approval of building and site design plans shall be reviewed by the Design Review Committee on a weekly basis, on regularly scheduled dates concurrent with meetings of the Precise Plan Review Committee. Provided, however, that the Community Development/Planning Director may schedule such additional meetings as deemed necessary to expedite determinations pertaining to such applications. 4 . Criteria for Approval of Applications. The responsible persons or agency for determinations on applications subject to the provisions of this section shall approve such application (s) if, after review of the appropriate plans and drawings pursuant to the intent and purpose of this section and in consideration of all design elements as set forth hereinbefore and such guidelines as may be adopted from time to time to assist in implementing the intent and purpose of this section, findings may be reasonably made that said plans comply with the following criteria: (a) The proposed plan and all design elements and features thereof are in conformity with good taste, good design and that the proposed development will, in general, contribute to the enhancement of the visual appeal, environmental soundness and economic stability of the City of Azusa. (b) The proposed development is not, in either its design or appearance, so at variance with the appearance of existing developments in its environs as to cause the:nature of the local environment to depreciate materially in either appearance or value. (c) The proposed development is comptible, in its design and appearance, with projected development of lands in the environs of the site, and in harmony with aesthetic goals, objectives and policies of the City. (d) The design and appearance of the proposed development are appropriate for and complementary to the function and use for which the development is intended. 19 . 57 . 050. FILING FEE. A uniform nonrefundable fee shall be paid for the purpose of defraying the cost incidental to the proceedings . Such charges and fees to be rendered shall be those which the City Council may from time to time determine, fix and establish by resolution duly and regularly adopted by it. -3- 19 . 57 . 060. GROUNDS FOR REJECTION. The Design Review Committee shall approve the site plan and elevations for a proposed development, except where it makes one or more of the following findings: 1. The provisions for vehicular parking and for vehicular and pedestrian circulation on the site, and onto adjacent public rights of way will create safety hazards. 2 . The bulk, location, and height of proposed uses thereof will be detrimental or injurious to other private development in the neighborhood or will result in the loss or damage to unique natural or topographic features of the site that are important to the environmental quality of life for the citizens of Azusa, and development of the site is feasible in a manner that will avoid these detrimental and injurious results. 3. The provisions for on-site landscaping do not provide adequate protection to neighboring properties from detrimental features of the development or major alteration that could be avoided by adequate landscaping. 4 . The provisions for exterior lighting are inadequate for the safety of occupants or users of the site or such provisions will damage the value and di .ni h the usability of adjacent properties. 5 . The exterior design of the buildings and structures will be injurious or detrimental to the environmental or historic features of the immediate neighborhood in which the proposed development is located and will thereby cause irreparable economic damage to property in the neighborhood, to the city and to its citizens . 6 . The proposed development will impose an undue burden upon off-site publice services including sewer, water, and streets, which conclusion shall be based upon a written report of the Division. of Public Works and there is no provision in the capital works program of the city to correct the specific burden within a reasonable period after the development of major alteration shall be completed. 19. 57 . 070. TIME LIMITS. Approval, conditional approval or denial of applications required by this section shall be made by the Design Review Committee within fifteen (15) calendar days subsequent to the acceptance of an application by the planning division as complete for processing. Provided, however, that said time limit for determination may be extended by the Planning Director or Design Review Committee for good cause shown, including, but not limited to, continuance of hearing for resolution of uncertainties, revisions of plans to bring about greater conformity with city design criteria or guidelines, or other similar justification. Any failure to act on an application filed pursuant to the provisions of this section within the time limits prescribed hereinbefore shall be deemed to constitute denial of such application excepting upon agreement by the applicant to extension of such time limit. 19 . 57. 080 . COMPLIANCE. No person shall violate or fail to comply with any adopted Design Review or any conditions or provisions thereof nor shall a building permit be issued for any structure which would violate or fail to comply with any adopted Design Review for the parcel or parcels on which such structure is to be located. -4- SECTION 2 . The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
