AN URGENCY ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF AZUSA EXTENDING THE EFFECTIVE
DATE OF ORDINANCE NO. 2210 ADDING SECTION
19. 40. 100 TO THE AZUSA MUNICIPAL CODE RELATING
TO CONFORMANCE OF ZONING WITH REDEVELOPMENT PLANS
AND AGREEMENTS AND SPECIFIC PLANS
THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN
AS FOLLOWS :
SECTION 1. Section 19. 40.100 is hereby added to the
Azusa Municipal Code to read as follows:
"19.40. 100. Redevelopment Plans and Agreements
and Specific Plans. Notwithstanding any of the
provisions of Title 19 , Zoning, whenever an area
of the City has been included in an approved
redevelopment plan, or in a specific plan pur-
suant to Government Code Section 65000, et. seq. ,
or the Community Redevelopment Agency has
entered into an agreement relating to use of
certain property pursuant to a redevelopment
plan, the land use standards contained in said
plans or agreements shall control to the exclusion
of any contradictory provisions of Title 19. "
SECTION 2. The planning staff and Planning Commis-
sion are studying the issue of the conformance of redevelopment
plans with zoning and the addition to the zoning code of a
provision similar to that set forth in Section 1. Pending the
conclusion of the study and anticipated action by the City
Council thereon, it is necessary to provide interim regulations
to enable the City and the Community Redevelopment Agency to
deal with these issues on pending agreements. Accordingly, the
provisions of Section 1 of this ordinance shall be in effect until
the study on such an amendment is completed and Council action
is taken thereon or the expiration of this ordinance.
SECTION 3. Pursuant to Government Code Sections
65858, 36934 and 36937, and other applicable law the City
Council of the City of Azusa hereby declares this ordinance
to be an urgency ordinance requiring the immediate enactment
thereof because the same is necessary for the immediate
preservation of the public peace, health, safety and general
welfare of the City and its citizens and, accordingly, the
provisions of this ordinance shall become effective immediately
as an urgency ordinance. The facts constituting such
urgency are set forth in Section 2.
SECTION 4. Pursuant to Government Code Section
65858, the City Council held a public hearing on March 5,
1984, and received testimony or other evidence relating to
the extension of Ordinance No. 2210 adopted on January
24 , 1984 , and adding Section 19. 40. 100 to the Azusa Municipal
Code as an urgency ordinance pursuant to Section 65858.
The City Council has considered all of the information
presented at said public hearing and, as a result of
receiving said information, hereby extends the effective
date of Ordinance No. 2210 and Section 19. 40. 100 of the
Azusa Municipal Code for an additional ten months and
fifteen days from and after the expiration date of Ordinance
No. 2210
SECTION 5. The City Clerk shall certify the
passage of this ordinance as an urgency ordinance and shall
cause the same to be published as required by law.
