HomeMy WebLinkAboutOrdinance No. 2216 MEOW ` Aloe ORDINANCE 2216 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA ADDING SECTION 5.32.040 TO THE AZUSA MUNICIPAL CODE RELATING TO THE REGULATION OF SALES OF "FULL SERVICE" GASOLINE OR MOTOR VEHICLE FUEL THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS : SECTION 1. The City Council of the City of Azusa does hereby find and determine: A. Most service stations within the City offer "self-serve" and "full-serve" sales of gasoline and other motor vehicle fuels. B. Gasoline and other motor vehicle fuels sold "full-serve" are substantially more expensive for the same grade of product than self-serve on the theory that the employee of the station provides more service to the customer in connec- tion with such sales. C. Consumers within the City are entitled to a certain level of service when purchasing "full-serve" gasoline and other motor vehicle fuels because of the obvious meaning of "full- serve" and the significantly higher price charged than on "self-serve" gasoline and other motor vehicle fuels. D. There are currently no regulations applica- ble to the sale of "full-serve" gasoline and other motor vehicle fuels other than a state directive that a service station employee must actually pump gasoline into the customer's car when the gas is sold on a "full-serve" basis. E. There exists a need to define what services are required when a service station advertises and sells gasoline or other motor vehicle fuels on a "full-serve" basis so as to protect the consumer's expectations and to maintain the welfare of the community. F. The regulations imposed by this ordinance do not conflict with state laws and regulations governing the advertisement of retail gasoline and other motor vehicle fuel prices. G. This ordinance is adopted pursuant to the authority of California Business and Professions Code Section 13545 and other applicable law. SECTION 2. Section 5.32.040 is hereby added to the Azusa Municipal Code to read as follows: "5. 32. 040 GASOLINE AND OTHER MOTOR VEHICLE FUEL SALES ON A FULL-SERVE BASIS. "A. All service stations or other establishments selling gasoline or other motor vehicle fuels to the public shall clearly indicate on the pumps, islands and price signs whether the gasoline or other motor vehicle fuel is sold on a "self-serve" or "full-serve" basis in addition to the display of all other information required by law . B. The designation "self-serve" shall be placed upon each pump and pump island of a service station or other establishment selling gasoline or other motor vehicle fuel to the public where the customer is expected to pump his or her own gas and perform all other routine maintenance on the vehicle . ; C. No service station or other establishment selling gasoline or other motor vehicle fuel to the public , nor any employee thereof, shall offer to sell, or sell , gasoline or other motor vehicle fuel from a pump designated "full-serve" unless an employee of the service station or other such establishment : ( 1 ) Pumps the gasoline or other motor vehicle fuel into the vehicle in an amount requested by the customer; (2 ) Washes the front and rear vehicle windows , unless otherwise instructed by the customer; ( 3 ) Checks the engine oil level of the vehicle and reports such level to the customer, unless otherwise instructed by the customer; ( 4 ) Checks the level of fluid in the radiator in the vehicle and reports such level to the customer, unless otherwise instructed by the customer; and ( 5 ) Checks the tire pressure of all exterior tires on the vehicle and reports such to the customer, unless otherwise instructed by the customer. " SECTION 3 . The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law . PASSED AND APPROVED this 5th day of March 1984 .
