HomeMy WebLinkAboutOrdinance No. 2214 ORDINANCE NO. 2214 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE AZUSA MUNICIPAL CODE, TITLE 19 , BY ADDING THERETO, SECTION 19. 32. 020(d) RELATING TO CHURCHES IN THE M-1 ZONE. THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1 . Section 19. 32. 020(d ) is hereby added to the Azusa Municipal Code to read as follows : "19. 32. 020 PERMITTED USES. * * * (d) Churches are permitted in the M-1 zone provided that : ( 1 ) Accessory uses of clinics or counselling centers in conjunction therewith are prohibited ; ( 2 ) The parking requirements of Section 19. 48. 030 ( 5) shall be met on the site ; and ( 3 ) The use must be within 100 feet of a residential zone or park. " SECTION 2. The City Council of the City of Azusa finds and determines that : (A) On June 20 , 1983 , after duly noticed hearings before the Planning Commission and the City Council , the Council rejected an amendment to the zoning ordinance which would have permitted churches in the M-1 zone and terminated all pro- ceedings on the issue. (B) On November 7 , 1983 , the City Council referred the proposed amendment permitting churches in the M-1 zone to the Planning Commission for review. (C) On December 27 , 1983 , the City Council , pursuant to Government Code Section 65853 , instructed the Planning Commission to hold the hearing on the proposed zoning ordinance amendment and to report to the Council within forty ( 40 ) days thereafter. (D) The Planning Commission failed to report to the Council within said forty ( 40) day period and , therefore , the City Council held a duly noticed public hearing on the proposed amendment on February 6 , 1984 , and received testimony on the proposed amendment and the negative declaration of environmental impact. (E) Pursuant to the provisions of Government Code Section 65863 . 6, the City Council considered the effect of the adoption of this Ordinance on , the housing needs of the region in which the city is located and balanced these needs against the public service needs of the residence of the city and the available fiscal and environmental resources . SECTION 3 . The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law . PASSED AND APPROVED this 21st day of February 1984.
