AN URGENCY ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF AZUSA REPEALING SECTION 2. 52 . 010
OF THE AZUSA MUNICIPAL CODE RELATING TO THE
DUTIES OF POLICEMEN TO AID PERSONS OR ANIMALS
IN DISTRESS.
THE CITY COUNCIL OF THE CITY OF AZUSA DOES
ORDAIN AS FOLLOWS:
SECTION 1. Section 2. 52.010 of the Azusa
Municipal Code is hereby repealed.
SECTION 2. This ordinance is hereby adopted
as an urgency ordinance pursuant to the provisions of
Government Code Sections 36934 and 36937 . The City
Council finds that the adoption of this ordinance as an
urgency ordinance is necessary for the immediate
preservation of the public peace, health, safety and
welfare of the City and its citizens, and, accordingly,
the provisions of this ordinance shall become effective
at once as an emergency ordinance. The facts
justifying this finding are that the duties of Police
Officers are described in the Policy Manual of the
Police Department and are substantially more limited
than the exceptionally broad duties set forth in
Section 2 . 52 .010 . More importantly, however, is the
fact that the Courts have recently construed ordinances
similar to this to impose financial liabilities upon
cities for virtually every act, or failure to act, of a
Police Officer regardless of whether the act, or
failure to act, was reasonable or was within accepted
Police procedures. Thus, the City by maintaining such
an ordinance exposes itself to substantially more
liability than is otherwise imposed by law or fair and
equitable. Without the immediate repeal of such an
ordinance, the City faces the grave possibility of
substantial and catastrophic financial liability each
day for acts for which it would not otherwise be liable
for .
SECTION 3. The City Clerk shall certify the
adoption of this ordinance as an urgency ordinance.
