HomeMy WebLinkAboutOrdinance No. 2286 ORDINANCE NO. 2286 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA ADDING SECTIONS 19 .44.060, 19 . 44.070, 19 . 44. 080, AND 19 . 44.090 TO THE AZUSA MUNIC- IPAL CODE RELATING TO OUTDOOR STORAGE IN COM- MERCIAL AND INDUSTRIAL ZONES THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. Purposes. The City Council of the City of Azusa finds, determines and declares the regulation of storage in commercial and industrial zones is necessary for the protection of the public health, safety and welfare in that, among other reasons: A. The City' s commercial and industrial zones must remain attractive and be maintained in an orderly and sanitary fashion to preserve the prop- erty values in the areas; B. The City' s commercial and industrial zones must be maintained in an attractive and neat condi- tion to attract more business into the area; C. Providing for outdoor storage in commercial and industrial zones will provide the area with a cleaner appearance which will improve civic pride and create a more aesthetically pleasing area for the enjoyment of visitors and neighboring resi- dents; D. Regulating outdoor storage in commercial and industrial zones will reduce crime in the area by removing from view property and other materials used in connection with commercial and industrial activity; and F. Notice of public hearings were duly given and published, and that a hearing was held by the City Council of the City of Azusa on the 16th day of September, 1985 and by the Planning Commission of the City of Azusa on the 21st day of August, 1985. G. Addition of these provisions to the Azusa Municipal Code is consistent with and in conform- ance with the General Plan for the City of Azusa. SECTION 2. Section 19 . 44.060 is hereby added to the Azusa Municipal Code to read as follows: "19 . 44 .060 - OUTDOOR STORAGE. Storage of materials and equipment for commercial and industrial uses shall be limited to accessory storage of such mate- rials and equipment as are sold, or utilized, in the conduct of a principal use on the lot, and shall be completely enclosed by a view-obscuring chain link fence with wood slats or decorative masonry block wall not less than six feet in height. " SECTION 3. Section 19 .44.070 is hereby added to the Azusa Municipal Code to read as follows: "19.44.070 - HEIGHT OF OUTDOOR STORAGE. Such mate- rials and equipment as are sold, or utilized and stored outdoors for commercial and industrial uses shall not be visible from neighboring properties where outdoor storage is permitted, except: 1. Quarry operations stock piles. 2. Storage/Shipping Containers. 3. Semi-trucks, trailers and similar equipment. 4. Similar equipment and materials as determined by the Planning Commission. " SECTION 4. Section 19 . 44.080 is hereby added to the Azusa Municipal Code to read as follows: "19 . 44 .080 - SALES AND DISPLAY AREAS. Outdoor sale and display areas for commercial and industrial uses shall be completely enclosed by a view-obscur- ing decorative masonry block wall not less than six feet in height, except the following specifically described outdoor sale or display areas which need not comply with such view-obscuring wall require- ment: 1. Motor vehicles, trailer and boat sales. 2. Nursery plants and flower sales. 3. Quarry operations stock piles. 4. Agricultural stock. 5. Similar sales and display areas, as determined by the Planning Commission. 6. Temporary sidewalk sales related to commercial establishments in adjacent buildings. " SECTION 5. Section 19.44.090 is hereby added to the Azusa Municipal Code to read as follows: "19 . 44.090 - NONCONFORMING OUTDOOR STORAGE. Not- withstanding any amortization period set forth in Section 19. 40.050, any existing nonconforming out- door storage areas in the commercial and industrial areas shall be granted an amortization period of six months from the date of adoption of this ordi- nance. Thereafter, all such unscreened outdoor storage shall be prohibited. " SECTION 6. The City Clerk shall certify the adoption of this ordinance and cause it to be published in the manner required by law.
