AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AZUSA REPEALING CHAPTER 15 . 28 CONSISTING OF
SECTIONS 15. 28. 010, 15 . 28. 020, 15. 28. 030, 15. 28. 040,
15. 28. 041, 15. 28. 050, 15. 28. 060, 15 . 28. 070 AND
15. 28. 080 OF THE AZUSA MUNICIPAL CODE AND ADDING
A NEW CHAPTER 15. 28 CONSISTING OF SECTIONS 15. 28. 010,
15. 28. 020, 15. 28. 030, 15 . 28. 040, 15. 28. 050, 15. 28. 060 ,
15. 28. 070, 15. 28. 080, 15. 28 . 090, 15. 28. 100, 15. 28.110 ,
15 . 28 .120, 15. 28 .130 , 15. 28.140 AND 15. 28.150 THERETO,
RELATING TO THE ADOPTION OF THE UNIFORM FIRE CODE,
1976, EDITION, AND MAKING CERTAIN CHANGES THEREIN
REQUIRED TO MEET LOCAL CONDITIONS.
The City Council of the City of Azusa does ordain as
follows:
SECTION 1. Chapter 15.28 consisting of Sections
15. 28. 010, 15 . 28. 020, 15. 28. 030, 15. 28. 040 , 15. 28. 041, 15. 28. 050,
15. 28. 060, 15. 28. 070 and 15. 28. 080 of the Azusa Municipal Code
are repealed.
SECTION 2. A new Chapter 15. 28 consisting of Sections
15. 28. 010, 15. 28. 020, 15. 28. 030, 15. 28. 040 , 15. 28. 050 , 15. 28. 060 ,
15 . 28. 070, 15. 28. 080 , 15. 28. 090, 15. 28.100 , 15. 28.110, 15 . 28.120,
15. 28. 130, 15. 28.140 and 15. 28 .150 are hereby added to the Azusa
Municipal Code to read respectively as follows :
"15.28.010. ADOPTION OF UNIFORM FIRE CODE.
There is hereby adopted by reference for the
purpose of prescribing regulations governing conditions
hazardous to life and property from fire or explosion
that certain code known as the Uniform Fire Code, 1976
Edition, developed by the International Conference of
Building Officials and the Western Fire Chiefs
Association, and the whole thereof, including Appendix
A (Recommended Safeguards and Safe Practices for the
Protection of Tanks Containing Flammable or Combustible
Liquids in Locations That May Be Flooded) , Appendix B
(Recommended Guide to Safe Practice Protection from
Corrosion for Underground Pipe, 'Fittings and Tanks
Containing Flammable Liquids), Appendix C (Rifle
Ranges) , Appendix D (Standard and Publications
Representing Nationally Recognized Good Practice) ,
Appendix E (Suppression and Control of Hazardous
Fire Areas) , and Appendix G (Test Procedures for
Fire Extinguishing Systems) . Not less than three
copies of the Uniform Fire Code 1976 Edition, have
been and are filed in the Office of the City Clerk
and, as excepted or otherwise provided in this
Chapter, the same is hereby adopted and incorporated '
as fully as if set out at length herein.
15. 28. 020 . DELETIONS.
Section 1. 215 of the Uniform Fire Code, 1976
Edition, is deleted.
Appendix F (Marinas) of the Uniform Fire Code
1976 Edition, is deleted.
15. 28.030. ADDITIONS .
Subsection "I" is added to Section 1. 201 of
the Uniform Fire Code, 1976 Edition to read as
follows:
"The apprehension and prosecution of any
one suspected of violating any fire law or arson
statute.
15. 28. 040. ADDITIONS.
Subsection b is added to Section 1. 203 of
the Uniform Fire Code, 1976 Edition to read as
follows:
b. Fire Prevention Bureau and Arson
Investigating Unit.
An arson investigating unit is established
within the Fire Department under the direction
of the Fire Chief. All members of the arson
investigating unit shall upon completion of re-
quirements as set forth in Penal Code §832 enjoy
full police powers as defined in said Penal Code.
15. 28. 050. ADDITIONS.
Section 1.205 of the Uniform Fire Code, 1976
Edition is added to read as follows :
"The Chief, members of the Fire Prevention
Bureau and members of the arson investigation
unit shall have the powers of a police officer
in performing their duties under this Code. "
15. 28. 060. AMENDMENTS .
Section 1.208 of the Uniform Fire Code, 1976
Edition is amended to read as follows :
" (a) The Fire Department shall promptly
investigate the cause, origin and circumstances
of each and every fire occurring in the
municipality involving loss of life or injury
to person or destruction or damage to property,
and if it appears that any such fire is of
suspicious origin, the arson investigator shall
pursue the investigation in accordance with
Section 1. 201 ' I ' . "
15. 28. 070. AMENDMENTS.
Section 1.217 of the Uniform Fire Code, 1976
Edition is hereby amended to read as follows:
"Section 1. 217. Liability for Damages.
This Code shall not be construed to hold the
public entity or any officer or employee, responsible
for any damage to persons or property by reason of the
inspection or reinspection authorized herein provided,
or failure to inspect or reinspect, or by reason of

the approval or disapproval of any equipment
or process authorized herein, or for any action
in connection with the control or extinguishment
of any fire or in connection with any other
official duties. "
15. 28. 080. ADDITIONS.
Section 1. 218 is hereby added to Division II
of the Uniform Fire Code, 1976 Edition, to read as
follows:
Section 1. 218. Blocking of Public Thoroughfares,
Etc. Notice.
"Any person excavating, or working upon any
street, alley or public thoroughfare and by reason
thereof or for any other reason, causing the same
to be blocked or made impassable shall notify the
Chief of the Fire Department at the time such work
is started, and upon the completion thereof. "
15. 28. 090. ADDITIONS.
Section 13. 103 is hereby added to Article 13 of
the Uniform Fire Code, 1976 Edition, to read as follows :
Section 13.103. Improper Use or Defective Condition
of Equipment.
" (a) No person shall maintain or use or
cause to be maintained or used, any device, appliance,
apparatus, equipment, tank, tank vehicle, business,
process, structure, or other place or thing which does
not conform to the provisions of this code, which due
to improper use, maintenance, or to be a defective
condition, constitutes or contributes to, or creates a
condition liable to cause fire.
" (b) When any such condition is found, it shall
be the duty of the Chief to order in writing an
abatement of correction or installation of adequate
safeguards, which shall conform to the minimum require-
ments of any ordinance of the City, law of the state,
or order as set forth by the Fire Marshal of the state.
In the event there is no such ordinance, law, or order,
covering the specific condition, then any such written
order given by the Chief shall be based upon the
current recommendation of the National Fire Protection
Association or other nationally recognized authority.
" (c) Unless immediate action is taken, to comply
with his order, then he shall have the power to cause
any act, performance, activity, operation or other
condition contributing to or creating such condition,
to cease until proper correction or compliance is made. "
15. 28.100. ADDITIONS.
Section 13. 104 is hereby added to Article 13 of
the Uniform Fire Code, 1976 Edition, to read as
follows:

Section 13.104. Tampering With Over-Current Devices.
"It shall be unlawful for any person to
tamper with or reduce the effectiveness in any manner
of any over-current devices used in any electrical
circuit.
15. 28.110. ADDITIONS .
Subsection "E" is added to Section 13.307 of
the Uniform Fire Code, 1976 Edition, to read as follows :
" (e) Every existing building used as a single
family or multiple family occupancy shall have
installed therein an approved products of combustion
detection system under the following conditions:
1. Whenever a permit is taken for addition
or alteration to that building;
2 . Prior to the sale of that building;
3. Prior to the renting of that building. "
15. 28.120 . AMENDMENTS.
Subparagraph (a) of Section 13. 307 of the
Uniform Fire Code 1976 Edition is amended to read
as follows:
"Section 13. 037. Fire Alarm Systems.
(a) Every apartment house three or more stories
in height or containing more than fifteen apartments ,
every hotel three or more stories in height or contain-
ing twenty or more guest rooms, shall have installed
therein an approved automatic or manually operated
fire alarm system designed to warn the occupants of
the building in the event of fire. Such fire alarm
system shall be so designed that all occupants of
the building may be warned simultaneously. "
15 . 28. 130. AMENDMENTS.
Subparagraph "C" of Section 27. 301 of Article
27 of the Uniform Fire Code, 1976 Edition, is amended
to read as follows:
" (c) Any person, upon discovering or being
notified of any uncontrolled or dangerous gas leak
or spill of flammable or combustible liquids on the
premises which he owns, rents, operates, manages,
controls or occupies, shall immediately notify the
Fire Department. "
15. 28. 140. AMENDMENTS.
Section 27.404 of Article 27 of the Uniform
Fire Code, 1976 Edition, is amended by adding thereto
paragraphs (c) , (d) , (e) , and (f) to read as follows :

" (c) All electrical appliances shall plug
directly into an approved, properly installed, grounded,
receptacle, without the use of any additional
extension cords. The length of such appliance cords
shall not exceed eight (8) feet, or as supplied by
the manufacturer. Flexible electrical cords shall be
suitable for the conditions of use and location.
" (d) Use and installation: Flexible electrical
cords may be used only for, (1) pendants; (2) wiring
of fixtures; (3) connection of portable lamps or
appliances; (4) elevator cables; (5) wiring of cranes
and hoists; (6) for the connection of stationary
equipment to facilitate their interchange; or (7)
to prevent the transmission of noise or vibration.
" (e) Prohibited Use: Flexible cords shall not
be used, (1) as a substitute for the fixed wiring of
a structure; (2) where run through holes in walls,
ceilings, or floors; (3) where run through doorways,
windows, or similar openings; (4) where attached to
building surfaces; or (5) where concealed behind
building walls, ceilings or floors .
" (f) Splices: Flexible cord shall be used in
continuous lengths not to exceed eight (8) feet with-
out splice or the use of any electrical current tap
or cube tap. "
Section 15 . 28. 150. ENFORCEMENT AUTHORITY.
Pursuant to the provisions of Section 836.5 California
Penal Code, the Fire Chief, together with his
designated fire prevention officers, has the duty to
enforce the provisions of Chapter 15. 28 (Fire Code)
of the Azusa Municipal Code. Pursuant to the pro-
visions of Section 836. 5 of the California Penal
Code, the Fire Chief, together with his designated
fire prevention officers, is authorized to arrest
persons in violation of the provisions of Chapter
15. 28 (Fire Code) of the Azusa Municipal Code. "
SECTION 3. The City Clerk shall certify to the
passage of this Ordinance and shall cause the same to be pub-
lished as required by law.
