AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF AZUSA ADDING SECTIONS 11. 28. 243, 11. 28. 244 ,
and 11. 28 . 245 TO THE AZUSA MUNICIPAL CODE
RELATING TO REGULATING AND CONTROLLING VEHICLE
PARKING FACILITIES RESERVED FOR THE USE OF
HANDICAPPED PERSONS IN PRIVATELY OWNED AND
MAINTAINED OFF-STREET PARKING FACILITIES .
THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN
AS FOLLOWS :
SECTION 1. Section 11. 28. 243 is added to the Azusa
Municipal Code to read:
"SECTION 11. 28. 243 - Handicapped Parking in Private
Off-Street Parking Facilities. Pursuant to Section
21107. 8 of the California Vehicle Code, the City
Council of the City of Azusa does hereby find and
declare that there are within the City of Azusa a
substantial number of privately owned and maintained
off-street parking facilities that are generally
held open for use by the public for vehicle parking.
The protection of the public peace and safety re-
quires that the provisions of Sections 22350, 22507. 8,
23103, and 23109 of the California Vehicle Code
applied to such privately owned and maintained off-
street parking facilities when the owner or operator
of privately owned and maintained off-street
parking facilities has filed with the Traffic Engineer
of the City of Azusa the following:
(1) A description of the off-street facility
sufficient to identify it.
(2) A written request that the provisions of
this ordinance become applicable to the
described off-street parking facility.
(3) A certification executed under penalty of
perjury that there has been erected in a
conspicuous place at each entrance to such
off-street parking facility a notice not
less than 17" x 22" in size with lettering
not less than 1" in height to the effect
that such off-street parking facility is
subject to public traffic regulations and
control. "
SECTION 2 . Section 11.28. 244 is added to the Azusa
Municipal Code to read:
"SECTION 11. 28. 244 - Handicapped Parking in Private
Off-Street Parking Facilities Violation. When the
provisions of Section 11. 28 . 243 become applicable to
any privately owned and maintained off-street parking

facility it shall be unlawful and a violation
of Section 22507. 8 of the California Vehicle
Code for any person to park or leave standing
any vehicle in a stall or space designated for
physically handicapped persons if immediately
adjacent to and visible from such stall or
space there is posted a sign consisting of a
profile view of a wheel chair with occupant in
white on a blue background unless a vehicle
displays either one of the distinguishing license
plates or a placard issued pursuant to Section
22511. 5 or to disabled veterans as specified in
Section 9105. "
SECTION 3. Section 11. 28 . 245 is added to the Azusa
Municipal Code to read:
"SECTION 11. 28. 245 - Handicapped Parking Private
Facilities Tow Away. Pursuant to Section 22511. 8
of the California Vehicle Code any person in
lawful possession of a privately owned and maintained
off-street parking facility, after notifying the
Police Department of the City of Azusa may cause the
removal from a stall or space designated for
physically handicapped persons in such facility to
the nearest public garage of any vehicle not dis-
playing one of the distinguishing placards or
license plates issued pursuant to Section 22511.5 or
Section 9105 of the California Vehicle Code, if there
is posted immediately adjacent to and visible from
such stall or space not less than 17" x 22" in
size with lettering not less than 1" in height, a sign
which clearly and conspicuously states the following:
'Unauthorized vehicles not displaying dis-
tinguishing placards or license plates
issued for physically handicapped persons
will be towed away at owner's expense.
Towed vehicles may be reclaimed
by telephoning 334-2943 . ' "
SECTION 4. The City Clerk shall certify to the
passage of this ordinance and shall cause the same to be
published as required by law.

hereby certify that the foregoing Ordinance No. 20+5
was regularly introduced and placed upon its first reading at
a regular meeting of the City Council on the 3rd day of
January , 197 8 . That, thereafter, said
ordinance was duly adopted and passed at a regular meeting of
the City Council on the 16th day of January , 197 8 , by the
following vote, to wit:
