HomeMy WebLinkAboutOrdinance No. 2035 ORDINANCE NO. 2035 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING SECTIONS 13. 04 . 050 and 18. 24 . 080 OF THE AZUSA MUNICIPAL CODE RELATING TO UNDER- GROUNDING OF ELECTRICAL FACILITIES. The City Council of the City of Azusa does ordain as follows: SECTION 1. Section 13. 04 . 050 of the Azusa Municipal Code is amended to read: " 13. 04 . 050 OVERHEAD FACILITIES - TYPES PERMITTED. Notwithstanding the provisions of this chapter, poles, overhead facilities and associated overhead structures, may be installed and maintained in a district, with the approval of the City Administrator in order to provide emergency of temporary service. "Any resolution adopted pursuant to Section 13. 04 . 030, shall not, unless otherwise provided in such resolution, apply to any of the following types of facilities: " (1) Any municipal facilities or equipment installed under the supervision and to the satisfaction of the City Engineer; " (2) Poles, or electroliers used exclusively for street lighting; " (3) Overhead wires (exclusive of supporting structures) crossing any portion of a district within which overhead wires have been prohibited, or connecting to buildings on the perimeter of a district, when such wires originate in an area from which poles, overhead wires and associated overhead structures are not prohibited; " (4) Overhead wires attached to the exterior sur- face of a building by means of a bracket or other fixture and extending from one location on the building to another location on the building or to an adjacent building without crossing any public street; " (5) Antennae, associated equipment and supporting structures, used by a utility for furnishing communication services; " (6) Equipment appurtenant to underground facilities, such as surface mounted transformers, pedestal mounted terminal boxes and meter cabinets, and concealed ducts; " (7) Temporary poles, overhead wires and associated overhead structures used or to be used in conjunction with construction projects. (Prior Code §§8404 , 8405) . " SECTION 2 , Section 18 . 24. 080 of the Azusa Municipal Code is amended to read: "18 . 24. 080 UTILITY FACILITY INSTALLATIONS . (a) Utility Lines . Utility lines , including, but not limited to, electric, communications , street lighting and cable television shall be required to be placed underground. The subdivider shall make the necessary arrangements with the respective utility companies , and shall be responsible for the installation of such facilities . "For the purpose of this section, appurtenances and associated equipment such as , but not limited to, surface mounted transformers , pedestal mounted terminal boxes and meter cabinets , and concealed ducts in an underground system may be placed above ground. "This section shall not apply to public or private utilities facilities which do not provide service to the area being subdivided. "The City Council may waive or modify the requirements of this section if topographical, soil or other conditions make such underground installations unreasonable or impractical. " (b) Street Lighting. Street lights shall be re- quired and shall be installed by the subdivider of the size and numers that shall be adequate for the type of street served according to City standards . The street lighting system shall be an underground ornamental system in accordance with the specifications of the Azusa light, power and water department . "The City Council may waive or modify the requirements of this section of conditions make such installation unreasonable or impractical . "(c) Overhead Electric and Telephone Lines . Over- head utilities , electric and telephone lines , when permitted, shall be located at the rear of lots along alleys or easements as the case may be . The subdivider shall make arrangements satisfactory to the affected public utility company for the necessary easements . (Prior Code 59100 . 20(1) ) . " SECTION 3 . The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
