The meeting opened with the Flag Salute. Invocation was given by Reverend Warne Pendleton. ROLL CALL: Councilmen: Ortuno, Johnson, Romero. Memmesheimer. City Attorney. City Engineer. Cit•.7 Clerk Absent: Councilman Fawcett The Minutes of the Meeting of August 15. 1955. were approved as submitted. Corrections to the Minutes of the Meeting of Aug. 29, 1955, were as follows: Page 295, Paragraph 5, Vacation for the City Engineer to be Sept. 22 and 23 instead of August 22 and 23; Page 299, Paragraph 5, should read "Light and Water Dept." instead of light and Water Company"; Page 305, Paragraph 4, regarding insurance coverage for light standards, the motion is to read "City Clerk be authorized to put a rider on the insurance policy cover- ing lht standards on Azusa Avenue and San Gabriel Avenue ' . The Minutes of August 29th were approved as corrected. 309 7:30 P.M. Flag Salute Invocation Roll Call Corrections It was announced that bids for furnishing and install- ing air conditioning system for the City Hall were opened in the office of the City Clerk on September 2, at 10 A.M. in accordance with Ordinance No. 483. Attendant at the opening were City Engineer, Councilman Romero and City Clerk. One bid was received from Ralph E. Manns Company of Wilmington, California, in the amount of $20,964.00. The City Engineer recommended that this bid be rejected and that the bidder's Bond be returned and the project be deferred until the engineers decide the time is right to get better bids, at which time the project can be re -advertised. The estimate by the Engineers for the cost of this system was $15,725.00. It was moved by Councilman Johnson, seconded by Council- man Ortuno and unanimously carried that the City Council accept the recommendation of the City Engineer and that the bid of Ralph E. Manns Company be rejected and that the City Clerk be authorized to return the Bid Bond. Opening of bids for air condition- ing City Hall. Recommendation that project be deferred. Bids on air con- ditioning rejected. It was the recommendation of the Planning Commission Variance request of that a variance be granted to Ralph G. Keim and E. W. R. Keim postponed. Kennedy for the construction of an enclosure for the temporary storage of empty boxes, etc. at the Yor-Way Market. Discussion was held on.this matter, and it was moved by Councilman Romero, seconded by Councilman Johnson and unanimously carried that the variance request of Ralph G. Keim be postponed until the matter of re-routing Highway #39 has been decided. The matter of compensation for Planning Commission members to remain tabled. The Supt. of Light and Water Department submitted a letter stating that Paul Gerek, employed as a Temporary Maintenance Man July 13, 1955, terminated on August 26, 1955, and as Mr. Gerek had been put on by Resolution, a Resolution should be prepared removing Mr. Gerek from the payroll. Mr. Smith also reported that Jack Hawkins, Temporary Maintenance Man, hired August 29, 1955, ter- minated September 1, 1955. Temporary employee: Water & Light Dept. si® CITY HALL AZUSA, CALIF. TUESDAY, SEPT. 6, 1955 Mr. Glenn R. Vanvoorhis was hired August 23, 1955, as temporary lineman, terminated August 24, 1955, and David E. Fry, temporary Lineman was hired as of Sept. 1, 1955. It was the opinion of the City Attorney that temporary employees would not necessarily have to be placed on Resolution. Supt. Smith requested permission to employ Linemen at the 3rd step in the pay range as he has found it Is extremely difficult to get competent men at a lower rate. Moved by Councilman Ortuno, seconded by Councilman Romero and unanimously carried that the Supt, of Light Department be authorized to employ temporary linemen at no higher than the 3rd step of the salary range and for a period not to exceed 90 days. The Supt, of Light and Water Department requested that advertisement for bids for equipment for the Azusa sub -station be authorized. Moved by Councilman Ortuno, seconded by Louncilman Romero and unanimously carried that the City Clerk be authorized to advertise for bids for equipment for the Light Department, specifications to be furnished by the Superintendent, bids to be opened September 30th and to be acted on October 3rd, 1955. Supt. Smith submitted a letter of resignation from Mrs. Emily Adams. Supt. Smith requested permission to employ Miss Jacquelyn A. Ross as Probationary Account -Clerk in the Light and Water Department. 311 7:30 P.M. Linemen to be em- ployed at 3rd step of pay range. Authorization to advertise for bids for equipment for sub -station. Resignation - Emily Adams Request for Proba- tionary Account -Clerk Chief of Police Kendrick requested retroactive pay Request for retro - from March 1, 1955 for Donald K. Ryle who has been active pay - Donald assigned as a motorcycle officer since that date, and K. Ryle. is entitled to be paid at Range 22. As'the Park and Recreation Commission had recommended that an Ordinance be set up prohibiting bicycle riding in the City Parks, it was recommended by the Chief of Amendment to Police and City Engineer that the following section be Ord. No. 438 added to Ordinance No. 438, Section to read: authorized. "It shall be unlawful to ride or drive any horse, or other domestic animal, or ride or drive any bicycle or vehicle whatsoever in any public Parks elsewhere than on the roads or drives provided for such purposes." Moved by Councilman Ortuno, seconded by Councilman Johnson that the City Attorney be instructed to amend Ordinance No. 438 to include the recommendation of the Chief of Police and City Engineer. Motion carried by the following vote: AYES: Councilmen: Ortuno, Johnson, Memmesheimer NOES: Councilman Romero ABSENT: Councilman Fawcett Chief of Police requested permission to employ additional outside officers for Azusa Golden Days parade. In past years these officers have been compensated at the rate Additional outside of $10.00 per day. officers to be hired Moved by Councilman Ortuno, seconded by Councilman for Golden Days Romero and unanimously carried that the Chief of Police Parade. be authorized to employ such additional men as will be necessary for policing duty on Golden Day October 15th. 812 CITY HALL AZUSA, CALIF. TUESDAY, SEPT. 6, 1955 The Chief of Police having received an anonymous letter which was derogatory to him and to the Police Depart- ment requested that the letter be read, that it may become a public record. The letter was then read by the City Clerk. Moved by Councilman Ortuno, seconded by Councilman Romero and unanimously carried that the City Clerk be instructed to forward a copy of the anonymous letter received by the Chief of Police to the District Attorney's office and request a Grand Jury investigation of the charges outlined. A report was submitted stating that the sum of $244.00 had been received from collections for dog licenses for the first part of the fiscal year 1955 - 1956. Moved by Councilman Ortuno, seconded by Councilman Johnson and unanimously carried that this report of dog license collections be filed. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that Ordinance No. 489 have its second reading, and that this reading will be of the title only, and that further reading be waived. The title was then read: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, AMENDING SECTIONS 3 AND 10 OF ORDINANCE NO. 355 OF SAID CITY OF AZUSA, ENTITLED "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, REGULATING THE CONSTRUCTION, INSTALLATION, ALTERATION AND USE OF PUBLIC AND HOUSE CONNECTION SEWERS WITHIN THE CITY OF AZUSA AND PROVIDING FOR THE ISSUING OF PERMITS THEREFOR, AND PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF: AND REPEALING ALL ORDINANCE IN CONFLICT THEREWITH," AS SAID ORDINANCE IS AMENDED BY ORDINANCE NO. 413 AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES INSOFAR ONLY AS THE PROVISIONS OF SAME CONFLICT THEREWITH." Councilman Ortuno moved the adoption of Ordinance No. 489, seconded by Councilman Johnson. This Ordinance was then passed and adopted by the following vote: AYES: Councilmen: Ortuno, Johnson, Romero, Memmesheimer NOES: None ABSENT: Councilman Fawcett. Councilman Ortuno offered the following Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, AUTHORIZING AND DIRECT- ING THE CITY TREASURER TO ISSUE THE WARRANTS OF THE CITY OF AZUSA IN SUCH AMOUNTS AS HAVE BEEN FIXED BY THE SUPERIOR COURT IN AND FOR THE COUNTY OF LAS ANGELES, POMONA BRANCH, TO ALL DEFENDANTS IN THAT CERTAIN ACTION WHEREIN THE CITY OF AZUSA IS PLAINTIFF AND ARCHIE B. HOLBERT, ET. AL., ARE DEFENDANTS, BEING ACTION NO. POMO. C 1910." Councilman Ortuno moved its adoption, seconded by Councilman Romero. Anonymous letter - Police Department. Dog license collectic report - filed. Ordinance No. 489 Amending Sec. 3 & 10 of Ord. No. 355 Resolution No. 3297 Condemnation Proceedings. 314 CITY HALL AZUSA, CALIF. TUESDAY, SEPT. 6, 1955 7:30 P.M. Mrs. Chenoweth appeared before Council requesting per- mission to construct an 852 square foot house on her lot located at 917 West 4th Street as this matter had been under consideration for a considerahle time. Moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that Mrs. Chenoweth be granted permission to build an 852 square foot house as requested. 315 Permission to con- struct 852 sq. ft. house granted - Mrs...Chenoweth The City Clerk asked if the policy of the Council would be that a variance would be necessary for the construction of houses less than 1,000 square feet. Moved by Councilman Ortuno, seconded by7Mayor Memmesheimer that future requests to construct houses of less than 1,000 square feet be handled through a variance procedure. Motion passed by the following vote: AYES: Councilmen: Ortuno, Romero, Memmesheimer NOES: Councilman: Johnson ABSENT: Councilman: Fawcett City Attorney reported that an appraisal had been made by Mr. C. N. Sheets, Appraiser, of the City -owned property on Virginia Avenue, zoned R-3. It was the opinion of the Appraiser that the value of this land would be $5,000 per acre or a value of $7,100 for this particular piece of land. Moved by Councilman Johnson, seconded by Councilman Ortuno.land unanimously carried that the City Attorney prepare the advertisement for the sale of 1.42 -acres of City -owned land now zoned R-3 on Virginia Avenue and that a minimum bid of $7,100 to be so stated in the advertise- ment. Variance necessary to construct less than 1,000 sq, ft. houses. City to advertise for sale of City -owned property - Virginia Avenue. Councilman Ortuno offered the following Resolution entitled: Resolution No. 3298 Placing D. Ryle on A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Salary Range No. 22 LOS ANGELES COUNTY, CALIFORNIA, PLACING DONALD K. RYLE ON RANGE #22 OF THE SALARY RANGE, RETROACTIVE TO MARCH 1, 19555 SAID ADVANCEMENT TO REMAIN IN EFFECT ONLY DURING SUCH TIMES AS HE IS ASSIGNED TO MOTORCYCLE DUTY." Councilman Ortuno moved its adoption, seconded by Council- man Romero. ROSS PROBATIONARY ACCOUNT CLERK IN THE LIGHT AND Probationary Acct. - WATER DEPARTMENT AT THE 1ST STEP OF THE SALARY RANGE." Clerk Councilman Johnson moved its adoption, seconded by Councilman Romero. This Resolution passed and adopted by the following vote: AYES: Councilmen: Ortuno, Johnson, Romero, Memmesheimer NOES: None ABSENT: Councilman Fawcett and numbered Resolution No. 3300 The Chamber of Commerce having submitted their statement of income and expenditures for the year ending June 30, 1955, and the City Attorney having approved same, it was the opinion of the Council that a payment for the last quarter of their fiscal year be allowed. Moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that the City Attorney be authorized to sign the Cancellation of Erroneous Assessment against William G. Popoff, 107 Azusa Lane, Azusa, California. Authorization No. 239. The City Engineer and Chief of Police submitted a report recommending the installation of stop signs at Manning for traffic entering Pasadena, and at McKinley for traffic entering Pasadena, and at the intersection of Russell and Pasadena for traffic entering Pasadena. They also recommended the installation of crosswalks on the North and South sides of the intersection of Pasadena Avenue and Mason Street. Moved by Councilman Ortuno, seconded by Councilman Romero and unanimously carried that the City Council accept the recommendation of the Police Chief and City Engineer and stop signs be erected at the locations o specified and that the crosswalks be painted as recom- mended. Quarterly payment allowed Chamber of Commerce. Cancellation of Erroneous Assess- ment - Wm. G. Popoff Stop signs to be installed & cross- walks painted as recommended. Moved by Councilman Johnson, seconded by Councilman Bonds for City Ortuno and unanimously carried that the City Clerk be Engineer and Supt. authorized to make the appropriate changes as required of Streets by Ordinance No. 18 and No. 19 for bonds for the City Engineer and Supt, of Streets. Moved by Councilman Johnson, seconded by Councilman Authority to file Romero and unanimously carried that the City Clerk be Notice of Completion authorized to file the Notice of Completion for Project Project #122. #122, installation of sewers in Cerritos Park, west of Pasadena Avenue, cost of Project - $40,014.22. Moved by Councilman Ortuno, seconded by Councilman Authority to employ Romero and unanimously carried that the City Engineer temporary employee be authorized to employ Howell Morse at the rate of for Park Dept. $1.50 per hour for a period not to exceed 90 days as a temporary employee in the Park Department. The Chamber of Commerce recommended that a charge of Charge of 10¢ per 10¢ be made for maps requested in excess of a reasonable map furnished in number. excess of one. CITY HALL AZUSA, CALIF. TUESDAY, SEPT. 6, 1955 Personnel Board submitted a letter of clarification in reference to the proposed pay plan revision. This re- vision would bring the time needed to reach Step 5 to 5 years instead of the present 7 years. Moved by Councilman Romero, seconded by Mayor Memme- sheimer that this clarification of the 5 year plan be referred to the Committee now making a study of the Civil Service Ordinance. Motion carried by the following vote: AYES: Councilmen: Ortuno, Romero, Memmesheimer NOES: Councilman Johnson ABSENT: Councilman Fawcett It was agreed by the Council that the matter of the Rules and Regulations governing the Community Recreation Center remain tabled until the next meeting. Application for Off Sale Liquor License for 101 S. Azusa Avenue was presented to Council. Moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that the application for Off Sale Liquor License Transfer to 101 S. Azusa Ave. be filed. Communication was received from the Citizens Anti -Smog Action Committee, Inc. asking that a Resolution be passed requesting the County Supervisors to do some- thing effective in the elimination of smog. Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried that this communication be filed. A petition was received from 13 property owners request- ing the City to instruct the County Building Department to desist from any further work on the parapet wall study This was requested because of the studies now under way of future change in the State Highways, and if remodel- ing was done at this time, it might be a waste of time and money. Moved by Councilman Ortuno, seconded by Councilman Romero and unanimously carried that the City Clerk be instructed to forward a letter to the County Building Department requesting them to desist from any further parapet wall study. The City Clerk announced that the Hearing for the Public Utilities Commission on the application for a change in route of the Azusa Motor Bus Company would be held on September 20th at 10 A.M. in the Auditorium. It was brought out that members of the City Council, the Attorney -and the Engineer would be absent from the City on that date. Supt, of Light Department, Virgil Smith, stated that a meter could be purchased for the High School at a savings of $200.00 if the order could be placed at this time. The estimated cost of the meter is $1800. Also a check value is needed for the new pumping station and the estimated cost is $1200.00 Moved by Councilman Ortuno, seconded by Councilman Johnson and unanimously carried that the Supt. of Light and Water Dept. be authorized to purchase the meter and check valve as requested. The letter received from Mr. Smith relative to the Planning Commission was ordered filed. 819 7:30 P.M. Clarification of 5 year plan referred to Committee. Recreation Bldg. rules to remain tabled. TUESDAY, SEPT. 6, 1955 Mayor Memmesheimer announced that several meetings were scheduled which he was desirous of attending. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that the Mayor be authorized to attend these luncheon meetings and expenses be allowed. Letter was received from Fire Chief an extension of 30 days sick leave Everett Iversen, Fire Engineer, who hospital with a heart attack. Moved by Councilman Romero, seconded Ortuno and unanimously carried that accept the recommendation of the Fir an extension of 30 days in addition sick leave for Everett Iversen. Madison requesting be granted to is now in the by Councilman the City Council e Chief and grant to the regular Mr. Hank Adams of the Golden Days Parade Committee addressed Council and suggested that Golden Day, October 15th would probably be a good time to dedicate the Azusa Recreation Center. It was point- ed out by Councilman Johnson that the Park and Recreation Commission believe that it will be the middle of November before the building is ready for dedication. City Clerk read a letter from Mrs. C. L. Gustin, 5521 Larkin Drive, Azusa, who was protesting about the poor condition of the dog pound in Azusa. No action taken.
