HomeMy WebLinkAboutOrdinance No. 1090 ORDINANCE NO. 1090 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING THE ANNEXATION TO, INCORPORATING IN, AND MAKING A PART OF SAID CITY OF AZUSA, CER- TAIN TERRITORY OUTSIDE THE SAID CITY AND CONTIGUOUS THERETO, KNOWN AS "EASTERLY ANNEXATION DISTRICT NO. 77 TO THE CITY OF AZUSA" . WHEREAS, on the 9th day of October, 1974, the Local Agency Formation Commission of the County of Los Angeles approved the annexation to the City of Azusa of the territory described in Section 1 hereof and authorized the City to proceed with the annexation without notice, hearing and election pursuant to Section 54797.1 of the Government Code, and WHEREAS, the owners of the land within the territory described in Section 1 hereof have filed with the City Clerk their consent in writing to such annexation, and WHEREAS, The City Council of the City of Azusa has determined that the annexation to the City of Azusa of the territory described in Section 1 hereof is in the best interest of the City and the owners of said territory; NOW, THEREFORE, the City Council of the City of Azusa does ordain as follows : SECTION 1, The annexation to the City of Azusa of the territory hereinafter described, the boundary description of which has been approved by the County Engineer of the County of Los Angeles and the Local Agency Formation Commission of the County of Los Angeles, and which territory was designated in the resolution of the Local Agency Formation Commission as "Easterly Annexation District No. 77 to the City of Azusa", be and the same is hereby annexed to, incorporated in and made a part of the City of Azusa, to wit : That portion of Section 35, Township 1 North, Range 10 West, Rancho Azusa as recorded in Book 2, Pages 106 and 107 of Patents in the office of the County Recorder, County of Los Angeles, State of California, described as follows : Beginning at the intersection of a line parallel with and 50 feet southerly, measured at right angles, from the easterly prolongation of the center line of Fifth Street, 60 feet wide, as shown on map of Subdivision No. 1 of Lands of Azusa Land & Water Co. recorded in Book 16, pages 17 and 18 of Miscellaneous Records, in the office of the Recorder of the County of Los Angeles and the northerly prolongation of the easterly line of Lot 78 of Tract No. 20495 as shown on map filed in Book 556, Pages 39 to 44 inclusive of Maps, in the office of said recorder, said intersection being an angle point in the boundary of the City of Azusa as same existed on September 3, 1974; thence northerly along said northerly prolongation to said easterly prolongation; thence North 89° 56' West along said easterly prolongation a distance of 310 feet to the southerly prolongation of the westerly line of that certain parcel of land described as Exhibit "A" in Lease to URA of Glendora, Calif. , Inc., recorded in Book M3184, page 835 of Official Records, in the office of said recorder; thence North 9° 25 ' East along said southerly prolongation, and said westerly line and its northerly prolongation a distance of 370 feet to a curve concentric with and 40 feet northeasterly, measured radially, from that certain curve having a radius of 2250 feet in the center line of the 80 foot strip of land (Alosta Avenue ) described in deed to State of California, recorded in Book 12230, page 230 of said Official Records; thence northwesterly along said concentric curve a distance of 95 feet to a line parallel with and 40 feet northeasterly, measured at right angles, from that certain course having a bearing and length of N. 40° 54' W. 687.17 feet in said last mentioned center line; thence North 40° 54' West along said last mentioned parallel line a distance of 33.60 feet to the most southerly corner of that certain parcel of land for Little Dalton Wash described second in Parcel No. 74 of Final Order of Condemnation in favor of Los Angeles County Flood Control District a certified copy of which is recorded in Book D1697, page 459 of said Official Records; thence northwesterly along said boundary of the City of Azusa and following the same in all its various courses and curve to the point of beginning. Said territory shall be designated as "Easterly Annexation District No. 77 to the City of Azusa" . SECTION 2. The territory hereby annexed to the City of Azusa shall be part of the City for all purposes from the date of filing with the County Recorder of the County of Los Angeles of the affidavit of completion of the annexation proceedings provided for in Sections 34080 and 34081 of the Government Code. SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law. Upon the effective date of this ordinance, the City Clerk shall file a certified copy thereof with the Secretary of State of the State of California and after such certified copy has been so filed and the Certificate of the Secretary of State certifying to its filing has been received by the City of Azusa, the City Clerk shall file with the County Recorder of the County of Los Angeles the affidavit and documents required by Sections 34080 and 34081 of the Government Code and shall file a certified copy of the map and boundary description of the annexed territory with the County Engineer and the County Assessor of the County of Los Angeles and with the State Board of Equalization of the State of California and the Census Bureau of the United States government. SOLIS, City Clerk of the City of Azusa, do hereby certify that the foregoing Ordinance No. 1090 was regularly introduced and placed upon its first reading at a regular meeting of the City Council on the 4th day of November , 1974.
