HomeMy WebLinkAboutOrdinance No. 1082 ORDINANCE NO. 1082 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA REPEALING SECTIONS 15.24.020, 15.28,010, 15.28.020, 15.28.030, 15.28.040 AND 15.28.050 OF THE AZUSA MUNICIPAL CODE AND ADDING SECTIONS 15.28.010, 15.28,020, 15.28.030, 15.28.040, 15.28.041, 15.28.050, 15.28.060, AND 15.28.070 THERETO, RELATING TO THE ADOPTION OF THE UNIFORM FIRE CODE, 1973 EDITION, AND MAKING CERTAIN CHANGES THEREIN REQUIRED TO MEET LOCAL CONDITIONS. The City Council of the City of Azusa does ordain as follows : SECTION 1. Sections 15.24.020, 15.28.010, 15.28.020, 15.28.030, 15.28.040 and 15.28.050 of the Azusa Municipal Code are repealed. SECTION 2. Sections 15.28.010, 15.28.020, 15.28.030, 15.28.040, 15.28.041, 15.28.050, 15.28.060 and 15.28.070 are hereby added to the Azusa Municipal Code to read, respectively, as follows : "15.28.010. ADOPTION OF UNIFORM FIRE CODE. There is hereby adopted by reference for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion that certain code known as the Uniform Fire Code, 1973 Edition, developed by the International Conference of Building Officials and the Western Fire Chiefs Association, and the whole thereof, including Appendix B Underground Plumbing for Flammable Liquids) , Appendix C Rifle Ranges) , Appendix D (Recommended Publications and Standards) , Appendix E (Control of Hazardous Fire Areas) , and Appendix F (Ordinance for Fire Prevention) , save and except Article 12, Fireworks, which is deleted and such portions thereof as are hereinafter in this Chapter deleted, added to or amended. Not less than three copies of the Uniform Fire Code, 1973 Edition, have been and now are filed in the office of the City Clerk and, as except as otherwise provided in this Chapter, the same is hereby adopted and incorporated as fully as if set out in length herein. 15.28.020. DET,FTIONS. Section 1.215 of the Uniform Fire Code, 1973 Edition, is deleted. 15.28.030. ADDITIONS. Section 1.218 is hereby added to Division II of the Uniform Fire Code, 1973 Edition, to read: Section 1.218. Blocking of Public Thoroughfares, Etc. Notice. Any person excavating, or working upon any street, alley or public thoroughfare and by reason thereof or for any other reason, causing the same to be blocked or made impassable shall notify the Chief of the Fire Department at the time such work is started, and upon the completion thereof. 15.28.040. ADDITIONS. Section 13.103 is hereby added to Article 13 of the Uniform Fire Code, 1973 Edition, to read: Section 13.103. Improper Use or Defective Condition of Equipment. (a) No person shall maintain or use or cause to be maintained or used, any device, appliance, apparatus, equipment, tank, tank vehicle, business, process, structure, or other place or thing which does not conform to the provisions of this code, which due to improper use, maintenance, or to a defective condition, constitutes or contributes to, or creates a condition liable to cause fire. (b) When any such condition is found, it shall be the duty of the Chief to order in writing an abatement of correction or installation of adequate safeguards, which shall conform to the minimum requirements of any ordinance of the city, law of the state, or order as set forth by the Fire Marshal of the state. In the event there is no such ordinance, law, or order, covering the specific condition, then any such written order given by the Chief shall be based upon the current recommendation of the National Fire Protection Association or other nationally recognized authority. (c) Unless immediate action is taken, to comply with his order, then he shall have the power to cause any act, performance, activity, operation or other condition contributing to or creating such condition, to cease until proper correction or compliance is made . 15.28.041. ADDITIONS. Section 13.104 is hereby added to Article 13 of the Uniform Fire Code, 1973 Edition, to read: Section 13.104. Tampering with Over-Current Devices. It shall be unlawful for any person to tamper with or reduce the effectiveness in any manner, of any over- current devices used in any electrical circuit. 15.28.050. AMENDMENTS. Subparagraph (a) of Section 13.307 of the Uniform Fire Code, 1973 Edition, is amended to read: Section 13.307. Fire Alarm Systems. (a) Every apartment house three or more stories in height or containing more than 15 apartments, every hotel three or more stories in height or containing 20 or more guest rooms shall have installed therein an automatic or manually operated fire alarm system. Such fire alarm system shall be so designed that all occupants of the building may be warned simultaneously and shall be in accordance with Section E 740-19, Part 3, Title 24, California Administrative Code. -2- 15.28.060. AMENDMENTS. Subparagraph (c) of Section 27.301 of Article 27 of the Uniform Fire Code, 1973 Edition, is amended to read: (c) Any person, upon discovering or being notified of an uncontrolled or dangerous gas leak or spill of flammable or combustible liquids on the premises which he owns, rents, operates, manages, controls or occupies shall immediately notify the Fire Department. 15.28.070. AMENDMENTS. Section 27.404 of Article 27 of the Uniform Fire Code, 1973 Edition, is amended by adding thereto paragraphs (c) , (d) , (e) and (f) to read as follows: (c) All electrical appliances shall plug directly into an approved, properly installed, grounded, receptacle, without the use of any additional extension cords. The length of such appliance cords shall not exceed eight (8) feet, or as supplied by the manufacturer. Flexible electrical cords shall be suitable for the conditions of use and location. (d) Use and Installation: Flexible electrical cords may be used only for, (1) pendants; (2) wiring of fixtures; (3) connection of portable lamps or appliances; (4) elevator cables; (5) wiring of cranes and hoists; (6) for the con- nection of stationary equipment to facilitate their inter- change; or (7) to prevent the transmission of noise or vibration. (e) Prohibited Use: Flexible cords shall not be used, (1) as a substitute for the fixed wiring of a structure; (2) where run through holes in walls, ceilings, or floors; (3) where run through doorways, windows, or similar openings; (4) where attached to building surfaces; or (5) where concealed behind building walls, ceilings or floors. (f) Splices: Flexible cord shall be used in con- tinuous lengths not to exceed eight (8) feet without splice or the use of any electrical current tap or cube tap. " SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law. Passed and approved this 5th day of August , 1974.
