The City Council of the City of Azusa met in regular session at the above time and place. The meeting opened with the Flag Salute. Flag Salute Invocation was given by Councilman Fawcett. Invocation ROLL CALL: Councilmen: Fawcett, Ortuno, Johnson, Roll Call Romero, Memmesheimer City Attorney, City Engineer City Clerk On Page 315 Paragraph 2, of the Minutes of Sept. 6th, the motion requiring construction of houses of less than 1,000 sq, ft. area be handled through a variance, pass- ed by the following vote: Corrections AYES: Councilmen: Ortuno, Romero, Memmesheimer NOES:, Councilmen: Johnson ABSENT: Councilman Fawcett Page 315, Paragraph 3 should be corrected to state "appraisal had been made" Page 319, Paragraph 7, the estimated cost of meter should be $1800 instead of $18.00. Minutes of Sept. 6th approved as corrected. In the Minutes of Sept. 12th, Page 331, regarding the widening of S. Virginia Avenue between 1st and Para- mount Streets, the motion was corrected to read "Moved by Councilman Ortuno, seconded by.Councilman Romero and unanimously carried that the City Attorney and the City Engineer be instructed to contact Cal Tech and the Glendora Irrigating Company owners of property on South Virginia Avenue for the purpose of acquiring sufficient land for the widening of South Virginia Avenue." Minutes of September 12th were approved as corrected. The Planning Commission having held a hearing on Sept. 7, 1955, on the request of Bill Y. and Yoshio Shimmoto for. Variance reauest a variance from R-1 to C-1 of their property located at of B. & Y. 305 S. Azusa Avenue for conducting a nursery and retail Shimmoto denied. floridt shop, recommended to Council that the Variance be'denied. Moved by Councilman Romero, seconded by Mayor Memmesheimer and unanimously carried that the City Council accept the recommendation of the Planning Commission and deny the variance request of Bill and Yoshio Shimmoto. A communication was received from the Regional Planning Commission relative to a variance request by the Regional Planning Emanual Baptist Church for the purpose of erecting a Commission - re: church building on their property located approximately Variance request 260 feet east of the South East corner of Cerritos and by Emanual Baptist 5th Street on 5th Street. This property lies within Church. the unincorporated area. Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried that the City Council would not object if it met with the approval of the Planning Commission. Announcement was made of a Public Meeting to be held in Meeting re: the Auditorium Thursday, Sept. 29th, at 7:30 P.M. relocation of relative to the proposed relocation of Highway 39 Highway 39. through Azusa. Moved by Councilman Fawcett, seconded by Councilman Martha Holmes - Ortuno and unanimously carried that the Supt, of Light temporary, part - and Water Department be authorized to employ Mrs. Martha time Light and Holmes on a temporary part-time basis and the rate of Water Dept. pay to be based on the rate paid to her before her termination from City employment. 334 335 CITY HALL AZUSA, CALIF. Moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that Tony Contreras be employed Tony Contreras, on the lst Step, Probationary Maintenance Man in the Probationary Water Dept, effective as of October 1, 1955, and the City Maintenance Man Attorney to prepare Resolution accordingly. Light Dept. Moved by Councilman Fawcett, seconded by Councilman Resignation of Ortuno and unanimously carried that the City Council Dick Sobelle, accept the resignation of Dick Sobelle, Temporary, Temp. Engineering Engineering Helper, effective Sept. 19, 1955, and City Helper Attorney to prepare Resolution accordingly. Moved by Councilman Ortuno, seconded by Councilman Romero Resignation of and unanimously carried that the City Council accept the Bill Shoemaker resignation of Bill Shoemaker as temporary helper in the Temp.Helper in Engineering Department effective Sept. 15, 1955, and the Engineering Dept. City Attorney to prepare Resolution accordingly. Moved by Councilman Ortuno, seconded by Councilman Romero and unanimously carried that the City Engineer be authorized to employ Mr. Burt Ret olds on a part- time basis as Engineering Helper @ $1.75 per hour. Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried that the City Council accept the resignation of Marion Brown, Typist -Clerk effective October lo, 1955, and the City Attorney to prepare Resolution accordingly. Moved .by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that the Personnel Board be instructed to hold an examination for Typist -Clerk. Moved by Councilman Johnson, seconded by -Councilman Fawcett and unanimously carried ;that the City Engineer be authorized to employ on a temporary basis, not to exceed 90 days, a replacement for Mrs. Brown in the Engineering Office. Burt Reynolds, Part-time Engineering Helper Resignation of Marion Brown, Typist -Clerk, Eng. Dept. Exam, authorized for Typist -Clerk. Temp, replacement for Mrs. Brown authorized. Moved by Councilman Ortuno, seconded by Councilman Personal Liability Romero and unanimously carried that the City Clerk be Ins, for City instructed to contact the City's insurance carrier to officials and determine costs and advisable amounts of Personal Dept. Heads. Liability Insurance covering City officials and Depart- ment Heads. It was recommended by the City Engineer that the water situation as it affects the City of Azusa should be made the subject of a complete engineering analysis by inde- 336 J CITY HALL AZUSA, CALIF. Water rates and financial condition Supt. Smith stated that in his opinion such a survey should be made and to include mapping of the system and the study of water rights. 337 7:30 P.M. Water situation - City of Azusa Moved by Councilman Johnson, seconded by Councilman Survey of water Ortuno and unanimously carried that the City Engineer and situation Supt of Water be instructed to investigate the possibility authorized. of obtaining a report as outlined by Mr. Williamson and probable cost thereof. A communication was read, signed by several residents in the vicinity of 583 E. Mason Street, petitioning the owner of the property at 583 E. Mason to clean up the property and have it maintained better. Moved by Councilman Romero, seconded;by Councilman Fawcett and unanimously carried that this petition be referred to the Police and Fire Departments for investigation by them, and if necessary to notify the Health Department of their findings. A letter was submitted requesting that the City Council ask for an actuary survey be made to show the costlD the City of items designated on State Retirement System Form 559-1 as Item C(9), Item C(10), Item D(12). The Report received from the Actuary covered all items in Paragraphs B, B & C, and B, C and D(12). Moved by Councilman Romero, seconded by Councilman Johnson and unanimously carried that the Council be furnished with copies of Acturay's letter and report for study. Request by Police Chief for Council to uphold 15 -day suspension given to John Mosley, effective Sept. 24, 1955. i Discussion was held relative to conflict between Rules & Regulations of the Personnel Board and the Civil Service Ordinance, and in the opinion of the City Attorney, if the Council wished to conform with the recommendation of the Chief of Police for a suspension, it would best be done by a Resolution by that body. Moved'by Councilman Romero, seconded by Councilman Fawcett that the Council accept the recommendation of the Chief of Police for a 15 -day suspension of John Mosley and a Resolution be prepared in conformance with the charges as set forth. Motion carried by the following vote: AYES: Councilmen: Fawcett, Johnson, Romero, Mitmmesheimer NOES: None ABSENT: None ABSTAINED FROM VOTING: Councilman Ortuno It was pointed out by the City Attorney that the effective date of suspension would be at the time the Resolution was adopted, not that which was set by the Chief of Police. The City Council was advised that the Chief of Police had notified the City of West Covina that the rate for male prisoner care would be $2.65 per day, effective October 1, 1955. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that this communication be filed. Petition for cleaning up of property= at 583 East Mason, referred to Police & Fire Departments. Actuary Survey to be made re: State Retirement. 15 day suspension John Mosley, Police Dept. Rate per male prisoner care, West Covina CITY HALL AZUSA, CALIF, MONDAY, SEPT. 26, 1955 The matter of a pay raise for City employees was discussed. Moved by Councilman Ortuno, seconded by Councilman Fawcett that the City Council recommend to the Personnel Board that the salaries of all certified employees be raised $25 per month. This motion passed by the follow- ing vote: AYES: Councilmen; Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilman Johnson ABSENT: None The Personnel Board submitted a list of recommended step raises as follows: Name: Class. The Golden Days Committee submitted an invitation to the Council invited to members of the City Council to ride in a Tally Ho in ride in Golden Day the Golden Days Parade. Parade. Moved by Councilman Fawcett, seconded by Councilman Romero and unanimously carried that the City Clerk be instructed to invite the City officials of neighboring communities to attend Golden Days Parade. Seating accomodations to be available in bleachers erected on lawn of City Hall. Recreation Director reported the official closing of the City Plunge to be Sept. 26, 1955• Moved by Councilman Fawcett, seconded by Councilman Johnson and unanimously carried that the report be filed. Shearer Company for 288 folding chairs and 4 Caddies as recommended by the Parks & Recreation Commission. The Parks & Recreation Commission recommended the tenta- tive date of November 20th for dedication of the new Recreation Building. Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried that the date for dedication of Recreation Building be tabled until the meeting of October 3rd. Moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that the proposed Rules and Regulations for the Recreation Bldg, be referred to the City Attorney for study. Bid awarded Shearer Co. for chairs & caddies. Date for dedicatio of Recreation Bldg -- tabled. Rules & Regulation for Recrea. Bldg. referred to City Attorney. Officer John Mosley appeared before City Council and stated that in his opinion the charges brought against John Mosley him by the Chief of Police were unfounded and unjust, protests charges. Mr. Mosley was advised by Mayor Memmesheimer to request a Hearing by the Personnel Board. Councilman Romero offered the Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, DIRECTING THAT CHARGES FILED BY THE CHIEF OF POLICE OF THE CITY AGAINST JOHN C. MOSLEY BE INVESTIGATED IN A PUBLIC HEARING BEFORE THE PERSONNEL BOARD OF THE CITY AND DIRECTING SAID BOARD TO FIX A TIME AND PLACE FOR SAID HEARING AND TO GIVE ALL LEGAL NOTICE THEREOF TO JOHN C. MOSLEY AS PROVIDED IN THE CIVIL SERVICE ORDINANCE OF SAID CITY." Councilman Romero moved its adoption, Councilman Fawcett. The City Clerk announced that the approval of boundaries for Easterly Annexation District No. 10 was received from the County Boundary Commission. $42 CITY HALL AZUSA, CALIF. MONDAY, SEPT. 26, 1955 Councilman Fawcett offered the following Resolution entitled: "RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF AZUSA TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIG - NATED "EASTERLY ANNEXATION DISTRICT NO. 10 TO THE CITY OF AZUSA", AND GIVING NOTICE OF THE PROPOSED ANNEXATION." 343 7:30 P.M.
