AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF AZUSA AMENDING SECTIONS 8. 36.040, 8. 36.050,
8. 36.070 AND 8. 36.080 OF THE AZUSA MUNICIPAL
CODE, RELATING TO THE SALE OF FIREWORKS.
The City Council of the City of Azusa does ordain
as follows :
SECTION 1 . Section 8. 36.040 of the Azusa Municipal
Code is amended to read:
"8. 36.040. SALE PERMIT - ISSUANCE.
Upon the receipt on or before April 1 of each year
of a written application therefor the Fire Chief may
issue a permit for the sale of safe and sane fire-
works to any non-profit association or corporation
organized for veteran, patriotic, youth serving,
civic betterment or charitable purposes which:
(a ) Has a bonafide sponsoring membership of at
least 20 adults and supports youth programs
solely for students of Azusa Unified School
District; or
(b ) Has :
(1 ) Its principal and permanent meeting place
in the City limits of the City of Azusa;
(2) Been organized and established in the City
for a minimum of three years continuously
preceding the filing of the application
for the permit; and
( 3) A bonaf ide sponsoring membership of at
least twenty adults who meet regularly
within the City.
The Fire Chief shall either grant or deny the permit
before May 1 . If the application for the permit is
denied, the applicant may appeal to the City Council .
After such investigation as it deems appropriate, the
City Council may issue or refuse to issue the permit.
If it issues the permit the City Council may attach
such conditions to the permit as are required for the
protection of the public peace or safety.
The decision of the City Council upon the application
shall be final . "
SECTION 2. Section 8. 36.050 of said Code is amended
to read :
"8. 36.050. SALE PERMIT - APPLICATION - INSURANCE REQUIRED.
Applications for a safe and sane fireworks sale permit
shall be in writing and shall contain the following:
1) Name and address of applicant;
2 The applicant ' s status as a nonprofit organization;
3) The date upon which the applicant was organized and
established, and the number of adults who are members
of the applicant;
(4) The name and addresses of the officers, if any, of
the applicant;
(5) The location where the applicant proposed to sell
fireworks;
(6) The location of the applicant ' s principal and perm-
anent meeting place;
(7) The applicant ' s State Board of Equalization Sales
Tax Permit Number;
(8) Assurance that if the permit is issued to applicant,
applicant shall at the time of receipt of such permit,
deliver to the City a copy of a twenty-five thousand
dollar/fifty thousand dollar public liability and a
five thousand dollar property damage insurance policy
issued to the applicant with a rider attached to the
policy designating the City as an additional assured
thereunder.
(9) Assurance that if the permit is issued to applicant,
the applicant will use the net proceeds from the
sale of fireworks for the promotion of youth activities,
civic or charitable activities within the City of
Azusa. "
SECTION 3. Subparagraph 13 of Section 8.36.070 of said Code
is amended to read :
" (13) No stand shall be placed closer than twenty feet to
any other building or one hundred feet to any gasoline pump
or other fireworks stand. "
SECTION 4. The second paragraph of Section 8.36.080 of said
Code is amended to read :
"If a permittee fails to comply with the provisions of this
Chapter or with the orders of the Fire Chief or Building
Inspector that fact shall constitute sufficient {;rounds for the
denial in any subsequent year of any application by that
organization for a permit to sell fireworks. "
SECTION 5. The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be published as required by law .

hereby certify that the foregoing Ordinance No. 1050was regularly
introduced and placed upon its first reading at a regular meet-
ing of the City Council on the 5th day of February , 1973.
That, thereafter, said ordinance was duly adopted and passed at
a regular meeting of the City Council on the 20th day of February ,
1973, by the following vote, to wit :
AYES : Councilmen: Rubio, Decker, Snyder, Clark, Solem
NOES : Councilmen: None
ABSENT: Councilmen: None

published prior to the expiration of fifteen days from the passage
thereof in the Azusa Herald and Pomotropic, a newspaper of general
circulation, printed, published and circulated in the City of Azusa,
on the 1st day of March , 1973, and that the same was published
