A. CONTINUED PUBLIC HEARING - on a request to amend various sections of the Azusa
Municipal Code to ensure conformance between the City's recently adopted General Plan and
the City's Development Code. Zone Changes Number Z-2004-01 . Recommendation:Waive
further reading and introduce proposed ordinance adopting the proposed Development Code
and Zoning Map including all revisions contained in Addenda and Modification Log.
B. Resolution Approving and Adopting Amended Appendix of the Conflict of Interest Code
Pursuant to the 2004 Mandatory Review and Filed Biennial Notice. Recommendation:
Waive further reading and adopt Resolution No. 04-C97, approving and adopting an amended
appendix of the Conflict of Interest Code pursuant to the Political Reform Act of 1974.
C. Approval of a Deposit Agreement with Azusa Land Partners Agreement Addendum for
Bond Counsel/Disclosure Counsel. and Selection of Financial Advisor for the Formation of
a Community Facilities District (CFD) for the Monrovia Nursery Project. Recommendation:
In order to proceed with the formation of a Community Facilities District (the District) for the
Monrovia Nursery project, the City Council need to approve the Landowner Deposit Agreement
with Azusa Land Partners; approve an addendum to the existing legal services agreement with
Best, Best &Krieger for bond counsel and disclosure counsel; and approve the selection of a
Financial Advisor an authorize the City Manager to negotiate and execute a professional
services agreement.

D. Acceptance of Parks and Recreation Commission Recommended Program for the Removal
and Subsequent Short-Term and Lone-Term Maintenance Plan for (22) Ficus Trees.
Recommendation: Accept the Parks and Recreation Commission recommended program for
the removal and subsequent short-term and long-term maintenance plan for (22) ficus trees.
E. Acceptance of Parks; and Recreation Commission Recommendation for Amending the
Previously Approved Implementation of a Community Tree Planting Program.
Recommendation: Accept the Parks and Recreation Commission recommendation for
amending the previously approved implementation of a community tree planting program.
V. CONSENT CALENDAR:
The Consent Calendar adopting the.printed recommended actions will be enacted with one

B. Human Resources Action Items. Recommendation: Approve Personnel Action Requests in
accordance with Section 3.3 of the City of Azusa Civil Service Rules and applicable
Memorandum of Understanding(s).
C. City Treasurer's Report as of November 30, 2004. Recommendation: Receive and file the
Report.
D. Amendment to the Police Department's Operating Budgets, Recognizing and Appropriating
$17.728 for F/Y2005 and $8,864 for FY2006 In State of California Office Of Traffic Safety
Grant Funds. Recommendation: Accept the Grant agreement from the State of California
Office of Traffic Safety (OTS), amending the FY2005 budget in the amount of$17,728. The City
of Azusa has been awarded up to $26,592 for a thirteen month period covering personnel
costs to conduct 6 sobriety checkpoints within the City of Azusa from December 1 , 2004
through January 10, 2006.
E. Approval of Purchase of Three (3) Gator TS Traditional Series Utility Vehicles in the
Amount of $17,163..18 Recommendation: Approve the purchase of three (3) Gator TS
Traditional Series Utility Vehicles, at a total of $17,163.18, to be used at Memorial Park,
Northside Park and Gladstone Park respectively from Coast Line Equipment, utilizing an existing
CMAS contract.
F. Request for Approval of professional Services Agreement for Director of Finance
Recruitment Services with Peckham &McKenny in an Amount Not to Exceed $21,000.
Recommendation: Approve the Professional Services Agreement for Peckham &McKenney,
for executive search services for the Contracted Director of Finance position in an amount not—
to-exceed $21 ,000.
G. Award of Bid for the (Replacement of Azusa Light &Water Utility Poles. Recommendation:
Award the bid to Sturgeon Electric Company, Inc., for the replacement of 24 Azusa Light &
Water Utility poles at a cost not-to-exceed $160,782.

H. Authorize the Notice of Completion on the Pioneer Park Restroom Project (CIP#42003
as Completed by lergensen Construction in the Amount of $290 224.41 and Authorize z
Staff to File the Notice of Completion with the Los Angeles County Clerk and Pay the 10%
Retention to the Contractor. Recommendation: Authorize the filing of the Notice of
Completion on the Pioneer Park restroom project (CIP # 42003D) as completed by Jergensen
Construction in,the amount of $290,224.41 , and authorize staff to file the Notice of
Completion with the Los Angeles County Clerk and pay the 10% retention to the contractor.

Technology Analyst. Recommendation: Adopt Resolution No. 04-C98, establishing the
position and salary range of the Senior Information Technology Analyst.

CODES.
RECOMMENDATION:
It is recommended to adopt Resolution approving and adopting an amended Appendix
to the Conflict of Interest Code pursuant to the Political Reform Act of 1974.
BACKGROUND:
On June 7, 2004, staff was directed to conduct a review of the City's Conflict of Interest
Code and submit the required Biennial Report, if there was a need for an update; the
review is conducted every two years.
There have been subsequent changed circumstances within the City that have made it
necessary to amend and update the Appendix to the City's Code.
The attached resolution contains details of the amendments and will update the current
Code which was last updated on December 16, 2002.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA, CALIFORNIA, APPROVING AND ADOPTING AN
AMENDED APPENDIX TO THE CONFLICT OF INTEREST
CODE PURSUANT TO THE POLITICAL REFORM ACT OF
1974
WHEREAS, the Legislature of the State of California enacted the Political Reform
Act of 1974,Government Code Section 81000,et seg.(the"Act"),which contains provisions relating
to conflicts of interest which potentially affect all officers,employees and consultants of the City of
Azusa (the "City"), and which requires all public agencies to adopt and promulgate a conflict of
interest code; and
WHEREAS,the City Council adopted a Conflict of Interest Code(the"Code")which
was amended on December 16, 2002, in compliance with the Act.; and
WHEREAS, subsequent changed circumstances within the City have made it
advisable and necessary pursuant to Sections 87306 and 87307 of the Act to amend and update the
Appendix to the City's Code; and
WHEREAS, the potential penalties for violation of the provisions of the Act are
substantial and may include criminal and civil liability,as well as equitable relief which could result
in the City being restrained or prevented from acting in cases where the provisions of the Act may
have been violated; and
WHEREAS,notice of the time and place of a public meeting on,and of consideration
by the City Council of,the proposed amended Appendix was provided to each affected designated
employee and was publicly posted for review; and
WHEREAS, a public meeting was held upon the proposed amended Appendix at a
regular meeting of the City Council on December 20, 2004, at which all present were given an
opportunity to be heard on the proposed amended Appendix.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA,
CALIFORNIA, DOES FIND AND DECLARE THAT:
SECTION 1. Approval and Adoption of Amended Appendix of the Conflict of
Interest Code. The City Council does hereby approve and adopt the proposed amended Appendix to
the City's Conflict of Interest Code; a copy of which is attached hereto and shall be on file with the
City Clerk together with the City's Conflict of Interest Code, and available to the public for
inspection and copying;

SECTION 2. Effective Date. The said amended Appendix of the Conflict of
Interest Code shall become effective thirty(30) days after the date of its adoption and approval on
January 19, 2005.

RECOMMENDATION
It is recommended that the City Council accept the Grant agreement from the State of
California Office of Traffic Safety (OTS), amending the FY2005 budget in the amount of
$17,728. The City of Azusa has been awarded up to $26,592 for a thirteen month period
covering personnel costs to conduct 6 sobriety checkpoints within the City of Azusa from
December 1, 2004 through January 10, 2006.
BACKGROUND
Entitled "Sobriety Checkpoint Program for Local Law Enforcement Agencies," the Azusa Police
Department Traffic Division received Grant #AM05037 from the State of California Office of
Traffic Safety. The goal of this program is to reduce the number of victims killed and injured in
alcohol-involved crashes in Azusa.
The grant obligates the Azusa Police Department to conduct 6 DUI checkpoints starting
December 1, 2004 and ending January 10, 2006. The checkpoints will be staffed by a
minimum of 11 sworn officers, one of which will be supervisory level, and 3 non-sworn
personnel. These checkpoints will be conducted during statewide and national mobilization
periods during peek holiday seasons as well as outside of the mobilization periods.

FISCAL IMPACT
This reimbursement grant from the State of California Office of Traffic Safety may not exceed
$26,592. Quarterly returns will be filed on a schedule set by OTS, with reimbursements being
deposited to account #28-20-310-046-4540. $17,728 is allotted for FY 2005 and $8,864 for
FY 2006.

BACKGROUND:
Please see the timeline attached detailing the history of the ficus tree in Azusa and the
accompanying three-tier recommendation for care,maintenance and removal as presented to the
Commission on Thursday, December 2, 2004, by Department Urban Forester at their regular
meeting.
FISCAL IMPACT:
There will be no additional expenditures bourn in the acceptance of this recommendation as all
labor and materials and supplies have been budgeted in the 2004-2005 fiscal year budget by the
affected Departments respectively.

AMENDING THE
PLANTING PROGRAM
RECOMMENDATION:
It is recommended that City Council accept the Parks and Recreation Commission recommendation for
amending the previously approved implementation of a community tree planting program.
BACKGROUND:
On September 7, 2004, the City Council approved the Commission recommended community tree
planting program coined "The Memorial Grove". The grove is a subset of the Garden Center in the
proposed Forest Gateway Interpretive Center project due to commence with construction in 2005. The
grove is designed to provide a vehicle and process for numerous tree planting requests; to centralize the
program to one location while improving aesthetics and consistency in the parks while reducing
maintenance staff time and expense.
The Commission was asked to revisit the item, address criteria and establish a cost for these services. As
a result, the Commission recommends the following criteria and fee assessment as dictated on the
attached application.
A. Any individual, family, business or organization may apply
B. Cost of tribute is $200.00 (includes appropriate recognition by name plate on donor wall in
Memorial Grove)
C. Opportunities to purchase additional tributes such as benches, fountains or trash receptacles are
available as well (please contact Director of Recreation and Family Services for further
information.
FISCAL IMPACT:
The $200.00 fee will assist in the initial planting and maintenance of the Memorial Grove in addition to
the financing of the name plate recognition on the donor wall. Once again, the ongoing maintenance of
the Interpretive Center Gardens as well as the Memorial Grove will be the responsibility of the U.S. Forest
Service as soon as the project is ready for their occupancy. At this time, this is the only Memoria Grov
