The City Council of the City of Azusa met in regular session at the above time and place. The meeting opened with the Flag Salute. Flag Salute Invocation was given by Rev. Durnal of the Emmanual Invocation Baptist Church. Roll Call: Councilmen: Fawcett, Ortuno, Johnson, Roll Call Romero, Memmesheimer City Attorney, City Engineer, City Clerk It was moved by Councilman Johnson, seconded by Council- man Ortuno and unanimously harried that approval or Corrections corrections of the Minutes of the Meeting of September 26th be tabled until the next regular meeting. Bids for the purchase by the City of one induction feeder voltage regulator, one 400 amp 15,000 volt oil circuit breaker and one 600 amp 7,500 volt oil circuit breaker, as advertised in the Azusa Herald and Pomotropic published on Sept. 15th and 22nd, 1955, were opened in the office of the City Clerk on Friday, at 10 A.M. on the 30th day of September. Present at the opening of the bids were City Engineer, John Williamson, Councilman Clarence Fawcett, Supt, of Light and Water, Virgil Smith, City Clerk, James Miller. The bids were advertised and opened in accordance with Ordinance -,x#483 of the City of Azusa. Unit Price - - - - - - - - - - - $9,256.00 1 -- 600 Amp 7.2KV Oil Circuit Breaker - Maydwell & Hartzell Unit Price - - - - - - - - - - - 2,105.00 1 -- 600 Amp 14.4KV Oil Circuit Breaker - Maydwell & Hartzell Unit Price - - - - - - - - - - - 2,444.00 The Westinghouse Electric Supply Company bid was $778.00 lower than the other bids on the regulator and the bid from Maydwell & Hartzell on the Oil Circuit Breakers was the same price as the bids from the other Companies. Moved by Councilman Fawcett, seconded by Councilman Romero and unanimously carried that the recommendation of the Committee be accepted and that the award of bids be made to the Companies as stated. Bid Bonds to be returned to the unsuccessful bidders. The Planning Commission recommended to the City Council that a variance be granted to a P Zone of the east 54 ft. of Lots 58, 59, 60 and 61, Tract #14069, from R-1. This variance would be granted to enable the Yor-Way Market to enlarge the parking facilities at their place of business Moved by Councilman Fawcett, seconded by Councilman Ortuno that the City Council accept the recommendation of the City Planning Commission and a variance be granted from R-1 to a P Zone to Mr. Kennedy and property owners of Lots 58, 59, 60 and 61 as per petition. City Attorney to prepare a resolution accordingly. It was to be stipu- lated in the resolution that the enclosure to be built around the motor and compressor room to be of a louver construction, of architectural pleasing appearance acceptable to the City Engineer. This motion passed by the following vote: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilman Johnson ABSENT: None Mr. Warren Teasley, Chairman of the Planning Commission appeared before Council to get the opinion of the Council as to whether another public hearing on the realignment of Highway #39 should be held before the Planning Commission. Variance granted R. G. Keim for erecting storage area - Yor-Way Market. 352 C CITY HALL AZUSA, CALIF. MONDAY, OCTOBER 3, 1955 It was the opinion of the Council that letters from residents of the City should be submitted to be considered at the next regular meeting of the City Council. Moved by Councilman Ortuno, seconded by Councilman Fawcett and unanimously carried that the newspapers be notified and requested to advertise the request for letters on this Highway subject. Mr. F. Maderigal, 328 N. Dalton Avenue, representing the Nite Lifers' Club appeared before the Council requesting a dance permit for the evening of October 15th instead of the previously rea_uested date of October 29th. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that this reauest be referred to the Police Department with power to act, and that the request for a dance on October 15th, by the Nite Lifers' Club, was favorable to the City Council, all of the restrictions imposed by the Police Department to be met. The City Engineer submitted a report stating Taylor and Hoover Construction Company had completed additions and alterations to the Paramount Pump Station and recommended the Notice of Completion be approved by the Council, and the City Clerk be instructed to file with the County Recorder. Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried that the recommendation of the City Engineer be accepted and the City Clerk file the Notice of Completion with the County Recorder. The City Engineer reported that due to difficulties in obtaining the necessary easement from the property owner, it will not be possible to locate one manhole as previous- ly anticipated on Project No. 133, and it will therefore be necessary to delete one manhole from the contract work and to add one additional terminal cleanout which can be located on the presently owned public right-of-way. It was recommended by the City Engineer that the Mayor be authorized to sign Change Order #1, Project No. 133, resulting in a net decrease in contract price in the amount of $136.20. Moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that the Mayor be authorized to sign Change Order No. 1, Project No. 133, decreasing the contract price by the amount of $136.26. The City Engineer submitted a report of the Community Redevelopment Agency meeting on Wednesday Sept. 28th. Mr. Arthur Cornwell was elected Chairman of the group at that time. A definite program by the group is expected to be set up in the not too distant future. It was moved by Councilman Johnson, seconded by council- man Ortuno and unanimously carried that this letter be filed. The City Engineer addressed Council and stated that in his opinion changes are necessary in the present sewer Ordinance of the City. It was moved by Councilman Ortuno, seconded by Council- man Romero and unanimously carried that the City Engineer and the City Attorney study the present sewer Ordinance and recommend changes for Council approval. 353 7:30 P.M. Request for letter; on Highway 39 subject to be published. Nite Lifers' Club request for dance permit referred to Police Dept. Notice of Comple- tion - Paramount Pump Station - to be filed with Couni Recorder. Mayor authorized to sign Change Order No. 1 -- Project x`133• Report of Community Redevelopment to be filed. Recom. for changes in sewer Ordinance to be submitted to Council. The City Engineer requested authority to employMrs. Carol Carpenter on a temporary basis at a salary of $271.00 per Temporary Steno - month as stenographer -clerk in the Engineering Department. Clerk in Engrg. Moved by Councilman Romero, seconded by Councilman Ortuno Dept. authorized. and unanimously carried that the City Engineer be authorized to employ Mrs. Carol Carpenter in the Engineering Office at a salary of $271.00 per month, on a temporary basis, not to exceed 90 days. In CITY HALL AZUSA, CALIF. MONDAY, OCT. 3, 1955 Report was received from Nr. Ben S. Parker, Architect, stating that the construction of the Recreation Build- ing is now complete as of October 3, 1955, with only final adjustments to operating equipment not yet completed These can only be made after the building is occupied. It was recommended that the City Attorney prepare the necessary Notice of Completion and the City Clerk file the same with the County Recorder. City Clerk announced receipt of a Registered Letter, No. 51139, H. A. Pulaski, 15627 Arrow Highway, Azusa, Calif., giving notice that Glen E. Hummer Construction Company is indebted to Harry A. Pulaski in the sum of $4,950.50, and requesting that the City withhold any monies due, or to become due, from said Glen E. Hummer Construction Company in a sum sufficient to satisfy this claim. The City Clerk announced also that Wilson Plumb- ing and Heating Company, 5065 A Street, Ontario, Calif. submitted a letter stating that a balance was due that Company from Glen E. Hummer Company in the amount of $5,337.19 and requesting the City to make payment of this amount to the Wilson Plumbing Company. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that the City Attorney be authorized to prepare a Notice of Completion for the Recreation Building, and the City Clerk to be instructed to record same. 355 7:30 P.M. MONDAY, OCT. 3, 1955 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, STATE OF CALIFORNIA, AMENDING ORDINANCE N0. 438 OF SAID CITY OF AZUSA, ENTITLED "AN ORDINANCE OF THE CITY OF AZUSA ESTABLISHING A 'TRAFFIC CODE', REGULATING TRAFFIC UPON THE PUBLIC STREETS AND REPEALING ALL ORDINANCES INCONSISTANT THEREWITH" BY AMENDING SECTION 12.03 THEREOF." The Ordinance was then read in full. Second reading of the Ordinance to be October 17, 1955. Councilman Johnson moved its adoption, seconded by Council- man Fawcett, Resolution was then passed and adopted by the following vote of the Council: AYES: Councilmen: Fawcett, Ortuno, Johnson, Romero, Memmesheimer NOES: None ABSENT: None and numbered Resolution No. 3309 The City Attorney reported that he had made an inspection of the property at 149 S. Vernon Avenue, which was subject to a complaint as being used as an R-2 use in an R-1 area. In his opinion it is.a fire hazard and that apparently two families do occupy the house on the lot. The City Attorney is to take up the matter with the owner of the property and instruct the owner of conditions required for R-1 zoning. City Attorney reported that he had examined the proposed Rules and Regulations for the Recreation Building which the Recreation Department requested,to be approved on a six-month trial basis. Moved by Councilman Romero, seconded by Councilman Johnson and unanimously carried that the City Attorney be instructed to prepare a Resolution adopting Rules & Regulations, and fee charge, and application for use of the new Recreation Building as submitted by the Parks and Recreation Commission, with suggested changes of Paragraph 19 which would include the Liability and Property Damage insurance to be approved by the City Clerk and City Attorney. Investigation of 149 S. Vernon being used as R-2 in R-1 area City Attorney to prepare Resolution adopting Rules & Regulations re: Recreation Bldg. The City Attorney reported that he had been studying the proposed sale of the City -owned land on North Virginia Avenue and that this land had been tax deeded property Proposed sale of and as other tax deeded property in the City, had been City -owned land on sold under a City Ordinance through Mr. John Bender. North Virginia Ave. He had contacted Mr. John Bender and was awaiting word from him regarding the proper proceedures to be followed. It was moved by Councilman -Fawcett, seconded by Council- man Romero and unanimously carried that the City Council raise from the table the proposed Amendments to the Civil Service Rules and Regulations tabled by the City Council at a previous meeting. Discussion was held regarding the proposed changes as related to sick leave. Amendments to Civil Service Rule: raised from table. 860 361 CITY HALL AZUSA, CALIF. MONDAY, OCT. 3, 1955 7:30 P.M. Moved by Councilman Fawcett, seconded by Councilman Recommended Amend - Johnson and unanimously carried that the City Council ments to Civil recommend to the Personnel Board that the proposed Rules Service Rules & and Regulations be amended as follows: Regulations. Section 86, Paragraph 1 - Sick leave with pay shall accrue to full time employees at the rate of one working day of leave for each calendar month of the employee's service, and any such leave accrued but unused in any year shall be accumulative for succeeding years up to a maximum of 90 working days. Sick leave may be taken in units of one hour. Paragraph 2, Item 6 will be deleted. (pregnancy excluded) Paragraph 3, Item 3 under the heading "Advance Sick Leave" - whenever circumstances require and with the approval of the Department Head, sick leave may be taken in advance of accrual up to a maximum of 12 working days. and that anyone in the employ of the City for five years or over may be granted additional time not to exceed 30 days with their presently accumulated sick leave. Chamber of Commerce submitted a letter to the City Council requesting consideration be given the following method of payment of City Funds to the Chamber for services Proposed method of rendered to the City by the Chamber, to wit: The City, payment of City through the City Council at the beginning of each fiscal funds to Chamber year will by Ordinance make a specific appropriation of of Commerce money to the Chamber, which appropriation will be drawn on quarterly by the Chamber, in such amounts as the Chamber deems necessary to carry out its obligations under its contract with the City. The Chamber is required to submit quarterly reports to the Council showing the source and amount of its income, and also a statement of its expenditures so that the City can determine therefrom the manner in which the Chamber expends the money appropriated by the City. Any appropriated money not expended or obligated by the Chamber during the fiscal year will be carried over into the next fiscal year and reflected in the Chamber's budget submitted to the Council. Moved by Councilman. Romero, seconded by Councilman Johnson and unanimously carried that the letter of the Chamber of Commerce regarding disbursement of funds by the City be referred to the City Attorney for study and report. It was brought to the attention of the City Council that this season the Chamber of Commerce did not contemplate decorating the tree on the City Hall lawn as in previous years. Moved by Councilman Ortuno, seconded by Councilman Johnson and unanimously carried that the Chamber of Commerce be informed that the City Council is unhappy with the in- tended Christmas program and that the City Council expects Christmas decorating of the tree to be the first item to be considered on Christmas decorations; and in addition, the setting of street lights across the high- way is to conform with State Highway requirements. Letter was received from Henry J. Adams, Chairman of the Water Resources Committee of the Chamber of Commerce encouraging the suggested survey to the City's water problems, as suggested by City Engineer Williamson. MONDAY, OCTOBER 3, 1955 Supt.of Light and Water reported that Mrs. Maude Beebe had been hospitalized and recommended an extension of sick leave be granted to her. Moved by Councilman Fawcett, seconded by Councilman Ortuno that Mrs. Maude Beebe be granted two weeks' additional sick leave. Motion passed by the following vote: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilman Johnson ABSENT: None Supt. of Light and Water requested authority to employ Mr. Dorsey Roules, lst step, Probationary Lineman Helper, effective date to be reported as soon as possible. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that the Supt. of Light and Water be authorized to employ Mr. Dorsey Roules at lst Step, Probationary Lineman Helper, and that the, City Attorney prepare necessary Resolution. The Supt, of Light and Water Dept., V. D. Smith, announced that Aerojet-General Corporation is requesting power service for their neva warehouse on Georgia Street and that it would be necessary to advertise for bids for a transformer to serve this place taken over by Aerojet. Aerojet-General Company had forwarded a check in the amount of $1500 to cover their phase of the initial electrical installation as estimated by Mr. Smith. Moved by Councilman Fawcett, seconded by Councilman Romero and unanimously carried that the City Clerk be authorized to advertise for bids for the purchase of transformer and other necessary appurtenances, Supt. Smith to furnish the necessary specifications, bids to be:opened in the office of the City Clerk on Nov. 4th. Supt, of Light and !==later Smith announced that oral inter- views were given this evening for Journeyman Lineman and that a Civil Service List for Journeyman Lineman had been furnished. However, it was impossible to hire any of the men on the list under 4th Step of the salary range. Mr. Meier, representative of J. L. Jacobs Company, addressed the Council and recommended that a flat rate. the 5th Step, be set for Journeyman Lineman for a period of at least six months in order to allow work to be carried on, and at the end of six months to consider all phases of the wage bracket for this type of workman as the availability of men is shown at that time. It was moved by Councilman Romero, seconded by Council- man Fawcett and unanimously carried that the Supt. of Light and plater be authorized to hire two Journeyman Lineman at the 5th Step, the effective date to be furnished by the Supt, upon determination, and the City Attorney to be instructed to prepare a Resolution accordingly. Engineer Williamson announced to Council that the develop- ers of the tracts in the proposed Easterly Annexation No. 10 to the City of Azusa, had informed him that the County Fire District will not install fire hydrants due to the possible annexation to the City of Azusa, and that the developers are anxious to have this fire pro- tection put in as soon as possible. It is estimated that approximately 37 hydrants will be needed. It was moved by Councilman Romero, seconded by Council- man Ortuno and unanimously carried that the City Engineer be authorized to advise the County Fire Department that if they will install hydrants in the contemplated Easterly Annexation District No. 10, that in event said territory becomes annexed to the City of Azusa, the City of Azusa would reimburse the CoiLnty Fire Department for the actual cost of the hydrants and installation charges. Motion carried unanimously. 363 7:30 P.M. Mrs. Beebe granted sick leave extension. Employment of Dorsey Roules, Probationary Lineman Helper authorized. To advertise for bids, for trans- former, etc. Journeyman -Lineman to be employed at 5th Step, for six- month period.
