RECOMMENDATION:
It is recommended that the City Council adopt the attached Resolution casting its votes for City
of Azusa Councilman Robert Gonzales to the position of alternate board member to the WQA
Board representing cities with prescriptive water pumping rights.
BACKGROUND:
The San Gabriel Basin Water Quality Authority (WQA) was established in 1993 to initiate and
oversee water treatment programs in the areas of the San Gabriel Valley that have been
designated as a Superfund site by the United States Environmental Protection Agency (EPA).
The Superfund site overlies groundwater that has been contaminated by years of industrial
dumping of various solvents and other contaminants.
The WQA operates under the direction and oversight of a seven (7) member board consisting of:
one member each from the three overlying municipal water districts (Upper San Gabriel Valley
MWD, San Gabriel Valley MWD, and Three Valleys MWD); one member representing a city
without prescriptive pumping rights; two members representing water producers in the Main San
Gabriel Groundwater Basin; and one member representing a city that has prescriptive pumping
rights. The City of Azusa is a city that has prescriptive water pumping rights and is also a water
producer in the Main San Gabriel Groundwater Basin.

The WQA provides oversight to six "operable units" for groundwater contamination cleanup in
the Main San Gabriel Groundwater Basin. As a point of information, none of the operable units
involve cleanup of groundwater water in the direct vicinity of Azusa Light & Water groundwater
wells or water treatment facilities.
Due to a vacancy on the WQA Board for an alternate board member to serve a four year term
representing cities with prescriptive water rights, WQA is seeking votes for nominated
candidates from those cities to fill the alternate seat for the next four year term. The candidates
nominated are:
Robert Gonzales of the City of Azusa;
Bart Patel of the City of El Monte; and
Mary Ann Lutz of the City of Monrovia.
Attached to this Scheduled Item Report are: a February 21, 2013 letter from WQA concerning
the impending election; the ballot to be cast; the List of Nominations; and the Resolution to be
approved by the Utility Board casting its votes for the candidate.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA, CALIFORNIA, CASTING ITS VOTES FOR
COUNCILMEMBER ROBERT GONZALES OF THE CITY OF AZUSA
AS AN ALTERNATETO THE ELECTED BOARD MEMBER
REPRESENTING CITIES WITH PRESCRIPTIVE PUMPING RIGHTS
ON THE BOARD OF THE SAN GABRIEL BASIN
WATER QUALITY AUTHORITY
WHEREAS,on September 22, 1992,Senate Bill 1679 was signed into law by Governor Pete
Wilson authorizing the creation of the San Gabriel Basin Water Quality Authority; and
WHEREAS,the Board of the San Gabriel Basin Water Quality Authority is composed of
seven members with three appointed members from each of the three municipal water districts,one
elected city council person from cities in the San Gabriel Basin with prescriptive pumping rights,one
elected city council person from cities in the San Gabriel Basin without prescriptive pumping rights,
and two appointed members representing water producers in the San Gabriel Basin; and
WHEREAS,each elected member of the Board is required to have an alternate under section
508 of the San Gabriel Basin Water Quality Authority Act; and
WHEREAS, an alternate position on the Board for cities in the San Gabriel Basin with
prescriptive pumping rights is vacant; and
WHEREAS,the City of Azusa is one of the cities in the San Gabriel Basin with prescriptive
pumping rights; and
WHEREAS,the City of Azusa may cast its votes for an alternate representative by resolution
no later than March 25, 2013 at 12:00 p.m.;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA,
CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1. The City Council of the City of Azusa casts its full votes for Councilmember
Robert Gonzales of the City of Azusa as the alternate representative for cities in the San Gabriel
Basin with prescriptive pumping rights.

Dear City Manager:
The nomination period for the special election of the WQA Alternate Board Member
representing cities with prescriptive pumping rights was closed on Tuesday, February 19, 2013 at
12:00 p.m. Enclosed is an election ballot, a sample resolution, a list of nominees, a list of cities
with pumping rights and the number of votes to which each is entitled. Each city has one vote
for each 10,000 residents or majority thereof, as determined by the 2010 U.S. census data. The
enclosed ballot indicates the number of votes your city may cast. Your city may cast its votes for
one candidate by resolution of the city council. Please be aware that a city is not limited to voting
for its own city council members and that a city may vote in an election whether or not it
nominated a candidate.
The resolution must be received at the address below by March 25, 2013 at 12:00 p.m. via
certified mail, UPS, FedEx with a sijinature required or hand delivered. Any resolutions sent
to the WQA without a signature required will not be accepted. Votes will be officially counted
during the Water Quality Authority's regular meeting on Wednesday, April 17, 2013 at 12:00
P.M.

number of votes to which your city is entitled, based upon population, is set forth above. All
your city's votes must be cast for only one candidate.

RESOLUTION NO. 10-C20
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA,
CALIFORNIA, AMENDING AND RESTATING RESOLUTION NO. 97-051
CONCERNING THE SELECTION CRITERIA AND TERM OF THE MAYOR
PRO TEM.
BE IT RESOLVED by the City Council of the City of Azusa as follows:
SECTION 1. That the City Council of the City of Azusa hereby amends Resolution. No. 97-051 in its entirety
and adopts the following mayor pro tem selection criteria and term of office.
(1) Intent. The primary intent of this Resolution is to ensure that the city's mayor pro tern is selected on
objective criteria. Criteria such as seniority and public support as expressed in the number of votes
received in an election are to be used as the basis for selecting the mayor pro tern. It is the
Council's intent to ensure that each council member serving on the Council receives the
opportunity to serve as mayor pro tem at least once during his or her four-year term as a council
member.
(2) Selection Criteria. Annually, at the City Council meeting on the third Monday in March, the mayor
pro tern shall be that council member with the greatest seniority, which has not previously served as
mayor pro tern. However, if such council member does not accept the nomination for mayor pro
tem, then the next most senior council member, whichhas not yet served as mayor pro tem, shall be
offered the position of mayor pro tern. However, if two or more councilmembers qualify for the
position of mayor pro tem by virtue of having equal seniority, then that council member who
received the highest number of votes in the March general City election shall be the mayor pro tem.
(3) Selection Criteria in the Event All Have Served. If all council members have previously served as
mayor pro tern, then the mayor pro tern shall be that councilmember with the greatest seniority. ,If
such councilmember does not accept the nomination for mayor pro tern, then the next most`senior
councilmember shall be offered the position of mayor pro tem. However, if two or more council
members qualify for the:position of mayor pro tern by virtue of having equal seniority, then that
council member who received the highest number of votes in the March general City election shall
be the mayor pro tern.
(4) Term. Mayors pro tern shall serve from March until March of each year succeeding year. A new
successor shall be selected on the third Monday in March in even numbered years and at the
reorganization meeting in March in odd numbered years. Notwithstanding this section, the mayor
pro tem shall continue to serve until his or her successor takes office.
SECTION 2. The City Clerk shall certify to the adoption of this Resolution.

RECOMMENDATION:
It is recommended that the Council Members receive, review, and file the City Treasurer's
Report for the City of Azusa for the month of February 2013.
BACKGROUND:
Transmitted herewith is the City Treasurer's Statement of Cash Balances for the City of Azusa
for the month of February 2013. City investments are made in accordance with the City's
Investment Policy adopted and approved with Resolution No. 05 —C16 dated, February 4, 2013,
and Government Code Section 53600 et seq.
FISCAL IMPACT:
The balances of cash, investments, and projected revenues for the next six months are expected
to be sufficient to meet cash disbursement requirements of the City for at least the next six
months.
The change in total cash in bank and investments from January 31, 2013 to February 28, 2013 is
a net decrease of$259,038.54.

RECOMMENDATION
It is recommended that the City Council approve a one year, Helicopter service contract
extension with the City of El Monte.
BACKGROUND
On May 7, 2007,the City of Azusa and the City of El Monte entered into a five (5)year
agreement for the City of El Monte to provide Helicopter services to the City of Azusa.
The contract ended on May 7, 2012 and the City of El Monte is requesting an extension
of our current contract from May 8, 2012 through June 30, 2013. The contract extension
has been approved as to form by the City Attorney. During this extension, the City of El
Monte will prepare and provide the City of Azusa with terms of a new five (5) year
agreement from July 1, 2013 to June 30, 2018.
ANALYSIS
During this extension, staff will explore other Helicopter service vendors and/or options
to compare to the City of El Monte's new five (5) year term contract offer. Staff will
make recommendations to the Council at that time. i

FISCAL IMPACT
Helicopter service for the current fiscal year 2012/2013 is paid through COPS/Brulte
funds ($37,500) and has been approved in the in the 2012/2013 budget. This expenditure
will not utilize any General Funds.

FIRST AMENDMENT TO MASTER AGREEMENT
(Parties: City of El Monte and City of Azusa)
(Helicopter Shared Use Agreement)
THIS 2012 FIRST AMENDMENT (the "Amendment") to that certain agreement entitled
"Helicopter Agreement" is made and entered into on this day of
2013 by and between the CITY OF EL MONTE, a municipal
corporation and general law city (hereinafter, "CITY") and THE CITY OF AZUSA, a
municipal corporation and general law city ("AZUSA"). For the purposes of this
Amendment, CITY and AZUSA may be referred to collectively as the "Parties." The
capitalized term "Party" may refer to CITY or AZUSA interchangeably.
RECITALS
WHEREAS, CITY is the owner of three R-44 Police Equipped Helicopters, Serial No.
331, Serial No. 11781 and Serial No. 1060 (collectively, the "Helicopters"); and
WHEREAS, on or about May 7, 2007, the Parties executed and entered into an
agreement entitled "Helicopter Agreement" (CA Agmt. No. 06PS080) (hereinafter, the
"Master Agreement") (A true and correct copy of the Master Agreement is attached
hereto as Exhibit "A"); and
WHEREAS, the Master Agreement generally provides for the shared use of the
Helicopters to provide aerial support to CITY police officers and AZUSA police officers
engaged in law enforcement functions in each jurisdiction; and
WHEEREAS, the Master Agreement also provides for joint staffing of the subject
Helicopters by CITY and AZUSA sworn personnel; and
WHEREAS, AZUSA desires to continue to utilize the Helicopters in aiding its policing
function.
NOW, THEREFORE, in consideration of the mutual agreements contained herein, and
other good and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, and intending to be legally bound hereby, the Parties agree as follows:
SECTION 1. The term of the Master Agreement is extended for a period of time
commencing May 8, 2012 and ending June 30, 2013 ("First Extension Term").
Thereafter, the Master Agreement shall renew automatically for a maximum of two (2)
three-month extension terms unless prior to the end of the First Extension Term or the
extension term immediately following, either Party gives written notice to the other of its
intent not to extend the Master Agreement. Nothing in this paragraph shall operate to

limit or otherwise amend or modify the ability of the Parties to terminate the Master
Agreement prior to the expiration of the First Extension Term or any other extension
term earlier as provided under Section 9 of the Master Agreement. Nothing in this First
Amendment shall prevent the Parties from approving a subsequent amendment to the
Master Agreement that provides for a greater extension of the Master Agreement and
that would otherwise supersede this First Amendment.
SECTION 2. Except as otherwise set forth in this First Amendment, the Master
Agreement shall remain binding, controlling and in full force and effect. This First
Amendment together with the Master Agreement shall constitute the entire, complete,
final and exclusive expression of the Parties with respect to the matters addressed in
both documents.
SECTION 3. The provisions of this First Amendment shall be deemed a part of the
Master Agreement and except as otherwise provided under this Amendment, the
Master Agreement and all provisions contained therein shall remain binding and
enforceable. In the event of any conflict or inconsistency between the provisions of this
First Amendment and the provisions of the Master Agreement, the provisions of this
First Amendment shall control, but only in so far as such provisions conflict with the
Master Agreement and no further.
IN WITNESS WHEREOF, the Parties hereto have caused this First Amendment to be
executed on the day and year first appearing above.
