Present at Roll Cell: Councilmen: Fawcett, Ortuno, Roll Call Johnson, Romero, Memmesheimer City Attorney, City Engineer City Clerk Councilman Johnson offered for its second reading Ordinance entitled: "AN ORDINANCE OF THE CITY OF AZUSA, IMPOSING A CITY SALES AND USE TAX: PROVIDING FOR THE PERFORMANCE BY THE STATE BOARD OF EQUALIZATION OF ALL FUNCTIONS INCIDENT TO THE ADMINISTRATION, OPH.RATION AND COLLECTION OF THE SALES AND USE TAX HEREBY IMPOSED: SUSPENDING THE PROVISIONS OF ORDINANCE(S) NO.(S) 392 AMID 491 DURING SUCH TIME AS THIS ORDINANCE? IS OPERATIVE: AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF." Moved by Councilman Johnson, seconded by Councilman Fawcett and unanimously carried that further reading of the Ordinance be waived. Moved by Councilman Johnson, seconded by Councilman Ortuno that this Ordinance be passed and adopted. This Ordinance was then passed and adopted by the following vote of the Council: AYES: Councilmen: Fawcett, Ortuno, Johnson, Romero, Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: None and numbered Ordinance No. 500 City Attorney Tscharner stated that a Resolution would be prepared for entering into Agreement for the State Ad- ministration of the Local Sales and Use Tax. Supt, of Light and Water, V. D. Smith, staged that it was desirea.ble to change the Light and Water Department over to cycle billing during the month of March, and recommend- ed approval of a. notice to be mailed to each customer explaining the changeover. Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried that the Light and Water Department change to cycle billing and that the notices be sent out to the customers as set forth in the Superintendent's recommendation. A report was submitted by V. D. Smith, Supt, of Light, and Councilman Ortuno, Chairman of the ?dater Dept., setting forth the progress on the street lighting program. Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried that this report be filed. Supt. Smith announced that it would be necessary to in- crease his order for luminaires, if this order could be give at this time, a. savings would be possible as the City could purchase on the original bid price set almost a year ago. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that the Supt, of Light and Water be authorized to purchase an additional 200 AK10 Luminaires. Discussion was held on the request for a survey of the light rates. Mr. Snaith, Supt, of the Light Department stated that it had been recommended to him that a survey of the entire light system should be made by a competent technician in order to establish the basis for a change in rates. LOK Ordinance No.50C Uniform Sales Tax Light and Clater Dept, to change over to cycle billing. Report on street lighting program filed. Additional Luminaires to be purchased. CITY HALL AZUSA, CALIF. MON. FEB. 27, 1956 Discussion was held relative to the manner of acquisition of the facilities of the Edison Company serving areas within the City. Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried that the City Attorney be instructed to prepare a letter, and the Mayor be authorized to sign the letter, requesting the Southern California Edison Company to quote a sale price for the facilities in the areas of the City being served by that Company, this letter to be submitted for Council approval before mailing. With consent of the second, this motion was amended to include: "that this request be broken down into sections: 1 - Industrial facilities 2 - Domestic facilities" The letter from James M. Montgomery Company, under date of Februar;r 2, 1956, was read, whereby the City had asked Mr. Montgomery to submit a. proposal for doing the additional work required to make a study of the cost and means of acquisition of privately owned facilities in areas that are in conflict with those in the City of Azusa. Additional discussion was held on the feasibility of acquiring technical assistance in framing the letter to the Edison Company or the acquiring of technical assistance for analyzing the e-Kpected reply from the Edison Company. Request for price of facilities - So. Calif. Edison Co. sale James M. Mont- gomery Company letter - 2/2/5 Supt. Smith stated that he had received letters from Mr. Loren W. East, Consulting Engineer, and Wayne N. Johnson, Consulting Electrical Engineer in respect to a study for Survey for new fixing new rates and earning levels for the Electric electrical rates Department. It was recommended by Supt. Smith that & earning levels Electrical Engineering Technicians be employed for the tabled. survey. It was moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that the City Clerk make available to the Council members copies of the letters from Mr. East and Mr. Johnson, and that the matter of the proposed survey be tabled until the meeting of March 5th. Moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that the City Council reconsider the vote on Councilman Johnson's motion relative to sub- mitting a letter to the Edison Company requesting their sale price of facilities in areas of the City now being served by them. On roll call, the motion: "that the City Attorney be instructed to prepare a letter, and the Mayor authorized to sign the letter, requesting the Southern California Edison Company to quote a sale price of the facilities in the areas of the City being served by that Company, this letter to be submitted for Council approval before mailing" was defeated by the following vote: AYES: Councilmen: None NOES: Councilmen: Fawcett, Ortuno, Johnson, Romero, Memmesheimer ABSENT: Councilmen: None o Moved by Councilman Johnson, and unanimously carried that the meeting of March 5th. seconded by Councilman Ortuno this matter be tabled until A request was submitted by Rolf B. Magnell, Sergeant in the Azusa Police Department for a leave of absence from February 11, 1956, pending the decision of his application for disability retirement, which is now pending. It was moved by Councilman Fawcett, seconded by Council- man Ortuno and unanimously carried that Rolf B. Magnell be granted a leave of absence from the Police Dept. for a period of six months. Motion re: letter to So. Calif. Edison Co. -- defeated. R. Magnell, Polic Dept., granted leave of absence CITY HALL AZUSA, CALIF. MONDAY, FEB. 27, 1956 Salvador Perez requested permission for his organization known as the Nite Lifers to hold a Fiesta and Dance at the Parish Hall, 4th and Dalton Avenues, on May 5th. Moved by Councilman Ortuno, seconded by Councilman Fawcett and unanimously carried that the request of the Nite Lifers be granted, and that it be referred to the Chief of Police with power to act. Moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously* carried that the report of the Chief of Police relative to the request for private dance submitted by the Sociedad Progresista Mexicana be filed. A report and statement for fire hydrant heads installed in Tracts #17939 and#16435 was received from the Azusa Valley Water Company. Moved by Councilman Fawcett, seconded by Councilman Romero and unanimously carried that the Water Dept, be authorized to pay for the hydrants as per statement. 87 8 P.M. The County Engineer, Mapping Division, submitted a recom- Recommendation mendation of house numbers and street names for Tract for house x{20502, numbers etc., - Moved by Councilman Fawcett, seconded by Councilman Romero Tract #20502 and unanimously carried that this be referred to the City Engineer for disposition. Communication was received from the Citrus Union High School District in answer to Resolution No. 3349 of the City Council and a Resolution of the City Park and Recreation Commission Citrus Union F$g in which the High School District was requested to furnish School District financial aid in the Azusa Recreation Program. It was the unable to furnisl decision of the School Board that the Citrus Union High financial aid School District could not grant the request as outlined to Recreation in the Resolutions. Program Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried that this letter be referred to the Park and Recreation Commission. A proposed Resolution and Agreement was received from the Sanitation Dis- Los Angeles County Sanitation District No. 22 relative trict - Res. & to the organization of a refuse collection and disposal Agreement tablet system in the District. Moved by Councilman Johnson, seconded by Councilman Ortuno that the Resolution and Agreement be tabled for further study until March 5th meeting. Upon consent, the second and the motion were withdrawn. Councilman Romero issued an invitation to the Council to Invitation to attend the Lions Clio sponsored Sports Show, Saturday, Sports Show. March 3rd, at the Citrus High School Gym. CITY HALL AZUSA, CALIF. MONDAY, FEB. 27, 1956 Mayor Memmesheimer reed the letter from the Junior College Baseball Tournament sponsored by the Civitan Club regarding the support of the City Council and the people of Azusa in this tournament. It was moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried that the City Council authorize the use of the City Departments and assistance towards the success of the tournament. The Jr. College Baseball Tournament also requested per- mission for installing banners across the Highway for this year's tournament. It was recommended by the City Engineer that he be authorized to grant encroachment permits to those groups regularly applying for same. It was moved by Councilman Ortuno, seconded by Councilman Fawcett and unanimously carried that authorization be given to grant encroachment permits to those groups who regularly apply for them. Mayor Memmesheimer announced the meeting of the Mayor's Safety Committee on February 29, 1956. It was brought to the attention of the Council that upon the widening of Angeleno Avenue, between 3rd and 4th Streets, it is noted that a fence has been erected very close to the curb line, by one of the owners whose property borders on Angeleno Avenue. It was moved by Councilman Ortuno, seconded by Councilman Romero and unanimously carried that the matter of the fence along Angeleno Avenue and 3rd Street be referred to the City Engineer and City Attorney. A letter was submitted from the Azusa Coordinating Council by Cecil V. Romero, President, requesting representatives be allowed to attend the Governor's Conference on Youth and Children, in Sacramento, 6lednesday, April 4th through Thursday, April 5th, 1956, It was also requested that the City Council advance the sum of $100 per person for expenses. It was recommended that the following persons attend the Conference: Mr. Nelson Price of the Azusa Coordinating Council Mrs. Laura D. Jones, Chairman, Park & Recreation Commission Alma Abel, Azusa Coordinating Council It was moved by Councilman Johnson, that Mr. Price, Mrs. Jones - or some other member of the Park and Recreation Commission, and Airs. Abel be authorized to attend the Governor's Conference in Sacramento and expense advance of $100 be allowed, to be accounted for at the conclusion of the Conference. Motion died for lack of a second. Moved by Councilman Romero, seconded by Councilman Fawcett that Mrs. Abel, Mr. Price and Mrs. Laura D. Jones or some other representative of the Park and Recreation Commission be authorized to attend the Governor's Conference on Youth and Children, April 4, through April 5, and that an advance of $100 for expenses be authorized. This motion carried by the following vote: AYES: Councilmen: Fawcett, Romero, Memmesheimer NOES: Councilmen: Ortuno, Johnson ABSENT: Councilmen: None Councilman Ortuno stated that his vote of "No" was be- cause Mr. Price did not live within the City and not that he was not doing service for the City. Mr. Michael Kay appeared before Council and requested that final approval be given to Tract map ,-;E20971. The City Engineer stated that the matter of the Azusa Agri- cultural plater Pipeline in Sierra Madre Avenue should be Z, 8 P.M. City Depts. authorized to assist - Jr. College Base- ball Tournament Authorization to grant encroachment permits. Mayor's Safety Comm. It was the opinion of the City Engineer that that drainage is properly designed, but that the matter of the discharge of waters on to the Spreading grounds has still not been satisfactorily determined. The City Attorney stated that Dir. Kay has written a letter relative to what plan he intends to use on the discharge of the waters on to the Spreading Corporation grounds, and that he had taken the matter of the letter up with Mr. Walters of the Spreading Corporation and Mr. Walters has stated his satisfaction with the letter. Also, that Dir. Mr. Kay asked what the conditions would be. The City Engineer stated that the conditions, as he under- stood them, would be that the City have a certification in writing that the drainage disposal on to the Spreading Corporation's grounds -is satisfactory to them, and also the conditions that the satisfactory bond, etc. be filed. Moved by Councilman Romero, seconded by Councilman Johnson' and so ordered that the following communications be filed: a Western Oil and Gas Company b Air Pollution Control District c The Hearing before the State Division of Forestry - Supplementary Budget on natural resources. (d) Remarks of Eugene R. Hoffman, Secretary of Watershed -Fire Council of Southern California, Meeting of February 14th. Councilman Johnson requested clarification on the attendance by Councilman Farcett to the Area D, Civil Defense Meeting. Mayor Memmesheimer reported that he had requested Councilman Fawcett to attend, it being on short notice. Mayor Memme- sheimer recommended Councilman Fawcett be appointed as an alternate to the Civil Defense Board, Area D, in place of Councilman Johnson. No action was taken by the Council. Councilman Fawcett reported on the meeting attended by him in the afternoon. The meeting was basically a study of the moving of communications center to the City of Claremont. Councilmen Fawcett also stated that he had been appointed to a Committee studying this problem. Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried that Councilman Fawcett be authorized to continue on this Committee until the assignment is completed. i Communications ordered filed.
