The meeting was opened with the Flag Salute led by Mayor Memmesheimer. Flag Salute Invocation was given by 'Reverend Wayne Pendleton. Invocation ROLL CALL: Councilmen: Fawcett, Ortuno, Johnson, Roll Call Romero, Mayor Memmesheimer Also Present: Acting City Attorney, City Engineer, City Clerk The Minutes of 4/16/56 were approved as submitted. The Minutes of April 17, 1956, Page 1, Item 3, re: Adams -- and Ells proposal, should read "was deferred for study Public Works - - - - until the ne-t meeting" - not "tabled". Appointments The Minutes of the Meeting of April 17th were approved as Corrections to corrected. CITY HALL AZUSA, CAL, MONDAY, MAY 7, 1956 Moved by Councilman Romero, seconded by Councilman Fawcett and unanimously carried that the meetings of the City Council terminate at 10:30 P.M., and if all matters of business have not been taken care of at that time, the City Council will adjourn until 7:30 P.M. one week from the following Tuesday. The City Clerk announced that bids for discing of lots in the program for Abatement of Weeds were opened in the office of the City Clerk on Friday, May 4, 1956, at 10 A.M. Present at the opening of the bids were Councilman Romero, City Engineer Williamson, Supt, of Public Works Brusnahan, City Clerk. The City Clerk presented the Affidavit of Publication of Notice Inviting Bids, this Notice having been published in the Azusa Herald and Pomotropic, April 19, 26, 1956. Mr. Leon Erwin, 126 Hubbard Street, San Fernando, submitted a bid at 5z¢ per 100 sq, ft. for lots under 5,000 sq, ft. in area, and -2 per 100 sq. ft, for lots over 5,000 sq, ft. in area. A Cashier's Check in the amount of $100.00 accom- panied the bid. Mr. Wm. Long, 172 N. Pasadena Avenue, Azusa, submitted a bid at $4.00 per lot for lots 5,000 sq, ft, in area or less, and $5.00 per lot for lots 5,000 sq. ft. in area or greater. A certified check in the amount of $100.00 was submitted with the bid. It was recommended by the City Engineer that the low bid of Mr. Erwin be accepted, as in addition to being the low bid, it was the only bid that met specifications. Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried that the City Council accept the recommendation of the Engineer and that the low bid of Leon Erwin be accepted, and that the City Clerk be authorized to return bid check to the unsuccessful bidder. Councilman Ortuno offered for its first reading an Ordinance entitled: "AN.ORDINANCE OF THE CITY COUNCIL AUTHORIZING AN AMENDMENT TO THE CONTRACT PROVIDING FOR THE PARTICIPATION OF THE CITY OF AZUSA IN THE CALIFORNIA STATE EMPLOYEES' RETIREMENT SYSTEM, MAKING ITS EMPLOYEES MEMBERS OF SAID SYSTEM." This Ordinance eras then read in full. The Chief of Police submitted to the Council a proposed Ordinance relay ve to possession, selling, loaning or exchanging any type of spring blade or push-button knife within the City of Azusa. Councilman Johnson offered for its first reading the Ordinance entitled: "AN ORDINANCE OF THE CITY OF AZUSA, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, PROHIBITING THE SALE, EXCHANGE, LOAN OR POSSESSION OF ANY TYPE SPRING BLADE OR PUSH-BUTTON KNIFE, AND PRESCRIBING THE PUNISHMENT FOR VIOLATIONS THEREOF, AND REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH." It was moved by Councilman Romero, seconded by Councilman Fawcett and unanimously carried that this be referred to the Park and Recreation Commission, and an Agreement be drawn up by the Commission_ outlining the proper procedures to be followed by the Little League relative to the development of their site. Requests were received from both American and National Little Leagues for temporary use of bleachers at their respective sites. Mayor Memmesheimer asked if the insurance policy held by Insurance the National Little League could be presented for inspection coverage for by the City Attorney. Upon inspection of the insurance Little Leagues policy by Acting City Attorney Williams it was his opinion that the City should be named as a co-insured on the liability* insurance policy. It was brought out that the American Little League also had the same type of insurance coverage, this being a standard policy reo_uired by the Little League Association. Acting City Attorney Williams stated that there should be an Agreement between the Little Leagues and the City showing what is to be done. It was the opinion of the Acting City Attorney that the City could not give or lend its property to a private user, however, if the City should enter into an agreement whereby an individual or group would perform a service for the City, the Cit;, could then loan or give in payment for such service. Smith of the Light and 'dater Department reported to the Council that the cost for furnishing a 2" meter and light service and temporary pole at the ball park located at First Street, west of Virginia Avenue, would amount to $365.00. For furnishing 1200 ft. of 2" pipe installed, and a 2" meter installed, plus light service and temporary pole, at the Lee School site, the cost would be $1565.00. Supt. Smith also reported that a 1" meter installed, plus 1200 ft. of 1" pipe and light service and temporary :pole at the Lee School would approximate $945.00. 215 7:30 P.M. Cost for f urnish- ing light service etc. at Lee School site. Councilman Ortuno asked the City Attorney if the City could spend money for installation of services on school property. It was the opinion of the City Attorney that this would be permissible if an Agreement was entered into to show that recreational facilities were being received by the City in return. The question was raised as to whether a water line or light facilities installed on school property could remain the property of the City. It was the opinion of the City Attorney that the School Board or School Manager could give permission for the City to install the facilities on the school property and the City would retain o,:anership of these facilities. The Cit,yT Attorney stated that he would endeavor to work with the Park and Recreation Commission on formulating a written Agreement bet1ween the City and the Little Leagues. The City Attorney asked if the Agreement should state that water and light, wilich is metered, would be donated by the,City. It was the opinion of the Council that the water and light would be furnished fL-ee provided the facilities could be used by City Recreation Department and other citizens when Little League activities are not scheduled. MONDAY, MAY 7, 1956 The City Clerk announced that proposals for a survey of the Light Department had been received and turned over to him. Those submitting proposals were Gibbs and Hill, Inc., Los Angeles; Wayne N. Johnson, Los Angeles. J. M. Montgomery & Company, Los Angeles. A letter was received from James M. Montgomery, Consulting Engineer, Pasadena, stating the desire not to submit a proposal for file work at this time, as they believed it was against the ethics of the American Institute of Con- sulting Engineers that the procurement of professional engineering services through competitive bidding on a price basis is a _repudiation of the status of engineering as a profession. Moved by Councilman Fawcett, seconded by Councilman Romero that these proposals be considered by a Committee composed of the City Cler'_c, City Attorney, City Engineer and Supt. of Light and Water Dept., and the report be submitted to the City Council by the first meeting in June, and passed by the following rote of Council: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilman: Johnson ABSENT: Councilman: None 217 7:30 P.M. The City Engineer reported that since the meeting of March 19th, at which time the Engineer and Attorney were authorized to enter into an Agreement whereby the City would accept dedication and improvement of a street to be known as "Dan Lee" street in return for property owrth $4,000 and $2,000 cash payment from the firm of Lee and Daniels owners of the property, but it now appears that due to circumstances attached to this project, plans and specifications should be prepared and this project submitted to bid. It was the opinion of the City Engineer that Mr. Daniels of Lee and Daniels Company would have the firm of Brooks and Miller who has already done some preliminary work on this street, to prepare the necessary plans and specifica- tions for the project if the City would agree to pay one- half' of the cost of such work. Moved by Councilman Fawcett, seconded by Councilman Ortuno that the City enter into an Agreement with the Lee and Daniels Company whereby the City would pay one-half of the cost for the preparation of plans and specifications for the construction of proposed Dan Lee Street. This motion carried by the following vote: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None The City Engineer reported that it had been brought to his attention that there was a possibility of the City acquiring rights to a cut and cover trash disposal site, and it was recommended by the City Engineer that this possibility be given serious consideration by the City. Lee and Daniels Street project CITY HALL AZUSA, CAL. Williamson Councilman Johnson offered an urgency Ordinance entitled: "AN ORDINANCE OF THE CITY OF AZUSA, DIRECTING THAT NO BUILDING PERMIT BE ISSUED FOR ANY BUILDING OR STRUCTURE IN CONFLICT WITH AND PROHIBITING ANY OTHER USE IN CONFLICT WITH THE PROPOSED NEW ZONING ORDINANCE." Councilman Johnson moved its adoption, seconded by Council- man Romero. This urgency Ordinance was then passed and adopted by the following vote of Council. AYES: Councilman: Fawcett, Ortuno, Johnson, Romero, Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: None and numbered Ordinance No. 501 A letter was submitted from the Supt. of the Light Dept. V. D. Smith stating that a new;substation would need to be built at the new Citrus High School within a few weeks in order to supply electricity for the school, and re- quested that his Department be authorized to hire a cement and brick mason for doing that type of work on the structure. Moved by Councilman Ortuno, seconded by Councilman Romero and unanimously carried that the City Attorney be instructed to prepare emergency Resolution authorizing the construction of the substation at the new Citrus High School.
