Mayor Memmesheimer opened the meeting with a salute to the Flag Salute flag. Invocation was given by Rev. Mel Miller of the Friends Invocation Church. ROLL CALL: Present: Councilmen: Ortuno, Johnson, Memmesheimer City Engineer, City Attorney, Asst. City Atty. Williams, City Clerk Roll Call Absent: Councilmen: Fawcett, Romero Corrections to the Minutes of May 7, 1956, were as follows: Page 5, item 4, re: approval of verbal agreement, the word "verbal" should appear in the 3rd line at the end of the paragraph before the word "agreement". Page 6, re: Committee to study proposals for survey of Light Department, on line 6, should read "a letter was re- ceived from James M. Montgomery, Consulting Engineer". Councilman Johnson also pointed out that the letter as stated in the Minutes, had not been read at the meeting of May 7th, and that if the letter had been read as shown in the Minutes, her vote on the following motion would have been "No". The motion would read thusly; "Moved by Councilman Fawcett, seconded by Councilman Romero that these proposals be considered by a Committee composed of the City Clerk, City Attorney, City Engineer and Supt. of Light and Water Dept., and the report be submitted to the City Council by the first meeting in June, and passed by the.following vote- I of Council: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None Page 6, third item, it was requested by Councilman Johnson that the reason stated by City Engineer on his request not to serve on the Committee to study proposals, should be included in the Minutes. The reasons are as follows: "Other members of the American Society of Civil Engineers have been expelled from membership in that Society for par`,icipating �n the request for bids of this type, so that's my reasons for asking that." On Page 7, 2nd item, re: appraisals of land and properties, etc., on line 6, the name should be "Hibsch" not "Gipps" as written. There being no further corrections, the Minutes were approved as corrected. Mayor Memmesheimer announced that this was the time and place for hearing any objections to the proposed removal weeds, rubbish, refuse and dirt, as stated in the Notice to Destroy Weeds in conformance with Resolution No. 3422 of the City of Azusa. Upon questioning, the City Clerk answered that no written protest had been filed. Corrections tc Minutes 5/7/56 Hearing on of Weed Abatemen Program Resolution No. 3422 The City Clerk presented the Notice to Destroy Weeds, and Remove Rubbish, Refuse, and Dirt as posted by the Supt. of Streets, as required by law. There being no protests, Mayor Memmesheimer ordered the Hearing closes Hearing closed. Mr. Cornelius Smith appeared before the City Council and stated that a picture, 36'+ by 22", painted by Elmer Wachtel was being offered as a gift to the City by the niece of Mr. Wachtel, Alva Wachtel Ayars of 428 Grand Avenue, South 252 253 CITY :HALL AZUSA, CALIF. MONDAY, MAY 21, 1956 7:30 P.M. Pasadena. This oil painting depicted a scene in the San Oil painting Gabriel Canyon as it looked in the early 1$90's. It was of San Gabriel the request of the doner that a small brass plate be Canyon offered placed under the frame with the following wording, "Painted to City. by Elmer Wachtel and given to the City of Azusa by Alva Wachtel Ayars, in memory of her father and mother, Mr. and Mrs. David C.'Wachtel, early residents of the San Gabriel Canyon." Councilman Romero entered the meeting and was seated at 7:45 P.M. Moved by Councilman Romero, seconded by Councilman Ortuno Acceptance of that the City Council accept the gift of the oil painting gift of oil from Mrs. Alva Wachtel Ayars, and that this painting be painting placed temporarily in the Personnel Board Office until more suitable arrangements can be made. The motion passed unanimously. ABSENT: Councilmen: Fawcett Moved by Councilman Romero, seconded by Councilman Ortuno Resolution of that a Resolution be prepared thanking Alva W. Ayars for thanks for presenting the painting to the City, and that a plate be painting to be made as requested and that Mr. Smith make the necessary prepared. arrangements. This motion passed unanimously. ABSENT: Councilman Fawcett City Clerk announced that word had been received from the Division of Housing that they are ready to proceed with the Hearing for condemnation proceedings for buildings located at First St, condemnation and Alameda Avenue and suggested a date for hearing before proceedings - the City Council on this matter be set. The suggested date Lopez building was June 4, 1956 at 8 o'clock P.M. June 4, 1956 Moved by Councilman Romero, seconded by Councilman Ortuno that the City Council set the date of Hearing in the con- demnation proceedings of the Lopez buildings located at First Street and Alameda Avenues for June 4, 1956, at 8 o'clock P.M. This motion was unanimously carried. ABSENT: Councilman Fawcett Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried that the items scheduled on the Agenda for the Planning Commission be tabled until the Minutes of the Planning Commission have been made available to the members of the City Council. This motion passed unanimously. ABSENT: Councilman Fawcett Councilman Fawcett entered the meeting and was seated at 8 o'clock P.M. A letter was submitted by Chief of Police Kendrick request- ing permission for Sergeant Warren to attend the International Association for Identification at San Jose, California, June 20-22, 1956, and requesting an advance of $75 be allowed to help defray his expenses, as Sergeant Warren will be on Advance to Sgt vacation during those dates, but will plan to attend the Warren to Conference, attend Con - Moved by Councilman Romero, seconded by Councilman Ortuno ference, San that, an advance of $75 be granted to Sergeant Warren for Jose, granted, attendance at the Conference. City porary basis as City Engineer and is engaged in private Engineer - practice, it is possible that he may have clients coming private before the City Council at some time and he wished the practice. 255 CITY HALL AZUSA, CAL. MONDAY, MAY 21, 1956 7:30 P.M. Council to be aware of this.possibility, and that he would be free to advise his clients that such an arrangement was agreeable and permissible. Discussion was held on the possibility of hiring an architect to work with the Redevelopment Agency for a Library building. Various suggestions were made, no definite action taken. Supt, of Light and ?later, V. D. Smith, reported that light Light and idate7 and water services had been installed at the American Little services - League Diamond on First Street, and that light service at American & the National Little League field on the Lee School property National has been installed, and that water service would be available Little Leagues by May 24th. It was the opinion of the Council that before the water service be installed, the Agreement which has been prepared by the City Attorney, should be signed by the National Little League and approved by the Park and Recreation Commission. Supt. Smith was advised to hold up on further work of installa- tion until the Agreement had been approved. Supt. V. D. Smith of Light and Water Dept. requested per- mission to advertise for bids on approximately 2,000' of 12-3/4" O.D. 10 gauge double dipped and wrapped pipe. Supt. Smith stated further that approximately 1200' of this pipe would be used to serve Tract x}20971, north of Sierra Madre Avenue. Moved by Councilman Ortuno, seconded by Councilman Romero that the City Clerk be authorized to advertise for bids for pipe as requested by Supt. Smith; Supt. Smith to furnish specifications. Motion passed by the following vote: AYES: Councilman: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None Supt. of Light and Water Dept., V. D. Smith, submitted for approval, the Consumers Agreement and application for installa- tion of Water Mains between the Ronduss Construction Company and the City of Azusa Water Dept, in Tract #20971, and re- ported that $21,000 was on deposit for this project. Upon being questioned on the validity of this, Asst. City Attorney Williams stated that it was his opinion that a project of this magnitude should go to bid. Supt, of the Light and Water Dept., V. D. Smith, reported that due to the increased loads on the main distribution substation, it will be necessary to increase the dapacity of the substation facilities as soon as possible and requested the City Clerk be authorized to advertise for bids on con- struction, erection and necessary engineering on the addition to the substation. Supt. Smith stated that in the call for bids, it would be set out that the City would furnish three switches and a regulator. It was estimated by Mr. Smith that the cost of construction would be between $35,000 and $40,000 and the cost of the regulators and switches furnished by the City would bring the total cost between $50,000 and $55,000. Moved by Councilman Ortuno, seconded by Councilman Fawcett and unanimously carried that the City -Clerk be authorized to advertise for bids for the necessary expansion to the substation facilities, plans and specificatisons to be furnished by the Supt. of Light and Water Dept., bids to be opened on June 15, 1956. Supt. Smith requested permission of City Council for a Change Order in order to install large pipes and air condi- tioning units above the ceiling in the Light and Water Dept. office. The extra cost of this project would approximate $492.00. Mr. Smith stated that this placing of the air conditioning system above the ceiling would greatly improve the appearance of the office and be more satisfactory. MONDAY, MAY 21, 1956 Moved by Councilman Fawcett, seconded by Councilman Ortuno that the City Council accept the recommendation of Supt. Smith and that a Change Order be allowed to conceal the unit.in the Light and Water Dept. office at the cost of $492.00. Motion carried by the following vote of Council: AYES: Councilmen: Fawcett, Ortuno, Memmesheimer NOES: Councilmen: Johnson, Romero ABSENT: Councilmen: None 7:30 P.M. Assistant City Attorney Williams, who had been studying the form of Agreement for furnishing water mains and facilities stated that although the Agreement is in good form, he was still of the opinion that a project such as this should be submitted for bid, and that he would recommend that the sub- divider be required to make the installation of the water mains. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that Supt. Smith inform the sub- divider that it would be necessary for them to make the arrangements for the installation of the water system sub- ject to City inspection, and that the Supt, of Light and Water be authorized to return the deposit of $21,000 received by him, and in addition, the subdivider be requested to furnish a'Faithful Performance Bond on the job. Supt. Smith stated that the subdivider of Tract {20971 is anxious to have the street lighting system installed, and that the City has the necessary materials for this project. If it is the opinion of the City Attorney that the street lighting system must go to bid, it would require considerable work in developing plans and specifications which are not necessary when the Department crew does the work. Moved by Councilman Fawcett, seconded by Councilman Ortuno that the City Clerk be authorized to advertise for bids for the lighting system in Tract No. 20971 and that the City furnish the materials, in addition, the necessary engineering to be farmed out on this project. Upon further discussion of this motion, Councilman Ortuno Withdrew his second and Councilman Fawcett withdrew the motion. City Engineer Williamson stated that much of the engineering could be done in the City office with perhaps the exception of the electrical engineering necessary. Supt. Smith stated that if the necessary engineering was farmed out, the cost would probably run between $3,000 to $5,000. Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimousl-- carried that the City Clerk be authorized to advertise for bids for the installation of the power system.in Tract „120971, and that any engineering that the City is unable to furnish to be farmed out, and the City Engineer be authorized to acquire the outside engineering service necessary. Mayor Memmesheimer asked if authority might be given to the Mayor to sign the Agreement between the Little League and the City upon the approval of the Park and Recreation Commission for the furnishing of water to the National Little League. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that the Mayor be authorized to sign the Agreement between the Little Leagues and the City of Azusa upon the approval of the Agreement by the Park and Recreation Commission and the City Attorney. Councilman Romero offered for its second reading, the Ordinance entitled: 257 Air-condition• ing unit -- Light & Water Dept. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that further reading of the Ordinance be waived. Councilman Romero moved the adoption seconded by Councilman Ortuno. Johnson, Romero, Councilman Fawcett offered for its second reading Ordinance entitled: "AN ORDINANCE OF THE CITY OF AZUSA, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, PROHIBITING THE SALE, EXCHANGE, LOAN, OR POSSESSION OF ANY TYPE SPRING BLADE OR PUSH BUTTON KNIFE, AND PRESCRIBING THE PUNISHMENT FOR VIOLATIONS THERE- OF, AND REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH." Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that the City Council waive further reading of this Ordinance. Resolution No. 3442 - Advancing J. Littlefieli and R.Torranc Fire Dept. The Personnel Board stated that the term of W. Westley Kloepfer, appointee to that Board by the City Council would complete Personnel his term of office in..June, it was suggested by the Mayor Board vacancy that the other members of Council consider an appointment in June. for this position to be recommended at the meeting of June 4th. The proposed Ordinance setting up the position of City Ad- ministrator was read to the Council. Councilman Johnson submitted a report of her objections to this Ordinance. Moved by Councilman Johnson that this Ordinance be referred to ';he Personnel Board with instructions that they shall establish qualifications, including responsible experience requirements, and recommend the salary to be paid, and upon the approval of such qualifications and salary recom- mendation by the City Council, that an examination be held for the purpose of finding the most qualified man for this job. This motion died for lack of second. Councilman Johnson moved that this proposed Ordinance submitted to all Boards, Commissions, and Department for their study and recommendations. This motion was seconded by Councilman Romero. Motion then passed by following vote of Council. City Clerk requested permission to attend the City Clerk's Institute to be held in San Jose on June 13th, 14th and 15th. Moved by Councilman Johnson, that the City Clerk be permitted to attend the Institute of City Clerks and an advance of expense money be allowed, to be accounted for. This motion died for lack of second. Moved by Councilman Fawcett, seconded by Councilman Romero that the City Clerk be authorized to attend the City Clerk's Institute and that an expense advance of $200 be allowed. Motion passed by the follovi_ng vote of Council: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None A report was submitted by Councilman Ortuno and Councilman Romero recommending that the proposal submitted by the firm of Lawson and Company be accepted for the performing the audit of the City of Azusa's books of accounts, for this year. It was recommended by Mayor Memmesheimer that the letter submitted by Lawson and Company be studied by the Council and be reported on at the meeting of June 4th. The City Clerk stated that all proposals submitted were available in the City Clerk's office, as was the report of the Lawson Company, made for the City of San Gabriel, for inspection by `,he City Councilmen. Motion to reject Ord. - failed. So. Calif. Edison Co. representative - Council meeting of 6/4/56 City Clerk authorized to attend City Clerk's institute, San Jose, 6/13 - 14 - 15 1956 Recommended acceptance of Lawson & Co. proposal re: audit of City books. The City Clerk announced that the request of the Los Angeles Banner for County Fair for permission to hang a banner across Foothill L. A. Fair - Blvd. had been referred to the City Engineer who has in the City Engineer past; handled these requests. It was moved by Councilman Ortuno, seconded by Councilman Mayor to sign Romero and unanimously carried that the Mayor be authorized Escrow Instruc to ;sign the Escrow Instructions on the purchase of 10 feet by tions - V. M. 135 feet in Tract x627 offered to the City of Azusa for i,iest $350.00 by Velma M. West. City Clerk announced that he had received notification from Res, re: the Boundary Commission as to the approval of boundaries Annexation for Annexation District No. 12 and that the Resolution on No. 12 - further proceedings would be presented at the meeting of June 4th June 4th, meeting. CITY HALL AZUSA, CAL. MONDAY, MAY 21, 1956 The City Clerk stated that copies of the proposed Agreement between the City and County Building Department had been sent to each Councilman. Moved by Councilman Romero, seconded by Councilman Fawcett and unanimously carried that this matter be held over until the recommendation relative to hiring a Building Inspector has been received from the Planning Commission. Councilman Johnson offered the following Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, CONSENTING TO THi3 COMMENCEMENT OF THE PROCEEDINGS FOR THE ANNEXATION OF SAID INHABITED TERRITORY DESIGNATED AS "EASTERLY ANNEXATION NO. 13". Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried that the City Council would waive further reading of this Resolution. Councilman Romero moved its adoption, seconded by Councilman Ortuno. This Resolution was then passed and adopted by the following vote of Council: AYES: Councilmen: Fawcett, Ortuno, Johnson, Romero, Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: None and. numbered Resolution No. 3443 Moved by Councilman Ortuno, seconded by Councilman Romero that Mayor Memmesheimer be designated as Director of the League of California Cities, Los Angeles County Division for the City of Azusa, and Councilman Fawcett be appointed as Alternate. There being no opposing vote, this motion was ordered passed. A letter was received from Los Angeles Airways, Inc. stating that they had surveyed two possible sites in the City of Azusa for a Heliport and stated as their preference a portion of the City -owned property at Fifth St. and Virginia Avenue, and their second choice being at the westerly City limits on Foothill Blvd, on the Consolidated Rock Company's property. Moved by Councilman Romero, seconded by Councilman Fawcett and unanimously carried that this be referred to the City Attorney, Councilman Fawcett, City Clerk, City Engineer and that the Consolidated Rock Company be contacted to see if some Agreement could be reached whereby they will lease to the City the property requested at a nominal sum. A letter was received from Squire Realty advising the Council tha'; the property purchased b -,T the City from Air. Gutierez would be vacant on or about May 22, 1956. Mr. West stated tha; it would be possible for his firm to rent it for $60 per month, on a month to month basis, and that his commission for this service would be 25% of the first month's rent. Moved by Councilman Romero, seconded by Councilman Fawcett and unanimously carried that Squire West be authorized to rent: this house on a month to month basis subject to approval by the City Attorney of the proper agreements being drawn. City Clerk announced to Council that a letter had been received from the General Telephone Company stating that they were installing a public telephone at 123 E. Foothill Blvd., in answer to the reauest for such a public telephone an Foothill Blvd. submitted by the City. Moved by.Councilman Fawcett, seconded by Councilman. Romero that the City Clerk advise the two persons who had written to the City Council requesting this phone, of the Telephone Company's action. Motion was ordered passed. 267 7:30 P.M. Agreement re: Bldg. inspecto. Resolution No. 3443 - Commencement of proceedings Easterly Annexation No. 13" League of Cal. Cities Director - Memmesheimer Possible Heliport site. Squire West to rent Gutierez property. Public tele- phone to be installed on Foothill Blvd. CITY HALL AZUSA, CAL. MONDAY, MAY 21, 1956 A letter was received from Harold L. Johnson, Registered Civil Engineer, offering services of his firm for engineer- ing requirements of the City. Moved by Councilman Johnson, seconded by Councilman Romero that this letter be filed. Motion was ordered passed. 7:30 P.M. A :letter was received from John A. Lambie confirming some of the matters discussed with the Council at the meeting on April 30th between the City and the County relative to building inspection. It was suggested by Mr. Lambie that the City designate a representative with whom the County Inspector would work on unusual problems. It was further stated that the County would be willing to assist in develop- ing forms and establishing procedures concerning business licenses and the issuance of building permits in connection therewith, Mr. Lambie stated further that if the City desired to move into a rehabilitation program it might be necessary to adopt some supplemental legislation to expedite the work. It was stated that copies of the additional ordinances adopted by the City of Los Angeles before they moved into their program could be made available to the Citi-. Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried that a copy of the letter from Mr. Lambie be made available to the Redevelopment Agency and that the letter would be taken up by the Council at a later date. A letter was received from Mrs. Ann Clapp, Assets Recon- struction Corporation, Ltd., requesting the Council to study the conditions relative to Tract #8507 before adopting the proposed zoning Ordinance. In particular, Mrs. Clapp wished consideration to be made to these smaller businesses in respect to the amount of off-street parking which is supposed to be required. Moved by Councilman Romero, seconded by Councilman Fawcett that this letter be held over until the City Council acts on the proposed Zoning Ordinance. This motion was ordered passed. City Attorney Tscharner stated that negotiations for acquir- ing the lot of land north of the City Plunge in Slauson Park, owned by a Mrs. Proulx and possibly some other person, was not progressing at a rapid rate, and it was his recom- mendation that the City institute condemnation proceedings. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that the City Attorney be instructed to start condemnation proceedings on the propert�r owned by Mrs. Proulx and/or others, located north of the Plunge at Slauson Park and noir being used by the City. 269 Letter from Civil Engr. ordered filed. Letter from County re: new contract, Bldg. Inspect. to be taken up at later date. Letter re: conditions relative to Tract #8507 - Zoning Ord. Atty. to initiate con- demnation Proceedings, property of Mrs. Proulx The City Engineer reported that he had received the Appraiser's report of various parcels of property which the City had wished appraised. These properties consisted of the Park site, the southeast section of the City; the Gum Grove site; and the outlying Fire Station site, and requested instructions as to how he should handle these reports. Appraiser's Moved by Councilman Romero, seconded by Councilman Ortuno report on and unanimously carried that the City Engineer furnish the Various sites members of the City Council the Appraiser's reports of these for City various sites with his recommendation as to the possible acquisition price. The City Attorney stated that several years ago, the Vosberg interests gave five acres in the northwest part of town for Park purposes, and now there is some doubt as to whether this parcel of ground has to be used for Park purposes or whether it was deeded to the City with no restrictions whatsoever. Moved by Councilman Romero, seconded by Councilman Fawcett and unanimously carried that the City Attorney be instructed to check into the property commonly referred to as North- side Parr to determine the status of the City, relative to ':his piece of property. Councilman Fawcett offered the following Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Resolution ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE No. 3444 -- FUNDS OUT OF 'WHICH THE SAPS ARE TO BE PAID." Allowing Claims and Councilman Fawcett moved this Resolution be passed and adopted, Demands seconded by Councilman Romero.
