MONDAY, JUNE 4, 1956 The City Council:bf the Cite of Azusa met in regular session at the above time and place Mayor Memmesheimer opened the meeting with a salute to the Flag. Invocation was given by Rev. J. Shoemaker of the Nazarene Church. ROLL CALL: Present: Councilmen: Fawcett, Ortuno, Johnson, Romero, Memmesheimer City Attorne;,, Asst. City Attorney City Engineer, City Clerk The Minutes of the Meeting of May 15th were corrected as foi.1ows: On Page 263 the items after the item instructing the Attorney to prepare a Resolution relative to H. Eastman, should appear in the following sequence: (a) Double checking on billing - Light & Water Dept. ((b))j) Light and water - temporary employee c Request for examination Cashier -Clerk - raised from the table. (d) Classification and examination authorized for Cashier -Clerk The Minutes of May 15th were then approved as corrected. 27.3 7:30 P.M. Flag Salute Invocation Roll Call Corrections - Minutes of May 15th The Minutes of the Special I'ieeting of May 18th were approved Minutes of as submitted. 5/18 approved. In the Minutes of May 21, 1956, on Page 9, second item, last Correction - line, the amount should read "$350.00. Minutes of The Minutes of May 21st were then approved as corrected. 5/21/56 A reauest had been received from the Los Angeles County for jurisdiction of a 50 foot strip of land for Highway purposes at Arrow Highway and Cerritos Avenue. A Resolution from the County Board of Supervisors was introduced, stating that .;he widening and improving of the portion of Arrow Highway 600 ft. easterly and 600 ft. westerly of Cerritos Avenue was con- templated, and asked the consent of the governing body of the City of Azusa to grant jurisdiction to the County, and agreement to the improvement. It was pointed out that this jurisdiction will be relinquished upon completion of the work. Mr. C. Galloway, Division Engineer, Los Angeles County Road Department, appeared before the City Council in reference to this str'_p of land along Arrow Highway which the County desires to improve. Mr. Galloway stated that the County had come to a settlement relative to acquiring the property which was part of the recent annexation by the City of Azusa. it was the opinion of the City Council that since the County- had acquired the property and that jurisdiction would be returned to the City upon the street improvement being completed, it would be well for the ]City to grant jurisdiction to the County at this time. Councilman Ortuno offered the following Ordinance, as an urgency measure, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, DECLARING THAT PORTION OF ARROW HIGHWAY IN THE CITY OF AZUSA, HEREINAFTER DESCRIBED AS A PART OF THE LOS ANGELES COUNTY HIGHWAY." Councilman Fawcett moved its adoption, seconded by Councilman Romero. This Ordinance then passed and adopted by the Request of L. A. County for jurisdic- tion of 50' strip at Arrov Highway and Cerritos - for street improvement. Ordinance No. 505 - Granting jurisdiction to L. A. Mayor Memmesheimer called the City Council to order. 7:30 P.M. CITY ATTY : "You are acquainted with the situation on Lots CITY ATTY: "Calling your attention particularly to foundations 1 and 2 of Mountain View Extension Tract in the City of Azusa.'' MOTLEY: "I am." CITY ATTY: "Now long have you been acquainted with those premises? MOTLEY: "Since some time in September of 1953". CITY ATTY.: "And at that time, when you first became acquainted MOTLEY: with those premises, did you have any discussion with Mr. Lopez, the owner?" MOTLEY: "I have spoken to I•:r. Lopez two or three times during my many visits to the premises, however•, CITY ATTY: my Spanish is rather poor and his English apparently was likewise, so that what conversation we had was MOTLEY: very limited and partially through an interprets_°.'' CITY ATTY: "Jill you describe the condition of the buildin;s on those premises since giving your first notice, at the time of giving your first notice in February of CITY ATTY: this year. M0''LEY: "';fell, the buildings are all in extremely poor structural condition and, well, there just isn't MOTLEY: anything in the way of protection to the health, the welfare and the safety of any occupants ,•rho might be in them." CITY ATTY: "Calling your attention particularly to foundations CITY ATTY: ''What about the roof? Were they safe? If not, in what manner were they unsafe?" MOTLEY: "The roofs sag because of insufficient rafters and bracing, and as far as the roof coverings themselves are concerned, I don't know whether or not they completely exclude the elements. and footings, etc., stringers and joists, what ,as the condition of those?" MOTLEY: "Foundations are inadequate in all cases, incomplete in some, and entirely absent in, I would say, three of the buildings - no foundations whatsoever." CITY ATTY: "The floors of the buildings, are they properly supported, or what was their condition?" MOTLEY: "None of the floors was in good condition, and all of them because of insufficient underfloor bracings had excessive give and spring besides having broken boards." CITY ATTY: "What can you say with reference to the condition of the walls on all of the buildings on the premises?" MOTLEY: "No building on the premises is constructed to present building code, and besides that, I don't believe there is a building on the premises which is actually structurally safe." CITY ATTY: "Isn't it true, that since you've :mown the condition of those buildings, the walls bulge out on practically all of them, and not properly studded? MOTLEY: "Correct" CITY ATTY: ''What about the roof? Were they safe? If not, in what manner were they unsafe?" MOTLEY: "The roofs sag because of insufficient rafters and bracing, and as far as the roof coverings themselves are concerned, I don't know whether or not they completely exclude the elements. 279 CITY HALL AZUSA, CAL. MONDAY, JUNE 4, 1956 8 P.M. CITY ATTY: "Hoi•r about the kitchens with reference to size. square footage, etc.; and their interior condi.- tion?" MOTLEY: " Some of the kitchens were definitely well under the minimum of 50 sq, ft. of superficial floor area as required by law. Some of them were the to ft. Some of them were the 50 ft. In those kitchens, with one exception, there was no vent over any kitchen stove to take care of gas or cooking odors, fumes, etc., and more than half of the stoves were connected to the gas supply by means of rubber hose and not by rigid pipe or metal tubing." CITY ATTY.: "How about the windows on the premises?" MOTLEY: "Windows are insufficient in size, and in several cases, not openable at all, and in the cases ';There there were screens, the screens are so clogged with dirt, dust, grease, etc. that there is very little air passage possible through them." CITY ATTY: ''You observed the condition of the plumbing in the buildings?" MOTLEY: "Yes, most of the plumbing is not properly trapped, practically none of it is properly vented, if vented at all, and in some cases the plumbing waste lines were connected to the sewage disposal system by means of rubber hose." CITY ATTY: With reference to the toilets on the premises, what can you say?" MOTLEY: "There were originally two toilets on the premises to take care of eleven living units. Those toilets were out in two small buildings of privy dimensions, 4 ft. x 4 ft. or less. The buildings were not properly constructed, wooden floors in very poor condition, wooden sides with a great many openings so that there was free passage of air, insects, etc. They were not built of materials which could be kept impervious to water, or kept in any kind of sanitary condition because of that." CITY ATTY.: Ir I.,hat can you say with reference to the cleanliness of them" MOTLEY: "The toilet bowls and the toilet buildings themselves were extremely sanitary at every inspection that I made." CITY ATTY: "What would you say with reference to the electrical services and their condition." MOTLEY: 'There were two electrical services to the two lots, one in each lot, one service has been removed within the past three months, I believe, fairly recently at least. Those electrical services were badly overloaded, and the wiring for the buildings on' the premises was strung by means of drop cord or extension cord materials from one building to the next without any protection whatsoever at the points where those wires went through wooden walls. The services inside the houses were, at any time of occupancy, were overloaded in that we would find a multiple connector in a ceiling outlet with any- where from two to a half-dozen extension cords trailing off in all directions around the room to take care of the appliances." 281 CITY.HALL CITY ATTY: MOTLEY: CITY ATTY: MOTLEY: CITY ATTY: MOTLEY: CITY ATTY: MOTLEY: CITY ATTY: MOTLEY: CITY ATTY: MOTLEY: AZUSA, CAL. "For how long a period of time to your knowledge has that condition existed, down on these lots." "To my personal knowledge since September of 1953." "September of 1953. The man that you spoke to there, and the owner of the premises is Camilo Lopez'?" "Correct". "In your best opinion, are these lots fit for human habitation - are the buildings fit for human habitation?" "Not at all." "Any of them?" "None of them." "Hoar many units did you say there were there?'' `Eleven living units in 8 or 9 separate buildings." CITY ATTY: "Isn't it true that since the Notices have been served on Mr. Lopez, quite a number of those buildings have already been torn down voluntarily by him?" MOTLEY: "Two buildings have been demolished, although the materials of which they had been constructed, have not been removed from the premises, and one of the original two public toilets on the premises has been removed from its building, but the building still is there. There is one functional public toilet." CITY ATTY: ";:could you care to give us an estimate in your best judgment as to the age of those.buildingsV' MOTLEY: "I would hesitate to say other than they are probably more than 20 ;rears old." CITY 'ATTY: "I guess that's all the questions." M3IVIHESHEIMER: "Does anyone have any estions they would like to ask Mr. Motley?" ORTUNO: "I would like to ask one. Are any of the remaining buildings occupied at present?" MOTLEY: "At the time of my last visit to the premises, last Thursday morning, one building was occupied. The tenant said that she was moving out, T understood, over this past weekend." ORTUNO: "Thank you." M; George I.'_iddleton was called as a witness and was sworn in by the City Clerk. CITY ATTY: ''Are you acquainted with the premises located on Lots 1 and 2 of Mountain View Extension Tract, the property of Camilo Lopez?" MIDDLETON: "Yes sir." CITY ATTY: "For how long a period of time have you known of them?" MIDDLETON: "Since 1953." CITY ATTY: ''Mould you describe the condition of the buildings on those premises since you've known it?" 'IDDLETON: If Well, they haven't changed any, there is no studding in most of them.'' CITY ATTY: "Will you speak just a little bit louder, please." FIDDLETON: `The structures are, well, there isn't much structure to them, the;, are mostly board and batten or single board walls on angles and not even stright. There are two of them have siding on, and some studs in them. The rest are just shed type construction." CITY ATTY: !4hen did you last examine those buildings." MIDDLETON: "Well, I stopped by there this morning about 11 o'clock" CITY ATTY: "Do you know whether any of them are presently in- habited?" MIDDLETON: "There was one last Thursday, but it was empty today, they have moved." CITY ATTY: "In your opinion, are any of those buildings fit for human occupation." MIDDLETON: ''No, they are not, they really are not fit for human occupation." CITY ATTY: 'I think that's all." K:_1IP,1ESHE,IMER: "Would you call and see if there is anyone else?" CITY ATTY.: "Is there anyone in the audience who wants to be heard in this matter, either for or against?" CITY ATTY: °Mr. Motley will you come back for just a moment?" I hand you these pictures marked Exhibit 1,2,3, and 4, Will you examine them. Are they reasonably good representation of the buildings in this location?" MOTLEY: "Yes, I made no particular effort to photograph only the worst conditions on the lot. I tried to take pictures of everything that was there. Thesc are typical of the type of construction and the general conditions." CITY ATTY: "I also hand you exhibit 5, is that a fair representa- tion of the condition of that building?'' MOTLEY: "Yes, this particular picture happens to show the string of four units, which, starting from the front of the photograph, from the right side, the first and third buildings have now been demolished.'' Councilman Johnson offered the following Resolution entitled: "RESOLUTION OF THE CITY COUNCIL DECLARING CERTAIN BUILDINGS WITHIN THE CITY OF AZUSA AS BEING A NUISANCE, AND DIRECT- ING THE OWNER, OF SAID BUILDINGS TO RAZE OR RECONSTRUCT WITHIN 30 DAYS. '' Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried. This Resolution then passed and adopted by the following vote: AYES:` Councilmen: Fawcett, Ortuno, Johnson, Romero Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: None and numbered Resolution No. 3=45 The Resolution was read in full. MEY24ESHEIVIER: "That will conclude the Hearing on the nuisance abatement.'' Hearing closed 8:25 P.M. The.•Committee appointed to study the proposals for the eight and Water system survey recommended that the pro- posal submitted by Wayne N. Johnson for furnishing engineering services for a survey of the Light and Power system, be accepted. The estimated cost of this survey is $25,000. Other proposals submitted were from: Gibbs & Hill, Inc. J. M. Montgomery and Company James M. Montgomery. It was moved by Councilman Romero, seconded by Councilman Ortuno that the recommendation of the Committee be accepted and that the proposal submitted by Wayne N. Johnson, Con- sulting Engineer, be accepted, and that the City Attorney be instructed to prepare the necessary Agreement. This motion passed by the following vote: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None Councilman Ortuno and Councilman Romero submitted the recom- mendation for employing Lawson and Company to perform the year-end audit. Resolution No. 3445 Condemnation of Lopez property. Light & Water survey pro- posal of Wayne N. Johnson accepted - Atty. to prepare Agreement AZUSA, CAL. MONDAY, JUNE 4, 1956 It was moved by Councilman Fawcett, seconded by Council- man Romero and unanimously carried that the City Council accept the recommendation of the Committee and that Lawson and Company be employed to complete the year-end audit, and that the City Attorney be instructed to prepare the necessary Agreement. Mr. Milton Voisinet of the Southern California Edison Co. introduced Mr. R. J. Doyle, Division Manager of the Company to the City Council. Mr. Doyle then read a prepared state- ment setting forth certain facts and figures concerning the operations of the Edison Company in the City of Azusa. It was brought out in the statement that if the City were to acquire the Edison Company's -facilities within the City, it would cost in the neighborhood of $571,200.00. Mr. Dorle also presented figures of the Edison Company's tax payment to the City and of the planned improvements by the Company. It was the request of the Edison Company that they be per- mitted to continue their present operating arrangements. Mayor Memmesheimer askef if any of the Council members wished to submit names for appointment to the Personnel Board, as the tem of W. Westley Kloepfer expired on 6i5/56. Councilman Fawcett submitted the name of Charles Andrews, 1035 O1dMill Road Councilman Ortuno submitted the name of Westley Kloepfer for reappointment. Councilman Johnson submitted the name of Westley Kloepfer for reappointment Councilman Romero submitted the name of Vernon Holmes, South Angeleno avenue The roll call vote was held on the following nominations: Charles Andrews AYES: Councilmen: Fawcett NOES: Councilmen: Ortuno, Johnson, Romero, Memmesheimer ABSENT: Councilmen: None W. Mayor Memmesheimer asked if the Council wished to submit further names. Councilman Ortuno asked that the Council reconsider their vote and reappoint Westley Kloepfer. Councilman Fawcett requested that this be held over until the next regular meeting. Moved by Councilman Fawcett, seconded by Councilman Romero that this matter be held over until the meeting of June 13th. This motion passed by the following vote: A"ES: Councilmen: Fawcett, Romero, Memmesheimer NOES: Councilmen: Ortuno, Johnson ABSENT: Councilmen: None The City Cleric announced that the County Boundary Commission had approved the boundaries of proposed Annexation District No. 12. The date for Hearing protests on this proposed Annexation was set for July 16th at the hour of 7:45 P.M. Councilman Ortuno offered the following Resolution entitled: 'RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF AZUSA TO ANNEX TO SAID CITY 287 Lawson & Co. to perform ;rear -end audit Atty. to pre- pare Agreement Report on operations of Edison Co. in Azusa Nominations for vacancy on Personnel Board Appointment to Personnel Bd. I o be held over to 6,/13/56 meeting Resolution No. 3446 - Easterly Annexation No. 12 CITY HALL AZUSA, CAL. MONDAY, JUNE 4, 1956 7:30 P.M. "CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIG- NATED "EASTERLY ANNEXATION NO. 121, AND GIVING NOTICE OF THE PROPOSED ANNEXATION." Moved by Councilman Ortuno, seconded by Councilman Romero that further reading of this Resolution be waived. Councilman Ortuno moved adoption of the Resolution, seconded by Councilman Johnson. This Resolution then passed and adopted by the following vote: AYES: Councilmen: Fawcett, Ortuno, Johnson, Romero, Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: None and numbered Resolution No. 3446 A Resolution of the Planning Commission was presented to Council recorrnnending a proposed Zoning Ordinance and zoning map to the City Council. Moved by Councilman Romero, seconded by Councilman Fawcett and unanimously carried that a. Public Hearing be held before the City Council on the proposed Zoning Ordinance and map at the hour of 8:00 P.P,., July 2, 1956. It was recommended by the Planning Commission that a full- time Building I:ispector be employed by the City of Azusa. Councilman Johnson stated that the County had submitted to the City a proposed Agreement whereby the County would furnish an Inspector at the rate of $4.85 per hour, and t;.iat this Agreement had previously been tabled. Discussion was held on the proposed Agreement and the City Engineer suggested that the renewal clause set forth in the Agreement is rather unusual, and in his opinion should be possibly rewritten: also, possibly no permits be issued without a City official signing in order that the City could be aware of all transactions. With permission of Councilman Johnson, Councilman Ortuno withdrew the second, and Councilman Johnson withdrew the motion. Moved by Councilman Ort-unc, seconded by Councilman Romero Agreement and unanimousl carried that the Agreement be referred to referred to the City Attorney and Cite Engineer with authority to Atty. & Engr. contact the County relative to the proposed revisions as stated. The City Engineer submitted a letter suggesting the installa- tion of appro_cimately 205 lineal feet of 8" sewer line and one manhole to make provision for future tie-in of the Tract designated as Foothill Park Unit #1. The City Engineer submitted a letter stating that in the Condemnation matter of ar_quiring right-of-way for the outfall sewer from of Sewer Tract #20971, located north of Sierra Madre and west of the Easement - Canyon Road, easements have been obtained from all necessary Tract 720971 property owners with the exception of one, this one being a Air. Courtney. It was recommended by the City Engineer that the City Attorney be instructed to take the necessary steps leading to condemnation of the recuired easement with immediate possession if necessar-,-. Moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that the Cite Council accept the recommendation of the City Engineer that the City Attorney be instructed to take the necessary steps leading to con- demnation of the required easement. The City Engineer presented the plans for the industrial area. sewer project currently authorized for bidding. Included in tee plan was the outfall sewer from Tract 720971. This is Plans #1178 saown as Plan ;`1178. It was _Pelt by the Engineer that by #1185, ;1186 including the outfall sewer project, in with the industrial ;"1187 - sewers, that a saving in overhead could be made. P.7-14 Moved by Councilman Ortuno, seconded by Councilman Fawcett approved and unanimously carried that the City Council approve the plans designated $'1178, 7r1185, 211186, ;'91187 specifications PW -14 as presented by the City Engineer. The City Engineer stated that previously he had brought to Report of the attention of the City Council, the possibility of a Engr, re: dump site in this locality and had made a considerable study dump site. o_' this possibility, but since making this report and study he had recently accepted employment from the person who was interested in the dump. Smith of the Light Department submitted a letter re- ouesting City Council to grant permission for tine :Edison Company to contact poles at the Azusa Foothill Shopping Center, of which they will be serving in the County area. It was stated. that the Edison Company has offered to set higher poles and pay the Cite of Azusa for transferring City lines to the new Edison Company poles. This is customary for all utilities to do under Joint Pole Agreements.
