The meeting was opened with the Salute to the Flag, led by Flag Salute Mayor Memmesheimer. Invocation was given by Rev. Farrell of the First Christian Invocation Church. ROLL CALL: Councilmen: Fawcett, Ortuno, Johnson, Romero, Roll Call Memmesheimer Asst. Cit-:- Attorney, City Engineer, Cita Clerk Discussion was held on the corrections of the Meeting of May 15th, Item (b) relative to the temporary employment for vaca- tion relief in the Light and Dater Dept., whether this temporary employment would have the classification of Cashier -Clerk or other. In the Minutes of June 4th, on Page 287, the item on the non_inations for the vacancy on the Personnel Board should show the address of Mr. V. Holmes as South Angeleno Ave. Movedby Councilman Fawcett, seconded by Councilman Ortuno that the Minutes of June 4th be accepted as submitted and corrected. This motion carried by the following vote of the Council: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilman: Johnson ABSENT: Councilmen: None The Minutes of the adjourned meeting of June 12th were corrected as follows: Page 295 - the i.ieeting did not open with the salute to the flag. Page 299 - Item relative to the sale of City -owned property a`, 5th and Virginia, the reference to an appraisal being made should be deleted. Page 299 - the item relative to Resolution No. 3449, the adoption was seconded by Councilman Ortuno, not Councilman Romero; and following that the word "Ordinance" should be stricken and the word "Rbsolution" inserted. Page 305 - Third item, relative to advertising for bids for water mains, the word "pipe" should be inserted in the motion and in the column index, instead of "mains". Page 306 - adjoa--onment should show only the time, not stating specific day and hour. The Minutes of Jt;.ne 12th were then accepted as corrected. Mayor Memmesheimer announced that this is the time and place set for the Hearing of protests on Easterly Annexation District No. 11. The City Clerk stated that Notices of the proposed Annexa- tion and time of Hearing had been mailed to all owners of property in the affected Annexation as appearing on the latest available Assessment Rolls, and in addition Notices were mailed to two churches who were known to have purchased land since the Assessment Rolls were first made up. The City Clerk stated that a letter had been received in his office signed by Mrs. Ruth E. McKinlay, owner of Lots 8 and 9, Block I, Subdivision #1, Azusa Land and Water Co., said lots being a. part of the proposed Annexation, It was requested by Mrs. P.icKinlay that the City delay action on this Annexation until the area had been extended to a larger size. This letter also contained six points which Mrs. McKinlay asked the Council 1-o consider. Correction to Minutes of 6/4/56 Correction to Minutes of 6/12/56 Hearing on Easterly Annexa tion District No. 11 CITY HALL AZUSA, CAL. MONDAY, JUNE 18, 1956 7:30 P.M. It was pointed out that if this letter from Mrs. McKinlay was to be considered as a protest, the assessed valuation of the property totaling $3900.00 was less than 50% of the total assessed valuation of the entire area proposed to be annexed. Mr. Albert W. IicKinlay and Mrs. McKinlay entered the meeting and were made aware of proceedings that had gone on before their entrance. When asked by I,ia or Iiemmesheimer if the letter which had been submitted eras a protest, Mr. McKinlay, speaking on behalf of Mrs. McKinlay, stated that it was not considered so much a protest as it was a letter trying to point out to the Council various phases and aspects which he felt the Cit;: might have overlooked when initiating the proceedings. Mr. George Holt, 18040 East 5th Street, owner of a portion of Lot 7 of Block I, stated that he was in favor of being annexed to the City of Azusa. . Mr. McKinlay again addressed Council and stated his reasons whir he thought that annexing the portion of his property as contemplated by the City would be a detriment to its value, and he urged that the Council consider waiting until additional areas could be included in a future annexation. Mrs. McKinlay addressed Council and stated that they are in the orange business and that in her opinion the additional taxes created by annexing to the City would be so costly as to preclude operating their business at a profit. Mr, and Mrs. McKinlay thanked the Council for hearing them at this time. There being no other person wishing to speak on the matter of the proposed Annexation No. 11, Mayor Memmesheimer ordered the Hearing closed at 8:20 P.M. 309 Ordinance re: Easterly Moved by Councilman Fawcett, seconded by Councilman Ortuno Annexation and unanimously carried that the City Council accept the recom- No. 11 to mendation of the Planning Commission relative to Easterly be prepared. Annexation No. 11, and that the necessary Ordinance approving the Annexation be prepared. Bids were opened in the office of the City Clerk at 10 A.M. June 15th, in answer to the Notice Inviting Bids for the construction of sanitary sewers in Foothill, Vernon. and McKeever Streets, designated as Project No. 155, as provided by Ordinance No. 1183. Present at the opening of the bids were Councilman Romero, City Engineer, Deputy City Clerk. Bids were received from the following firms: COMPANY AMOUNT Chorak Construction Co. - - - - - - $ 38,505.15 Montebello, Cal. Martin Kordick - - - - - - - - - - -$ 39,032.34 Arcadia, Cal. Frank Chutulc - - - - - - - - - - - -$ 39,410.44 Pomona, Cal. The Engineer's est=imate of the cost of the Project was $37,036.72. It was recommended that the bid of the Chorak Company be accepted and that the Bidder's Bonds be returned to the unsuccessful bidders. Moved by Councilman Fawcett, seconded by Councilman Romero and unanimously carried that the recommendation be accepted and that the Chorak Construction Company be awarded the bid in the amount of $38,505.15, and that bid bonds be returned to the unsuccessful bidders upon the signing of the contract by the Chorak Company. Report on bid opening - Project #155, Sanitary Sewers Foothill, Vernon and McKeever Sts. Chorak Constr. Co, awarded bid Project #155 310 CITY HALL AZUSA, CAL. MONDAY, JUNE 18, 1956 Bids were opened in the office of the City Clerk at 10 A.M., June 15, 1956, in answer to the Notice inviting Bids for the desiggn, construction and erection of addition to the 11KV and 4 KV substation, in accordance with Ordinance No. 483. Present at the opening of the bids were Councilman Romero, City Engineer, Deput;- City Clerk, and Supt, of Light and Water. Bids were received from the following Companies: COMPANY Amount Bechtel Corporation - - - - - - - - $ 36,370.00 J. M. Montgomery - - - - - - - - - 36,985.00 F. Eggers - - - - - - - - - - - - - 37,200.00 It was recommended that the bid of the Bechtel Corp. in the amount of $36,370.00 be accepted. Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried that the City Council accept the bid of the Bechtel Corporation in the amount of $36,370.00 for the construction of addition to the substation, and that bid bonds or checks be returned to the unsuccessful bidders upon the signing of the contract. 311 7:30 P.M. Report on bid opening, addition to substation Bechtel Corp. awarded bid -- addition to substation. A letter was received from the Azusa Library Board recom- mending that Mr. Ben Parker, Architect, be employed to Authorization undertake the preliminary work on the proposed Library for preliminary building, and to work with the Committee studying the pro- plans for posed Library site. Library The Library Board considered the northwest corner of Soldano Avenue and Foothill Blvd, as the best location for the Library building. It was the opinion of the Library Board that a building of approximately 17,500 sq. ft. would serve the future needs of the Cit;. Moved by Councilman Romero, seconded by Councilman Fawcett and unanimously carried that the Library Board be authorized to have P•1r. Parker develop the preliminary plans for the Library, the funds to be paid out by the Library Board from the appropria- tio_zs made by the Cit;%. It was brought to the attention of the City Council that in order for the Light Department to complete the construction of a looped main line feeder circuit, it was essential that an easement be obtained from the Pacific Electric Railway Co. to permit the installation of poles in their right-of-way south of the Dalton School grounds. The Pacific Electric is request- ing the payment o:' $1,000 in exchange for the necessary Pacific Elec. easement. It was the opinion of the City Engineer that if no Easement. other alternative could be shorn, it would be necessary to pay the Pacific Electric the $1,000 as requested. Moved by Councilman Johnson, seconded by '.Councilman Romero and unanimously carried that this matter be referred to the Cit;r Attorney and City Engineer to make a further attempt to negotiate with the Pacific Electric Railway relative to the acquisition of the easement. The City Engineer submitted plans for Council approval for the construction_ of Danlee Street, between McKeever and 9th Street. It was recommended by the Cit;- Engineer that if the plans as submitted were approved by the City Council, that authoriza- tion be granted to advertise for bids for the construction of the work. Moved by Councilman Ortuno, seconded by Councilman Romero and unanimousl- carried that the City Council approve the plans and specifications of Danlee Street as submitted by the City Engineer. Moved by Councilman Ortuno, seconded by Councilman Fawcett and unanimously carried that the City Clerk be authorized to advertise for bids on the Project, bids to be opened July 13, 1956, plans and specifications to be furnished by the Engineer. Danlee Street Project. Clerk to adver- tise for bids Danlee St. Project. 312 CITY HALL AZUSA, CAL. MOiIDAY, JUNE 181 1956 7:30 P.M. The City Engineer s_ibmitted a report regarding the water installation in Tract #20971. Originally, it was planned on the basis of the City installing the water system. The problem now is to arrange for the contracting work and still providing a source of water suppl, as soon as possible. It was recommended to the Council that the following pro- cedures be followed, concerning the water installation in this tract. (1) The letting of bids for furnishing the necessary water mains to the Tract limits with the City furnishing the pipe for the contractor, which pine will be made available through the sub- divider as result of an exchange of pipe between the City and the subdivider as previously approved by the Council. (2) The subdivider to install all water mains and hydrants within the tract limits, in accordance with the plans approved by the City Engineer. It was recommended, however, that the Council approve the furnishing of its backhoe and operator on a rental basis to the contractor which would allow the City to realize the revenue on its equipment. (3) The subdividerts plans of the mains necessary to furnish the tract with water will be used as a basis for obtaining bids for the performance of this Stork. (IE) All services within the tract to be installed by the City plater Department. (5) In order to provide adequate fire protection to the tract, it will be necessary to make certain modifi- cations to an inactive pumping station located near the intersection of Sierra Madre and San Gabriel Canyon Road. This work will be done by City forces as maintenance work. 313 Report on water) installation Tract #20971 It was pointed out by the City Engineer that the work being done by the City on the system outside of the tract is in accordance with the Master Plan developed by the Montgomery Company in their report. Moved by Councilmen Ortuno, seconded by Councilman Romero and unanimously carried that the City Council approve the plans of the iIater line layouts within Tract ,#20971 as pre- sented by the City Engineer. MONDAY, JUNE 18, 1956 The City Engineer reported that he had been asked by the Citrus High School and Azusa City Schools District whether the City intends to continue its policy with respect to paving of streets adjacent to neer schools. Both School Districts have indicated that street improvements, including curbs and gutters would be considered as part of their construction contract, but do not feel that they could justify the expense of paving within the street right-of-way. The Engineer pointed out that the policy in the past of the City was to nave the section bet:,een the gutter and the existing shoulder adjacent to school sites. Moved by Councilman Ortuno, seconded by Councilman Romero and unanimously carried that the Cit, -y Clerk be instructed to inform the School District that the City Engineer was au'chorized to continue the policy of the City relative to paving to the vicinity of the schools. The City Engineer reported that the County Road Department had contacted his office and stated their desire to install a traffic signal at the intersection of Gladstone Street and Irwindale Avenue if the City would bear 1/4 of the cost of installation. It i-ras estimated the cost to the City would be approximately ti7,000.00. Moved by Counciln:a.n Romero, seconded by Councilman Ortuno ane. unanimously carried that the City Engineer advise the County Road Department that the City would be agreeable to the traffic light installation providing the County bear the cost of maintenance. 315 7:30 P.M. Street improve. ments, School Districts City to pave streets in vicinity of schools Traffic light Gladstone & Irwindale The Engineer reported that the Contractor installing the air conditioning in the City Hall had been delayed in their work by the Worthington Company not furnishing a cooler unit in the time promised, and that the Ralph Manns Company, Contractor, could advocate a unit which would cause an additional expendi- ture of about $200. It was felt by the Council that due to Air condition- the:possible short length of time of delivery from the ing delay. Worthington Company and the fabrication of a unit by the Manns Company that the project should continue as planned. The City Engineer reported that the Fire Chief had spoken to him relative to lack of fire protection on Todd Ave. north fro. -ii Foothill Blvd. It was the opinion of the Engineer that this situation should be looked into with the thought in mind of a line extending up toward and beyond the P.E. right-of-way to hook into the existing line at 10th Street in order to make a circulating system, which would be better than having a deadend line 800 or 900 ft. north from Foothill Blvd. Fire Chief Madison asked that the Engineer also be requested to look into the r:a'tter of Fire protection at Gladstone and Azusa Avenue stating that at this time the City has no lines on Gladstone to offer protection to businesses in that area. Moved by Councilman Ortuno, seconded by Councilman Romero and unanimously carried that the Engineer, Water Supt. and Fire Chief check into the fire protection situation at Todd and Gladstone locations and report to the Council. City Engineer stated that in company with the Chief of Police he had made an inspection at the rear of Alexander's Market, where there is noel a 20 foot service road between the wall that had been erected on Russell Street and the stores, which causes a dangerous situation at each of the openings in the wall for foot traffic. Moved by Councilman Ortuno, seconded -by Councilman Romero and unanimously carried that the Engineer and the Chief of Police investigate this situation and inform the owners of the property of the condition and suggest safety measures. Councilman Ortuno offered the following Ordinance for its second and final reading, entitled: Fire situation Gladstone and Todd to be checked into. No. 507 - OF BUSINESSES, TRADES, PROFESSIONS, CALLINGS AND OCCUPA- Business TIONS IN THE CITY OF AZUSA, FOR THE PURPOSE OF RAISING License Ord. MUNICIPAL REVENUE AND PROVIDING A PENALTY FOR THE VIOLA- TION THEREOF AND REPEALING PRIOR BUSINESS.LICENSE ORDINANCES NO. 326, 400 AND 405, AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE." This Ordinance was then read in full. Councilman Ortuno moved adoption of the Ordinance, second- ed by Councilman Romero. Moved by Councilman Johnson, seconded by Councilman Fawcett and unanimously carried that further reading of the Resolution be waived. Councilman Johnson moved its adoption, seconded by Councilman Ortuno. Councilman Romero offered the following Resolution entitled: Resolution No. 3455 - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Rates for FIXING THE RATES OF ADMISSION TO TIDE MUNICIPAL SWIMMING POOL." MONDAY, JUNE 18, 1956 7:30 P.M. A letter was received from Donald T. Hartwell and June H. Flying of model Hartwell askinS the City Council to consider modifying airplanes. the proposed Ordinance which would ban the flying of model airplanes within the City limits. It was the opinion of Mr, and Mrs. Hartwell that an outright ban would shut off any future possibility of conducting regulated activity in the flying of model planes. It was suggested that restrictions on early morning flying and only in designated areas would be a wiser and a fairer thing. It was recommended by Supt. Smith that Paul Hayes, Journey- man Lineman, having completed his probationary period on June 27, 1956, be placed on permanent status. Moved by Councilman Fawcett, seconded by Councilman Ortuno that the City Council approve the placing of Mr. Hayes on a permanent employment status, and the City Attorney be instructed to _prepare the necessary Resolution. There being no objections, this motion was ordered carried. It was recommended by Supt. Smith that Mrs. Martha Holmes be employed on a temporary basis, not to exceed 90 days for vacation relie_' in the Light and Mater office. Moved by Councilman Fawcett, seconded by Councilman Ortuno that Mrs. Martha Holmes be employed for a temporary period as vacation relief in the Light and Water Department. This motion carried by the following vote of Council: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilman: Johnson ABSENT: Councilmen: None Supt. Smith of the Light Department requested the City Council to authorize the following change as recommended by the J. L. Jacobs Company: "The City Council should require that the utility office shall mail delinquent notices to consumers who have not paid their utility bills not earlier than 30 days after the original bills have been mailed and should require that utility services should be disconnected if the delinquent bill has not been paid 15 days after the mail- ing of the delinquent notice." Moved by Councilman Ortuno, seconded by Councilman Romero that the City Attorney be instructed to prepare necessary Ordinance changing the mailing date of delinquency notices as recommended. There being no objections, this motion was ordered carried. A letter was received from the Park and Recreation Commission stating that Mr. Ivan D. Turner had been unanimously appoint- ed to the Recreation Commission by the other four members for an additional three year period beginning July 1, 1956. Moved by Councilman Romero, seconded by Councilman Ortuno that the letter be filed. No objections, and it was so ordered. A communication was received from the Library Board stating that the term of Firs. Lydia Wheelehan and Mr. Robert S. Manning expired on June 30, 1956, and recommended to the Council that Mrs. Wheelehan and Mr. Manning be reappointed to the Library Board. Moved by Councilman Drtuno, seconded by Councilman Romero that the City Council accept the recommendation of the Library Board and that Mrs. Wheelehan and Mr. Manning be reappointed as a member of the Board of Trustees of the Azusa Public Library, on the term beginning July 1, 1956. A request for an e:_tension of time on the Special Use Permit issued on December 20, 1955, was received from the Independent 322 i, CITY HALL AZUSA, CAL, iiONDAY, JUNE 18, 1956 7:30 P.M. Iron Works who are desirous of erecting a foundry in this City. Due to the survey being held by the Air Pollution Control District not being completed, they are unable to begin their operations at this time, and therefore request an additional extension of six months on their Special Use Permit. Pioved by Councilman Ortuno, seconded. by Councilman Romero that the Special Use Permit issued to the Independent Iron Works be extended for an additional six months, from June 20, 1956, to December 20, 1956. There being no objections, this motion was ordered carried. The City of Hope submitted a request for permission to permit the appearance of a trained elephant to be exhibited at Lou Towers Richfield Station, 303 E. Foothill Blvd. on Sunday, June 24. it further stated that the station area is fully protected by Public Liability Insurance. Moved by Councilman Romero, seconded by Councilman Fawcett that the request of the City of hope for the appearance of the trained elephant be granted provided a certificate of insurance be filed Frith. the Cit;;. There being no objections, this motion was ordered carried. Communication was received from the Board of Supervisors requesting the annexation to either the City of Azusa or the; City of Covina of a portion of Arrow Highway, bounded by the two Cities and extending east and west of Cerritos Avenue, a distance of approximately 1100 Feet. Moved by Councilman Fawcett, seconded by Councilman Ortuno that this be referred to the City Engineer to contact the City of Covina and the Chief Deputy County Engineer for working out this problem. There being no objections, this motion was ordered carried. Councilman Johnson offered the following Resolution entitled: "A RESOLUTION OF TIS CITY COUNCIL OF THE CITY OF AZUSA, ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF ':RICH THE SAME ARE TO BE PAID." Councilman Johnson moved its adoption, seconded by Council- man Ortuno. This Resolution was then passed and adopted by the following vote of Council: 323 Extension of Spec.
