Mayor Memmesheimer opened the meeting and led in the salute to the flag. Invocation was given by Rev. Axstel of the Four Square Church. Present at Roll Call: Councilmen: Fawcett, Ortuno, Memmesheimer Absent: Councilmen: Johnson, Romero Also Present: City Attorney Williams, City Engineer, City Clerk The Minutes of July 16 and July 24, were approved as Approval of written. Min. 7/16 &7/211 The Guadalupe Society submitted a request for permission to hold dances at the Parrish Hall on the nights of Request to hold August 18th and September 15th, 1956, dances - Moved by Councilman Ortuno, seconded by Councilman Fawcett Guadalupe SOciE and ordered carried that this request be referred to the ty Chief of Police with power to act. A communication was received from the Azusa Foot -Hill Citrus Company stating their desire to negotiate with the City on a previously proposed action whereby an exchange would be worked out for the transfer of property owned by that Company Possible known as the "Gum Grove" and City owned property known as transfer of "the old Reservoir site". It was stated by the Company that City -owned titles of ownership on the "Reservoir site" have been cleared property for by the receipt of Quit Claim Deeds. It was requested by the property Foot -Hill Company that representatives of the City be authorized owned by to negotiate this transfer and also be authorized to discuss Foot -Hill other matters of mutual interest. Citrus Co. It was recommended by Mayor Memmesheimer that Attorney Williams and the City Engineer be authorized to discuss with the Foot - Hill Company matters of mutual interest between the City and that Company. Moved by Councilman Fawcett, seconded by Councilman Ortuno that the Council accept the recommendation of the Mayor. With no dissent, motion ordered carried. Moved by Councilman Ortuno, seconded by Councilman Fawcett Increased asses that the communication from the Los Angeles County Tax ments 1957 - Assessor relative to increased assessments for the year 1958 - filed. 1957-1958 be filed. 1.1ithout dissent, motion ordered carried. Moved by Councilman Orti.no, seconded by Councilman Fawcett Fund raising that the recuest by the iluscular Dystrophy Committee for a drive Muscular fund raising drive in the month of December be granted with Dystrophy montY the stipulation that names of canvassers be filed and cleared of December with the Police Department before start of solicitations. Motion ordered carried. Notice of approval of boundaries by the County Boundary Com- mission of a portion of Tract#1306 proposed to be annexed Approval of to the City by Richard Barclay, owner of the property, was boundaries, noted. MONDAY, AUG. 6, 1956 7:30 P.M. Moved by Councilman Ortuno, seconded by Councilman Fawcett Additions to and ordered carried the letter submitted by the City Dump Site Engineer giving additions and clarifications on the report report of the Dump Site submitted July 10, 1956. The City Engineer reported that Cal -Teen -rias willing to deed to the City the property required for the widening of Paramount and Virginia Avenue for the sum of $1,000.00, provided the City would relocate their fence, and in addition install a sewer lateral to the curb line on Virginia Avenue. It was recommended by the Engineer that these items be made a part of the Agreement to purchase the property. The Engineer further recommended a pave- ment width of 48 feet with concrete curb and gutter on the north side of Paramount Street, and a paving width of 36 feet with rolled asphalt drainage gutter on the west side of Virginia Avenue. Moved by Councilman. Fawcett, seconded by Councilman Ortuno and ordered carried that this be referred to the City Attorney for the preparation of an Agreement of the sale with the recoirmiendations of the City Engineer. The City Engineer reported that if all Cities in the area would participate in an aerial mapping project, the Fair- child Aerial Survey Company would furnish a complete set of 300 scale wall maps, a complete set of 1,200 scale stereoscopic prints, and a 400 foot scale wall map and appropriate index: maps for a cost of $380.00. Loved by Councilman Fawcett, seconded by Councilman Ortuno and ordered carried that the City Engineer be authorized to enter into an Agreement with the Fairchild Aerial Survey Company for the aerial photo maps as outlined. The City Engineer recommended that in lieu of payment of $1,000 to the Pacific Electric Railway Company for an ease- ment over a portion of their property, it might be possible to resolve this matter on a more favorable basis to the City by agreeing to maintain certain of the street crossings of the P. E. tracks. Moved by Councilman Ortuno, seconded by Councilman Fawcett and ordered carried that the Engineer be authorized to make the necessary arrangements as outlined in his report. Cal -Tech property acquisition Aerial Photo Maps -- Fairchild Aerial Survey Company Pacific Elec. Easement for pourer line. The City Engineer reported that his office had been contacted by representatives of the County Road Department for suggestions as to how the City might benefit from a proposed $150,000,000 County -wide bond issue. It was estimated that the City's Proposed share of this fund would be approximately $400,000 (revised County Bond figure - $393,000.). The Engineer stated that he had advised Issue Report the County that should such an amount become available to the City, he .rould recommend that the money be applied toward the solution of the City's serious traffic problem created by the industrial area west of Virginia Avenue and south of Foothill Blvd. Moved by Councilman Fawcett, seconded by Councilman Ortuno and ordered carried that the Engineer's report relative to the County Bond Issue be filed. The City Engineer stated that each City would be requested to present a formal recommendation by Aug. 28, 1956. Moved by Councilman Ortuno, seconded by Councilman Fawcett and ordered carried that the City Attorney and City Engineer be instructed to study and report relative to the proposed County -wide Bond Issue for Streets and Highways. Mayor Memmesheime-r announced that it was now 8 o'clock, the time originally set for the hearing of protests relative to Easterly Anne:_ation District No. 14, but since the Council had at a previous Special Meeting terminated the proceedings on this Annexation, no consideration of the matter would be given at this meeting. Atty. & Engr. to study County Bond Issue Easterly Annexation District No. 14 CITY HALL AZUSA, CAL. MONDAY, AUG. 6, 1956 The City Engineer reported that upon investigation of the request for an Easement by the General Telephone Company within Tract No. 627, he could see no objection to granting this Easement. Councilman Ortuno offered the following Resolution entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, AUTHORIZING THE EXECUTION OF A RIGHT OF WAY TO THE GENERAL TELEPHONE COMPANY OF CALIFORNIA." Councilman Ortuno moved further reading of the Resolution be waived, seconded by Councilman Fawcett. Motion ordered carried. Councilman Ortuno moved adoption of the Resolution, seconded by Councilman Fawcett. This Resolution then passed and adopted by the following vote of Council: AYES: Councilmen: Fawcett, Ortuno, Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: Johnson, Romero and numbered Resolution ".0. 3481 Councilman Romero entered the meeting and was seated at 8:02 P.M. The City Engineer recommended that the right-of-way running in an east -west direction approximately 300 ft, northerly of Foothill Blvd., between Vernon Avenue and a point just north of Thelma's Cafe, be named "Industrial Street". Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried that the City Attorney be authorized to prepare the necessary Ordinance or other legal action to designate this right -of -Dray as "Industrial Street". 411 7:30 P.M. Resolution No. 3481 - Easement - General Tele- phone Co. Designation of street name - Industrial St. It was recommended by the City Engineer that Byron B. Johnson, Jr., #1 on the Certified Civil Service List III, be appointed Civil Engrg. to the position of Civil Engineering Assistant as of Aug. 1, Asst. -- 1956• B. Johnson Moved by Councilman Fa,•rcett, seconded by Douncilman Ortuno and unanimously carried that Byron Johnson be appointed Civil Engineering Assistant as of August 1, 1956. It was requested by the City Engineer that the Personnel Board hold an open examination for the position of Park Foreman. Open examina- Moved by Councilman Ortuno, seconded by Councilman Fawcett tion for and unanimously carried that the Personnel Board be instructed Park Foreman to set up an examination for the position of Park Foreman. Mrs. Ann Clapp appeared before the City Council relative to the proposed zoning in Tract -#8507. Mrs. Clapp was informed by the Council that at the previous meeting an Interim Zoning for Zoning Ordinance was adopted which placed that Tract under Tract #8507 the original Ordinance No. 400, and amendments. The City Engineer stated that the Notice of Completion was ready to be forwarded to the County Recorder's Office as Notice of the First Street bridge was now complete. Completion -- Moved by Councilman Fawcett, seconded by Councilman Ortuno First St. and ordered carried that the City Clerk be authorized to Bridge forward for recordation the Notice of Completion on the First Street bridge. The City Engineer reported that on.making a survey= of the Possible water costs for water installation in order to insure proper fire installation - protection, it was his estimate that such an installation on Todd Ave., Todd Avenue mould approximate $7,650.00, and on Gladstone Gladstone St. Street in the vicinity of Alexander's Market, the cost would approximate $14,550.00. 412 413 CITY HALL AZUSA, CAL. MONDAY, AUG. 6, 1956 7:30 P.M. Fire Chief Madison addressed the City Council and stated that in his opinion this work should be done as soon as possible. Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried that the City Engineer be instructed to prepare the plans and specifications necessary for advertising this project to go to bid. The report of the Supt, of Streets relative to the discing of lots on the weed abatement project in 1956 was submitted to the City Council. Councilman Ortuno offered for the second and final reading, an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED "EASTERLY ANNEXA- TION DISTRICT No. 12" TO THE CITY OF AZUSA." Moved by Councilman Ortuno, seconded bey Councilman Fawcett and unanimously carried that further reading of the Ordinance be waived. The City Engineer recommended that necessary setbacks be established in the new Zoning Ordinance in order to insure proper Police and Fire protection. Fire Chief Madison recommended that Tract No. 8507 be placed in fire zone #1. City Attorney Williams suggested that Ordinance No. 514 be repealed when corrective measures have been put into effect by the new Zoning Ordinance. It was moved by Councilman Ortuno, seconded by Councilman Atty. P. J. Romero and unanimously carried that the Leave of Absence Tscharner -- of P. J. Tscharner be extended indefinitely and until Leave of further action of the Council is taken. Absence This Leave of Absence will be without compensation. Moved by Councilman Fawcett, seconded by Councilman Romero and ordered carried that the Planning Commission be instructed to establish the necessary zoning to allow the labor temple to be constructed on the property being purchased by them on Virginia Avenue. 419 7:30 P.M. Resolution No. 3487 - Grant of Easement - F. Sarinana Resolution No. 3488 -- Grant of Easement - Lucio D. Cruz Resolution No. 3489 - Sale of Real Estate to Internatl. Assoc. of Machinists Zoning to allow labor temple on Virginia Ave. property 420 CITY HALL AZUSA, CAL. MONDAY, AUG. 6, 1956 Moved by Councilman Ortuno, seconded by Councilman Romero and ordered carried that the City Clerk be instructed to enter into escrow instructions relative to this property purchase. The City Clerk announced that the ambulance agreement be- tween the City and White's Ambulance Service previously presented to the City Council had been withdrawn by Mr. White owner of the ambulance service, and a new Agreement substituted. The only change in the Agreement was in the monthly charge, which under the new submitted Agreement would be for $300 per month. 421 7:30 P.M. Escrow Instruct Virginia Ave. property New Ambulance Service Agree- ment - White's Ambulance Service Moved by Councilman Ortuno, seconded by Mayor Memmesheimer that tj Ambulance Agreement be tabled until the next regular meeting. City Clerk announced that it was necessary for the Mayor to sign the Agreement with the Mutual Pipe and Construction Company for the installation of the water line on Sierra Madre Avenue. A check in the amount of $2100.00 was on deposit in the City Clerk's Office for faithful performance of the Agreement. The City Attorney checked the Agreement as to form. The City Clerk announced that the Labor and Material Bond had been deposited by the Chorak Construction Co. in connection with the construction of sanitary sewers Project #155. Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried that the Labor and Material Bond submitted by the Chorak Co. be accepted by the City Council. Agreement re: Water line on Sierra Madre Avenue Labor and Matl. Bond accepted Proj• #155, Chorak Co. City Engineer Williamson stated that it would be necessary to acquire an Easement to complete Project #155, or to acquire the Easement by condemnation as the owner of the property, Sewer line - although seemingly willing to grant, the Easement, has not Project #155 signed the necessary papers granting such Easement. It was the opinion of the City Attorney that the sewer line could be put in and that it would be considered an inverse condemnation. The City Engineer requested instructions from the City Council to proceed with the installation of the sewer line. Moved by Councilman Ortuno, seconded by Councilman Fawcett and unanimously carried that the City Council instruct the contractor to proceed with the necessary installation of the sewer line all properties in order to insure installation. A request was received on behalf of Mr. Max Goldman, owner of the property on the corner of Motor Avenue and First St. and the corner of Irwindale Avenue and First St., for the Request for City to dedicate the portion of the alley between the two dedication of properties to Pr. Goldman. By dedicating the alley to Mr. alley - Goldman he would be able to connect his business properties.
