Mayor Memmesheimer led in the Salute to the Flag. Invocation was given by Rev. Shoemaker of the Nazarene Church. Present at Roll Call: Councilmen: Fawcett, Ortuno, Johnson, Romero Mayor Memmesheimer Also Present: Acting City Attorney, City Engineer City Clerk City Clerk announced that approval of the Minutes of July 10, 1956 had inadvertently been overlooked. There being no corrections offered, the Minutes of July 10, 1956, were approved as written. Mayor Memmesheimer asked if there were any corrections additions or admissions of the Idinutes of the Special Meeting held July 30, 1956. Councilman Johnson.made the following statement: "I was not here and I received no timely notice, there- for these Minutes are of an illegal meeting and I must vote against approving them, and I wish the record to so state that." Councilman Ortuno asked the following question of Council- man Johnson and requested this statement to appear in the record: "Mrs. Johnson, were you contacted by a Police Officer and refused to be served?" Councilman Johnson: "I did not accept them." Councilman Ortuno: "Thank you, in other words, you refused to be served of the Notice." Councilman Johnson: "I did not accept them" It was moved by Councilman Fawcett, seconded by Councilman Ortuno that the Minutes of the Special Meeting, held July 30, 1956, be approved as written. Motion carried by the following vote of Council: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None Mayor Memmesheimer asked if there were any corrections or additions to the Minutes of the Special Meeting held August 2, 1956. Councilman Johnson'made the following statement: "Mayor, I received no timely notice, therefore these Minutes are of an illegal meeting". It was moved by Councilman Fawcett, seconded by Council- man Ortuno that the Minutes of the :Special Meeting held August 2, 1956, be approved as written. This motion carried by the following vote of Council: AYES: Councilmen: Fawcett, Ortuno, Memmesheimer NOES: Councilman: Johnson ABSTAIN FROM VOTING: Bouncilman Romero Councilman Romero stated that he would abstain from voting because he was not present at the meeting. Mayor Memmesheimer asked if there were any corrections or additions to the Minutes of the Meeting of August 6, 1956. Councilman Johnson stated that the correction to the Minutes of July 16th relative to Mr. Williamson's statement that the word "Mayor" should preceed the statement. Councilman Johnson stated that the corrections to the Minutes of July 2, 1956, which appeared on the Minutes of July 16th relative to the report of the Engineer on dump sites, was not worded in the manner of the original correction. The phrase following the word "area" should be deleted as the intent of the Council at the meeting of July 2nd was "that the City Engineer should continue with his study of the G' m 7:30 P.M. Minutes of Special Meeting 8/2/56 approved Corrections to Minutes of 8/6/50 CITY HALL : AZUSA, CAL. MONDAY, AUG. 20, 1956, dump site and complete his report and submit it to the Council at the earliest possible date." Councilman Johnson stated that in the Minutes of Aug. 66th, page 4, 3rd line of the first item, the word "now" should be inserted for the word "not" relative to the bridge being completed. The Minutes of August 6th were then ordered approved as corrected. Mayor Memmesheimer announced that it was now three minutes until 8 o'clock and if anyone in the audience had a written protest relative to Annexation DistrictNo. 15, it should be filed with the City Clerk before the time for the hearing which is set for 8 o'clock. At 8 o'clock Mayor Memmesheimer announced that this is the time and place for the hearing of protests relative to Annexation District No. 15. Mayor Memmesheimer recommended that instead of holding the hearing tonight, it would be well to continue the hearing until 8 o'clock, September 17th, and at that time proper recognition can be given to all written protests that are on file, and that any protest filed between now and September 17th would also be considered as long as they are properly filed before 8 o'clock, Sept. 17th. Moved by Councilman Fawcett that the City Council accept the recommendation of the Mayor and that the Hearing on Annexation No. 15 be continued until 8 o'clock P.M., September 17th, 1956. This motion died for lack of second. District No. 15 continued to 9/17/56 Moved by Councilman Fawcett, seconded by Councilman Ortuno Hearing re: and unanimously carried that the hearing set for this Vacation of date on the vacation of Fenimore Avenue be continued until Fenimore Ave. the meeting of October 15, 1956, continued. A request by the County Assessor for the use of the Auditorium each Friday, from January 18th to April 26th was received. Moved by Councilman Ortuno, seconded by Councilman Fawcett and unanimously carried that approval be given to the County Assessors for use of the Auditorium as requested. An offer was received from John M. Pon, Realtor, for the purchase of City -owned property described as Lot No. 194, Tract 1#10660, located on Coney Avenue, for the price of $900.00. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that the offer for the purchase of the property submitted by John M. Pon not be accepted. County Assessor use of Audi- torium Offer by J.Pon for City property denied Moved by Councilman Romero, seconded by Councilman Fawcett Auction - that a one -day auction license be granted to Jack Rouse & Coulombe & Co. Son, Auctioneers, for Thursday, August 30, 1956, for a sale communication received to take place at 1050 West Foothill Blvd. No dissention, the County Department motion ordered carried. of Parks A letter was received from the Department of Alcoholic Acknowledgment Beverage Control, acknowledging receipt of the protest of protest filed by the City against the issuance of an Alcoholic letter - Alcoh. Beverage License to Melvin A. and Veronica M. Freitas at Bev. Control - 345 N. Azusa Ave. filed. Moved by Councilman Ortuno, seconded by Councilman Fawcett protests, the motion and unanimously carried that this letter be filed. was ordered carried. Moved by Councilman Ortuno, seconded by Councilman Fawcett that the Mayor be authorized to speak with Rev. Pendleton Mayor to speak and his group at the First Baptist Church relative to the with group at possibility of their withdrawal of their protest on the First Baptist issuance of a license to Mr. and Mrs. Freitas, 345 N. Azusa Church Avenue, and to report to the Council. This motion carried by the following vote of Council: AYES: Councilmen: Fawcett, Ortuno, Memmesheimer NOES: Councilmen: Johnson, Romero ABSENT: Councilmen: None Moved by Councilman Romero, seconded by councilman Johnson that the City withdraw their protest which was filed on the application for a license by Mr, and Mrs. Freitas, 345 N. No protests, the motion was ordered carried. 442 443 CITY HALL AZUSA, CAL. MONDAY. AUG. 20, 1956 7:30 P.M. Request was received from the Azusa Golden Days Committee that the Council authorize Department Heads to work with Assistance the Committee in conjunction with Golden Days. for Golden Moved by Councilman Romero, seconded by Councilman Fawcett Days. and unanimously carried that the Chief of Police be authorized to employ the necessary personnel for Golden Days as in the past at $10.00 per day, and that the Public Works Department and Light and Water Department be authoriz- ed to assist the Golden Days Committee. A request for Leave of Absence by W. H. Wilkinson, Patrol- Leave of Absenc, man #113, from November 22, 1956, through December 31st, granted 1956, was received. Wilkinson Moved by Councilman Johnson, seconded by Councilman Romero that the Leave of Absence requested by W. H. Wilkinson be granted. With no protests, motion was ordered carried. Chief of Police Kendrick submitted the names of the follow- ing men appointed to the Azusa Police Reserve Corps: 1 - Ray "Mc L" Scott Police Reserve 2 - Robert J. Hawkins Officers 3 - Peter Rossel, Jr. 4 - Cornelius J. Flynn 5 - Ernest G. Watts The effective date of the appointments to be Sept. 1, 1956, to be paid at the regular rate of $1.50 per hour. Moved by Councilman Ortuno, seconded by Councilman Fawcett that the list of Reserve Officers be accepted, as requested by the Chief of Police. This motion passed by the following vote of Council: AYES: Councilmen: Fawcett, Ortuno, Memmesheimer NOES: Councilmen: Johnson, Romero ABSENT: Councilmen: None Moved by Councilman Ortuno, seconded by Councilman Romero that the Mayor be authorized to sign a letter to the Edison Co. Southern California Edison Company granting that Company elec. energy permission to serve electrical energy to property located to 352-354 S. at 352 and 354 S. Irwindale Avenue. With no objections, Irwindale the motion was ordered carried. Councilman Romero requested the Supt. of Light Dept. to Inadequate investigate the inadequate street lighting at the corner Street of 3rd Street and Dalton Avenue, and at 4th Street and lighting Dalton Avenue. Supt, of Light and plater requested permission to file cost estimates for the installation of water lines on various projects for which plans and specifications had been prepared by the City Engineer. The City Engineer stated that plans and specifications had Installation of been prepared for the installation of water lines in the water lines vicinity of Todd Avenue and Loren Avenue, and on Gladstone Street in the vicinity of Alexander's Market, which would be included as one project, and asked that the City Clerk be authorized to advertise for bids for the construction of water lines for this project. Moved by Councilman Ortuno, seconded by Councilman Romero that the City Clerk be authorized to advertise for bids for the installation of water lines for the above project as per the plans and specifications which have been prepared by the City Engineer, and that the bids be opened on Sept. 14, 1956. With no objection, the motion was ordered carried. Moved by Councilman Johnson, seconded by Councilman Romero that the City Council approve the step raises as outlined. With no protest, the motion was ordered carried. The Personnel Board submitted Civil Service List II for City Engineer, listing the three names of applicants Holwell to be according to rank: employed as 1 Mr. William Kirkgaard Civil Service 2 Mr. William Jensen List II - 3 Mr. George Mim Mack City Engr. Councilman Ortuno asked City Engineer Williamson if he would - tabled. consider accepting reappointment as the City Engineer. Mr. Williamson stated that he would answer at the next meeting of the City Council. C. With no protests, Agency. the motion was ordered carried. The City Engineer, submitted a report regarding the requested alley vacation in Tract #8507 asked for by the Azusa Salvage Company. It was recommended by the Engineer that the request be denied. Alley vacation Moved by Councilman Fawcett, seconded by Councilman Romero Tract #8507 - that the City Council accept the recommendation of the City denied. Schad employee, Moved by Councilman Romero, seconded by Councilman Fawcett Survey Crew that the City Engineer be authorized to employ Claude R. Howell as part-time employee in the survey crew. Motion ordered carried, no protest. Discussion was held relative to the employing of regular C. Schad to be City employees for part-time work within the City during employed as their available time. It was pointed out that Clarence A. part-time Schad was a member of the Azusa Fire Department. employee -- Moved by Councilman Ortuno, seconded by Councilman Fawcett Survey Crew that Clarence Schad be included as a part-time employee in the Survey Crew. This motion carried by the following vote of Council: AYES: Councilman: Fawcett, Ortuno, Memmesheimer NOES: Councilmen: Johnson, Romero ABSENT: Councilmen: None It was recommended by the City Engineer that the City Clerk Notice of be instructed to file a Notice of Completion of the Sierra Completion, Madre Water Line, and that he be authorized to return the Sierra Madre cash bond posted by the Company at the expiration of the Water Line lien period, provided no liens are filed. CITY HALL AZUSA, CAL. MONDAY, AUG. 20, 1956 Moved by Councilman Johnson, seconded by Councilman Ortuno that the recommendation be accepted and that the City Clerk file the Notice of Completion. With no objection, motion ordered carried. City Engineer recommended that an alteration of the contract for Project No. 155 be made. This being necessary due to conditions which would prohibit installation of the sewer line on the alignment covered by the contract. It was recommended by the Engineer that items 1, 5 and 6 be omitted from the contract and that under Item 4, four manholes be omitted. It was requested by the Engineer that he be instructed to advise the contractor of the changes and to prepare necessary modifications in the drawings for re - advertising at the earliest possible date. Moved by Councilman Ortuno, seconded by Councilman Fawcett that the City Council accept the Engineer's recommendation and that the City Attorney and Engineer prepare an Agreement modifying the contract for Project No. 155, and that the necessary plans and.specifications be prepared by the City Engineer for advertising as recommended. Motion carried unanimously. The City Engineer presented to the City Council drawings showing the location of a proposed road extending north from Jackson Street and Gladstone to Foothill Blvd., lining up with Todd Avenue. The City Engineer stated that the estimated cost of this road would be higher than the estimated alloca- tion to the City with the proposed Bond Issue suggested by the County for road improvements should pass. City Engineer estimated the cost of the right-of-way acquisitions to be $420,000.00. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimousl carried that the City of Azusa request an allotment of $435,350.00 for right-of-way acquisition if the proposed Bond Issue should be successful. The City Clerk read a report submitted by Paul E. Kressly and filed with the City Clerk that evening, relative to Mr. Kressly's examination of the report of John Williamson on the disposal site. Moved by Councilman Romero, seconded by Councilman Ortuno that the City Engineer be instructed to contact the State Water Pollution Board to determine the steps necessary to be taken for the filing by the City for approval for a sanitary landfill within Van Tassel Canyon, the Engineer to report his findings to the City Council. This motion carried by the following vote: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None A letter was received from the Los Angeles Airways reiterat- ing their desire to have a heliport located on the City - owned property at 5th and Virginia, if the City was in favor of a heliport, the second choice remaining on the Consolidated Rock property at the east limits of the City. A letter was submitted by the Chamber of Commerce asking the City Council to consider the 5th Street and Virginia Avenue property as the heliport site. Mr. Henry Cappel of the Azusa Post Office spoke in favor of helicopter service for that Department. Moved by Councilman Fawcett, seconded by Councilman Romero that the City Council go ahead and expedite the establish- ing of a heliport at the 5th Street and Virginia Avenue site as soon as possible. Motion was amended by adding that the City Engineer be authorized to negotiate an Agreembnt with the Los Angeles Airways relative to the heliport, said Agreement to be submitted to the Council for approval. 447 7:30 P.M. CITY HALL AZUSA, CAL.- MONDAY, AUG. 20, 1956 The motion, with the amendment as added, was carried by the following vote of Council: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None Mr. Orland Kilmer appeared before the Council relative to the formation of an off-street parking district. Mr. Kilmer introduced Mr. J. B. Hanauer, Financial Consultant who had submitted a proposal for Council approval. Mr. Kilmer requested that the Council sign the Agreement with Mr. Hanauer in order to expedite the creation of the parking district. It was the opinion of the Council that the Committee on off- street parking should prepare the necessary recommendation for submittal to Council. Mayor Memmesheimer stated that as it was 10:30 o'clock, would it be the desire of the Council to continue the meeting to have the first reading of the Ordinance establishing tax rates. Moved by Councilman Romero, seconded by Councilman Ortuno that this meeting be extended beyond 10:30 for consideration of the Ordinances on the tax rate. This motion carried by the following vote of Council: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None Councilman Ortuno offered the following Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID." 7:30 P.M. Off -Street Parking District Council Meet- ing continued beyond 10:30 P.M. Resolution No. 3493 - Allowing Claims and Demands Councilman Ortuno moved adoption of the Resolution, second- ed by Councilman Fawcett. Resolution was then passed and adopted by the following vote of Council: AYES: Councilmen: Fawcett, Ortuno, Johnson, Romero, Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: None and numbered Resolution No. 3493 Councilman Johnson offered for its first reading an Ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA FIXING THE AMOUNT OF MONEY NECESSARY TO BE RAISED BY TAXATION FOR THE CURRENT FISCAL YEAR BEGINNING JULY 1, 1956." Moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that further reading of this Ordinance be waived. Councilman Johnson offered for its first reading an Ordinance entitled: "AN ORDINANCE OF THE COUNCIL OF THE CITY OF AZUSA, FIXING THE RATES OF TAXES AND LEVYING TAXES FOR THE FISCAL YEAR BEGINNING JULY 1, 1956' Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried that further reading of this Ordinance be waived. Councilman Romero requested that the City Attorney obtain copies of the pin ball Ordinance passed by the City of Monterey Park and forward a copy of said Ordinance to each member of the Council. Councilman Romero offered the following Resolution entitled: First reading Ordinance re: fixing amount necessary for taxation year 1956. "RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF AZUSA TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "EASTERLY ANNEXATION NO. 16", AND GIVING NOTICE OF THE PROPOSED ANNEXATION." The date for protest hearing on Annexation No. 16 was set for October 15, 1956. Moved by Councilman Romero, seconded by Councilman Fawcett that further reading of this Resolution be waived. No objections, motion ordered carried. Councilman Romero moved adoption of the Resolution, seconded by Councilman Fawcett.
