The City Council of the City of Azusa met in regular adjourned session at the above time and place to continue the Hearing on Northerly A.nne:.ation District No. 15. Present at Roll Call: Councilmen: Fawcett, Ortuno, Johnson, Memmesheimer Absent: Councilmen: Romero Also Present: Asst. City Attorney Williams, Acting City Engineer Williamson, City Clerk Mayor Memmesheimer asked the City Attorney if he now had a report on the valuations. The City Attorney stated that if the Government or publicly owned property is included, then the protest is far below the 50%. It was the opinion of the City Attorney* that the protest filed by two citizens of the United States was invalid. The City Attorney further stated that if a Section of the Government Code involved could be interpreted so as to exclude publicly owned lands, and to include only what appears on the Assessment Roll, the protest figure of $39,510.00 would still be less than evalua- tions appearing on the assessment rolls, which is in excess of $80,000.00, The amount in excess of $80,000.00 did include the pipe lines and easements brought out at the last meeting by the Duarte Mutual Water Company , when the valua- tions were being checked, but was included from the protests since they were not described in the written protests filed. The City Attorney stated that he would report that there was not a majority protest. It was recommended by the Attorney that the City Council make a finding of valuation on Govern- ment owned property both as to market value and assessed value. Mr. Shatford, Attorney for the Duarte Mutual Water Company objected to the exclusion of the valuation of the pipe lines owned by the Companies he represents from the protest valua- tions. Mr. Willard Decker, Attorney for Mr. Fred Heyden and owner of property within the proposed annexation, appeared before the City Council and requested that the protest which had been filed, with conditions attached, not be counted in the protest valuation. The Council took no action on this request. Moved by Councilman Fawcett, seconded by Councilman Ortuno that the City Council find that the value of Government and publicly owned :property within the annexation area is as fixed by the report of the appraiser Mr. Bruner, as to its market value, in his original report, and that its equivalent assessed value is correctly set forth in the supplemental letter of Mr. Bruner, except the value of the real estate without improvements owned1by the City of Azusa is $50.00 as shovm on the last equalized assessment roll. This motion was passed by the following vote of Council: AYES: Councilmen: Fawcett, Ortuno, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: Romero 497 Roll Call Continued Hearing on Northerly Annexation District No. 15 Valuation as fixed by appraiser It was moved by Councilman Ortuno, seconded by Councilman Majority Fawcett that the City Council find that in connection with protest not Northerly Annexation District No. 15 that a majority protest presented or has not been presented or filed in accordance with Section filed. 35313 of the Government Code. A representative of the Consolidated Rock Products Co, appeared before Council and stated that pursuant to their letter sub- mitted, they request that that Company's property be excluded from the J)roposed annexation. Councilman Ortuno offered for the first reading an Ordinance entitled: First reading of Ordinance "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS re: Northerly ANGELES COUNTY, CALIFORNIA, APPROVING THE ANNEXATION OF Annexation CERTAIN UNINHABITED TERRITORY, DESIGNATED "NORTHERLY District ANNEXATION DISTRICT NO. 15 TO THE CITY OF'AZUSA.I No. 15 This Ordinance rias then read in full. Moved by Councilman Fawcett, seconded by Mayor Memmesheimer and unanimously carried that this meeting adjourn until Tuesday, September 25, 1956, at 7:30 P.M. Time of adjourn- ment 8:08 P.M.
