Mayor Memmesheimer opened the meeting and led in the salute to the flag, Invocation was given by Rev. Paul Farrell of the First Christian Church. Present at Roll Call Councilman Fawcett, Ortuno, Johnson, Romero, Memmesheimer Also Present; Acting City Atty, Williams, City Engr, Kirkgaard, ROLL CALL City Clerk -Administrative Officer Miller Mayor Memmesheimer asked if there were any corrections or omissions to the minutes of December 3, 1956, Corrections to the meeting of Nov. 19th which appeared on the Dec: 3rd meeting should have read "Mayor Memmesheimer shall sign the escrow instructions and the City Clerk shall attest thereto", Page 29 Item 8 of Dec. 3 relative,to Westerly Annexation District No. 17 be corrected to read."A petition with the signatures of nine property owners was,•submitted". Page 5, item 2, the word "Atty" should be inserted in place of the word "Mayor". Minutes were then approved as corrected, Mr. P, J. Tscharner, Attorney for the Redevelopment Agency, appeared before Council and requested clarification as to which agency of the City should be the one to designate the areas which were to be considered for redevelopment. Mr. Tscharner stated that upon the choice of the agency a resolution would be prepared for presentation -at the next meeting of the City Council. Moved by Councilman Romero, seconded by Councilman Ortuno, the Planning Commission to be the agency to designate the areas to be considered for redevelopment. Motion carried by the following vote: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson The following eligibility list for the position of Mainten- ance Man I was submitted by the Personnel Board, Mr. C. Gelling, Mr, C. Grindelgnd, Mr. C. Condon, Mr, C. Reyes, respectively. It was noted that Mr, Grindeland and Mr, Condon had a tie score for second place on the list. Upon the request of the department heads the following employees were recommended for step raises by the Personnel Board. J. Johns, Step 4, ($345) effective Jane 1, 1957 The Administrative Officer suggested changes in the effective date,for Avis Whitlock and Wm, Holden as noted. It was moved by Councilman..Faweett, seconded by Council- man Romero and unanimously carried, the'step raises as recommended bj the Personnel Board be accepted with the effective dates as noted. It was requested by the Supt; of Public Works that the Personnel Board hold.an examination for the position of street foreman. This position now being vacant due to the retirement of the former foreman. It was also recommended that an inter -departmental examination be held, Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried, that the Personnel -Board be authorized to hold an -interdepartmental examination for the position of street foreman: 181 CORRECTIONS TO 'MINUTES 12/3/57 PLANNING COMM; TO DESIGNATE AREAS FOR REDEVELOP- MENT, STEP RAISES APPROVED INTERDEPART- MENTAL EXAM, FOR STREET FOREMAN 182 CITY HALL AZUSA, CALIFORNIA MONDAY,DECEMBER 17,1956 It was recommended by the Administrative Officer the following equipment, now in possess on of the Public Works Department, and of no furth r use to the City be offered for sale to the highest bidder. This equipment consists of the following items: a 1 3 HP Motor b 1 5 HP Motor to be used as a pump head. c 1 Pump and Motor (7 HP). Items (a) and (b) were removed from the plunge;at the time of the change over in the filtration system was made. Item (c) was removed from the sewer plant at the time the City sold the plant to the Sanitation District. Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried, that these items be offered for sale and the City Clerk be authorized to advertise for bids. In order to bring the complement of park maintenando men to full strength, it was recommended,by the Admin- istrative Officer and the Supt. of Public Works, that Mr. C. Gelling and Mr. C. Grindeland No. 1 and No.2 men on the eligible list of maintenance No. 1, be employed on a probationary basis. Moved by Councilman Fawcett, seconded by Councilman Ortuno, that the recommendation be accepted and Mr. Gelling and Mr. Grindeland be appointed td the position of Maintenance Men No. 1, effective as of January 1, 1957, at the first step of the pay range on a probationary basis. With no objections, motion ordered carried. A representative from the firm of E. Jackson Faustman had been in Azusa during the week relative to the roposal of the cost of a traffic survey for an off- treet parking district. A proposal had been expected prior to the time of the Council meeting but had not rrived. Moved by Councilman Ortuno, seconded by Council rn Romero and ordered carried, that this matter be laid ver until receipt of the proposal. A report was submitted from the engineering department Felative to a survey now.underway, of the Palm Drive 4lignment, and upon completion of the survey a plan and cost estimate will be prepared. It was moved by 0ouncilman Fawcett, seconded by Councilman Ortuno and ordered carried, this matter be tabled until completion of the survey, and the filing of the cost estimate, The City Clerk requested authority to employ one of the first four persons on the eligibility list for Account Clerk. It was pointed out that the person in No. 1 position is•at the present time working for the Light and Water Department and will probably remain in that department, and that the difference in the rating score of the next three was very small. It was felt that, upon additional interviews, one could be selected who, perhaps, would fit in better in the City Accounting Department. The need for the account clerk has been made.necessary because of the recent termination of an employee. Moved by Councilman Ortuno, seconded by Councilman Fawcett, that the City Clerk be authorized to employ an account clerk as requested. No objections, the motion ordered carried. Page 2 7:30 P.M. Clerk las 184 CITY HALL AZUSA, CALIFORNIA DECEMBER 17;196 Page 3 7:30 P.M. The Administrative Officer reported that the rate for the employment of Mr. T. Holabird, was obtained to negotiate the transfer of the old reservoir site or' a portion of the Gum Grove site, would be $100 per diem. This cost would more than likely be less than the usual broker's commission of 5%. It was further reported that Mr. Holabird is a registered real estate broker. Moved by Councilman Ortuno, seconded by Councilman Fawcett, that Mr. Holabird be retained to negotiate for the transfer of the property, subject to a letter of confirmation,of the terms being received. Motion carried by the following vote of Council: Ayes: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer Noes: Councilman Johnson Absent: None The Administrative Officer announced that the Court Hearing on the condemnation proceedings of the Abdelnour property on Foothill Blvd. has been set for April 8, 1957. Due to the great difference between the price set by the Abdelnour interest and the appraisal by the City representative, the employ- ment of another appraisor might be desirable. Upon discussion of this subject it was the opinion of the Council that the City appraisal, as made by it's rep- resentative, shoulA be sufficient. 185 Emp. of T. Holabird for transfer of property Abdelnour Appraisal Mayor Memmesheimer announced-that--it-was now 8:00 P.M. toe time set for the Hearing on Westerly Annexation District No. 17 which Ai d been continued until this time. The City Clerk announced that no additional protests had been received, and that in checking, protests submitted the previous meeting, it was found the'valuations of the protests amounted to less than 50% of the total assessed valuations of the lands within the area; and in addition, there were fewer than 12 registered voters in the area. It was moved by Councilman Ortuno, seconded by Councilman 'Fawcett, that the City Council finds there has not been a majority protests filed.regarding Westerly Annexation' No. 17. Motion `carried by the following vote: Ayes: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer Noes: Councilman Johnson Absent: None Hearing Westerly Annexation District No. 17 Councilman Ortuno offered the following Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, IAS ANGELES COUNTY, CALIFORNIA, APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED "WESTERLY ANNEXA- TION DISTRICT NO. 17" TO THE,CITY OF AZUSA. First Reading Moved by Councilman Ortuno, seconded by Councilman Romero, of Ord. that,further reading of this ordinance be waived. There re Annex. being no objection, motion ordered carried. District y ' No. 17 City Clerk reported thatl on the morning of Dec. 7th,1956 a petition was filed in the office of the City Clerk, requesting annexation of the identical uninhabited terri- tory previously covered by;,the petition filed on Oct. 8, 1956 (Westerly Annexation District No. 17). The new petition that was filed contained the legal description as amended by the County Boundary Commission on Oct. # 1956., Mr. Russell Moore, Vice -Chairman of the Duarte Incorporation Committee, 1309 E. Huntington Drive, Duarte appeared before Council stating that he questioned the legality of the annexation proceedings on the grounds that the proposed City of Duarte had priority on this territory and tuxlther re- quested that this protest be recorded. 187 Page . It mas moved by Councilman Romero, seconded by Councilman Ortuno, the City Attorney be instructed to prepare the necessary resolution instituting proceedings on the new filing for annexation, incorporating a description as approved by the County Boundary Commission. Motion carried by the following vote: Ayes: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer Noes: Councilman Johnson Absent: None The Council, at this time, returned to th'e.discussion Abdelnour relative to the employment of another appraiser in the property matter of the condemnation hearing of the Abdelnour property. It was moved by Councilman Johnson, seconded by Councilman Romero, that the City Council not employ another appraisor for the reappraising of the Abdelnour property. The City Clerk announced that a petition for annexation tq'the City of Azusa of uninhabited,territory,,ivas filed in the office of the City Clerk on Dec. 5, 1956. This petition was signed by Mr. Fred Hayden, and Mr. Albert P. Se our. and contained territory previously embodied in Anniexation District No. 15. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried, this petition be referred to the City Attorney for study and recommendation. Announcement was made that the Water Pollution Control Board will hold a hearing in Azusa on Thursday December 203 1956, at 9:30 A.M. in the auditorium relative to the City of Azusa's request for a dump site in Van Tassel Canyon. Moved by Councilman Romero, seoonded by,Councilman Fawcett and unanimously carried, the following persons be authorized to attend this hearing: Administrat2ve Office, City Engineer, City Attorney, former City Engineer and Council members. Moved by Councilman Ortuno, seconded by Councilman Fawcett and unanimously carried, that the services of John Williamson be terminated and the Administrative Officer be instructed to write a letter of thanks and appreciation to Mr. Williamson for his services to the City. Moved by Councilman Romero, seconded by Councilman Ortuno, the Administrative Officer be authorized to direct a letter to the Seaboa,I'Engineering Company, employers of John Williamson to determine the possi- bility of arranging for the services of Mr. William- son in an advisory capacity until several unfinished projects have been completed. Page 5 Councilman Fawcett offered the following resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING CONSUMER"S AGREEMENT AND APPLICATION FOR INSTALLATION OF WATER MAIN BETWEEN THE CITY OF AZUSA AND LEE & DANIEL AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST SAME. Smith of the -Light and Water Department requested permission to employ one of the applicants on the Civil Service List of Account Clerks to the position of Cashier -Clerk in the Light and Water Department. However, at this time the descriptionfbr the required easement necessary for the relocation of the power poles is being pre- pared by the Engineering Department for submittal to property owners for signing. It was recommended by the Administrator that signing of the agreement by the City be delayed until this work has been completed and easements obtained. Moved by Councilman Fawcett, seconded by Councilman Ortuno, the agreement be tabled until easements for pole relocations have been obtained. The matter of purchasing certain property owned by the Atchison, Topeka and Sante Fe Railway Company was considered and the purchase price of $6,059.20 agreed upon. RESOLUTION NO. 3558 - Stop signs .143 144 9 145 CITY HALL AZUSA, CALIF. MONDAY, DEC. 17, 1956 Administrative Officer M13ler reported on the meeting with the State of California Division of Highways Engineers on December 10, 1956, relative to proposed locations of the Foothill Freeway and the State Highway Commission policy regarding freeway route adoptions. The Engineer- ing Department is presently studying a preferred route as set forth by the State Commission, recommendation to be submitted at a meeting set for Wednesday, January 9th at 2:00 P.M. City Engineer requested to prepare maps for the information of Council members. 7:30 P.M. Page 8 State Highway Division Meeting Request was made by the American Cancer Society for per- American mission to hold their annual fund drive. Cancer Moved by Councilman Fawcett, seconded by Councilman Ortuno Drive and so ordered, request be granted, subject to the regular condition of registering with the Police Department. A copy of a letter addressed to the Azusa Community Redevelop- ment Agency signed by Mrs. Martha M. Johnson of community ownership of the N 60f lot 110, Tract 13736. Moved by Councilman Ortuno, seconded by Councilman Romero and so ordered, letter be filed. Permission to hold a fund drive was requested by the Seventh- Day Adventist Church of Azusa to conduct it's yearly Welfare Campaign in the City from December 9th to December 22nd. 7th Day Moved by Councilman Fawcett, seconded by Councilman Adventist Ortuno and so ordered, request be granted. Welfare Campaign Letter was received from the Rotary Club of Azusa endors- ing an off-street parking plan in the downtown business - district and urging the development of a plan which is Off-street urgently needed. Parking Moved by Councilman Fawcett, seconded by Councilman Ortuno and,so ordered, letter be filed. Letter was read from the Engineering Dept, of the University of California announcing the Ninth Annual Street and High- way Conference at Berkeley, January 23-25, 1957, This Conference gives emphasis to techniques of street administra- tion and engineering. 9th Annual Moved by Councilman Johnson, seconded by Councilman Ortuno Street & and so ordered, the City Engineer be authorized to attend Highway the Ninth Annual California Street and Highway Conference Conference with compensation to be made for expenses. Announcement was made of the 8th Annual Conference of the California Society of the American Institute of Park 8th Annual Executives, Inc. to be held in San Jose, on January 20 Conf. Page 9 The Administrative Officer reported that Mr. Motley and Mr. Baxter, representatives of the State Housing Administration, had advised him Lopez that the City could utilize its own forces to property remove the rubbish from the Lopez property on Alameda Avenue which had bean condemned and ordered cleaned up by the owners. An exact cost record would have to be kept on this pro- ject. Upon clearing of the property the City Council would set a date of hearing, at which time they could instruct that the entire cost of the clearing be placed as a lien on the Lopez property and so shown on the tax.roll; or the City could reduce the cost, or absorb the cost. Moved by Councilman Fawcett, seconded by Councilman Johnson and unanimously carried, the Public Works Department be instructed to clear the Lopez property located at First Street and Alameda Avenue, and that an exact accounting of cost be kept and that this cost be placed as a lien on the property, on the tax assessment roll. A Financial Statement for the month of November, FINANCIAL 1956 was submitted by the City Treasurer giving STATEMENT the bank balance as of November 30, 1956, $415,157.82 Receipts for November, $131,304.78, Disbursements for November, $153,46.87, Government Bondss$200,000, Interest on bonds, $13,450.75. Moved by Councilman Johnson, seconded by Councilman Romero and so ordered, statement be filed. Announcement was made of the League of California Cities Board of Directors meeting to be held January 3, 1957. League of Calif. Cities Letter was received from Squire West, realtor, with Board Meeting check for $22.50 enclosed for the rental of the property at 1201 N. San Gabriel Ave. He further stated the property was now vacant and that the Rental of $60.00 monthly fee, in his opinion, was excessive City Property and suggested $45.00 per month. Moved by Councilman Ortuno, seconded by Councilman Fawcett, rent be reduced to $45.00 per month for this property. There being no objections, motion so ordered. Letter was submitted addressed to Supt. Smith from M. A. Voisinet, District Manager of Southern Calif- Request by ornia Edison Company recommending the City reserve So. Cal.Edison an area approximately 150 ft by 200 ft adjacent to the existing substation on the north for future extension of the substation area. Moved by Councilman Ortuno, seconded by Councilman Romero this matter be referred to the Administrative Officer, City Engineer, City Attorney and Light & Water Supt, for report. It was recommended by the Planning Commission that relocation permits be granted to the following: 420 E. Second Street and 164 N. Soldano Avenue, subject to approval by the Council, due to the age Request for of the houses proposed to be moved in being over Relocation five years. It was the opinion of the commission Permits that these houses would be a definite improvement to the neighborhood. Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried, the recommendations of the Planning Commission be denied and no reloca- tion permits be issued for the houses as requested. i CITY HALL AZUSA, CALIF, DEC. 17, 1956 7:30 P.M. It was recommended by the Planning Commission, sitting as the Capital Improvement Committee, the City proceed with committed land acquisition, including sites for the library, central fire station, corporation yard and park land north of the plunge; any surplus to be set aside for the library building. Also that a bond issue be considered for financing the remainder of the program. Moved by Councilman Johnson that we do not acquire the land on Dalton Avenue, that we allow the library to be built where the Public Works Building now stands. This motion died for lack of second. A letter was submitted from the National Safety Council relative to the presentation of the Index and Safety Report at the January 17th meeting. It was recommended by the Mayor that the City bear the cost•of the luncheon.
