CITY HALL AZUSA, CALIF. MON., APR. 1, 1957 7:30 P.M.
The City Council of the City of Azusa met in regular session
at the above time and place.
Mayor Memmesheimer led in the salute to the flag. Flag Salute
Invocation was given by Rev. Ben Paroulek, of the First Invocation
Presbyterian Church.

Mayor Memmesheimer asked if there were any corrections or
omissions to the minutes of the regular meeting of March 18,
1957.
Councilman Johnson pointed out on page 5, last paragraph,

Clean-up Week

Attorney Williams stated Mr. Newton Anderson, Attorney for
the Bonding Company, had contacted him relative to surplus
funds of the City being in excess of the permitted amount.

The low bids submitted for the purchase of a 1 -ton truck for
the Fire Department were as follows:

Based on equipment and specifications furnished by the dealers,

Dates for the annual clean-up week were submitted for approval
of Council. These dates were for the period from April 27th

to May 4th, inclusive. A longer period of time, it was felt

would be more beneficial to the public.

Moved by Councilman Ortuno, seconded by Councilman Fawcett,
the dates of clean-up week to be set from April 27th to May
6th, inclusive, and that all City Departments cooperate
wholeheartedly in this program, to make it successful. There
being no objections, motion so ordered.
The Administrative -Officer submitted a request for a six -line
rotary switchboard to be installed in the City Clerk's office
and the employment of a switchboard operator -receptionist with
recommended salary at Range 21, $265.00 - $322.00 per month.
Moved by Councilman Ortuno, seconded by Councilman Fawcett,
that Administrative -Officer be authorized to proceed with this
installation of a switchboard, and the Personnel Board to
arrange an examination for switchboard-operator-receiptionist.

Request was submitted for authorization to advertise for bids
on asphaltic materials for the next year.
Moved by Councilman Fawcett, seconded by Councilman Ortuno
and so ordered, the Administrative Officer be authorized
to advertise for bids on asphaltic materials for the City,
specifications to be furnished by the Engineer and Public
Works Superintendent.
Councilman Romero entered the meeting at 8:00 P.M.
Mayor Memmesheimer announced that it was now 8:00 P.M., the
time set for the Hearing of Protests on Proposed Easterly
Annexation District No. 21.

The Clerk submitted Affidavits of Publication giving Notice Hearing on
of Proposed Easterly Annexation District No. 21, showing Easterly Anne*
that publications vias made in the Los Angeles Daily Journal ation District
on March 4, 1957 and March 11, 1957 and published in the No. 21
Azusa Herald and Pomotropic on March 4, and 11, 1957.
City Clerk submitted list of property owners to whom written
Notice of Proposed Easterly Annexation District No. 21 had
been mailed.
The Clerk stated that, upon examining the records of the Los
Angeles County Registrar, he found that there were fewer
than 12 registered voters in the area.
The valuation of the property located in the areas is as
follows: Land, $60,150; Improvements, $10,850;
Total $71,000.
There were no protests filed in the Clerk's office up to the
time of the Hearing.
At this time, 8:01 P. M., a written protest against annexing
to the City, signed by six property owners, was submitted.
Mayor Memmesheimer asked if there were anyone in the audience
who wished to be heard in regard to the proposed annexation.
The following people addressed Council protesting the inclusion
of their property within the proposed annexation: Action on
Robert G. Merrick, 18826 E. Fondale Street Hearing held
Mrs. Josephine Corbin, 5903 Ben Lomond Avenue over until
Robert West, 18834 Citrus Edge Avenue next meeting.
It was moved by Councilman Fawcett, seconded by Councilman
Ortuno, that action on this matter be held until the next
regular meeting, at which time an evaluation of the protests
will be given. Motion carried unanimously.
A letter of resignation from the..position of City Attorney
was presented by Mr. P. J. Tscharner, who also expressed
his thanks to the City Council for the considerations
extended to him during his years of service.
Moved by Councilman Fawcett, seconded by Councilman Ortuno,
the resignation of Mr. Tscharner be accepted, and the
Administrative Officer be authorized to write a letter of
commendation; the Chamber of Commerce to be asked to arrange
a testimonial dinner in his behalf. Motion carried by
unanimous vote.
Mr. Tscharner reported on the following cases being handled
by him which would need continued legal counsel:
(a) The case of Jehovah Witnesses vs the City of Azusa.
(b) The acquisition of a portion of a lot needed for the
widening of Vernon Avenue south of Third Street.
This property has been in litigation but is very
close to settlement.

(c) The acquisition of the lot at Slauson Park. The
Attorneys for the owner had been changed, but, upon
satisfaction of title by the Title Company, a
definite answer should be forthcoming soon.
(d) In the matter of City of Azusa vs Nicholas G. Abdelnour,
et al, condemnation involving the Abdelnour property
on Foothill Blvd. being acquired by the City for a
Fire Station. This case is set to go to trial in
Superior Court in Pomona, April 8th.
Moved by Councilman Romero, seconded by Councilman Fawcett,
that the City of Azusa retain the firm of Tscharner and
Tscharner to handle the unfinished legal cases previously
handled by P. J. Tscharner as City Attorney, to their con-
clusion. Motion carried by the following vote:

The Administrative Officer reported that the present contract
for garbage pick-up within the City expires on June 30th. Garbage pick -

The Administrative Officer reported that the committee set
up by Council to investigate the rubbish contract had come
to the conclusion, with the exception of the Administrative
Officer that the contract for a combined rubbish andgarbage
pick Zu Ibe negotiated with the present holder of the rubbish
contract, Western Disposal Company. The contractor has
rendered satisfactory service to the City and agrees to making
satisfactory payments for dumping privileges, in the event
the City should operate its own disposal facilities.

Request was made by the Light and Water Department that
Council re-establish policy relative to the divulging of
information about customers. Other utility companies have
been reciprocating with information to the City and this
plan has been working outsatisfactorily.

that information be given to utility companies on a recipro-
cal basis, and all other inquiries are to be cleared through
the Police Department. There being no objections, motion so
ordered.

Rock Company is unwilling to grant an easement on the portion
of ground necessary for the relocation of the power line in

Ortuno that condemnation proceedings be authorized to obtain
an easement on Consolidated Rock Company property.

Mrs. Wheatley requested Council to consider these trees with
regard to the hazardous condition created in some cases and
the need for trimming or removal.
It was moved by Councilman Romero, seconded by Councilman
Ortuno, the Public Works Supt. be authorized to remove or
trim, as needed, those trees considered to be of immediate
hazard. There being no objections, motion so ordered.
The Supt. of Public Works, upon investigation as to the best
type of skip -loader for use in the City's Street Department
reported the Tractomotive Loader Model TL -10 would best fit
the City's purposes: Cost of this item is $7,410.00 plus
sales tax.
Moved by Councilman Fawcett, seconded by Councilman Romero
this recommendation be accepted and purchase authorized for
a Tractomotive Loader at the cost quoted.
Motion carried unanimously.
It was requested by the Public Works Superintendent that
Martin Lopez be employed at the third step of Maintenance
Man I. The third step was recommended due to the experience
of this man in this line of work, also Mr. Lopez was No. 1
man on the eligibility list.
It was moved by Councilman Johnson, seconded by Councilman
Ortuno, Mr. Lopez be hired, on a probationary basis, at the
first step of the pay range, effective date April 16, 1957.
Motion carried unanimously.

The Administrative Officer reported that Ordinance No. 532
as adopted by the Council on March 18, 1957, and as published
in the Azusa Herald contained typographical errors. These
errors were the numbering of the Resolution setting forth the
date of protest Hearing on Annexation No. 20. The Resolution
number appeared in the Ordinance as "3526" but should have
appeared as "No. 3562".

discussion on changes that had previously been recommended,
and which are to be incorporated into the Ordinance. A
petition was submitted, signed by the members of the Azusa
Property Owners and Taxpayers Association relative to the
property between 1st and 5th Streets, and Azusa and Pasadena
Avenues, protesting the passage of the proposed zoning
Ordinance temporarily, and requesting that further consider-
ation be given to the matter of rezoning in that area.

Mrs. Brocamontes, 166 Dalton Avenue, protested the lack of
fire hydrants in the vicinity of Alameda and Soldano Ave.
at the intersection of Second Street; also the need of lights

that the Light Department Superintendent and the Fire Chief vicinity of

Request was submitted by the Police Department that the
adoption of the Rabies Ordinance be held over for further
study.

There being no objections, motion so ordered.
The Chorak Construction Company submitted a claim in the
amount of $7,895.99 in relation to Project No. 155, the
construction of sanitary sewers on Vernon and McKeever
Avenues and Foothill Blvd. This contract, by mutual agree-
ment, was terminated before the sewers were installed on
Foothill Blvd., however, the Attorney and Engineer felt,
upon investigation, that the charge should be allowed on
the project.
This item was in the amount of $600.00 and check in this
amount would be transmitted to the Chorak Company and its
Attorney, if approved by Council.
Moved by Councilman Johnson, seconded by Councilman Ortuno
the recommendation for settlement be accepted and check in
the amount of $600.00 be transmitted in settlement of all
claims by the Chorak Construction Company. Motion carried
by unanimous vote.
The matter of the Northside Park alley was reported on by
the Administrative Officer who stated that there was a
possibility of future litigation by residents, who had
purchased land from the City, and who wished ingress and
egress to their property, in the event that the alley would
be blocked off.

this matter be tabled. Motion ordered carried.
7:30 P.M.
A letter was received from the State Compensation Insurance
Fund stating a claim has been filed against Clarence E.
Evans, who was involved in the accident of Feb. 11, 1955,
in which Rolf B. Magnell, former police officer, was injured.
The City of Azusa may make a claim also against Mr. Evans
for compensation paid Mr. Magnell in the amount of one
year's salary. it was recommended by the City Attorney
that Council request State Compensation Insurance Fund
Attorney to represent Azusa in this claim to avoid any
duplication of efforts.
Moved by Councilman Ortuno, seconded by Councilman Fawcett
the Administrative Officer contact the State Compensation
Insurance Fund attorney relative to his representing the
City of Azusa in its claim against Clarence E. Evans for
compensation paid to Mr. Magnell. There being no objections,
so ordered.
The Tentative Requirements for the disposal of refuse in
Van Tassel Canyon set forth in Resolution No. 57 of the
Regional Water Pollution Control Board was forwarded to
the Council members for study. Certain requirements were set
forth relative to the prevention of odors or unsightliness

Further comments and recommendations were pointed out
with respect to the policy of the County of Los Angeles
regarding utilization of water courses in a manner adverse
to flood control and water conservation.
Moved by Councilman Romero, seconded by Councilman Fawcett,
the Administrative Officer write the Regional 'dater Pollu-
tion Board requesting that the application by the City for
approval of a municipal dump be removed from their agenda
until such time as the City is ready to act upon the estab-
lishment of a disposal site. Motion carried by unanimous vote.

its consent to the commencement of Rnnexation proceedings
for territory designated as Annexation District No. 24,
and located south of Gladstone Street, extending westerly
from Donna Beth Avenue to the Little Dalton Wash, then
northerly to Payson Street and extending west to proposed
city limits of Irwindale, then north to Gladstone and east

A report was submitted by the City Treasurer stating that Repurchase of
$50,000 Treasury Bills, now owned by the City, have the Treasury
following maturity date, April 18, 25, May 2, 9, 31, 1957. Bills
Authorization is requested from the Council for the City authorized.
Treasurer to repurchase Treasury Bills in similar amounts
upon the maturity of the above mentioned bills.
Moved by Councilman Johnson, seconded by Councilman Fawcett
the Treasurer be instructed to repurchase 91 day Treasury
Bills, as listed, upon date of maturity in similar amounts,
as recommended by the City Treasurer. Motion carried unanimously.
The Guadalupe Society of Irwindale requested permission to
hold a dance at the St. Frances Parish Hall on Saturday,
April 27th, 1957.
Moved by Councilman Fawcett, seconded by Councilman Ortuno
request be referred to the Police Department with power to
act. Motion carried unanimously.

Notice of the meeting of the Los Angeles County Division Cal.League
of the California League of Cities will be held April 4th, Cities meeting

Announcement was made of the meeting of Area D, Civil Defense Civil Defense
held on March 18, 1957, in Monrovia, Report given by meeting
Administrative Officer Miller.
Moved by Councilman Johnson, seconded by Councilman Romero,
notice and report be filed. There being no objections,
motion ordered carried.
The Administrative Officer asked if the Council wished further
negotiations to beheld with representatives of the Azusa
Agricultural Water Company relative to the possible purchase
by the City, of the outstanding stock of the company. Pre-
liminary meetings had been held with Attorney Williams and
John Williamson representing the City.
Moved by Councilman Johnson, seconded by Councilman Romero,
James M. Montgomery be authorized to make an appraisal of
stock and properties of the Azusa Agricultural Water Company
and submit a report to Council. Motion was carried by a
unanimous vote.
