Motion carried unanimously. The question of appointing an Attorney to institute condemna- tion proceedings relative to clearing the approaches to the proposed heliport site, was discussed. Discussion Attorney Williams stated that he did not feel he should relative to represent the City in this matter due to his business associa- heliport sit tion with interested parties. The Administrative Officer stated that the Consolidated Rock Products Company would offer the City a License Agreement for the use of the portion of their property needed for the re- location of power lines. This license agreement would contain a 90 day cancellation clause. It was the opinion of the Attorney that, if the 90 day clause was invoked the City would have time to enter condemnation proceedings. Councilman Fawcett entered the meeting at 8:30 P.M. Moved by Councilman Romero, seconded by Councilman Ortuno, that the City Council consider the License Agreement proposed by the Consolidated Rock Company. License Motion was carried by the following vote: Agreement by AYES: Councilmen: Ortuno, Romero, Memmesheimer Consolidated NOES: Councilman Johnson Rock to be Councilman Fawcett- stated that he wished to abstain from voting considered having just entered the meeting. 1 CITY HALL AZUSA, CALIF. APRIL 9, 1957 7:30 P.M. Authorization was requested by Counsel to employ expert witnesses in the condemnation suit of City of Azusa vs. Abdelnour et al. Attorney P. J. Tscharner, of the firm of Tscharner and Tscharner, counsel 2)r the City in the matter, set forth the justification for the employment of additional expert witnesses. It was moved by Councilman Fawcett, seconded by Councilman Memmesheimer, that Counsel for the City be authorized to employ expert witnesses as needed in connection with the condemnation proceedings of City of Azusa vs N. and M. Abdel- nour, et al. Motion carried by the following vote: AYES: Councilman: Fawcett, Ortuno, Memmesheimer NOES: Councilmen: Johnson, Romero The Administrative Officer stated that a letter had been pre- pared requesting the Water Pollution Board to remove from their agenda -the matter of the Van Tassel disposal site re- quirements requested by the City of Azusa. A hearing on this item was set for April 18th. After discussion, it was the opinion of the Council the letter to the Water Pollution Board should not be sent in order that a determination of the requirements could be obtained from the Board. Moved by Councilman Romero, seconded by Councilman Fawcett that the action taken by the City Council at the meeting of April 1, 1957, directing that a letter be forwarded to the Water Pollution Board requesting the matter of the Van Tassel Canyon be removed from the agenda, be rescinded. Motion carried by the following vote: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None It was moved by Councilman Fawcett that the Administrative Officer direct a letter to the Water Pollution Board requesting that the requirements for the side canyons be considered at this time and that the matter of the main canyon requirements be withdrawn. Motion withdrawn. The City Engineer stated that a field inspection would be made of the canyons prior to the date of the Hearing. It was moved by Councilman Fawcett, seconded1by Councilman Ortuno, that the Administrative Officer request Mr. John A. Williamson to appear at the Hearing of the Water Pollution Board on behalf of the City. Motion carried by the following vote: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None The Administrative Officer read copy of a letter addressed to Senator Richard Richards protesting the passage of Senate Bill 2521 which would abolish the State Division of Housing, It was moved by Councilman Fawcett, seconded by Councilman Romero, letter be mailed to senator Richards protesting in behalf of the City. Motion was carried unanimously. Announcement was made of the invitation to attend the Installa- tion of Officers of V.F.W. on Saturday April 27th, 1957. Request was submitted for a car allowance in the amount of $60.00 per month for the City Engineer. Discussion was held on the comparable expense of City -owned cars. Moved by Councilman Ortuno, seconded by Councilman Fawcett, a Resolution be authorized allowing car expense in the amount of $60.00 per month to the City Engineer. APRIL 9, 1957 The proposed Zoning Ordinance was given further consideration, especially in the matter of lot sizes and with the opinion expressed that lots of record, with a frontage of less footage than required in the proposed Ordinance be allowed. It was moved by Councilman Johnson that this proposed Zoning Ordinance be tabled permanently, and the Planning Commission be instructed to prepare such amendments to Ordinance 409 as may be necessary, giving due notice in each case to all persons affected in the manner provided by law, and that Ordinance No. 501 be rescinded. Motion failed for lack of second. The matter of widths of sideyards on each side and on the street side of corner lots was discussed. Moved by Councilman Ortuno, seconded by Councilman Romero the following changes be referred to the Planning Commission for their recommendation and reports. 7:30 P.M. Section 9230.70 paragraph c: "In C-2 Zone: Advertising signs, structures and devices used for outdoor advertising not exceed- ing two in number on any lot or parcel ofland and not exceeding a total of 100 square feet in area which may indicate the person occupying the premises, the business conducted by him on the premises or the goods produced or sold on the premises and shall contain no other advertising matter. If there are two or more separate businesses on the same lot or parcel of land, and the restriction of not more than two signs would constitute an unnecessary hardship, and in permitting more than two signs the spirit of this section can be observed, public safety secured, and substantial justice done, the Planning Commission may permit additional signs and sign area. Section 9208.30 Minimum Lot Size. The lot size requirements shall be as follows: (a) In R -la Zone, every lot shall have a minimum width at the building line of ei hty (80) feet and a minimum area of ten thousand (10,000 square feet. (b) In R -lb Zone, every lot shall have a minimum width at the building line of seventy (70) feet and a minimum area of seven thousand five hundred (7,500) square feet. (c) In R -lc Zone, every lot shall have a minimum width at the building line of sixty (60) feet and a minimum of area of six thousand (6,000) square feet. 291 Zoning Ordinance Recommended changes in Zoning Ordinance provided, however, that where a lot has less width or less area than required by this Ordinance and was held under separate owner- ship or was of record at the time this Ordinance became effective such lot may be occupied by any structure or use permitted in the zone in which it is located. Subsection 9208.40 (b) A side yard of at least ten (10) percent of the width of the lot on each side of the lot; provided that in no case shall the required side yard be less than three (3) feet nor more than five (5) feet in width; provided further that there shall be a side yard of at least ten (10) feet in width on the street side of a corner lot in the R -lb and R -lc Zone and at least twelve and one-half (12 1/2) feet in the R -la Zone. Section 9209.30 - Minimum Lot Size Every lot shall have a minimum width at the buildin line of sixty (60) feet and a minimum area of six thousand (6,000) square feet provided, however, that where a lot has less width or less area than required by this Ordinance and was held under separate ovinership or was of record at the time this Ordinance became effective, such lot may be occupied by any use permitted in the R-2 zone. 292 293 CITY HALL AZUSA, CALIF. Council then held further discussion during which time Council- man Ortuno wished public clarification made on the rumor that there would be no change in the re -zoning of the 25 ft. lots, since he had been in favor of having this zoning revert to the former classification of R -lc.
