HomeMy WebLinkAboutE-10 Staff Report - Annual Progress Report (APR) CONSENT ITEM E-10 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: SERGIO GONZALEZ, CITY MANAGER VIA: MATT MARQUEZ, DIRECTOR OF ECONOMIC AND COMMUNITY DEVELOPMENT DATE: MAY 6, 2019 SUBJECT: GENERAL PLAN HOUSING ELEMENT ANNUAL PROGRESS REPORT (APR) FOR 2018 CALENDAR YEAR. BACKGROUND: Each year, California local agencies – cities and counties – are required to prepare an annual progress report (APR) on the status of implementing the General Plan’s Housing Element and submit the report to the State Department of Housing and Community Development (HCD) and the Governor’s Office of Planning and Research (OPR). Using a form provided by HCD, Staff provides data to show housing unit production across affordability levels, a listing of development applications received, building permits issued, provides an update on housing program implementation, and other topics. The annual report shall be provided to the legislature (City Council) prior to sending it to HCD and OPR. However, please note that Staff has already submitted the APR to ensure the report was submitted to the State prior to the April 1st deadline. Further, if the City Council requests additional revisions to the APR, Staff is permitted to submit an amended report to HCD and OPR if necessary. On April 10, 2019, the Planning Commission reviewed and recommended approval of the General Plan Housing Element annual progress report (APR) for 2018 calendar year as amended. RECOMMENDATION: Staff recommends that the City Council the following action: 1. Authorize Staff to submit the 2018 Housing Element APR; and 2. Adopt Resolution No. 2019-C16 - A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF AZUSA, TO RECEIVE, ACCEPT AND APPROVE THE HOUSING ELEMENT ANNUAL PROGRESS REPORT FOR CALENDAR YEAR 2018 AND AUTHORIZE ITS SUBMITTAL TO THE CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT AND THE GOVERNOR’S OFFICE OF PLANNING AND RESEARCH. General Plan Housing Element Annual Progress Report (APR) for Calendar Year 2018 May 6, 2019 Page 2 of 5 ANALYSIS: Per California Government Code section 65400, the City is required to provide a General Plan Housing Element annual progress report (APR) for submittal to City Council, HCD, and OPR by April 1st of each year. The purpose of this is to provide the aforementioned agencies/bodies a status report on meeting the City’s fair share of the Regional Housing Needs Allocation (RHNA) as required by California Government Code section 65584. At this time, it is unclear to Staff as why it was not done in previous years but moving forward, Staff will be preparing the reports in a timely manner. The City Council adopted an update to the City’s Housing Element on October 21, 2013 (Resolution No. 13-C79), which is effective from 2014-2021. The Housing Element is one of seven mandated elements of a City’s/County’s General Plan and includes information related to the City’s existing housing needs, population analysis, employment trends, household characteristics, inventory of land suitable for residential development, and goals, policies, and programs intended to meet the identified housing needs and state-mandated requirements. The following table represents the City’s RHNA (excerpt from the 2014 General Plan Housing Element): Staff has prepared the 2018 Azusa Housing Element Annual Progress Report (APR) included as Attachment 1. Some of the highlights of the year include: New Applications Received and Processed The City of Azusa’s Planning Division received a total of 25 applications for new residential construction in 2018. Of those, a total of 343 new residential units were proposed and a total of 306 residential units were approved throughout the year. Some of the applications that were reviewed and approved in 2018 include: • Design Review No. DR-2018-12 – The Orchard mixed-use project featuring 163 residential units, • Design Review No. DR-2018-15 – The Avenue mixed-use project featuring 127 residential units, • Two duplexes for a total of four dwelling units, and • Ten accessory dwelling units (ADUs). General Plan Housing Element Annual Progress Report (APR) for Calendar Year 2018 May 6, 2019 Page 3 of 5 Building Permits Issued The City of Azusa’s Building Division issued a total of 189 residential building permits for construction. Some of the building permits issued include: • 84 units at the Citrus + Palm townhome development located in Rosedale, adjacent to the APU/Citrus College Gold Line station, • 6 units at the Metro Walk townhome development adjacent to the Azusa Downtown Gold Line station, and • 60 units at the Gladstone Senior Villas located on Gladstone Street. Housing Element Programs The City made progress in implementing the goals and programs of the Housing Element. Table D of the City’s 2018 APR below shows some of the existing programs in the 2014-2021 Housing Element that are in the process of being implemented: Table D Program Implementation Status pursuant to GC Section 65583 Housing Programs Progress Report Describe progress of all programs including local efforts to remove governmental constraints to the maintenance, improvement, and development of housing as identified in the housing element. 1 2 3 4 Name of Program Objective Timeframe in H.E Status of Program Implementation Single-Family Rehabilitation Program Provide 25 grants and loans annually, to assist a total of 150 households during the 2014-2021 planning cycle. Continue to allocate Redevelopment Set-Aside, CDBG, and HOME funds for this program. 2014-2021 Ongoing Rental Housing Inspection Program Continue to administer the rental inspection program to ensure properties remain safe and well maintained, preserving existing affordable housing in the City. 2014-2021 Ongoing Mixed-Use Sites Continue to facilitate the construction of residences in mixed-use developments. 2014-2021 Ongoing Senior Housing Continue to provide appropriate standards to encourage development of senior housing to meet the needs of the City’s growing senior population. Focus a portion of Redevelopment Set-Aside Funds toward the development of senior housing. 2014-2021 Ongoing General Plan Housing Element Annual Progress Report (APR) for Calendar Year 2018 May 6, 2019 Page 4 of 5 Alternative Housing Models Facilitate the development of alternative housing models suited to the community housing needs through the provision of flexible zoning regulations. 2014-2021 Ongoing Density Bonus/Development Incentives Continue to comply with State law for density bonuses as a means to facilitate affordable housing development. Continue to allow waivers of covered parking requirements for affordable housing units, consistent with existing Development Code Section 88.36.080. 2014-2021 Ongoing Residential Densities on Identified Sites As part of the Preliminary Plan and Design Review processes, continue to evaluate new projects for consistency with General Plan objectives as they relate to housing and the RHNA obligations. 2014-2021 Ongoing Progress Toward Meeting Regional Housing Needs Allocation (RHNA) Table B of the City’s 2018 APR below shows the City’s progress toward RHNA in 2018 but not the previous years as Staff did not submit the required reports from 2013-2017. Please note that Staff submitted those reports at the end of last year (2017) but they are not reflected on the table below and cannot be inputted since the form is auto-populated and locked from editing by HCD. It is important to note that RHNA is to serve as a guide for future housing development/construction and it is not necessarily a requirement. Per California Government code section 65584(a)(2), “It is the intent of the Legislature that cities and counties should undertake all necessary actions to encourage, promote, and facilitate the development of housing to accommodate the entire regional housing need, and reasonable actions should be taken by local and regional governments to ensure that future housing production meets, at a minimum, the regional housing need established for planning purposes.” As such, although it is strongly encouraged that cities and counties meet RHNA goals, they will not be penalized if they fail to do so. FISCAL IMPACT: There is no fiscal impact associated with the City by authorizing Staff to submit an amended Housing Element APR. Exhibit A – City of Azusa’s Housing Element Annual Progress Report for Calendar Year 2018 RESOLUTION NO. 2019-C16 A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF AZUSA, TO RECEIVE, ACCEPT AND APPROVE THE HOUSING ELEMENT ANNUAL PROGRESS REPORT FOR CALENDAR YEAR 2018 AND AUTHORIZE ITS SUBMITTAL TO THE CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT AND THE GOVERNOR’S OFFICE OF PLANNING AND RESEARCH WHEREAS, California Government Code Section 65400(a)(2) requires the planning agency to provide an annual report to the City Council, the Governor’s Office of Planning and Research (OPR), and the State Department of Housing and Community Development (HCD) regarding progress toward implementation of the housing element of the general plan; and WHEREAS, in accordance with these requirements and in the interest of time, Planning Staff on March 28, 2019, reviewed and submitted the annual report to the Governor’s Office of Planning and Research (OPR), and State Department of Housing and Community Development (HCD); and WHEREAS, on April 10, 2019, the Planning Commission of the City of Azusa (“Planning Commission”) adopted Resolution No. 2019-PC08 recommending to the City Council of the City of Azusa (“City Council) to receive, accept, and approve the Housing Element Annual Progress Report (APR) for calendar year 2018 and authorize its submittal to HCD and OPR as amended; and WHEREAS, the City Council has reviewed the annual report and affirms its compliance and consistency with the requirements prescribed by law; and WHEREAS, the City Council desires to submit the annual report to the City Council with its recommendation for retroactive approval and acceptance; and WHEREAS, the City Council has reviewed all written evidence and oral testimony presented to date. NOW, THEREFORE, CITY COUNCIL FOR THE CITY OF AZUSA, DOES HEREBY RESOLVE AND FIND AS FOLLOWS: Section 1. Recitals. The recitals set forth above are true and correct and are incorporated into this Resolution by this reference. Section 2. CEQA Compliance. The submittal of the City’s Housing Element’s Annual Progress Report through this Resolution does not commit the City Council to any action that may have a significant effect on the environment. As a result, such action does not constitute a project subject to the requirements of the California Environmental Quality Act. The City Council of the City of Azusa based on substantial evidence in the administrative record of proceedings and pursuant to its independent review and consideration, does hereby receive and accept the annual progress report on the Housing Element (Exhibit A), attached and incorporated by reference herein, and authorize the submittal of the report to the Governor’s Office of Planning and Research and the State Department of Housing and Community Development pursuant to Government Code Section 65400(2) without amendment. Section 4. Severability. If any provision of this Resolution or the application of any such provision to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are severable. The City Council would have adopted this Resolution irrespective of the invalidity of any particular portion of this Resolution. Section 5. Certification.
