AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA
AMENDING PARAGRAPH 2 OF SECTION 5.08.070 OF, AND ADDING
SECTION 5.20.070 TO, THE AZUSA MUNICIPAL CODE RELATING
TO ORGANIZATIONS ENGAGED IN CHARITABLR SOLICITATIONS.
The City Council of the City of Azusa does ordain as
follows :
SECTION 1 . Paragraph 2 of Section 5.08.070 of the Azusa
Municipal Code is amended to read :
" (2) The provisions of this title shall not require a license
fee to be paid by any person for engaging in commerce with foreign
nations or among the several States or with the Indian tribes.
The provisions of this title shall not require a license fee to
be paid by any clergyman or church or religious, fraternal, charit-
able, benevolent or non-profit corporation for activities carried on
by him or it for religious, charitable or benevolent purposes, prov-
ided, however, that nothing in this section shall exempt any such
person from complying with the provisions of Section 5.20.070 re-
quiring such person to obtain a permit (but without paying a license
fee ) from the City Council or officer, to carry on any such religious,
charitable or benevolent activity. "
SECTION 2. Section 5.20.070 is added to said code to read :
"5.20.070. Charitable Solicitations - Permit.
Except as otherwise granted by the City Council, no fee-exempt
permit shall be issued to any charitable, philanthropic, benevolent
organization or non-profit corporation to solicit contributions of
cash or property or to engage in the sale of merchandise within the
city unless the following information is filed annually in the Office
of the City Clerk:
(a ) A copy of a determination letter from both the United
States Internal Revenue Service and the California State
Franchise Tax Board declaring that the organization or
non-profit corporation is exempt from the Federal and State
income taxes .
(b ) A list of the names and addresses of all officers of the
organization or non-profit corporation and the names and
addresses of all persons responsible for the activity for
which the application for the permit is being made .
(c ) A specific statement of all contributions collected or
received by the organization or non-profit corporation
within the year immediately preceding the date of the
filing of the application and the expenditure or use
made of such contributions, including the names and
amounts paid to all persons as _ages, compensation or
commissions from such contributions .
(d) Such other information as may b-e reasonably requested by
the City Clerk. "
SECTION 3. The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be published as required by law . •
