Mayor Memmesheimer led in the salute to the flag. Flag Salute Invocation was given by Rev. R. W. Durnel of the Emmanuel Invocation Baptist Church. Present at Roll Call: Councilmen: Fawcett, Ortuno, Johnson, Romero, Roll Call Mayor Memmesheimer Also Present: City Engineer Kirkgaard, City Attorney Williams City Clerk/Administrative Officer Miller Mayor Memmesheimer asked if there were any corrections or omisssions to the Minutes of the meeting of May 6th. At the meeting of May 6th, Minutes were corrected of the following meetings - April 9, 15 and 23rd. The Minutes should show that the correction to the Minutes of April 1st relative to Northside Park Alley appearing on Page b should Minutes of state that the motion was "ordered carried". 5/6/57 The Minutes of May 6th should be corrected as follows: approved On Page 6, item relative to Resolution No. 3603 should be shown that the motion on waiving of further reading of the Resolution should contain the word "further" instead of the incorrect word "second". There being no further omissions or corrections, the Minutes of May 6th were approved as corrected. Mayor Memmesheimer askef if there were any corrections or Minutes of 5/14/57 omissions to the Minutes of May 14, 1957. approved There being no corrections or omissions, the Minutes were accepted as submitted. The Administrative Officer reported that he had contacted the present holder of titles of the Tract proposed to be annexed to the City and designated "Easterly Annexation District No. 21". It was stated that Mr. Al Berg whose address is 6399 Easterly Wilshire Blvd., Los Angeles, owned 97% of the stock in the Annexation Corporation now in possession of the Tract. District 21 Mr. Berg appeared before Council and stated that at this No. time he wished proceedings in the Annexation to remain in a status quo, and that future buyers determine whether they wish to annex to the City. Discussion was held by the Council relative to the proceedings of Annexation District No. 21. It was moved by Councilman Johnson, seconded by Councilman Romero that the City Council abandon all proceedings in Easterly Annexation District No. 21 and that the City Attorney be instructed to prepare the necessary Ordinance disapproving the Annexation. Motion failed by the following vote: AYES: Councilmen: Johnson, Romero NOES: Councilmen: Fawcett, Ortuno, Memmesheimer ABSENT: Councilmen: None Further discussion was held on the desirability of the City Council to proceed with the Annexation at this time. It was suggested by Mayor Memmesheimer that in view of the statements of Mr. Berg and the manner in which the title'of the property had appeared on.the Tax Roll, that reconsideration should be made by the Council. It was moved by Councilman Fawcett, seconded by Councilman Romero that the City Council reconsider their vote previously taken to abandon all proceedings in Easterly Annexation District No. 21 and rescind this motion. Motion carried by the following vote: AYES: Councilmen: Fawcett, Johnson, Romero, Memmesheimer NOES: Councilmen: Ortuno ABSENT: Councilmen: None CITY HALL AZUSA, CALIF. Mon., MAY 20, 1957 7:30 P.M. Moved by Councilman Johnson, seconded by Councilman Romero, that Annexation proceedings on Easterly Annexation District No. 21 be discontinued and that the City Attorney be instructed to prepare the Ordinance abolishing said proceedings. This motion carried by the following vote: AYES: Councilman: Fawcett, Johnson, Romero, Memmesheimer NOES: Councilman: Ortuno ABSENT: Councilmen: None Request for employment of a Journeyman -Lineman remained tabled until such time as the appointment of a Working Foreman has been made. It was recommended by the Administrative Officer that the re- quest for the employment of an Estimator in the Electric Department should be tabled until further consideration can be made of the duties in this classification. Moved by Councilman Fawcett, seconded by Councilman Romero that this matter be tabled temporarily. With no objections motion ordered carried. Administrative Officer stated that a representative of the State Division of Highways had conferred with Supt. Smith of the Water Department and the City Engineer on the matter of re- locating the water line on Azusa Avenue, south of First Street, to Gladstone Street. It was pointed out]by Supt. Smith that the State would finance the installation of a 10" line along this route, however, it was recommended by the City Engineer that a 20" line would be more feasible for the City to install. Supt. Smith stated further .that the State requested -this work be done as rapidly as.possible since they expected to be work- ing that area in July. 341 Ord, to be prepared abolishing proceedings Re: Annex. Smith stated that the project previously authorized for the installation of water line on Gladstone Avenue, between City Clerk t Azusa Avenue and Pasadena Avenue, should be reconsidered in advertise fo the light of Montgomery's report and that an 18" line be in- bids for pip stalled in that area. Moved by Councilman Fawcett, seconded by Councilman Romero that the City Clerk be authorized to advertise for bids on the required amount of 18" pipe and 20" pipe, specifications to be furnished by the Supt, of Water and the City Engineer, with bids to be opened on June 17th at 10 A.M. in the Office of the City Clerk. Motion carried unanimously. Moved by Councilman Romero, seconded by Councilman Ortuno that Plans and the City Engineer be instructed to prepare the necessary plans Specs for and the specifications for the installation of the water lines water line on Azusa Avenue and on Gladstone St., these plans and specs to Council to be submitted to the Council at the meeting of June 3rd. 6/3/57 Motion carried unanimously. It was requested by the Police Chief and the Fire Chief that permission be granted to send one man from each Dept. to the Arson and Fire Investigation Seminar to be held June 10 through 15th, 1957, at the University Extension at U.C.L.A. Permission Moved by Councilman Romero, seconded by Councilman Ortuno that granted request of the Police and Fire Chiefs be granted and that a attendance man from each Department be allowed to attend the Seminar at at Arson & U.C.L.A., with expense allowance advanced in the amount of Fire Invest. $40.00 each, plus mileage for one car. This motion carried Seminar unanimously. Robert Edborg, Police Officer, now on Leave of Absence sub- Resignation; mitted his letter of resignation from the Police Dept. R. Edborg, Moved by Councilman Ortuno, seconded by Councilman Fawcett Police Dept, and unanimously carried that the resignation of Robert Edborg be accepted, effective as of May 20, 1957. Police Chief Kendrick requested confirmation of this appoint- ment of Dvid J. McCullen as a Patrolman on a probationary 342 343 CITY HALL AZUSA, CALIF. MON., MAY 20, 1957 7:30 P.M. basis, effective June 1, 1957. Moved by Councilman Romero, seconded by Councilman Fawcett that Appt. of the appointment of David McCullen as a probationary Patrolman McCullen, in the Police Dept, at Step 1 of the Salary Range, effective Patrolman June 1, 1957, be confirmed. Motion carried by the following vote: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilman: Johnson ABSENT: Councilmen: None Dr. Hankins of North Orange Avenue, one of the property owners interested in the establishment of an alley at Northside Park, Meeting to b appeared before Council and stated that the authorized meeting held re: between the property owners and membersof the Park and Recrea- alley at tion Commission had not been held up to this time. The Admini- Northside strative Officer was directed to forward a letter to the Park Park and Recreation Commission requesting a joint meeting be held with interested property owners and the Commission at the earliest possible time. A request for a relocation of a single-family residence was submitted by Rev. R. W. Durnal, Emmanuel Baptist Church. The house to be relocated is now situated at the southwest corner Relocation o of Puente Avenue and Azusa Avenue, Covina, and is to be re- house to located at 1121 North Azusa Avenue and is to be used as the 1121 N. Azus parsonage for the church. (Emmanuel Administrative Officer and Councilman Ortuno stated that they Baptist had inspected the house, which appeared to be in good condition Church) and quite presentable, and also viewed the site where it was to be relocated. The address on North Azusa Avenue, in their opinion, would not be affected in a detrimental way by the locat- ing of this house at that address. Moved by Councilman Fawcett, seconded by Councilman Ortuno that the request for the relocation of the house to 1121 N. Azusa Avenue be granted, subject to the fulfilling of all re- quirements proposed by the Building Department, and the deposit of necessary bonds for corrections. Motion carried by the following vote: AYES: Councilmen: Fawcett, Ortuno, Johnson, Memmesheimer NOES: Councilmen: Romero ABSENT: Councilmen: None Fire Chief Madison requested permission to attend the Pacific Coast Inter -Mountain Association of Fire Chiefs' Conference to be held at Portland, Oregon, on July 16th through July 19th inclusive. Moved by Councilman Johnson that this request be denied. This motion failed for lack of a second. Moved by Councilman Romero, seconded by Councilman Ortuno that the request of the Fire Chief to attend the Conference be granted, with expenses allowed in the amount of 50.00 plus mileage. This motion carried by the following ote: AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None Fire Chief granted per- mission to attend Conference, Portland, Oregon It was recommended by the Park and Recreation Commission that Spec. Office a Special Officer be assigned to Slauson Park during the summer for Slauson season as has been done in the past years. Park for Moved by Councilman Romero, seconded by Councilman Ortuno that summer. this recommendation be accepted and that -the Police Chief be authorized to direct an Officer be stationed at Slauson Park, effective on the opening date of the Plunge. This motion carried unanimously. It was recommended by the Park and Recreation Commission that the request submitted by the Jr. Chamber of Commerce and the Jr. Woman's Club for permission to use Memorial Park for a fireworks display on July 4th be granted. It was also recommended that.the band shell in the City Park be made available for band concerts this summer, as it was in the past. Moved by Councilman Fawcett, seconded by Councilman Romero that these recommendations be accepted, subject to the filing of Liability Insurance holding the City harmless in the matter of the Fireworks display. Motion carried unanimously. It was brought to the attention of the City Council that the Aguilar, Park term of Anthony Aguilar as a member of the Park and Recreation & Rec. Comm. Commission expired as of June 1, 1957, term expires Mayor Memmesheimer stated that he would submit a name at the 6/1/57 next meeting of the Council for approval. It was requested by the Supt. of Public Works that a full-time Custodian be employed. It was recommended that ##1 man on the Civil Service List be appointed. It was moved by Councilman Romero, seconded by Councilman Fawcett that the #1 man on the Civil Service List (Herbert Zube) be appointed Custodian on a probationary basis at Step 1 of the Salary Range, effective June 1, 1957. This motion carried unanimously. It was requested by the Supt, of Public Works that he be authorized to employ a Carpenter at the regular Union Scale, to be used as needed. It was pointed out that the prevailing Union Scale is $3.00 per hour. It was moved by Councilman Romero, seconded by Councilman Fawcett that the request be granted and that the Supt. of Public Works be authorized to employ a Carpenter as needed at the hourly rate of $3.00 per hour. This motion carried unanimously. Custodian appointed - H. Zube Carpenter to be employed as needed. It was requested by the Supt, of Public Works that an examina- tion be held for fiIling the position of Park Foreman. Dis- Request for cussion was held on the authorization for discharging an exam, for employee while serving on a probationary basis. Section 79 Park Foreman of the Rules and Regulations of the Personnel Board gives the authority to the Department Head for the discharge of any employee serving a probationary period. The question arose as to whether or not the Rules and Regulations of the Personnel Board had been adopted by the City Council or if it was necessary for the Council to adopt the Rules and Regulations. The City Attorney and Administrative Office were instructed to investi- gate this matter. Supt, of Public Works Brusnahan defended his position in dis- charging the Park Foreman who was serving his probationary period. Moved by Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried that the City Council ratify the act of the Supt, relative to the discharge of the Park Foreman. It was moved by Councilman Ortuno, seconded by Councilman Fawcett and unanimously carried that the Personnel Board be authorized to hold an examination for the position of Park Foreman. The City Engineer reo_uested that the City Council consider waiving the qualification of applicants for the position of Engineering Assistant as to the necessity of being a qualified voter in California. It was pointed out that the Civil Service Ordinance allows waiving of this qualification, if in the opinion of the City Council and the Personnel Board, that said requirement is detrimental to recruitment of qualified personnel. It was moved by Councilman Romero, seconded by Councilman Fawcett and unanimously carried that the Personnel Board be notified that in the opinion of the City Council, the re- quirement of being a qualified voter of the State of California be waived in the recruitment of Engineering Assistant, and that they also consider this item. This motion carried unanimously. Examination authorized Council agrees to waiving of qualified voter requi; ment for Engr. Ass' 346 347 CITY HALL AZUSA, CALIF. MON., MAY 20, 1957 7:30 P.M. The City Engineer reported that the estimated cost for aving islands on Gladstone Street, east of Citrus Avenue was 2200.00, but that a more definite cost could be established after plans Paving of of the islands have been received from the County Office. It was moved by Councilman Romero, seconded by Councilman Ortuno that this matter be tabled until a more accurate cost estimate is reported. With no objections, Motion ordered carried. It was reported that in connection with the installation of the sewer line north of 11th Street, that forms of Deed of Easement had been mailed to the property owners for their execution. The City Engineer submitted conditions which he felt City Tract No. Council should consider before granting approval to the Tract 20502 Map #20502 (Study #10). Tract #20502 is located on Gladstone Street between Pasadena Avenue and Cerritos Avenue, covering an area of approximately 20 acres. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that the City Attorney and City Engineer meet with the owners of the property for discussion of the con- ditions set forth by the Engineer; this meeting to be held prior to the time the map is submitted for Council approval. Councilman Johnson offered for its second and final reading an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, COUNTY Ordinance OF LOS ANGELES, STATE OF CALIFORNIA, PROVIDING FOR THE LICENS- No. 538 - ING, REGULATING, IMPOUNDING, VACCINATION AND REVACCINATION Rabies WITH RABIES VACCINE OF ALL DOGS, AND FOR THE CONTROL OF DANGER- Vaccinatior OUS AND BARKING DOGS, TESTING FOR RABIES OF DOGS THAT HAVE BITTEN HUMAN BEINGS, AND PROVIDING FOR FEES IN CONNECTION WITH IMPOUNDING AND HANDLING OF DOGS AND OTHER ANIMALS, AND RESCIND- ING OF ORDINANCES NO. 437, 439 and 452. Resolution No. 3609 - Conditional Use Permit for Parking Purposes Resolution No. 3610 Promotion of Good Busines Climate Moved by Councilman Romero, seconded by Councilman Ortuno that this Resolution be adopted. Resolution was then passed and adopted by the following vote: AYES: Councilmen: Fawcett, Ortuno, Johnson, Romero, Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: None and numbered Resolution No. 3610 A copy of the proposed Mutual Aid Agreement for fire services between the Cities of West Covina, Covina, Glendora, and Azusa was submitted to the Council for their consideration. Moved by Councilman Johnson, seconded by Councilman Fawcett that the Mayor be authorized to sign such a Mutual Aid Agree- ment for fire services, and the City Clerk to attest thereto. This motion carried unanimously. The City Attorney presented the Agreement between the City and the A.Y.P. extending the period of time to December 31, 1957. The new Agreement differed from the original Agreement in that the A.Y.P. would use 75% of the proceeds from the con- cessions for jointly sponsored programs with the Recreation Department, and 25o of the proceeds would be used for A.Y.P. programs. Moved by Councilman Johnson, seconded by Councilman Ortuno and ordered carried that copies of the agreement be forwarded tolthe A.Y.P. and the Park and Recreation Commission for their consideration. Attorney Williams stated that he had prepared an Ordinance for Council's consideration which amended Traffic Ordinance No. 438 and was set forth in the language requested by the State Department of Public Works as it related to State High- ways. This Ordinance would in effect allow the City to proceed with necessary changes on State Highways, subject to withdrawal if the approval of the State was not received. Councilman Romero offered for its first reading an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMEND- ING ORDINANCE NO. 438 RELATING TO THE REGULATION OF TRAFFIC. Mutual Aid Agreement for fire services. Agreement between Cit? & A.Y.P. Ordinance amending Traffic Ord. 438 1st reading of Ordinane amending Traffic Ord No. 438 350 CITY HALL AZUSA, CALIF. MON., MAY 20, 1957 Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that further reading of this Ordinance be waived. With no objections, motion was ordered carried. The Administrative Officer stated that further negotiations are being carried on relative to the rubbish and garbage con- tracts. The proposals that have been submitted were based on 3 and 5 year periods, with prices for the pickup variable. A report will be submitted for the next meeting outlining the various proposals that have been submitted. At the meeting of the Planning Commission held on May 8, 1957, a Hearing was set for May 22, at 8:30 P.M. on a proposed re- zoning to C-2 of Annexation District No. 23. This annexation and zoning was reauested by Turner and Stevens for the estab- lishment of their neer mortuary on South Azusa Avenue north of Arrow Highway. At the meeting of the Planning Commission held on May 8, 1957, it was recommended that a Variance be granted to Willis P. Harris, et al, allowing the construction of a 6 ft, concrete block wall with a setback on the northwest corner of Rockvale Avenue and Matchwood Street to be 40 ft, rather than the 25 ft. setback as called for in the Ordinance. This wall will be constructed along Rockvale Avenue on the property line of four contiguous lots. The City Clerk announced that a letter of protest had been received signed by Robert Tucker and W. R. Dees, which objected to the granting of this Variance for the construction of the wall. Moved by Councilman Romero, seconded by Councilman Ortuno that this matter be referred to the City Engineer and Adminis- trative Officer for a report and a recommendation. With no objections, the motion was ordered carried. IS 851 7:30 P.M. Rubbish & garbage pro- posals for next meeting Turner & Stevens annexation Request for Variance for block wall - Willis Harris At the meeting of the Planning Commission held on May 8, 1957, it was recommended that a variance be granted to Cletus A. Variance Austin for his property at the northeast corner of Pasadena granted Avenue and 8th Street to allow the construction of a two-story C. A. Austin building located 18 ft, from the nearest building on the same for two - lot. This is in variance to the Ordinance which requires 20 ft, story bldg. between buildings. Annexation It was moved by Councilman Romero, seconded by Councilman District Ortuno that the recommendation of the Planning Commission be No. 25 accepted and that the Variance be granted to Cletus A. Austin permitting the construction of the building as requested, and the City Attorney* to prepare the necessary Resolution. This motion carried unanimously. At the meeting of the Planning Commission held May 8, 1957, it was recommended that the City Council start proceedings for the annexation of a strip of land extending from the present City boundaries east of Cerritos Avenue on Arrow Highway and extend- ing southerly across Arrow Highway to the boundary line of the City of Covina. The area of this annexation to be a 1 ft. Southerly strip. This annexation would be designated as "Southerly Annexation Annexation District No. 25." District Moved by Councilman Fawcett, seconded by Councilman Ortuno No. 25 that the recommendation of the Planning Commission be accepted and that the map and legal description be forwarded to the County Boundary Commission for their report. MON., MAY 20, 1957 It was requested by the City of Hope that the Mayor be author- ized to issue a proclamation setting forth the month of June as the "City of Hope Month". Moved by Councilman Romero, seconded by Councilman Fawcett and unanimously carried that the Mayor be authorized to sign a proclamation naming June as "City of Hope Month" and that the City of Hope be advised of the registration and identification requirements needed to be filed with the Police Department prior to solicitations being carried on within the City,. Copies of applications for Liquor Licenses from the Alcoholic Beverage Control for the following addresses were submitted to Council for consideration: (a) On -sale Beer at 353 S. Irwindale Ave., Donald Andrukitus & Paul A. Drop, Proprietors (b) Beer and Wine Wholesaler and Retail Package Off -sale Beer and Wine, at 771 N. Vernon Avenue, presently licensed by Park Beverages, a change of ownership and owners noted. Moved by Councilman Johnson, seconded by Councilman Romero that these applications be filed.
