ORDINANCE NO. 1006
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING
SECTION 3400.5 OF CHAPTER 4 OF THE AZUSA MUNICIPAL CODE RELATING
TO THE POWERS AND DUTIES OF THE DIRECTOR OF CIVIL DEFENSE AND
DISASTER.
The City Council of the City of Azusa does ordain as
follows:
SECTION 1. Section 3400.5 of Chapter 4+ of the Azusa
Municipal Code is hereby amended to read as follows:
"Section 3400.5 SAME. DISASTER PROCLAMATION DUTIES.
In the event of a proclamation of a disaster
or emergency as herein provided, or the proclamation
of a state of disaster or a state of extreme emergency
by the Governor or Director of the California Disaster
Office, the Director is empowered:
(a) To make and issue rules and regulations
on matters reasonably related to the protection of
life and property as affected by such disaster;
provided, however, such rules and regulations
must be confirmed at the earliest practicable time
by the Council.
(b) To obtain vital supplies, equipment and
such other properties found lacking and needed for
the protection of the life and property of the
people, and bind the City for the fair value thereof
and if required, immediately to commandeer the same
for public use.
(c) To require emergency services of any
City officer or employee and in the event of the
proclamation of a state of disaster or a state of
extreme emergency by the Governor in the region in
which this City is located, to command the aid of
as many citizens of this community as he thinks
necessary in the execution of his duties; such
persons shall be entitled to all privileges, benefits
and immunities as are provided by State law for
registered civil defense and disaster service
volunteers.
(d) To requisition necessary personnel or
material of any City department or agency.
(e) To order that no person shall loiter or
remain upon any public street, park or playground,
public school property, public library property or
any other publicly owned property within the City
between such hours as he shall designate; and said
order shall be applicable to the entire City or
any designated portion thereof as the Director shall
determine for the safety and welfare of the people
and property both public and private.
(f) To execute all of his ordinary powers as
City Administrator, all of the special powers con-
ferred upon him by this Chapter or by resolution
adopted pursuant hereto, all powers conferred upon
him by any statute, agreement approved by the Council
or by any other lawful authority, and in conformity
with Section 38791 of the Government Code of the
State, to exercise complete authority over the City
and to exercise all police power vested in the City
by the Constitution and general laws. "

SECTION 2. The City Clerk shall certify to the adoption
of this Ordinance and shall cause a copy of same to be published
in accordance with law.

I, DEAN F. KLARR, City Clerk of the City of Azusa do
hereby certify that the above Ordinance No. 1006 was duly
and regularly introduced and placed upon its first reading
at a regular meeting of the City Council on the 16th day of
November , 1970, and that, thereafter said orcTTnance
was duly adopted and passed at a regular meeting of the City
Council on the 7th day of December , 1970, by the
following vote, to wit:
AYES: Councilmen Rubio, Decker, Snyder, Clark, Solem
NOES: Councilmen None
ABSENT: Councilmen None

I DO FURTHER CERTIFY that I caused said ordinance to be
published prior to the expiration of fifteen days from the
passage thereof in the Azusa Herald and Pomotropic, a news-
paper of general circulation, printed, published and circulated
in the City of Azusa, on the 16th day of December , 1970,
and that the same was published in accordance with law.
