HomeMy WebLinkAboutOrdinance No. 997 ORDINANCE NO. 997 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA PROHIBITING THE USE OF LAND IN THE CITY FOR THE CONSTRUCTION OR ESTABLISHMENT OF CONDOMINIUMS. The City Council of the City of Azusa does ordain as follows: WHEREAS, the City Council, to protect the public health, safety, and welfare, is considering a revision of the permissable uses of lands for con- dominiums; and WHEREAS, Section 65858 of the California Government Code authorizes the adoption of an interim ordinance prohibiting any usage of land which may be in conflict with a contemplated zoning proposal which the legislative body, planning commission or planning department is considering or studying or intends to study within a reasonable amount of time; NOW, THEREFORE, the City Council of the City of Azusa does hereby ordain as follows: SECTION 1. Notwithstanding any provision now contained in Article IX of the Azusa Municipal Code or elsewhere in said Code the use of any land in the City for the purpose of constructing or estab- lishing condominiums is hereby prohibited until such time as the City Council determines whether the existing provisions of the zoning regulations should be amended to provide for such uses in order to protect the public health, safety and welfare. SECTION 2. The provisions of this Ordinance shall not affect the present lawful use of land within the City for condominiums, which use shall constitute lawful non-conforming use. SECTION 3. No building permit shall hereafter be issued for construction or establishment of a condominium. SECTION Li . This Ordinance is declared to be an ordinance for the immediate protection of public safety, health, and general welfare. The facts constituting the urgency are as follows: It has been revealed that the present zoning regulations do not regulate the estab- lishment, construction, alteration or enlarge- ment of condominiums or any facility incidental or appurtenant thereto. The matter is presently set for extensive study by the Planning Commiss- ion of the City. Since it is urgent that proper regulations be established governing the use of property for condominiums or any facility incidental or appurtenant thereto in order to protect the public health, safety, and general welfare, it is essential that sufficient time be provided to permit the Planning Commission to conduct such study and hold public hearings in connection therewith. SECTION 5. This ordinance, being an emergency ordinance for the immediate protection of the public safety, health, and general welfare containing a declaration of the facts, constituting the urgency and passed by a four- fifths vote of the Council shall take effect immediately upon its adoption. SECTION 6. The City Clerk shall certify to the adoption of this ordinance and cause the same to be published as required by law.
