Mayor Memmesheimer led in the salute to the Flag. Invocation was given by Mr. James King of the Church of Christ, Azusa. Present at Roll Call: Councilmen: Fawcett, nrtuno, Romero, Memmesheimer Absent: Councilman Johnson Also present: City Attorney Williams, City Fngineer xirkgaard, and City Clerk -Administrative Officer Miller Mayor Memmesheimer asked if there were any corrections or omissions to the Minutes of the Meeting of May 20th. The Administrative Officer stated that relative to the cor- rections as shown for 4/9/57, these should be disregarded and in its place should be 'that the Minutes of April 1, on Page 8, relative to the alley at Northside Park, the motion should have been 'motion ordered carriedli There being no further corrections or omissions, the Minutes of the Meeting of May 20th were ordered approved as sub- mitted. 7:30 P.M. Flag Ralute Invocation Roll Call Corrections Minutes of 5/20/57 Councilman Johnson entered the meeting at 7:47 P.M. and was seated at the Council table. The City Clerk presented the Affidavit of Publication of Notice Inviting Bids for 8,000 tons, more or less, Asphaltic Concrete surfacing material to be delivered to the City within a year's period. This Notice Inviting Bids re- Bid for guested bids on: Asphaltic Alternate A: --material F.O.B. plant site, net per Materials ton, including all taxes, awarded to Alternate B: --material F.O.B. job site, Azusa, net Industrial per ton, including all taxes Asphalt Bids were received from the following Companies: Alternate A Alternate B Industrial Asphalt 3.952 per ton 4.442 per ton Warren Southwest, Inc. 14.10 per ton 4.52 per ton Moved by Councilman Fawcett, seconded by Councilman. Ortuno and unanimously carried that the bid of Industrial Asphalt as low bidder be accepted, and the bid bond be returned to the unsuccessful bidder. A Resolution by the Board of Directors of County Sani- tation District No. 22, setting forth their intention to construct, maintain and operate a reuse transfer and disposal system within the boundaries of the District, has been received. The construction and maintenance, etc. of a refuse transfer disposal system is provided for in Assembly Bill #741, which also provides under Section 4741.2 of said Act a political subdivision may request exclusion from the proposed refuse transfer and disposal Sanitation system upon the delivery of a certified copy of a Reso- District lution to the District requesting exclusion. This No. 22 Resolution must be delivered to the District Board within to operate 90 days of the adoption of the Resolution by the District refuse of its intention to construct, maintain and operate the transfer refuse transfer and disposal system. & disposal Moved by Councilman Fawcett, seconded by Councilman system Ortuno and unanimously carried that this be referred to $56 CITY HALL AZUSA, CALIF. MON., JUNE 3, 1957 City Attorney for his study and report, and that copies of the Resolution of the Sanitation District be for- warded to Council members. The City Administrative Officer stated that copies of the budget requests of the various Departments within the City have been delivered to each Council member for their consideration. This budget would be for the fiscal year 1957-1958. Moved by Councilman Johnson, seconded by Councilman Romero and unanimously carried that the City Council set study meetings for consideration of the budget for June 12 and 14th, in the City Auditorium to convene at 7:30 P.M., and that newspaper publicity be given about these budget meetings. The resignation of Mrs. Dorothy Moskus, Steno -Clerk in the office of the City Clerk was submitted, with the request that her name be retained on the eligibility list. Moved by Councilman Roinero, seconded by Councilman Ortuno that the resignation of Mrs. Moskus be accepted and that her name be placed on the eligibility list as requested. Motion ordered carried. City Clerk requested permission to employ the #2 person on the eligible list of Switchboard Operator -Receptionist as a Typist Clerk. It was pointed out that the examin- ation given for the Operator -Receptionist was similar to that given for Typist -Clerk, and in addition would provide switchboard relief as necessary. Moved by Councilman Fawcett, seconded by Councilman Ortuno that the City Clerk be authorized to employ the #2 person on the certified list for Switchboard -Operator as a Typist - Clerk, effective June 10th, if available. This motion carried unanimously. Mayor Memmesheimer announced that it was now 8 o'clock P.M., time set for the public hearing on the appeal of the decision of the Planning Commission recommending the denial for rezoning from R -lc to R -s and R-3 as requested by Walker Built Homes, Inc., for Tract #20502. This Tract is located on the north side of Gladstone Street between Pasadena Avenue and Cerritos Avenue. The City Clerk presented the Affidavit of Publication of the Notice of the Public Hearing on the appeal, said Notice being published in the Azusa Herald on May 20, 1957. Also presented were the names of property owners to whom Notices of the Hearing had been mailed, and a copy of the poster which had been posted in the neighborhood. In a letter submitted by Herbert L. Braun of Walker -Built Homes, Inc., it stated that in their opinion the Planning Commission based their decision upon information which was misleading and erroneous. It further states that they sincerely believe that good zoning practice and the best interests of the City of Azusa would require the granting of their request for the zone change. Mr. Henry Wall of the Stephen W. Cunningham Associates, Planning Consultants, addressed Council and presented his views on behalf of the Walker -Built Homes, Inc. Mr. Wall explained to the Council about the extensive survey made by him to support the request for the multiple dwelling zoning. The proposed tract map (tentative) was submitted for Council's consideration. Mayor Memmesheimer asked if there were any in the audience who wished to comment on the proposed rezoning which would 357 7:30 P.M. 1957-1958 budget re- quests submitted to Council Resignation of Mrs. Moskus accepted Typist -Clerk to be employed in City Clerk's office Hearing re: rezoning Tract #20502 358. 359 CITY HALL AZUSA, CALIF. MON., JUNE 31 1957 7:30 P.M. allow multiple dwelling in Tract #20502. Mr. W. Wilkinson, 401 S. Pasadena Avenue addressed the Council and stated that the petition signed by 82 persons in the vicinity had been submitted to the Planning Com- mission protesting the rezoning of the property, and requested that that area remain as an R-1 zone. Mrs. Lana Dixon, 327 S. Pasadena, also appeared before the Council protesting the rezoning of the property. Mrs. Eva Wilkinson, 401 S. Pasadena, stated to Council Rezoning that additional names could have been obtained on the Tract petition if all people in the area could have been contacted. #120502 Mr. Herbert Braun of Walker -Built Homes, inc., stated denied that multiple dwellingsxere suitable in an area which was adjacent to a shopping center. There being no further comments, Mayor Memmesheimer ordered the Hearing closed at 9 P.M. Moved by Councilman Fawcett, seconded by Councilman nrtuno and unanimously carried that the City Council accept the recommendation of the Planning Commission and that the appeal presented by walker -Built Homes, Inc. for the re- zoning of Tract 4120502 from R -lc to R-2 and R-3 be denied. Mayor Memmesheimer announced that the Council now had the Hearing on the appeal of the Planning Commission's recom- mendation to deny the zone change from R-1 to C-2 of Tot #137, Tract ##13824 as reo_uested by Mr, and Mrs. P. Mexia. This lot is located at the Northwest corner of T,ouise Ave. and Gladstone Street. The City Clerk presented the Affidavit of Publication of the Notice of Public Hearing on the appeal of Mr, and Mrs. Tot 437 Mexia, which was published in the Azusa Herald: and Pomo- Tract tropic on May 20, 1957. The City Clerk also presented a 413824, list of the names and addresses to whom Notices of the rezoned Hearing had been mailed, and a copy.of the poster which from R -lc had been posted in the area, It was further stated by the to C-2 City Clerk that no written protest had been received in his office. Mayor Memmesheimer asked if there were any in the audience who wished to comment on the proposed rezoning of this lot. Mrs. Mexia appeared before Council and stated that her property would be used for a patio furniture retail sales shop and a beauty shop, the buildings for which would be erected if the zoning was granted. It was further stated by Mrs. Mexia that her property abutted C-2 property on the West. It had been recommended by the planning Commission in its motion,- which had not passed, that the rear 100 ft. of the lot be zoned C-2, with the stipulation that a block wall be erected on the north property line. With no further protests or comments being offered, Mayor Memmesheimer ordered the Hearing closed. Moved by Councilman Romero, seconded by Councilman nrtuno that the appeal from the recommendation of the planning Commission be accepted, and that Tot #37, Tract *13824, be rezoned from R -lc to C-2, with the condition that a concrete block wall be constructed on the north property line. . A report was submitted by the City Engineer stating that the subdividers meeting with him and the City Attorney were in agreement on several of the recommendations ex- 360 361 CITY HAr.r. This area would be in the northwest portion of the tract. Mr. Braun of walker -Built Homes, Inc. requested the City Council to approve the tentative map of Tract 1120502. Moved by Councilman Johnson, seconded by Councilman Romero that the tentative map of Tract 1120502 not be approved. Tscharner, Attorney, who has been handling the Atty. legal proceedings in the case of Jehovah witnesses vs. Tscharner the City of Azusa, requested the City Council to submit to con - decision as to whether the City Council wished to continue tinue the legal action which would, in all probability, become with extensive and costly, with the case being appealed to Jehovah the :State Supreme Court, and possibly further. witnesses Moved by Councilman Fawcett, seconded by Councilman case Romero that Attorney Tscharner be authorized to con- tinue legal action in the case of Jehovah witnesses vs. City of Azusa. This motion carried unanimously. On questioning by Mayor Memmesheimer, Atty. Tscharner stated that the City Council should decide their course of action in relation to the condemnation proceedings recently held in Superior Court, and stated that a decision by the Council should be reached by the meeting of June 17 since it would be advisable to have the answer prior to June 23rd. The eligibility list for Switchboard Operator -Receptionist, Consumer's Serviceman and Recreation Director were pre- sented by the personnel Board, and would be taken up as topics under the various nepartments affected. The eligibility list for the Recreation Director contained the following names: Peter P. Scott, Azusa - 1st wm. Pacifico, Covina -- 2nd Donald Renner, Alhambra -- 3rd a letter was submitted by the Park and Recreation Commission recommending that the City Council consider the employment of Wm. Pacifico as Recreation nirector for the City of William Azusa, at the 4th step of the salary range. The Park and Pacifico Recreation rommission justified their request for the appointed starting salary on Step 4 due to the length of time Mr. Recreation Pacifico has been connected with Recreation while in the nirector employ of the County of Los Angeles, under previous 2, years that he had been assigned to the City of "zusa as Recreation nirector. A letter was also received from Rev. B. J. Paroulek, a member of the Park and Recreation Commission, recommend- ing the employment of wm. Pacifico as Recreation nirector at the 4th step of the salary range. Moved by Councilman Romero, seconded by Councilman Ortuno $62 CITY HALL AZUSA, CALIF. MON., JUNE: 3, 1957 that the recommendation of the Park and Recreation Com- mission be accepted and that Wm. Pacifico be employed as Recreation nirector on the 4th Step of the salary range, with the understanding that an increase to the next step would require the necessary time element. This motion was unanimously carried. The definition and typical tasks of employment standards for the classification of Junior Accountant as approved by the Personnel Board was submitted to the City Council for their approval. Moved by Councilman Romero, seconded by Councilman nrtuno that .the. definitions and typical tasks for the classifica- tion of Jr. Accountant be accepted by the Council. This motion carried by the following vote: A.YFR: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: Johnson ABSENT: Councilmen: None It was recommended by the Park and Recreation Commission that approval be given by the City Council for the Park nepartment and Recreation nepartment to employ students (minors) during the summer vacation. The minors would be employed for a maximum of 10 hours per week and would comply with all regulations for the employment of minors. It was pointed out that the students would do general cleanup work in the Park nepartment and umpire Pee -wee baseball games and work in the Arts and Crafts nepartment in the Recreation Department. Moved by Councilman Romero, seconded by Councilman nrtuno that the recommendation be accepted and that the Park and Recreation nepartment be authorized to employ minor students for a maximum of 10 hours per week at a salary rate of $1.00 per hour. This motion carried unanimously. The Park and Recreation Commission requested approval of purchase of electric basketball scoreboard to be installed in the Recreation Center gymnasium. Moved by Councilman Romero, seconded by Councilman Fawcett that this matter be tabled at this time. No objections, motion ordered carried. The Park and Recreation Commission recommended that the Recreation Director be authorized to hire the necessary personnel to man the City Plunge for the summer season. It was set forth that the Personnel to be employed would be for the most part those who had worked at the Plunge in previous years. Moved by Councilman Romero, seconded by Councilman nrtuno and unanimously carried that the Recreation Director be authorized to employ the necessary personnel for the operation of the City Plunge with the salaries to be as set by the City Council for the year 1956-1957. The Park and Recreation meeting on May 29, 1957, recom- mended that the City Council consider the acquisition of a portion of proposed Trace 420502 for park purposes. The area recommended to be acquired would consist of Lots 1 through 20, and Lots 35 through 50, of Tract Map #20502 Study #10. Moved by Councilman Romero, seconded by Councilman nrtuno that the City Attorney, Administrative office, City Engineer negotiate with the owners of the property for possible acquisition by the City for a park site as recom- mended by the Park and Recreation Commission. With no objections motion ordered carried. A letter was received and presented to the City Council for the purchase of a 25 ft, strip of land between the Northside Park and the following properties: 363 7:30 P.M. Classifi- cation of Jr. Accountant established Employment of minors in Park & Recreation Department authorized (during summer vacation) Purchase of electric scoreboard tabled Authoriza- tion to employ necessary personnel for City Plunge Negotiations to continue for acauisi- tion of a park site in Tract 420502 364 CITY HALL AZUSA, CALIF. MSN., JUNE 3, 1957 Dr. Roland Pierce - $ 80.00 Mrs, olvina Meier - t120.00 Paul Brecht - - - - $ 60.00 It was point out that this 25 ft, strip of land would act as a buffer between the Park and their properties. Moved by Councilman Johnson, seconded by Councilman Romero that a copy of this letter be forwarded to the Park and Recreation Commission for their consideration, with the recommendation that a joint meeting be held with the property owners and the Commission, with no objections, this motion ordered carried. It was recommended by Councilman Fawcett that a joint meeting with the Library Board and the City Council be set, for consideration of a building site. Moved by Councilman Romero, seconded by Councilman Fawcett that the recommendation be accepted and that June 18th be set as the date for the joint meeting between the Council and the Library Board. This meeting to be held at 7:30 P.M. in the Auditorium, and members of the Library Board to be so notified. This motion ordered carried. Councilman Romero stated that a letter of complaint against Officer Mosley submitted by the Machinist's Union should be considered by the City Council. Administrative Officer stated that this letter had been referred to the Personnel Board who had taken no action but had referred it to the City Council for their recom- mendation as to the action to be taken. It was the opinion of the City Council that a complaint of this nature was a matter for the Personnel Board to consider and make recommendation. Moved by Councilman Ortuno, seconded by Councilman Romero that this letter again be referred to the Personnel Board for their recommendation as to disposition. With no objection, motion ordered carried. The Committee appointed to consider rubbish and garbage contracts submitted the following recommendations: (a) That the rubbish contract be awarded to the Western Disposal Company on the following terms - that upon termination of their present contract, a flat monthly payment in the amount of $5,250.00 be made with the provision that should the number of metered and unmetered stops go below 5,000 that a readjustment would be made at the rate of $1.00 per stop or meter, and if the metered count and unmetered count should go above 5,400 an adjustment would be made at the rate of $1.00 per customer (b) That the existing contract with the Valley Dis- posal Company for the garbage pickup be continued at the same terms. Both of these contracts to run for a three-year period with an appropriate cancellation provision, and the filing of necessary bonds. Moved by Councilman Fawcett, seconded by Councilman Ortuno that the recommendation of the Committee be accepted and that the City Attorney prepare the necessary agreement. With no objection, motion was ordered carried. A letter was received from Mr. Goebel, Attorney for Mr. Belcoe owner of a parcel of land on Foothill Blvd, located between what is presently known as Thelma's Cafe and the offices of M. Penn Phillips at 1100 W. Foothill Blvd, in which it is stated that Mr. Belcoe is unwilling to make the improvements requested by the City Engineer at this time. Mr. Belcoe has sold a portion of this property for a manufacturing tract, designated as Tract #f23774, the 365 7:30 P.M. Offer to purchase 25' strip at Northside Park referred to Park & Recreation Commission Council and Library Board to meet 6/18/57 Letter of complaint referred to Personnel Board for recommenda- tion. Rubbish and Garbage contracts 366 CITY HALL AZUSA, CALIF. MON., JUNE 3, 1957 tentative map of which was approved by the City Council on March 18th. Mr. Belcoe retained frontage on Foothill Blvd, for a depth of about 160 ft, and would agree to make the improvements at the time that this portion is improved. The improvements requested by the City Engineer would be sidewalks, curbs, lights and one fire hydrant along Foothill Blvd. Moved by Councilman Johnson, seconded by Councilman Romero that this matter be tabled at this time. With no objections motion ordered carried. The City Engineer stated that he had investigated the petition for Variance for the erection of a block wall on Rockvale Avenue submitted by Mr. W. Harris, Mr. Harris has agreed to limit the height of the wall to 316" to a point 10' behind the building line in order to alleviate a traffic hazard at the intersection. Moved by Councilman Fawcett, seconded by Councilman Romero that a Variance be granted for the construction of this block wall, subject to recommendations and approval of the City Engineer. With no objections, motion ordered carried. Plans and specifications for the installation of the water line on Azusa Avenue between Paramount and Gladstone Sts. were presented by the Engineer and Supt. of Public Utilities. Moved by Councilman Ortuno, seconded by Councilman Romero that the plans and specifications, as recom- mended, be accepted and the City Clerk be authorized to advertise for bids to be opened on June 17th at 10:30 A.M. in the office of the City Clerk. Motion carried unanimously. The matter of installing a sewer line on Azusa Avenue, between Little Dalton Wash and Paramount Avenue, was discussed, with the City Engineer stating the work could be accomplished with City force account. Moved by Councilman Ortuno, seconded by Councilman Romero the Engineer be authorized to proceed with the project of installing this sewer line. Motion carried unanimously. With regard to the position -df Estimator in the Light and Water Department, and due to the difficulty in ob- taining capable applicants for this position, a recom- mendation was made to have the Water and Light Foreman and Warehouseman undertake the Estimator's duties along with their own, for a six -month's trial, because of the necessity of having the system in operation. Moved by Councilman Ortuno, seconded by Councilman Romero to accept the recommendation -as stated and put this plan in operation for a trial period of six months. Motion carried unanimously. It was requested that Wm. Tannehill, No. 1 man on the eligible list for Consumer's Serviceman in the Light & Water Dept., be employed on Step 3 of the salary range. Mr. Tannehill is presently employed at Step 3 of Mainten- ance Man II in the Public Works Dept. Moved by Councilman Romero, seconded by Councilman Ortuno request be granted and Wm. Tannehill be employed as Consumer's Serviceman on Step 3 of the salary range, effective June 4, 1957. Motion ordered carried. It was requested Mrs. Martha Holmes be employed for vacation relief in the office of the Light and Water 367 7:30 P.M. Street im- provements requested by Engineer of Belcoe property on W. Foot- hill Blvd. tabled. Variance granted for construction of block wall - W. Harris Adv, for bids re: water line Azusa Ave. Engineer to proceed with in- stallation of sewer line Light & Water fore- man and warehouseman to take duties of Estimator W. Holmes Moved by Councilman Ortuno, seconded by Councilman vacation Romero request be granted and Mrs. Martha Holmes be relief - employed temporarily in the Light and Water -Dept. and Light & be paid at the salary range of the step she was on Water Dept. while formerly employed as Account Clerk. With no objections, motion ordered carried. New street lights that have been installed and in opera- tion at this time are from Virginia Avenue to Cerritos New Street Avenue, from First St, to Gladstone, as reported by lights Supt. Smith. report - Moved by Councilman Johnson, seconded by Councilman filed Romero that this report be filed. Motion ordered carried. The matter of writing off uncollectable bills as Accounts Uncollectable Receivable, in the Light and Water Dept., was discussed. Bill - Light Moved by Councilman Romero, seconded by Councilman Ortuno & Water Dept. that this matter be tabled. Motion ordered carried. Councilman Johnson offered for second reading the following Ordinance entitled: Ordinance No. 539 - "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA Amending AMMENDING ORDINANCE NO. 438 RELATING TO THE REGULATION Ord. 438 OF TRAFFIC." re: regula- tion of Moved by Councilman Johnson, seconded by Councilman traffic Ortuno that further reading of this Ordinance be waived. The motion was carried by unanimous vote. Moved by Councilman Ortuno, seconded by Councilman Romero this Ordinance be passed and adopted. Ordinance wa then passed and adopted by the following vote: AYES: Councilmen: Fawcett, Ortuno, Johnson, Romero, Memme sh eimer NOES: Councilmen: None ABSENT: Councilmen: None and numbered Ordinance No. 539. Councilman Romero offered the following Ordinance to be placed upon its first reading: 1st reading Ord. dis- "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA approving DISAPPROVING EASTERLY ANNEXATION DISTRICT NO. 21." Easterly Annex. Moved by Councilman Romero, seconded by Councilman Dist. Johnson that further reading of this Ordinance be waived. No. 21 Motion failed by the following vote: AYES: Councilmen: Fawcett, Johnson, Romero, Memmesheimer NOES: Councilmen: Ortuno ABSENT: Councilmen: None Councilman Ortuno requested that his vote be reconsidered and changed to "AYE". Motion was then•carried.unanimously. Councilman Romero offered the following Ordinance to be placed upon its first reading: 1st reading of Ord. re: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA swimming REQUIRING THE FENCING OF SWIMMING POOLS, WADING POOLS pools AND FISH PONDS." Moved by Councilman Romero, seconded by Councilman Ortuno reading of this ordinance be waived. The motion was carried by unanimous vote. 370 871 CITY HALL AZUSA, CALIF. MON., JUNE 3, 1957 7:30 P.M. Councilman Romero offered the following Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A CONDITIONAL USE PERMIT AND VARIANCE." Moved by Councilman Romero, seconded by Councilman Fawcett further reading of this Resolution be waived. With no Resolution objections, motion ordered carried. No. 3612 Variance Moved by Councilman Fawcett, seconded by Councilman Ortuno granted Resolution be adopted. Reolution was thenadopted by to C.
