AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AZUSA AMENDING THE AZUSA MUNICIPAL CODE BY THE
ADDITION THERETO OF A NEW SECTION 4277 RELATING
TO LOITERING ON PRIVATE PROPERTY AND DECLARING
THE URGENCY THEREOF.
WHEREAS, numerous citizens in the City of Azusa have
been annoyed, harassed, threatened or intimidated while exercising
their rights to use public streets, alleys, sidewalks, and private
property open to public use and in the operation of their businesses
by numerous persons loitering about parking lots, shopping centers
and private property generally open to use of the public; and
WHEREAS, the City Council of the City of Azusa finds
and determines that the conduct of such persons trespassing on
and loitering about such private property open to use of the pub-
lic constitutes an immediate hazard to the preservation of public
peace and safety;
The City Council of the City of Azusa does ordain as
follows:
SECTION 1. The Azusa Municipal Code is hereby amended
by the addition thereto of the following Section 4277:
"SECTION 4277. LOITERING ON PRIVATE PROPERTY PROHI-
BITED UNDER CERTAIN CIRCUMSTANCES.
(a) No person shall at any time, singly or in concert
with others, loiter or stand in or upon any
parking lot, shopping center or other private
property, in such manner as to obstruct or
unreasonably interfere with free ingress or
egress to or from any public premises, place
of business or place of public assemblage or so
as to obstruct or unreasonably interfere with
the free use of public streets, sidewalks,
alleys or other public ways adjacent or contig-
uous thereto.
(b) No person, other than a public officer or
employee acting within the course and scope of
his employment may enter upon, loiter or stand
in or upon any parking lot, shopping center
property or any other private property open to
the public, at or during any time when the owner
or his agent has prohibited loitering or tres-
passing thereon by means of posting as described
in subsection (c) below.
(c) The prohibition described in subsection (b)
above may be effected by posting in a prominent
place on the property a sign prohibiting loiter-
ing or trespassing thereon during any designated
period of time. Such sign shall be not less
than eight inches by twelve inches in size, of
white background with contrasting letters not
less than one inch in height. Nothing herein
shall be deemed to prohibit entry upon any prop-
erty at any time with the express consent of the
owner or his agent. "

SECTION 2. The City Clerk shall certify to the adoption
of this ordinance, and it shall take effect immediately on its
adoption as an urgency ordinance for the immediate preservation
of the public peace, health and safety.

hereby certify that the foregoing Ordinance No. 950 was duly
introduced and adopted as an urgency ordinance at a regular meet-
ing of the City Council on the 7th day of October , 1968,
by the following vote, to wit:
AYES: Councilmen: Rubio, Decker, Cooney, Calvert, Solem
NOES: Councilmen: None

I do further certify that I caused said Ordinance to be
published prior to the expiration of fifteen days from the passage
thereof in the Azusa Herald and Pomotropic, a newspaper of general
circulation, printed, published and circulated in the City of Azusa,
on the 16th day of October , 1968, and that the same was
published in accordance with law.
