Invocation was given by Councilman Fawcett. Invocation Present at Roll Call: Councilmen: Fawcett, Ortuno, Johnson, Romero, Memmesheimer Roll Call Also present: City Attorney, City Engineer, City Clerk -Administrative Officer Mayor Memmesheimer asked if there were any corrections or omissions to the minutes of the -- meeting held on June 3, 1957, Councilman John- son stated the time of her entry to the meeting was 7:47 instead of 8:17 P.M. as stated. Page 3, line 2 should be corrected to read Corrections "Mr. Herbert Brawn" Page 4, line 12 should have the word "possibil- fty" deleted. Page 7, paragraph 5, should have included "With no objections, motion ordered carried." Motion carried by unanimous. vote. 7:.30 P.M. 2 Bid awarded for material to Southern Pipe & Casing Moved by Councilman Romero, seconded by Councilman Fawcett, that all bids be rejected for the instal- lation of the pipeline and Attorney be instructed to draw resolution authorizing that day labor be used and ordering the work done in that manner. Motion carried by the following vote: Certain bids Ayes: Councilmen Fawcett, Ortuno, Romero, rejected Memmesheimer Noes: Councilman Johnson The Park and Recreation Commission, in a joint meeting with the property owners of land ad- jacent to Northside Bark, discussed the offer made by the owners to purchase a 25 ft strip of land from the City. However, it was deter- mined that with plans being prepared for parking area and a planting program planned, it will not be necessary to purchase this property. Moved by Councilman Fawcett, seconded by Council- man Romero, the offer to purchase from the City be rejected, and owners to be advised according- ly. With no objections, motion was ordered carried. Moved by Council man Romero, seconded by Council- man Rawcett,=the-City Engineer, be instructed'.to iiraw. plans in' accordance -with the -recommendations made by the Park -and Recreation Commission.- With ommission.With no objections, motion ordered -carried. Mayor Memmesheimer announced that it was now 8:00 P.M.:; the time set for the public hearing of protests on Southerly Annexation District No. 23, this being that property petitioned to be annexed to the City of Azusa for the estab- lishment of a mortuary by Turner & Stevens, and is located on Azusa Avenue north of Arrow Highway. The City Clerk presented the Affidavit of Pub- lication of the Notice of the Public Hearing, said Notice being published in the Azusa Herald and the Los Angeles Daily Journal on May 13th. The Clerk stated that there had been no written protests filed, since the owner petitioning for annexation is the only one receiving a Notice of Public Hearing. Mayor Memmesheimer asked if there were any oral protests. There were no oral protests. Mayor Memmesheimer ordered the hearing closed. Moved by Councilman Fawcett, seconded by Council- man Ortuno, the necessary ordinance be prepared for the annexation of this property to the City. Police Chief Kendrick reported that the next class of the California Highway Patrol Training Academy would begin August 12th. It was recommended that Officer Moseley Officer Moseley attend this class beginning with to attend Aca- Unit 4 and expenses be allowed. demy Moved by Councilman Johnson, seconded by Council- man Romero that Officer Moseley be directed to attend the California Highway Patrol Training Academy as recommended with expenses allowed as follows: Attendance fee at the academy $118.95 balance of cost amounting to 46:60 plus mileage to be paid to Officer Moseley to cover residence expense off the academy grounds. Motion carried unanimously.. A 'Master Plan of Streets and Highways' for the City of Azusa was recommended by the Planning Commission. Public Hearings had bean held before the Planning Commission on April 17th and May 8th, 1957 on the proposed Master Plan. Moved by Councilman Fawcett, seconded by Council- man Ortuno, the Administrative Officer arrange a public hearing on July 15th, at 8:00 P.M. in the Auditorium. Motion was carried unani- mously. It was recommended that Warren Teasley be re- appointed as a member of the Planning Commission. The terms of Mr. Teasley and Mr. Lopez will ex- pire as of June 30, 1957. Moved by Councilman Romero, seconded by Council- man Fawcett, the recommendation be accepted and Mr Teasley be appointed a member of the Planning Commission. A second recommendation for the ex; piration of Mr. Lopez" term will be made later. Motion carried by the following vote: Ayes: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer Noes: Councilman Johnson + A conditional use permit was granted by the Planning Commission to Richfield Oil Company to allow two signs of 80 sq ft each and 8 gas pumps on their property located at the southwest corner of Citrus and Gladstone Streets. Unless an appeal is made within twenty days, as specified under Ordinance No. 535, said Conditional Use Permit would be allowed. No action taken by Council at this time. It was recommended by the Planning Commission that a change of zone from R-1 to C-2 be granted for the construction of a mortuary of Azusa Ave. north of Gladstone Street which is contained in Annexation No. 23 Moved by Councilman Ortuno, seconded by Council- man Romero, the Administrative Officer arrange a public hearing for July 15th at 8:30 P.M. 6n the question of rezoning of this property from R-1 to C-2. Motion carried unanimously. Mr. Nick Abdelnour requested Council to render a decision relative to the City's acquisition of his property on West Foothill Blvd, which had recently gone through condemnation proceed- ings. Discussion followed relative to fran- chise rights and future water rights. Moved by Councilman Johnson, seconded by Council- man Ortuno, this matter be referred to the City Request by Attorney and Engineer to determine franchise Azusa Valley rights, future water rights, etc. and report Water Co. to to Council. With no objections, motion ordered install line carried. The City Engineer reported that the owner of a large lot of land located on the north side of Foothill Blvd. at Coney Avenue had sold a portion of the land for the development of In- dustrial Tract 23774 but had retained the front- age on Foothill Blvd. to a depth of 1601. It was recommended by the Engineer that certain improvements (curb, sidewalk, fire hydrant and Improvement of street lights) be assured on the Foothill front- Belcoe property age before acceptance of the final map of Tract No. 23744 Moved by Councilman Fawcett, seconded by Council- man Ortuno, this be referred to the City Attorney and City Engineer for report and recommendation to Council. With no objections, motion ordered carried. The City Engineer requested permission to employ one temporary draftsman at the first step of salary range 25.5.until such time as a qualified engineering assistant has been appointed. Moved by Councilman Ortuno, seconded by Council- man Romero, request be granted and temporary Temporary draftsman be employed at salary range 25.5. draftsman Motion carried unanimously. approved -Eng. Request was submitted by the City Engineer for the use of IBM electric computers through an agreement with the Service Bureau Corp. By use of this service many man hours would be saved within his department, with the average cost approximately $25.00 per project. With no objections, motion ordered car- ried. It was requested that the Civil Service Board hold an examination to establish an eligible list for Maintenance Man I in the Public Works Department. Moved by Councilman Fawcett, seconded by Council- man Ortuno, the Personnel Board be instructed to hold examination for Maintenance Man I. in the Public Works Department. With no objections, motion ordered carried. CITY HALL AZUSA. CALIFORNIA JUNE 17th, 1957 The Guadalupe Society requests permission to i. have a 2 day Jamica, July 20th and 21st at the Parish Hall grounds, 4th and Dalton Ave. Permission is also requested to sell beer with the dinner. Moved by Councilman Ortuno, seconded by Council- man Romero, request be referred to the Police Chief with power to act. Motion carried unanimously. A resolution was submitted from the Board of Directors of Sanitation District No. 22, with reference to the Refuse, Transfer and Disposal System proposed to be established by the Sani- tation District. It has been requested by the County Sanitation District that the City render a decision by August 20th as to whether parti- cipation or non -participation in the proposed refuse, transfer and disposal system is desired. Moved by Councilman Fawcett, seconded by Coun- cilman Ortuno, the City Attorney, John William- son and Administrative Officer be authorized to contact the Hixons relative to obtaining the use of Van Tassel Canyon. Motion was carried by the following vote: Ayes: Councilmen: Fawcett, Ortuno, Memmesheimer Noes: Councilmen: Johnson, Romero The City Attorney informed Council he had re- ceived a communication from the firm of Darling, Shattuck and Edmunds requesting authority to file a Petition for Writ of Mandate relative to the proceedings to incorporate Duarte. Motion was made by,Councilman Fawcett, seconded by Councilman Romero, authorizing the firm of Darling, Shattuck and Edmunds to be retained to represent the City of Azusa for the sum of $1.00 to file a new petition for Writs -of Mandate to stay proceedings for the incorporation of the proposed City of Duarte, in the event a prelim- inary count of the ballots indicate a favorable vote, and that the Mayor be authorized to verify the petition. Motion was carried by the following vote: Ayes: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer Noes: Councilman Johnson Councilman Fawcett offered the following Ord- inance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING ORDINANCE NO. 535 SO AS TO REZONE CERTAIN PREMISES. Moved by Councilman Fawcett, seconded by Councilman Romero, that further reading of the Ordinance be waived. Motion was carried unanimously. The Administrative Officer.reported that, upon the completion of the specifications for rubbish and garbage pick-up, the agreements would be submitted for Council approval and signatures. Councilman Ortuno offered the following resolu- tion entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A VARIANCE FOR A SIX FOOT BLOCK WALL. Attorney Williams reported, relative to the matter of the Civil Service Rules and Regulations, that these rules and regulations had been adopted by the Personnel Board on January 24, 1952, but had not been recommended to, nor approved by, the Council. Certain sections were found to be in conflict and it was recommended the rules and regulations, and amendments be brought up to date, for presentation to the Council for approval and adoption. Moved by Councilman Romero, seconded by Councilman Fawcett, the Administrative Officer be instructed to have the Personnel Board get the Rules and Regu- lations in order for presentation to the Council for acceptance. With no objections, motion ordered carried. Councilman Fawcett offered the following reso- lution entitled: A RESOLUTION OF THE CITY COUNCIL OF TIDE CITY OF AZUSA AUTHORIZING THE EXECUTION OF A GRANT OF EASEMENT TO THE SOUTHERN CALIFORNIA EDISON COMPANY FOR A SUBSTATION SITE. With no objections, motion ordered �arruied. 392 CITY HALL AZUSA, CALIFORNIA JUNE 17, 1957 7:30 P.M. 8 The Quarter ?•fidget Association submitted an agreement between the Association and the City of Azusa for use of the area of City owned prop- arty located at First Street and Virginia Ave. It is requested by the Association, that they be permitted to operate, in connection with it's events, a soft drink and refreshment concession. with profits going to the Association. Moved by Councilman Romero, seconded by Council- man Ortuno, this agreement be referred to the City Attorney for study, possible re -writing and report to Council. Motion carried unanimously. A request was submitted for authorization to have a light pole and lights erected in the center of the track, and lights, as needed at the restrooms. The Supt. of Light Department was instructed to submit an estimate of the cost involved in com- plying with this request. Quarter - Midget Assn. Smith be authorized to investigate the possibilities of Delinquent collection, by outside agencies, and report to Accounts -- Council. Motion was carried unanimously. L & W Dept. The City Treasurer submitted the Financial State- ment as of May 31, 1957, giving the following balances: Bank balances 6413,845.39 Treasury Bills 300,000.00 Earnings on Treasury Bills 16 600.2 Total 730..445-64 Statement was ordered filed. Request was submitted by Mr Merle Mead for permission to -relocate a single-family resi- dence and garage to the premises at 321 North Coney Avenue. The house was stated to be ap- proximately 4 years old, and certain require- ments had been specified by the Building Ins- peotor including posting of the necessary bond, which would be returned to the owner subject to the completion of all requirements as set forth. A communication was received from the Omart Investment Company requesting that certain construction requirements for Fire Zone 2 be waived, in order that the cost of a proposed construction project, covering an addition to their existing office building, would be decreased. It was felt that, due to their property being placed in Fire Zone 2, with certain code re- quirements necessary, the cost would be extremely prohibitive. Moved by Councilman Fawcett, seconded by Council- Request of man Romero request be denied. Motion was carried Omart Inv. Co. unanimously. The�City Clerk reported that a summons answerable in the Citrus Municipal Court Judicial District Summons re - was received on June 14th, relative to the case ferred to of Robert A. Fitzgerald vs the City of Azusa, Insurance had been referred to the insurance carrier for company the City. A communication received from the Azusa Herald & Pomotropic quoting prices for the publication of legal notices as follows: $1.40 per inch for the first insertion and 61.20 per inch for subsequent runs, with a choice of either 6 point type or 8 point type. Motion carried unanimously. Councilman Romero offered the following resolu- tion entitled: A RESOLUTION OF THE CITY COUNCIL. OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID.
