HomeMy WebLinkAboutOrdinance No. 939 ORDINANCE NO. 939 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE AZUSA MUNICIPAL CODE RELATING TO DRIVE-IN BUSINESSES AND AUTOMOBILE SERVICE STATIONS . The City Council of the City of Azusa does ordain as follows : SECTION 1. Upon recommendation of the Planning Commission and after due and proper notice and hearings before the Planning Commission and the City Council, Section 9212.10 of the Azusa Munici- pal Code is hereby amended by deleting subsection (c) thereof and amending subsection (i) thereof to read as follows : "(i) Drive-in businesses may be permitted after a public hearing in each case under a Conditional Use Permit in accordance with procedures stated in Section 9231.12 and Sections 9231.20 to 9231.29, inclusive. The Commission may not grant a Conditional Use Permit for a drive-in business unless it finds that such use at the proposed location will be consistent with the General Plan and will not adversely affect the public peace, health, safety or general welfare, and in granting such permit may impose such conditions as are necessary and proper to prevent any such adverse effect. In determining whether a Conditional Use Permit will be granted, or if granted, the nature and extent of conditions imposed thereon, the Commission shall consider the following: 1. Nature and use of real property within 250 feet of the proposed use. 2. Relationship of the proposed use to the traffic pattern of the City. 3. Protection of persons residing on or using adjacent real property from noise, odors and light resulting from the proposed use. 4. Protection of the general public from any fire or traffic hazard resulting from the proposed use. 5. Prevention of adverse effect of proposed use on value of adjacent real property. 6. Off-street parking necessitated by the proposed use. 7. Time of operation of the proposed use. 8. Landscaping and maintenance of proposed use. 9. Area and configuration of lot on which proposed use is to be located. The Planning Commission may adopt a resolution or resolutions setting forth specific standards to implement the foregoing. " SECTION 2. The City Clerk shall certify to the passage of this ordinance and shall publish the same as required by law.
