HomeMy WebLinkAboutOrdinance No. 925 1 •� :.� ORDINANCE NO. 925 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE AZUSA MUNICIPAL CODE RELATING TO A TIME LIMIT FOR CONDITIONAL USE PERMITS. The City Council of the City of Azusa does ordain as follows: SECTION 1. Upon recommendation of the Planning Commission, Section 9231.28 of the Azusa Municipal Code is hereby amended to read as follows: "SECTION 9231.28 TIME LIMIT. Each determination of the Commission granting a permit shall, where appropriate, contain as a condition thereof the following: 'The permit hereby allowed is conditional upon the privileges being utilized witkill six months after the effective date thereof, and if they are not utilized or con- struction work is not begun within said time and carried on diligently in accordance with conditions imposed by the Commission, this authorization shall become void, and any privilege, permit or variance granted hereby shall be .deemed to have elapsed. ' The Commission, however, shall have autho- rity to extend the time limit in the case of unavoidable delay for a maximum of six months, except with respect to any permit upon which the City Council has affirmed, reversed or modified any action of the Commission by resolution pursuant to Section 9231.27 above. Any permit on which the City Council has so acted by resolution pursuant to Section 9231.27 may be extended beyond the time limit only by the City Council, and for a maximum of six months in the case of unavoidable delay. Once any portion of the variance or Conditional Use Permit is utilized, the other conditions thereof become immediately operative and must be strictly complied with." SECTION 2. The City Clerk shall certify to the passage of this ordinance and shall publish the same as required by law.
