HomeMy WebLinkAboutOrdinance No. 869 ORDINANCE NO. 869 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING CERTAIN PROVISIONS AND REPEALING CERTAIN OTHER PROVISIONS OF THE AZUSA MUNICIPAL CODE RELATING TO CIVIL DEFENSE AND DISASTER. The City Council of the City of Azusa does ordain as follows: SECTION 1. Section 3400 of the Azusa Municipal Code is hereby amended to read as follows: "SECTION 3400. PURPOSES. The declared purposes of this Chapter are to provide for the preparation and carrying out of plans for the protection of persons and property within this City in the event of a dis- aster, and to provide for the coordination of the civil defense and disaster functions of this City with all other public agencies and affected private persons, corporations and organi- zations. Any expenditures made in connection with such civil defense and disaster activities, including mutual aid activities, shall be deemed conclusively to be for the direct protection and benefit of the inhabitants and property of the City. " SECTION 2. Subsection (b) of Section 3400.1 of the Azusa Municipal Code is hereby amended to read as follows: "(b) Disasters. As used in this Chapter, the term 'dis- aster' means actual or threatened enemy attack, sabotage, extra- ordinary fire, flood, storm, epidemic, riot, earthquake or other similar public calamity. " SECTION 3. Subsections (c) and (d) of Section 3400.2 of the Azusa Municipal Code are hereby amended to read, respectively, as follows: "(c) The Assistant Director, appointed by the City Admin- istrator with the advice and consent of the Council who, under the supervision of the Director, shall develop civil defense and disaster plans and organize the civil defense and disaster program of this City, and shall have such other duties as may be assigned by the Director. " "(d) Such deputy directors and chiefs of civil defense and disaster departments, services or divisions as are provided for by resolution pursuant to this Chapter. " SECTION 4. The opening paragraph and subsections (a) and (b) of Section 3400.4 of the Azusa Municipal Code are hereby amended to read, respectively, as follows: "There is created the office of Director of Civil Defense and Disaster. The City Administrator shall be the Director of Civil Defense and Disaster. The Director is hereby empowered: (a) To request the Council to proclaim the existence or threatened existence of a disaster or an emergency and the termination thereof, if the Council is in session, or to issue such proclamation if the Council is not in session, subject to confirmation by the Council at the earliest practicable time. (b) To request the Governor to proclaim a state of dis- aster or a state of extreme emergency when in the opinion of the Director the resources of the area or region are inadequate to cope with the disaster. " SECTION 5. The opening paragraph of Section 3400.5 of the Azusa Municipal Code is hereby amended to read as follows: "In the event of a proclamation of a disaster or emergency as herein provided, or the proclamation of a state of disaster or a state of extreme emergency by the Governor or the Director of the California Disaster Office, the Director is empowered: " SECTION 6. Subsections (c ) and (e) of Section 3400.5 of the Azusa Municipal Code are hereby amended to read, respectively, as follows: "(c ) To require emergency services of any City officer or employee and, in the event of the proclamation of a state of disaster or a state of extreme emergency by the Governor in the region in which this City is located, to command the aid of as many citizens of this community as he thinks necessary in the execution of his duties; such persons shall be entitled to all privileges, benefits and immunities as are provided by State law for registered civil defense and disaster service volunteers. "(e) To execute all of his ordinary powers as City Adminis- trator, all of the special powers conferred upon him by this Chapter or by resolution adopted pursuant hereto, all powers conferred upon him by any statute, agreement approved by the Council, or by any other lawful authority, and in conformity with Section 38791 of the Government Code of the State, to exercise complete authority over the City to exercise all police power vested in the City by the Constitution and general laws. " SECTION 7. Section 3400.7 of the Azusa Municipal Code is hereby amended to read as follows: "SECTION 3400.7. DIVISIONS, SERVICES AND STAFF OF THE CIVIL DEFENSE AND DISASTER ORGANIZATION. The functions and duties of the Azusa Civil Defense and Disaster Organization shall be distributed among such divisions, services and special staff as the Council shall prescribe by resolution. The Council shall concurrently with the adoption of this Chapter, adopt a resolution setting forth the form of organization, establishment and designation of divisions and services, the assignment of functions, duties and powers, the designation of officers and employees. Insofar as possible, the form of organiz- ation, titles and terminology shall conform to the recommendations of the Civil Defense and Disaster Agency of the Federal Govern- ment and State of California. " SECTION 8. Parts 1, 2 and 3 of Chapter 4 of Article III of the Azusa Municipal Code, consisting of Sections 3410 through 3410.8, Sections 3420 through 3420.11 and Sections 3430 through 3430.9 are hereby repealed. SECTION 9. Part 4 of said Chapter and the title of said Part 4 are hereby eliminated and Section 3440 of the Azusa Municipal Code is hereby renumbered Section 3400.10. -2- SECTION 10. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law.
