Mayor Memmesheimer led in the salute to the flag. The Invocation was given by Councilman Fawcett. Present at Roll Call: Councilmen: Fawcett, Ortuno Romero, Memmesheimer Absent: Councilman Johnson Also present at the meeting: City Attorney, City Engineer, City Clerk -Administrative Officer. The Mayor asked if there were any corrections to the minutes of the meeting held July 15, 1957. The following corrections were pointed out: Page 1. Russell Benshoof, Utility Warehouseman, was raised to 4th step of pay scale, in place of "completion of probationary* period". Page 6 "Resolution No. 545' was incorrectly stated should be "Ordinance No. 545". With no further corrections, the minutes were ordered approved as corrected. The resignation of Marshall Bacon from the Police Reserve Corps was received, with the recommendation from Police Chief Kendrick, that it be accepted and Mr. Bacon be removed from the payroll. Moved by Councilman Fawcett, seconded by Councilman Ortuno, the resignation of Mr. Bacon be accepted and the City Attorney prepare resolution of termination. With no objections, motion ordered carried. A request was submitted to the Police Department, by Stanley Geddes, Principal of Magnolia School, for a crossing guard.to be stationed at the intersection of Gladstone and Citrus Avenue for the benefit of the children attending the new Magnolia School. Al- though the school is within the incorporated limits of the City, the children to benefit by crossing guards would be mainly from unincorporated territory. In an opinion of the Attorney General, the Board of Supervisors may request the California Highway* Patrol to provide guards to be placed within the limits of an incorporated city and request the State Controller to deduct from the Countyts share of the Highway Users Tax Fund payment for such services. Moved by Councilman Ortuno, seconded by Councilman Fawcett, the City Attorney prepare a resolution requesting the Board of Supervisors to request the California Highway Patrol to provide crossing guards for the Magnolia School. With no objections, motion was carried uanimously. The eligibility list for the position of Park Fore- man was submitted by the Civil Service Board con- taining the following names: 1. Motion carried unanimously. Councilman Johnson entered the meeting at 7:50 P.M. Councilman Johnson stated that, since no copy of the minutes of the previous meeting had been received, Approval of the motion approving the minutes should be rescinded, minutes with - if there were corrections, at the next meeting. held. The Administrative Officer reported that the esti- mated cost of amending the City's contract with the State Employees Retirement System would be based on Cost of the contribution rate of 5.417% of the total pay- amending roll. Retirement At the present time, the City is contributing at the System rate of 6.208%. With the amendment to include OASI for miscellaneous employees, the additional cost to the City would be approximately $175.00 per month, based on an average monthly payroll of $45,200. Moved by Councilman Romero, seconded by Councilman Ortuno the City Clerk be authorized to receive the necessary resolutions from the State Retirement Board to allow a Referendum to be held by the miscel- laneous employees. Motion carried unanimously. Mayor Memmesheimer announced that it was now 8:00 o'clock P.M., the time set for the public hearing Hearing - on the adoption of Electrical Safety Orders, 1955 Electrical Edition and National Electrical Code, 1956 Edition. Safety Orders The City Clerk presented Affidavit of Publication of and National Notice of Hearing published in the Azusa Herald Electrical on July 18th.and 25th, 1957. The Mayor asked if Code there were any protests filed. The City Clerk stated no protests had been filed in writing. There were no oral protests, and the Mayor declared the hearing closed. With no objections, motion ordered carried. 442 CITY HALL AZUSA, CALIFORNIA MONDAY AUGUST .59 1957 Moved by Councilman Ortuno, seconded by Councilman Fawcett, this ordinance be passed and adopted. This ordinance was then passed and adopted by the fol- lowing vote: Ayes: Councilmen: Fawcett, Ortuno, Johnson, Romero, Memmesheimer Noes: None Absent: None and numbered Ordinance No. 546. A request was submitted by the Azusa Valley Water Company for permission to install a 24" diameter cement lined steel pipeline in Tenth Street and Old Mill Road. The plans were approved by the City Engineer and deposit made in the sum of $1420.00 for the repaving of Old Mill Road. Ownership of the pipeline would be retained by the company, whose obligation it would be to operate and maintain the pipeline. Discussion was held relative to the necessity of obtaining a franchisee It was stated by the Administrative Officer that several surrounding communities did not require a franchise to be obtained by privately owned utilities. Motion Page 3 443 Request for installation of water line Azusa Valley Water Co. comp y carried by the following vote: Ayes: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer Noes: Councilman Johnson Absent: None A statement was submitted by Councilman Johnson, relative to the installation of a pipeline by the Azusa Valley Water Company on Tenth Street, upon which construction had begun and been halted. It was contended by Councilman Johnson that this installation was unauthorized. Moved by Councilman Ortuno, seconded by Councilman Fawcett and unanimously carried, this statement be filed. The Engineering Department reported on the projects that have been prepared for the coming fiscal year. Prdject 41 establishes a fund of 422,000 for the maintenance of all the streets within the City. Project 42 is for the opening and improvement of Twelfth Street. Project 43 is the repaving and widening of Vernon Avenue within the limits noted. Project 44 provides for repaving of Third Street. Project 45 is the repaving of Vernon Avenue and widening as noted. Project 46 provides for the repaving and widening of Fifth Street. Project 47 will be the elimination of the sharp dip in First Street at the end of Dalton Avenue. Other projects remaining from previous years will be undertaken before these if possible. Councilman Ortuno offered the following resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ADOPTING BUDGET AND APPROVING= MEMORANDUM OF AGREEMENT FOR EXPENDITURE OF GAS TAX ALLOCATION FOR MAJOR CITY STREETS. Moved by Councilman Ortuno, seconded by Councilman Fawcett, further reading of this resolution be waived. With no objections, motion ordered carried. Statement by Councilman Johnson Resolution No. 3632 - Gas Tax Al- location 444 CITY HALL AZUSA, CALIFORNIA MONDAY AUGUST 5, 1957 Page 4 A Memorandum of Agreement has been prepared for the expenditure of engineering funds. The City is granted 04000 per year for the engineering of streets within the City. Councilman Fawcett offered the following resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ADOPTING BUDGET AND APPROVING 1.1EMORANDUM OF AGREE'SIEENT FOR EXPENDITURE OF FUNDS ALLOCATED UNDER SECTION 2107.5 OF THE STREETS AND HIGHWAY'S CODE. The repaving of Irwindale Avenue has been tentatively selected as the street to be repaired using the County Gas Tax money. Definite arrangements are to be made with the County before this project is pre- sented to Council for consideration. It was recommended by the City Engineer that Mr. John Ott, whose name was on the eligibility list for the position of Asst. Engineer, be employed as Employment of August 5, 1957• of John Ott, Moved by Councilman Romero, seconded by Councilman Asst. Engr. Fawcett, Mr. John Ott be employed on step one of the pay scale, on a probationary basis, effective August 59 1957• Motion carried unanimously.. The owners of undeveloped property west of the pro- posed sewer line extending north from Twelfth Street, have been contacted for the purpose of obtaining the necessary easements to allow the installation of a sewer line to serve residents of that area. Moved by Councilman Johnson the Engineer be instructed to proceed with installation of sewer line of Azusa Avenue to service homes on the west side of Azusa Avenue north of 12th Street. With no one appearing before Council to speak on this matter, the Mayor declared the hearing closed. Motion carried unanimously. Supt. Smith, of the Light and Water Department, submitted estimated costs of installation of street lights in the annexed tracts east of Citrus Avenue as follows: Tract No. 161V35 - north of Gladstone $16,106.54 Tract No. 17939 - south of Baseline 19,878.00 Street light Tract No. 16384 - north of Mauna Loa 4,367.09 Project Estimated total 7,351-63 It was further stated that the cost of materials would increase approximately 10% within a short time, which would increase the total cost accordingly. Motion carried unanimously. Moved by Councilman Fawcett, seconded by Councilman Ortuno the City Clerk be authorized to advertise for bids on lighting material, specifications to be fur- nished by the Public Utilities Supt. and the City Engineer, with opening date to be August 30th, 1957 at 10:00 A.M. in the office of the City Clerk. Motion carried unanimously. It was requested by the Public Utilities Supt. that permission be €ranted to employ two maintenance men in the Light and Water Department on a temporary basis. Smith Ortuno and so ordered, vacation be approved, effad- tive date being August 61 1957. 450 CITY HALL AZUSA, CALIFORNIA MONDAY AUGUST 5, 1957 The date scheduled for the joint m.eetin.r, of Council members with the Library Board will, of necessity, be changed from the scheduled time of August 7th to another night, Moved by Councilman Johnson, seconded by Councilman Memmesheimer, the Administra- tive Officer arrange a joint meeting, to include the Park and Recreation Commission members. Motion carried unanimously. It was requested by Miss Boyer, of the Recreation Dept. whether it would be the desire of Council that the City again have a Nativity Scene during the coming holiday season. If so, the figures would have to be made new, since the ones previously used have become unusable, and this requires that work be started soon in order to have the project completed in time. Loved by Councilman Romero, seconded by Councilman Ortuno, the City display the Nativity Scene as in previous years, and Miss Boyer arrange the scene, with the help of City Departments and the Chamber of Commerce. With no objections, motion ordered carried. A request was submitted by a Mr. Rubio, for per- mission to relocate a single residence to the lot at 3111 Dalton Avenue. Moved by Councilman Ortuno, seconded by Councilman Romero the request be granted, subject to the re- quirements of the Building Department. Motion carried unanimously. Moved by Councilman Ortuno, seconded by Councilman Romero Council establish a policy of whereby proper- ty owners adjacent to any proposed relocation side, would be notified by the City Clerk of the request for relocation, and of the time it would be acted upon by Council. Page 7 Joint meeting with Library Board re -sche- duled Nativity Scene approved 451 Relocation of residence approved -Rubio The property owners of the Arcade Building on North Azusa Avenue, represented by their attorney, have requested an extension of time to repair the parapets. Repair of The Building Department had serv6d notice on Marsh- parapets - Fairchild Suman, Inc. regarding the repairs. The Arcade Bldg. owners protested the notice, which they claimed did not state the method by which corrections should be made nor determine what corrections were being required. Moved by Councilman Romero, seconded by Councilman Ortuno the City Engineer inspect the parapet and such parts of.the building as may be necessary, in addition to the Arcade, and submit report to Council and copy of report to owners of the property. Motion carried unanimously. In connection with the relocation of power lines for the purpose of completing the heliport, property owners have agreed to grant easements upon their propetty for the necessary power lines. Authorization is requested for the City Attorney to sign Cancellation of Erroneous Assessments as follows: 1. The State of California having acquired Cancellation land for highway purposes. 2. Motion carried unanimously. City Attorney Williams explained the benefits and non -benefits to the City upon being excluded from the system. Moved by Councilman Fawcett, seconded by Councilman Romero, that the part of the previous motion, rela- tive to the City being excluded from the proposed refuse, transfer and disposal system, be rescinded. (Relative to the court litigation and the decision rendered relative to "leave to sue the City of Azusa in Quo Warranto" granted to The Duarte Mutual Water Company and the Duarte Domestic Water Company, and the Duarte Domestic Water Company, the City Attorney stated he will have verifications prepared in answer to the suit. There were no objections. license-Ortuno A letter of protest was received from property owners adjacent to the area owned by the Pacific Electric Railway at 9th and San Gabriel Avenue. The letter stated that this property was in an unsightly condition due to litter being thrown thereon and also the sidewalk on Ninth Street hear the station is being used by cars parking in such a way that pedestrians are crowded into the street. Upon discussion it was decided the Administrative Officer to investigate and contact the Pacific Electric Railway office and report to Council. A request was submitted by the Bank of Amebica for.the City to improve lighting at the corner of Foothill Blvd. and Alameda Avenue due to the hazardous traffic conditions especially at dusk ,,hen the crosswalk is used extensively by pedes- trians. Moved by Councilman Fawcett, seconded by Council- man Ortuno, the City Clerk be authorized to adver- tise for light standards for Foothill Blvd., specifications to be furnished by the Supt. of Light and Water Department, with the opening date on August 30, 1957 at 10:00 A.M. The Dalton Homeowners Association of (-Jest Covina extended an invitation to Council to contact that organization if, in any way, they could be of benefit. A request was submitted by the Boy Scouts, rep- resented by Mr. Munday, Troup 401 and secretary of the Building Committee, for the City to set ,aside part of the City owned ground located north I6f the pump house on old San Gabriel Road south of Sierra Madre Avenue for their use. ,Mr. Ed Webb addressed Council in behalf of Troup 401 and stated the need for a location in order that all troups may participate in their various events. (Mayor Memmesheimer stated that arrangements should be made for a joint meeting with representatives lof all troups, and members of Council, at which (time all interested parties could discuss the matter. 'This meeting to be arranged as soon as possible. lIt was requested by the Guadalupe Society of St. Francis Church that permission be granted to hold !a benefit dance on September 14 at Parish Hall :grounds, Fourth and Dalton Avenue, from 8:00 until 12:00 midnight. The regular monthly meeting of the League of Calif- ornia Cities will be held in Burbank, Thursday August 15, 1957• The Los Angeles County Watershed Commission will hold their next meeting Friday, August 16, 1957 at 9:30 A. M. at County Fire Suppression Camp No. 2 in Oak Grove Park, Pasadena. Councilman Fawcett will attend as representative of the City of Azusa. The Purchasing Manual, as presented by the Account- ing Department, required that purchases in excess of $p1000 be presented to Council for approval. The Administrative Officer reported that, in some instances large items, such as transformers which are needed to maintain service to a customer of the Light and Water Department create a situation whereby delay in purchasing interferes with main- taining service. It was requested that the Admin- istrative Officer be permitted to approve such purchases, upon determination of the urgency and need of the material being requisitioned. Councilman Johnson commended the Accounting Depart- ment on the manual prepared, but felt certain words should be eliminated from the manual. Moved by Councilman Johnson that the words "signi- ficant and lavish" should be deleted from Section 3, item 4, of the Purchasing Manual. Motion failed for lack of second. The Administrative Officer reported on the investi- gation made regarding the property owned by Walker - Built Homes, Inc. at Pasadena and Cerritos Avenue north of Gladstone Street, stating that Internal Revenue stamps in the amount of $83.60 had been attached to the deed. At the rate of $1.10 per $1000, the cost of the property would approximate $910960.
