AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AZUSA ADDING CERTAIN PROVISIONS TO THE AZUSA
MUNICIPAL CODE RELATING TO CONDOMINIUMS.
The City Council of the City of Azusa does ordain as follows:
SECTION 1. Subsection (k) of Section 9100.2 of the Azusa
Municipal Code is hereby amended to read as follows:
"(k) Lot, as used in this Chapter, does not mean or
include a condominium as defined in Section 783 of the Civil
Code, or any unit constituting a part of such a condominium,
when the provisions of Chapter 1, Title 6, Part 4, Division
Second of the Civil Code have been met, including the recorda-
tion of a plan pursuant to Section 1351 of the Civil Code and
of a declaration of restrictions pursuant to Section 1355 of
the Civil Code containing the power of attorney set forth in
paragraph (b) (9) thereof. For the purposes of this Code, the
definition of 'condominium' contained in Section 783 of the
Civil Code shall be deemed to include those situations in which
some or all of the units include the separate ownership of the
land upon which the unit rests and no horizontal limiations upon
such separate ownership. "
SECTION 2. The definition of "Lot" contained in Section
9206 of the Azusa Municipal Code is hereby amended to read as follows:
" 'LOT ' : (1) A parcel of land abutting on one or more
public streets with a separate and distinct number or other
designation shown on a plat or Record of Survey recorded in
the office of the County Recorder of Los Angeles County, or
(2), a parcel of real property abutting at least one public
street and shown on the records of the County Assessor as held
under separate ownership from adjacent property prior to June
6, 1957.
Lot, as used in this Chapter, does not mean or include a
condominium as defined in Section 783 of the Civil Code, or any
unit constituting a part of such a condominium, when the pro-
visions of Chapter 1, Title 6, Part 4, Division Second of the
Civil Code have been met, including the recordation of a plan
pursuant to Section 1351 of the Civil Code and of a declaration
of restrictions pursuant to Section 1355 of the Civil Code con-
taining the power of attorney set forth in paragraph (b) (9)
thereof. For the purposes of this Code, the definition of 'con-
dominium' contained in Section 783 of the Civil Code shall be
deemed to include those situations in which some or all of
the units include the separate ownership of the land upon which
the unit rests and no horizontal limitations upon such separate
ownership. "
SECTION 3. Section 9308 of the Azusa Municipal Code is
hereby amended to read as follows:
"SECTION 9308. CONDOMINIUMS.
This Chapter shall not apply to the division of any lot,
piece or parcel of land into condominiums as defined in Section
783 of the Civil Code when the provisions of Chapter 1, Title 6,
Part 4, Division Second of the Civil Code have been met, including
the recordation of a plan pursuant to Section 1351 of the Civil
Code and of a declaration of restrictions pursuant to Section
1355 of the Civil Code containing the power of attorney set
forth in paragraph (b) (9) thereof. For the purposes of this
Code, the definition of 'condominium' contained in Section 783
of the Civil Code shall be deemed to include those situations in
which some or all of the units include the separate ownership
of the land upon which the unit rests and no horizontal limitations
upon such separate ownership. "
SECTION 4. The City Clerk shall certify to the passage of
this ordinance and shall publish the same as required by law.

certify that the foregoing Ordinance No. 801 was regularly introduced
and placed upon its first reading at a regular meeting of the City
Council on the 4thday of May , 1964. That, thereafter,
said ordinance was duly adopted and passed at a regular meeting of the
City Council on the 18th day of jiffy , 1964, by the following
vote, to-wit:
