AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AZUSA AMENDING THE AZUSA MUNICIPAL CODE TO REQUIRE
CERTAIN STRUCTURES TO BE CONNECTED TO A PUBLIC
SEWER AND DECLARING THE SAME TO BE AN URGENCY
MEASURE TO TAKE EFFECT IMMEDIATELY.
The City Council of the City of Azusa does ordain as
follows:
SECTION 1. Subsection (a) of Section 7500.13 of the Azusa
Municipal Code is hereby amended to read as follows:
"SECTION 7500.13. SEWER REQUIRED.
(a) All plumbing affecting the sanitary condition of any
building or structure within the boundaries of any lot shall
be connected with a public sewer, provided that if such building
or structure had been connected already to a cesspool or septic
tank prior to the construction of a public sewer abutting the
property on which such building or structure is located, it
may be continued, but when such cesspool or septic tank is
discontinued for use or is in an unsanitary condition, then
such building or structure shall be connected immediately with
and drained into a public sewer. Provided, however, that if
there is no public sewer in any street, alley or right of way
abutting the lot upon which the structure is located and there
is no public sewer to which it can be connected within three
hundred feet of the structure:
(1) If the structure is a single family dwelling or a
multiple family dwelling containing not more than three dwelling
units, it may be connected to a cesspool or septic tank.
(2) If the structure is any other type of structure and
the Superintendent of Sewers finds in writing that the expected
effluent and soil conditions are such that adequate drainage
would be accomplished and no polution or harm would result,
the structure may be connected to a cesspool or septic tank for
such length of time and subject to such conditions as the
Superintendent of Sewers may impose."
SECTION 2. This ordinance is urgently required for the
immediate preservation of the public health and safety. The facts
constituting such urgency are as follows: Several large multiple
family apartment house projects are about to be commenced within
the City without any connection to a sanitary sewer and with the
intention of using cesspools. The use of cesspools on so large a
scale and such concentration of sewage in the soil would threaten
the purity of underground water, prove inadequate for sanitary
purposes and impair the public health and safety.
SECTION 3. The City Clerk shall certify to the passage of
this ordinance and shall publish the same as required by law and the
same shall be effective immediately upon its passage.
