The City Council of the City of Azusa ihet is regular -session at the above time and place.-- The,meeting was called to order by Mayor Memme- Flag Salute sheimer; who led in the salute to the flag. Invocation was given by Rev. Robert Campbell, of the First Baptist Church Present -at Roll Call: Councilmen: Fawcett, Ortuno, Johnson, Memmesheimer City Atty., City Engr.,City Clk-Adorn. Off. Absent:-' Councilman Romero Mayor•Memmesheimer asked if there were any oorrec- tions or=omissions to the minutes of the meeting held on,Sept. 16, 1957. It was pointed out that on page 1, in the corrections, the motion relative to the $300,000 set aside for the construction of the Library Building did not include the "architects fees" as included in the original motion. On page .3, item 1, the words "and water" to be ink ;.,eluded in the services furnished by the City of Azusa. On page 7, paragraph 12, motion shall include "of that land owned by" etc. Councilman Romero entered the meeting at approximately 7:40 P.M. Mayor Memmesheimer announced that this was the time and place fixed by the Council for hearing objections or proteats on the proposed work, or the extent of the, assessment district, or on the proposed grades under the resolution of intentions, Resolution No. 3653s.covering the construction of certain street work in the City of Azusa. The -City Clerk presented the Affidavits of Publica- tion, Affidavits of Mailing and Affidavits of Posting. Moved by Councilman Ortuno, seconded by Councilman Fawcett and unanimously carried, the Affidavits of Publication, Mailing and Posting be approved and ordered filed. Mayor Memmesheimer asked the City Clerk if there were any written protests on file in the office of the City,,Clerk. The Clerk read written protests from the following: Mr. And -Mrs, Robert E. Cochran, 110 S. Virginia Ave, who protested against the installation of curbs and •gutters on Virginia Avenue or First Street, due to the narrowness of Virginia Avenue',and also because "of the proposed freeway, which may follow along First Street. -Ivan and Jeanette Turnmire, 118 So. Virginia Ave., who felt that a block wall on the west side of Vir- ginia Avenue from First to Paramount, would be pre- ferable.to the installation of curbs and gutters, which they felt, would increase the congestion be- cause of the narrowness of the street. Leslie R. LaMeer and Jeanne S. LaMser protested the construction of curbs and gutters, sidewalks and driveways on South Aspen Avenue, between Paramount and Gladstone Streets, because of the expense in- volved. It was their feeling that an added expense Would be placed upon the property owner for the in- stallation of sewer lines for those not yet connected, after"the curbs, eta* have been constructed. G. Elofson, 101 North Dalton Avenue protested the construction of these improvements because he felt other improvements were more needed and of more im- portance. The Mayor asked if there were any oral protests or objections concerning the work, extent of assessment district or grades. There being no other persons present desiring to be heard, the City Engineer was requested to advise the Council the percentage of the area of'the property to be assessed for the proposed improvement, that is represented by written protests filed with the City Clerk. Councilman Romero offered the following resolution entitled: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, -CALIFORNIA, MAKING FINDINGS AND OVERRULING PROTESTS AND OBJECTIONS. (Assessment District No. 1955-8) WHEREAS, this City Council by its Resolution No- 3653, adopted on the 3rd day of September, 1957, declared its intention to order the construction of certain street..-wbrk under the Improvement Act of 1911, Divi - bion 7,of the Streets and Highways Code of the State of ''California, and in said resolution fixed the 7th day of•Ootober, 1957, at the hour of 7:30 o'clock P.M. in"`the"Council Chambers of this City Council, as the �tiiae and place for the hearing before this City Coun- ail,of_.protests and objections; and WHEREAS'$ at the time and place fixed in said Resolu- tion No. 36539 a hearing was duly held by this City Council at which all written protests or objections, if any,; were duly presented and read all persons do - siring -,to be heard thereon were heard, and this City Council'gave all persons present an opportunity to 'be heard in respect of any matter relating to the *ork.proposed in said Resolution No- 3653 or the boundaries of the assessment district described there- in, or"in any way relating to the proceedings proposed by said Resolution No. 3653; and WHEREAS,,all persons desiring to appear and be heard have been heard, and this City Council has taken evi- dence relating to said proposed work, the boundaries of the proposed assessment district and the benefits -to the-propertyto be included in the , proposed asaesa- ment'district, and is fully informed in the premises; ---NOW, THEREFORE, the City Council of the City of Azusa, California, DOES HEREBY FIND, RESOLVE, DETERMINE AND ORDER as follows: Section 1. That protests or objections have not been made by the owners of one2half of the area of the .property to be assessed for said proposed work. Section 2e That all protests and objections are hereby"overraled and denied. Resolution No. 3665 -Overruling Protests Section 3. That no changes are to be made in the boundaries of the proposed assessment district or in the work proposed to be done, and the boundaries of'the assessment district are defined and established as -the boundaries described in the resolution of in- tention, to wit: Resolution No. 3653, and the work proposed to be done is likewise defined and established as the work described in said Resolution No- 3653 and reference is hereby made to said Resolution No- 3953 for a full and complete description of said work and of the assessment district and for further particulars. Cuff Hearing on to the,;.Planning Commission decision on the rezoning Rezoning- .of,the northwest corner of Cerritos and Sixth Street Cuff property from,R-2 to R-3 for the purpose of constructing a ''multiple unit (apartment) building. 'Mr. P. J: Tscharner, Attorney, presented plans and drawings, in behalf of the applicants, showing the proposed building to be constructed. : Mr..Cuff, who was sworn in as a witness in his own behalfy addressed Council further stating his plans ..for' -the development of this property. The Mayor asked if there were any written or oral protests. Therebeing no written or oral protests, the hearing was declared closed. Moved by- Councilman Romero, seconded by Councilman Fawcett, Mr. Conrad, City Attorney Williams and Administrative Officer hold joint meeting for the purpose of agreeing to such terms as may be changed -in this contract, relative to insurance coverage. -Motion carried unanimously. Moved,by Councilman Johnson, seconded by Councilman Ortuno, the terms of the rubbish collection contract to include increase in the insurance coverage to 050,000 and $100,000 public liability, and the Mayor to be authorized to sign this contract. With no objections, motion ordered carried. An Agreement with the Los Angeles County Recreation Department was submitted for consideration by Coun- cil; said agreement for the purpose of conducting a program of community recreation in the City of Azusa for the fiscal year ending June 30, 1958. Moved by Councilman Romero, seconded by Councilman Ortuno, the Mayor be authorized to sign the agree- ment. With no objections, motion so ordered. The Sewer Maintenance Agreement between the City of Azusa and the Gladstone School District was presented for consideration. Moved by Councilman Fawoett, seconded by Council- man Romero, the agreement be approved subject to the exclusion of the provision relative to "water service" by the City in the event of annexation, and the Mayor authorized to sign. With no objections motion ordered carried. The appointment of Lawrence Trujillo as patrolman In the Police Department was recommended by Police Chief Kendrick. .,Moved by Councilman Johnson, seconded by Council- man Romero and so ordered, this appointment be ,ratified. Moved by Councilman Johnson, seconded by Council- man Romero, the appointment of Robert A. Doubleday as Crossing Guard be ratified. With no objections, motion ordered carried. It was recommended that authorization be given to the Police Dept. to employ an estimated 50 extra police, personnel, at $10.00 each, for Azusa Golden Days Parade. Moved by Councilman Romero, seconded by Councilman Ortuno, that request be granted and Police Chief authorized'to employ police personnel. With no objeotiona, motion ordered carried. It was•requested by the Guadalupe Society that permission be granted to hold a t;enesit dance on October 26th at the Parish Hall Moved by Councilman Romero, seconded by Council- man Ortuno and unanimously carried, that permis- sion be granted subject'kto the regular requirements. A request was submitted by the Deacon's Club for Permission to hold a dance at the Parish Hall on November 2nd. It was recommended that Jose Estrada be raised to the 4th step of Maintenance Man I. effective Oct. 19 1957. Motion carried unanimously. It was announced that Mr. Cornelius Reed had been elected.Chairman of the Azusa Personnel Board. Notice was ordered filed. The Agreement between the City and Benjamin Parker, srohitect, was presented for consideration. The matter of certain extras which had been discussed was to be excluded from the cost of the construction. Moved by Cp6noilman Romero, seconded by Councilman Fawcett.the agreement on the construction of the Library Building to be approved, with the sum set in the amount of $300,000 not to include the expra costs, but to cover the construction of the building and the architect's fee. Motion carried unanimously. Councilman Romero offered the following resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 'AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME SHALL BE PAID. Moved by Councilman Romero, seconded by Councilman Fawcett, this resolution be adopted. This resolution was adopted by the following vote: AYES$ Councilmen: Fawcett, Ortuno, Romero, Memme- sheimer NOES: Councilman: Johnson Absent: None and numbered Resolution No- 3670.
